REQUEST The applicant requests approval of a special use permit to allow parking of automobiles of an adjacent commercial use on R-3 (Residential Three) zoned property. Section 26-204 of the Code of Laws specifies that parking of automobiles of clients, patients or patrons of adjacent commercial uses requires a special use permit in this instance. Pursuant to Section 26-114 of the Code of Laws, the Community Development Director has the ability to decide upon applications for administrative special use approval, without requirement for a public hearing, provided the following conditions are met: 1. A completed application package has been submitted and fee paid. 2. The Community Development Department has notified adjacent property owners by letter notice and the site has been posted for at least ten (10) days, 3. No written objections have been received in such ten-day period; 4. The Community Development Director concludes that the criteria for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; or, 2. Whether the SUP is personal to the applicant and may or may not be inherited; and /or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section II. PROPERTY DESCRIPTION The property in question is zoned both Commercial-One (C-1) and Residential-Three (R-3). The portion of the property which the proposed parking will be located is zoned R-3. The property in question is approximately 11,500 square feet in size, or .26 acres. The current use, and ownership, encompasses three different properties. The area of the property in question will be used as parking for the commercial use which is on an adjacent property, under the same ownership. The subject area is currently used as parking; the special use request will legitimize this use however given current regulations. In order for the applicant to reconstruct the buildings on the property and make site improvements, all current development standards must be met, and this includes the use of parking in the subject area. III. SPECIAL USE PERMIT CRITERIA Before an administrative special use is approved, the applicant shall show and the Community Development Director shall find that the proposed special use: 1. Will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use. Case No. SUP-05-071Wheat Ridge Cyclery The proposed use will not have a detrimental effect on the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use. There is no change in use proposed; the special use legitimizes the existing use of the subject area for parking. 2. Will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics of the proposed plan. The request will not create or contribute to blight in the neighborhood. The subject area is currently used as parking, and the special use will allow the applicant to make physical improvements to this area including paving and buffering. 3. Will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution. The request will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution. 4. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service of internal traffic conflicts to the detriment of persons whether on or off the site. Any physical improvements made to the subject area will require the applicant to meet all current standards with regards to parking dimensions and drive aisles. The request was referred to all necessary agencies, including the fire district, with no comment. The request will help the applicant meet the number of required spaces for the adjacent commercial use to allow physical improvements to be made on the property. 5. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. All applicable development standards must be met for any physical improvements to the subject area. The request is to legitimize the use of parking in the subject area, which helps the applicant meet the required number of spaces for the adjacent commercial use. Buffering, paving, screening and landscaping in the subject area must meet current standards. 6. Will not overburden the capacities of the existing streets, utilities, parks, schools and other public facilities and services. All responding utility agencies are able to serve the property. There will be no impact to streets, utilities, parks or schools as a result of the special use. 7. History of compliance by the applicant with Code requirements and prior conditions, if any, regarding the subject property. No history was found regarding code requirements on the subject property. There are no relevant conditions on this property or the applicant pertaining to this proposal that were found. 8. Ability of the applicant or any permitted successor-in-interest to continuously meet the conditions of the proposed permit. If conditions of an approved special use are violated, the permit can be revoked. It is in the applicant's best interest to follow the terms and conditions of any approval received from the city. NEIGHBORHOOD MEETING A meeting for neighborhood input was held on August 16, 2005. There was one adjacent property owner in attendance. The main concerns expressed were with regards to drainage on the site and surrounding residential property. V. AGENCY REFERRAL All affected service agencies were contacted regarding the ability to serve the property, which consisted of the following. STAFF RECOMMENDATION/FINDINGS OF FACT Staff recommends approval of Case No. SUP-05-05, a request for approval of a special use permit to allow parking of automobiles of an adjacent commercial use on R-3 (Residential Three) zoned property with the following findings of fact: 1. Parking of automobiles of clients, patients or patrons of adjacent commercial uses (allowed on lots adjacent to a business only if the business owner also owns the adjacent lot) requires a special use permit on Residential-Three (R-3) zoned property. 