At our meeting you expressed your desire to move forward with a zone change application for your property located at 12700 W. 42 ° Avenue. You indicated that you would like to apply for a zone change from the existing A -1 zoning on the property to a commercial zone district. Unfortunately, the city does not allow a commercial zone change to a "straight- zoned" district such as C -1, Commercial -One. Pursuant to Section 26- 301.B., all zone change requests for commercial zoning must be to a planned development district. A zone change to a planned development district requires certain documents to be submitted with the land use application. One of the required documents to be submitted with the application is an Outline Development Plan document. Without the required submittal documents, the application is considered incomplete and will not be processed. Under the current zoning requirements, there are no other options for you to apply for a zone change. The City's planned development approval process is comprised of two steps. The first step is the rezoning approval, which requires submittal of an Outline Development Plan (ODP) which must be prepared professionally. The Outline Development Plan would rezone the property and define the allowable uses for the property, as well as establish broad development standards such as permitted maximum density, minimum landscaped coverage, maximum building height and maximum building coverage. In addition to a pre - application neighborhood meeting, public hearings would be required in front of both Planning Commission and City Council. Please see the attached example of an Outline Development Plan. The second step is approval of a Final Development Plan (FDP). The Final Development Plan addresses the finer details of the development including landscaping, architectural design of the proposed structure(s), and drainage improvements. The Final Development Plan step would require public hearing reviews by Planning Commission and City Council. A neighborhood meeting regarding a zone change to commercial to allow a contractor's office /warehouse for your property was held on January 25, 2005. Six neighbors were in attendance and voiced opposition to your proposal. Attached are a copy of the minutes from the meeting and the sign -up sheet. Due to the period of time that has passed since the January 2005 meeting, another neighborhood meeting will be required prior to submittal of a zone change application. You indicated that you had heard that the neighbors, who spoke in opposition to your proposal at the January 2005 meeting, may now be receptive to it. If the neighbors have modified their views, comments given at the neighborhood meeting will give us an idea of whether they will support the project, or at the very least, not object to it. Finally, I would strongly recommend that the assistance of a professional land planner and /or architect be retained to provide the necessary documents and assistance through the public hearing process. Dear Mr. Chessnoe, (303) 235-2861 FAX (303) 235-2857 I have completed the third review of the above referenced plat for the property located at 12600 W. 42nd Avenue received on June 27, 2005, and have the following comments: 1. In the Basis of Bearing statement it is stated that the monuments are two 3-1/4" aluminum caps on #5 rebar. Please double-check this information, as all of the Section and'/4 Section monuments set by John Lambert (P.L.S. 13212) are a 3-1/4' brass cap on 30" pipe. 2. The Lee & Baugh Ditch needs to be completely described with bearings and distances, even if shown as approximate (include the CL and a channel width, or the 2 exterior top of bank boundaries, etc.). 3. Please correct the 79' discrepancy in the storm drainage easement distance as indicated on the redlined Plat. 4. The Stormwater Detention Easement information should be inside the easement area. Either darken or change the stormwater easement linetype for clarity. 5. Add the word "HEREBY" to all easements that are to be dedicated by this Plat. 6. Please be advised there is an encroachment of the northerly boundary of the parcel into the West 42 d Avenue ROW. The northerly boundary as shown does not lie on or is parallel to the existing 42nd Avenue ROW (as defined on the ROW Map accepted by the City and recorded at Reception Number 88013279). There is a 0.14' encroachment at the westerly property line, and a 3.36' encroachment at the easterly property line. The northerly line as shown is N 89°25'14" E and the record bearing for the southerly ROW line for W. 42nd Ave. is S 89d57'37" E. Since a portion of the proposed stormwater detention area would lie within the area of encroachment as currently described on the Plat, the proposed easement should to be moved southerly to lie outside of the platted ROW for 42nd Avenue. A couple of suggested remedies would be to make the northerly easement line contiguous with the accepted southerly ROW line (and fully describe with bearings & distances) or to simply move the entire easement 3.5' to the south (again, these are only suggestions). The encroachment issue will need to be resolved prior to acceptance of the Plat. Whether or not this situation exists depends upon the time of concentration to be determined by the engineer doing the Final Drainage Report. 