In the event that landscaping required by Wheat Ridge Code of Laws, Section 26-502
and/or as shown on an approved landscape plan is not installed
by 2Q 2001n (date) the City of Wheat Ridge or its designee shall
have e right to enter upon said property to construct and/or install such improvements
or do other such work to accomplish that purpose as may be necessary, provided that the
City of Wheat Ridge shall first give notice in writing to the contractor, developer or
owner of its intent to do so.
If the City of Wheat Ridge exercises its right to perform work of any nature, including
labor, materials and use of equipment either by force account or contract, the City shall
have the absolute right to withdraw the escrow funds to complete said landscape
improvements. The only precondition to the City's right to withdraw the escrow funds
for this purpose shall be a letter from the Planning and Development Director, stating that
the landscape improvements have not been completed or provided and that the
compliance date of Aitf-1 Zg 00(o has expired.

Dear Mr. Kaufman:
We have gone to the site and have surveyed the existing pond as of December 19, 2005. The volumes of
the pond meet the required storage volume as determined in the original approved drainage report. The
channel on the north side of the property has a liner in it to help avoid the erosion until it can be seeded
in the early spring. The emergency overflow structure has been built and backfilled up to the necessary
heights.
It appears that the completed construction for the drainage will meet all of the criteria set forth in the
original drainage report. All questions based on a letter dated July 5, 2005 have been addressed and are
now in conformance.
On the following sheet you will see a copy of the record drawing.

Discussion: The purpose of the memo is to memorialize the telephone conversation.
Mr. Kaufman stated that he had a letter he felt was a "certification" letter from Lane Engineering for
the drainage. As I had on various prior occasions, I explained to Mr. Kaufman that the letter dated and
received on May 12, 2005 was not a drainage certification letter but simply a letter from Mr.
Kaufman's engineer (Mr. Richard Romberg, P.E. - Lane Engineering) stating that the site has not yet
been completed per plan. Mr. Kaufman stated that his contractor Terry Hackbart faxed a letter to Jeff
Hirt, Planner stating the outstanding drainage items mentioned in the original "certification" letter
"have been addressed". Mr. Kaufman asked why this couldn't serve as the Drainage Certification. I
again reminded Mr. Kaufman that the Drainage Certification letter is to be signed and sealed by the
Professional Engineer who produced the Final Drainage Report, and also that As-Built plans
supporting the statements in the certification letter are to be submitted per City Code requirements. Mr.
Kaufman stated that when he called Lane Engineering they said they would be performing a field
survey (which is exactly what is required to produce the As-Built drawings). Mr. Kaufman was
distraught that this is going to cost him more money. I told Mr. Kaufman that once the outstanding
items have truly been addressed this is the correct procedure to obtain the signed and sealed Drainage
Certification Letter. I explained to Mr. Kaufman the Engineer-of-Record's P.E. seal and signature
provide a legally-binding assurance (with the as-built plans serving as evidence) of the project being
constructed per his originally approved design. Mr. Kaufman stated he was in a bind with the storage
of his buildings and wanted Public Works to give him approval to store the buildings on-site. I stated
that is not an engineering issue, and that sort of request would need to be processed through the
Community Development Department rather than Public Works. I transferred him to Kathy Field.
NOTES:
1. Mr. Kaufman has been informed of the Drainage Certification requirement on numerous
occasions during 2005 (e.g., May 9'b, June 2"d, October I O'', and on December 166). These are
certainly not the only times the drainage certification requirement was discussed with Mr.
Kaufman, but simply a few of the times where Public Works has written documentation
memorializing the conversations.
2. On Monday December 19, 2005, Alan White, Director of Community Development and
Meredith Reckert, Senior Planner met with Mr. Kaufman and his contractor to discuss the
storage of the buildings. Mr. Kaufman stated that he will bring in the Drainage Certification
Letter and as-builts on Tuesday December 20, 2005. Mr. Kaufman will be able to move his
buildings on-site as soon as the Drainage Certification Letter and as-built drawings have been
received by the City.

On Friday, July 1, 1 went to the site to check on the project's drainage system. The
following items need to be finished before we can write a letter of conformance to the
design.
1. Where the overflow structure is located, the ground needs to be graded to the
channel. At the present time, the concrete channel is just sitting on the ground.
Backfill should be deposited up to the top of the channel.
2. The backfill next to the garage is not complete. The ground is not compacted and
when I visited the site on July 1st, the contractor said they were going to build a wall
3 feet west of the foundation.
3, The side slopes of the pond need to be graded and the channel from the west needs
to be seeded or protected. At the present time the ground will just erode unless
some protection is applied to the channel on the north side of the property.
4. The grading on the other lots is not complete because the construction has not yet
started. Each lot should have a drainage scheme that allows the water to go into the
gutter along the private drive.
After the work is completed, our field crew will need to topo the area and verify the
volumes and drainage structures. If you have any questions, feel free to call me.