2. Adjacent property owners were notified by certified mail of the application, the site was posted for a period of ten days. 3. A written response has been submitted by an adjacent property owner, Kathy Havens who owns property at 7060 W. 39`s Avenue. Ms. Havens is not objecting to the special use, but is expressing her concern regarding drainage in the area. See attached copy. 4. The applicant, Wheat Ridge Cyclery, has the ability to continuously meet the conditions of the special use permit. 5. The proposed special use permit will not have a detrimental effect upon the general public health, welfare, and safety. 6. The proposed use will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. 7. The proposed use will not adversely affect the light and air to adjacent properties. Therefore, Case No. SUP-05-07 is hereby APPROVED with the following conditions: 1. The use of the subject area shall be for parking of automobiles for the adjacent commercial use, Wheat Ridge Cyclery consistent with the plans submitted. 2. The special use permit for this facility shall ran with the applicant and may be inherited. 3. The special use permit shall remain valid as long as sufficient vehicular access to the subject parking area is provided. 4. The subject parking area shall be paved and striped and be kept in good condition in order for the special use to remain valid. All applicable regulations, including the dimensions of the parking spaces and drive aisles shall be met. 6. A 6 foot landscape buffer shall be required from the north and east property lines adjacent to the parking area. Within this landscape buffer, a new 6 foot high solid fence shall be constructed and maintained in good condition. 7. One of the conditions of approval of the SUP is that a drainage report be reviewed and approved prior to issuance of a permit for paving. Let me know if you need anything else. I would have given you my comments in writing at that time had I known that a decision might be reached administratively by the Planning Division. Drainage in this area has been problematic in the past, especially with water and snowmelt flowing towards 39"' Avenue from 38 h Avenue. The net result is usually a pool of water in front of my home which is unable to drain, both because the drains are often clogged and because they're located uphill towards High Court. It is my understanding that the storm drains were placed to drain water running off of 38 h Avenue down High Court-not water accumulating on W. 39 h. I would like the assurance of the Wheat Ridge Planning Division that this project's drainage has been considered by the City's en~ neers and shown to be adequate to drain not only High Court but also runoff on W.39 Ave. Currently there is a fence surrounding the proposed parking area on both the north and west sides. I would like the Planning Division's assurance that this fence is part of the permanent plan for the parking lot. I feel strongly that a fence, as it is presently configured, is needed to shield my property from the parking lot. The portion of the use in question, currently zoned R-3, is in the northeast corner of the site on the lot addressed 7051 West 38 h Avenue. This area is currently used as parking for the commercial use, and this land use application (special use permit) will legitimize this use as it is currently nonconforming, and the applicants wish to make substantial physical improvements to the property. Applicant's Proposal: Legitimized the use of a specific area of the site for parking, as it is currently nonconforming pursuant to the City's current parking regulations. Issues Discussed: • Drainage was the main concern expressed. Currently, drainage goes to the north, impacting the adjacent properties along 39th Avenue. • The storm sewers do not always drain properly at this location, many times because they are not properly cleared out. • There is an existing fence surrounding the parking area. This fence is in disrepair and it would be beneficial to replace it. • The Grange parking area to the north should be paved and striped. • Will there be any more lighting in this area? A neighborhood meeting will be held on Tuesday August 16th, 2005 6:30 pm at Wheat Ridge City Hall located at 7500 W. 29ih Avenue. The purpose of the request is to allow cleanup, landscaping, paving and striping of the existing parking lot at the north end of the lot, just east of the Grange property. Dear Neighbor, We at Wheat Ridge Cyclery are requesting a special use permit to legitimize the use of an existing employee parking lot. This area is currently being used for employee parking and after the improvements will remain as such. Again our plan is to cleanup, landscape, pave and stripe an existing lot. The property is zoned R-3 (Residential-Three). A special use permit is required under current city regulations to allow for parking in this area. The City of Wheat Ridge has adopted a requirement that prior to any application for Special Use Permits an applicant must notify all residents and property owners within 600 feet and invite them to a Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to present his proposal to the neighborhood and to give the neighborhood a foram to express their concerns, issues and desires. A Staff Planner will attend the meeting to discuss City policies and regulations and the process involved, however, the Planner will remain impartial regarding viability of the project. Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as testimony, it is the public hearings in front of the City Council where decisions are rendered.
