All notification and posting requirements have been met; therefore, there is jurisdiction to make a
determination regarding this request.

I. REQUEST
The applicant requests approval of a Special Use Permit to allow the establishment of a private college
on Restricted-Commercial (RC) zoned property located at 10900 W. 44 h Avenue.
The Zoning and Development code prescribes that public schools and private colleges and universities
must receive approval of special use permit to be located in an RC zone district.
Pursuant to Section 26-615, the Community Development Director has the ability to decide upon
applications for administrative special use approval, without requirement for a public hearing,
provided the following conditions are met:
1. A completed application package has been submitted and fee paid;
2. The Community Development Department has notified adjacent property owners by letter
notice and the site has been posted for at least ten (10) days;
3. No written objections have been received in such ten-lay period;
4. The Community Development Director concludes that the criteria for approval, as set forth
below, are substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval,
which may include physical design, operational, and maintenance considerations to ensure compliance
with the criteria for review.
The Community Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity; or,
2. Whether the SUP is personal to the applicant and may or may not be inherited; and /or,
3. Whether the SUP is granted only for a defined period, after which time the special use
shall expire unless renewed subject to all of the requirements of this section
II. PROPERTY DESCRIPTION
The property which is .43 acres in size has an existing two-story office building on it with a footprint
of 3100 square feet. The rest of the property is comprised of parking and landscaping. Access is by
way of single curb cuts on both W. 44d' Avenue and Owens Street.
The college's facility is located at 2930 W. 72"d Avenue, Westminster, Colorado.
III. SPECIAL USE PERNIIT CRITERIA
Before an administrative special use is approved, the applicant shall show and the Community
Development Director shall find that the proposed special use:
1. Will not have a detrimental effect upon the general health, welfare, safety and
convenience of persons residing or working in the neighborhood of the proposed use.

The property in question has always been utilized commercially. No substantial changes are
proposed to the site, except for removal of unsightly storage sheds to the south of the building and
landscaping improvements; therefore, there will be no detrimental effect on the health, welfare,
safety and convenience of persons residing or working in the area.
2. Will not create or contribute to blight in the neighborhood by virtue of physical or
operational characteristics of the proposed plan.
There will be no blight in the neighborhood as a result of the college. The proposed improvements
to the property should prove to be a benefit to the neighborhood.
3. Will not adversely affect the adequate light and air, nor cause significant air, water or
noise pollution.
The site conditions are not changing, therefore, there should be no impact on light, air, or water to
adjacent properties. The property is bounded on the north, west and east by commercially zoned
and used property. As there is an existing 6' high solid fence along the south property line, there
will be minimal impact to the adjacent residential property.
4. Will not result in undue traffic congestion or traffic hazards, or unsafe parking,
loading, service of internal traffic conflicts to the detriment of persons whether on or off
the site.
The traffic generated by the college should not be greater than the amount generated by a typical
office use. All parking requirements have been met based on the proposed use of the interior of
the building.
5. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering,
screening and landscaping, so as to be in harmony and compatible with the character of
the surrounding areas and neighborhood, especially with adjacent properties.
Adjacent properties are commercial in nature and will experience minimal impact from the
proposed special use. As there are no changes proposed to the property, there should be no
associated negative impacts.
6. Will not overburden the capacities of the existing streets, utilities, parks, schools and
other public facilities and services.
All responding utility agencies are able to serve the property. There will be no impact to streets,
utilities, parks or schools as a result of the private college use.
7. History of compliance by the applicant with Code requirements and prior conditions, if
any, regarding the subject property.
A search of the City's code enforcement records has shown that there was one zoning code
violation which occurred in 1980 related to landscaping sight triangle obstructions. The violation
was abated in a timely manner.

8. Ability of the applicant or any permitted-in-interest to continuously meet the conditions
of the proposed permit.
If conditions of an approved special use are violated, the permit can be revoked. If the permit is
revoked, then the use of the property as a private college must cease. It is in the applicant's best
interest to follow the terms and conditions of any approval received from the city.
9. Other factors relevant to the specific application.
There are no other relevant factors.
IV. NEIGHBORHOOD MEETING
A meeting for neighborhood input was held on August 31, 2005. There were no area property
owners in attendance.
V. AGENCY REFERRAL
All affected service agencies were contacted regarding the ability to serve the property. Specific
referral responses follow.
Arvada Fire Protection District: A change of occupancy will require interior upgrades.
Valley Water District: Can serve.
Wheat Ridge Building Division: Is working with the applicant regarding installation of
accessibility improvements.
Public Works Department: No comments.
VI. STAFF RECOMMENDATION/FINDINGS OF FACT
Staff recommends approval of Case No. SUP-05-08, a request for approval of a Special Use Permit
for property located at 10900 W. 44'x' Avenue to allow a private college, with the following
findings of fact:
1. This request for an administrative special use meets all applicable conditions as
required by Section 26-114 of the City of Wheat Ridge Code of Laws.
2. Staff has not received written comments in opposition to this request from the adjacent
property owners.
3. There will be no changes to the property itself therefore; there will be no detrimental
effect on the health, safety and welfare of the area.
4. There should be no impact on light, air, or water to adjacent properties and minimal
impact on traffic in the area.
5. The proposed use of the building meets the City's parking requirements based on
interior use of the structure.
6. All agencies can serve the property.