Dear Mr. Lister:
The above mentioned plat has been reviewed and I have the following comments:
1. Please modify the easement language to reflect the conditions on the plat. There will be 5
foot front and rear easements, and 5 foot easements on the side property lines not adjacent to
Tract B (Ingress/Egress and utility easement). The language "with the exception of side
property lines adjacent to Tract B as shown on this plat" should be inserted as shown on the
redlined plat.
Please make these changes and submit a blackline photographic mylar for recording with Jefferson
County. Please provide a mylar that is acceptable for recordation, which includes a one inch
margin. The fees for recording with Jefferson County are $11 per page.

I have completed the first review of the above referenced document for the Riley's Roost Subdivision located at
37i1 Avenue and Eaton Street received on October 19, 2005, and I have the following comments:
Surveying Comments
1. The title needs to be changed to: "Riley's Roost Subdivision Amendment No. I".
2. Please modify the easements, both north and south of the proposed lot lines to be adjusted. The easements
are currently shown as being centered on the new (not yet created) lot lines rather than on the existing
lines. Also include the distances for the easement widths that are to be vacated (e.g., 3' on the northerly
side of the adjusted lot line, and 7' on the southerly side, etc.).
3. Show the existing 5' utility easements as 5' Drainage & Utility Easements.
4. Add the word "HEREBY" for the 2 statements shown: "Lot Line HEREBY Vacated by this plat".

On Wednesday October 19, 2005 I received a Lot Line Adjustment Plat submitted by Mr. Ed
Kaufinan.
Please be advised that there are still outstanding drainage issues for the Riley's Roost Subdivision.
The drainage improvements have not been fully completed, nor has a Drainage Certification Letter
from Lane Engineering been received by the City.
On June 2, 2005 Iliad a meeting with Mr. Kaufman's engineer, Ray Aregood onsite to discuss this as
well as other drainage related items. At that time Mr. Aregood stated that he anticipated submitting
as-built to the City along with the Drainage Certification Letter within a couple of weeks (please find
the attached "Memo to File").
The City has yet to receive these items that are required by the Municipal Code of Laws.
Therefore, Public Works will review the submitted Plat, but recommends that upon approval of this
plat that it not be released for recordation prior to receipt of the required Certification and As-Builts
by the City.

Development: Riley's Roost Subdivision
In Attendance: Dave Brossman, Ray Aregood (Lane Engineering),
Discussion: The purpose of the memo is to memorialize the on-site meeting pertaining to
the pipe construction to address the drainage issue for the Luebke Apartments
caused by the importation of fill material for Lot 6, Riley's Roost Subdivision.
I walked the site with Ray Aregood, and observed (since we waited out a
substantial rainstorm) that the pipe placed to drain Leubke's Apt's does in fact
function.
Mr. Aregood stated that he will be submitting to the City As-Built Plans and a
Drainage Certification Letter for the site subsequent to the completion of the
emergency overflow for the pond.
Ray anticipates this to be completed within a couple of weeks or so. The
contractor was there (didn't catch his name) and said that he is going to place
a liner in the grass-lined swale to help stabilize it from any erosion. Ray stated
that he would mention this in the Drainage Certification as well since it is an
addition not found on any of the original approved documents.

Upon the basis of recent field measurements, the detention pond for the
referenced development has been found to have a volume of 1371 cubic feet at
plan high water line elevation of 5422.00. This volume is greater than the
required detention volume of 1228 cubic feet.
At the time of field observation, the required restrictor plate on the pond outlet
structure was not installed, nor was any provision for emergency pond overflow
evident.

Dear Mr. Kaufman,
On Thursday April 21, 2005, and again on Wednesday May 4, 2005, I was contacted by Mr. Duane Luebke with
regards to a drainage problem at the Leubke Apartments located at 3765 Depew Street, the parcel directly east of
Lot 6, Riley's Roost Subdivision. Mr. Leubke stated to me that the drainage problem was created during the
construction activities at the Riley's Roost Subdivision.
Public Works staff has observed that the overlot grading performed at 5705 W. 37'b Avenue (Lot 6, Riley's Roost)
has impeded the flow of an existing drainage pipe which has historically flowed from the Leubke Apartments into
Lot 6, Riley's Roost Subdivision. On Tuesday April 26, 2005 Bill Weyman, Field Services Supervisor, and Tom
Gray, Engineering Technician met with you onsite at Lot 6 to discuss this drainage issue and to come to an
agreement on a solution. At that time you stated to Mr. Weyman and Mr. Cray that you would prefer to place a
pipe rather than construct a swale as identified on the Final Drainage Report, and that "You will take care of this
matter as soon as possible."
On Friday May 6, I spoke with you on the telephone pertaining to this drainage issue. During our conversation
you stated to me also that you wish to resolve the drainage issue by installing a pipe, rather than creating a
drainage swale. I recommend that the pipe be pre-approved by the Engineer-of-Record prior to its placement, as
he will be required to provide a Drainage Certification Letter requirement as discussed below.
Please be advised that a Drainage Certification Letter from the Engineer-of-Record (Richard Romberg, P.E.), is
required prior to the issuance of any Certificates of Occupancy for the subdivision. The Drainage Certification
Letter shall state that the site drainage will function per the approved Final Drainage Report/Plan, and be
accompanied by As-Built Plans showing that all drainage facilities and site grading have been completed and are
in compliance with all approved documents.