6. A Stormwater Detention Easement area will need to be fully described on the Plat, along with the standard stormwater easement language (please see attached sheet). It may prove beneficial to wait until the Drainage Report is completed before finalizing the Plat, so the easement area can be properly located (and sized). 7. If the irrigation ditch flows onto this site from the west, please extend the ditch line to the parcel boundary. 8. Identify the irrigation ditch (Lee & Baugh Ditch). 9. Include the Reception Number for the City's Storm Sewer Easement along the easterly side of the parcel. The proposed building will have multiple units occupied by different tenants. One of the tenants is proposed to be an office /warehouse space for the applicant's roofing contractor business. It was stated that this business will have 6 to 8 vehicles associated with it, along with 5 to 6 employees in the office. The other uses in the building are anticipated to be more office and professional uses. There will be no tar or similar materials utilized for the roofing business that will be manufactured, created, or poured on the premises. It was stated that the similar materials used for the business arrive on the site in a roll. It was stated that these materials, and other materials used for the roofing business may be stored on the site for a period of 3 to 4 days before being used on a job. A small area for outside storage was proposed. There cannot be any waste materials on the site accumulating for the roofing business. All waste materials must be taken directly to the landfill. All outside storage must be in a screened area. Per the Code of Laws Section 26 -631 (B) materials may be stored or displayed behind the front of buildings within side or rear yards only where completely screened from adjacent properties and streets by a six foot high opaque wall or fence. Materials cannot be stacked at a height greater than that of the screening fence. There will be no variation from this standard in the PCD. Staff does not support outside storage on this property. The status of the ditch running through the property must be determined before proceeding with this project. If the ditch is to stay in its current location along the southern boundary of the properties, it must be shown on the plans relative to the proposed structures and the access drive. If the ditch is to be in its previous location, running through the middle of the properties, there may be issues with the construction of the building and the ditch company must agree to the location and configuration of the ditch. As a portion of this property lies within the floodplain, any changes to the grade of the property may be problematic. A floodplain special exception permit will be required. Please be advised of the City's access requirements pertaining to spacing from property lines and on the same lot. Per the Code of Laws Sec. 26 -501 (D)(4) no vehicular entrances or exits may be closer than 25 feet to any property line and vehicular entrances and exits on the same lot must be spaced at 100 foot intervals. The layout of the building brought to the pre - application meeting would not be supported by staff. Staff feels it is too impactive on the adjacent residential property to the west. A revised site plan that was brought in after the pre - application meeting showing an L- shaped building is more desirable to staff. 2 Staff will recommend implementation of some type of performance standards to be included in the PCD. These performance standards will specify conditions to be adhered to such as lighting standards and outside storage. As the property is adjacent to the Clear Creek Greenbelt, staff strongly suggests the installation of landscaping in these areas on the south side of the property. Illustrating this in the plans submitted will gain support not only from staff but likely from adjacent property owners who will be concerned about the impact the proposed use will have on the area. This proposal would also include the combining of the present two vacant parcels into one lot. Thus, necessary platting of the property will be provided. The facility would be positioned in the middle of the land area. The building will be a concrete tilt -up with glass similar to the (Johnston) building across the street. Parking is proposed on all three sides as shown. Circulation would be around the entire building for access to the rear for indoor storage and warehouse use. Rock's Roofing would occupy the westerly end of the building and will market other tenant(s) to lease the remainder of the facility. The intent would be to rezone the property from Agricultural to Planned Commercial Development (PCD). We will comply with all the required items for this district including setbacks, height, parking, landscaping, etc. At this time we do not propose any variances. We understand the required ODP and FDP process and would propose undertaking them at the same to expedite the project.