7. There has been a history of compliance of the property with the provisions of the
Zoning and Development Code.
Therefore, Case No. SUP-05-08 is hereby APPROVED with the following conditions:
1. The Special Use shall be a grant of use to the applicant, Jim McCloskey, and it may be
inherited.
2. A minimum of 34 parking spaces including two handicapped spaces be maintained on-site.
3. The existing landscaping adjacent to the east side of the structure must remain although it
may be replanted with new live, plant materials.
4. The three existing sheds on the south side of the structure must be removed.

City Of Wheat Ridge This letter is in regard to your submittal for approval of Special Use Permit to allow a real estate
college at 10900 W. 44th Avenue in the City of Wheat Ridge. I have reviewed your submittal
and have the following comments.
1. There currently appear to be striped 21 parking spaces on-site. Please provide a
statement in regard to the required parking for the college. Pursuant to Section 26-50 1 (Off-street
parking requirements), one parking space is required for each faculty or staff plus one space per
each 100 square feet of classroom area. You have indicated that the bottom floor will be used as
office space. This area must have parking to meet one space per each 200 square feet of floor
area. Unusable areas such as bathrooms, hallways and mechanical areas can be removed from
this calculation. Using a strict 90% building usage figure, 13 spaces alone are required for the
basement level.
2. Removal of the three sheds at the rear of the structure will be required as a condition of
approval of the special use permit. This will result in more available parking on the property but
it is impossible for me to ascertain the number of additional spaces at this time.
Attached are referrals received from other city departments and outside agencies.
Public Works Department: Pursuant to correspondence dated September 16, 2005, the Public
Works Department has no comments at this time.
Arvada Fire Protection District: See attached letter from Sparky Schriver, dated September 13,
2005.
Valley Water District: See attached letter from Robert Arnold, dated September 15, 2005.
Building Department. It is my understanding that you are meeting with a building inspector on-
site to discuss needed accessibility improvements.
This concludes the summary of comments. Please address each of these comments and respond
back at your earliest convenience. Once all outstanding issues are resolved, the ten day posting
and notification period can commence.

2. Additional water main lines, fire hydrants or fire sprinkler lines may be needed to
meet Arvada Fire Protection District requirements which would be at owner's expense.
3. Any modifications or additions to the existing water facilities and service would
be subject to Valley Water District rules and regulations.

Dear Sir or Madam;
The following represents response to the nine questions required by the City of
Wheat Ridge concerning the approval of our application for the Special Use Permit on
10900 West 44`" Avenue.
1. Our real estate college will have no negative affect whatsoever on the health,
welfare, safety or convenience of persons residing or working in the neighborhood.
2. The building plan will remain as it currently is. All operations are internal.
Consequently there is no possibility of contribution to blight in the neighborhood by
virtue of physical or operational characteristics of the location or use planning.
3. Since all activity is confined indoors there will be no adverse affect on the air or
water in the area and will not contribute to noise pollution in any way.
4. There will be only minimal traffic increases since our students arrive and stay for
a number of hours at a time and do not come and go on a continual basis. There is very
little material that is delivered so loading issues are negligible. There is adequate on site
parking which eliminates concerns regarding parking safety issues whether on or off site.
5. Building currently exists and there are no additions planned. The landscape will
be updated and will increase the harmony and compatibility expected and anticipated by
the surrounding inhabitants.
6. Our facility will have no negative affect on existing streets, utilities, parks, school
or other public facilities or services.

8. Our college has operated on a continual basis since 1986 and see no reason why
there would be any aversion to continually perform in perpetuity the conditions of the
proposed permit.

9. American Real Estate College will contribute to the gentrification efforts
currently planned by the City of Wheat Ridge. Our wide market exposure will introduce
a diverse variety of corporate and individual interests that would otherwise have no
exposure to Wheat Ridge. This entire proposal is a win-win situation for all parties
concerned with no perceived negatives for the participating parties.
Grant of Use:
This use is a condition of purchase and will run in perpetuity.
2. The Principles involved consist of a father and daughter in joint tenancy with
Right of Survivorship. Title will be taken in this way to eliminate any anticipated estate
inheritance concerns.
3. There should be no reason to put a time frame on this special use since the process
of education procedure will continue in its current form.

History of the College
■ American Real Estate College, previously known as AJ Education began offering
higher education courses in Real Estate Practice in 1986 since it's inception as a tenant
at 2930 W. 72nd Ave., Westminster, CO 80030.
• As a result of the possible public taking of the present premises the principal of the
college, Mr. James McCloskey, has decided to move the college to its own location
and to acquire ownership of a building situated at 10900 W. 44 h Ave., Wheat Ridge,
CO 80033. Legal Description: Lot 1 in Block 2, and Tract A, Owens Park
Subdivision, excepting therefrom the North six feet of Tract A.
■ The College has an excellent academic reputation in Colorado for providing superior
quality higher education to the Real Estate profession. It has consistently achieved the
highest pass rate in Colorado for state administered examinations and is one of the
largest Real Estate Colleges in Colorado.
• Its instructors have all been drawn from University level positions as associate
professors and all courses have been approved by the Colorado Department of Higher
Education, The Appraisal Foundation and the Colorado Real Estate Commission.
• The College also stocks ancillary Real Estate documents and paraphernalia which is
sold in its college store. Therefore it will provide significant sales tax revenue and
other fiscal benefits to the City of Wheat Ridge if the transaction is accomplished.
The Business Plan and Explanation of the Request
■ James McCloskey and partners have made a written offer to purchase the Real Estate
at 10900 W. 44"' Ave., Wheat Ridge, CO 80033 and the offer has been accepted.
■ However due to the zoning (RC) of the property a Special Use Permit is needed to
allow the building to be used as a college of higher education and this communication
is being used to initiate the process.
■ The business plan is based upon the successful outcome to the aforestated application.

The new owner contends that the buildings and parking facilities are more than
adequate to house the College and service its staff and students. Site plans and other
documents will be provided in support.
The buildings and grounds need significant rehabilitation to meet the high standards of
the College and the City of Wheat Ridge, and the new owners intend to proceed with
the work as soon as practicably convenient. They also intend to take advantage of
several economic development incentives available through the City of Wheat Ridge
and Jefferson County to create an attractive and harmonious academic environment for
its students and the citizens of Wheat Ridge.
These contentions will be amplified in further documents submitted at the formal
application stage.

NOTICE OF NEIGHBORHOOD INPUT MEETING
American Real Estate College is proposing a Special Use Permit on property located at
10900 West 44`" Avenue, Wheat Ridge, CO 80033. A neighborhood meeting will be
held on .L 3 112 P_ lv at 10900 W. 44`s Avenue. The purpose of
the request is to allow erican Real Estate College to operate a College of Higher
Education.
The City of Wheat Ridge has adopted a requirement that prior to any application for
Rezoning of property and for Special Use Permits an applicant must notify all residents
and property owners within 600 feet and invite them to a Neighborhood Input Meeting.
The purpose of this meeting is to allow the applicant to present his proposal to the
neighborhood and to give the neighborhood a forum to express their concerns, issues and
desires.
A Staff Planner will attend the meeting to discuss City policies and regulations and the
process involved, however, the Planner will remain impartial regarding viability of the
project.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be
entered as testimony, it is the public hearing#in front of the
City Council where decisions are rendered. If you want input in the decision-making
process, it is imperative that you attend the public hearings.
The kind of concerns residents normally have include the following:
• Is the proposal compatible with surrounding land uses and zoning?
■ Are there adequate utilities and services in place or. proposed to serve the project?
• What is the impact on our streets?
■ How will this proposal affect my property?

Use building located at 10900 West 44th Avenue for Real Estate College. A special use
permit is required for colleges in the R-C zone district.

Planning comments:
A special use permit will be required to allow for the proposed use on the property.
Colleges require a special use permit to be allowable in the R-C zone district. The special
use permit can be approved administratively (without a public hearing) if there are no
written objections directly related to the special use request during the 10-day public
notice period and if the site plan meets the requirements of the zoning and development
code.
The college will utilize the existing building, with three classrooms on the top level and
space leased on the ground floor for an additional use.
Parking will be required at a rate of one space per each faculty member or staff, plus one
space per each 100 square feet of class room area. Please be advised that there are
also parking requirements for any additional space that will be leased on this property.
Office uses, for example, require 1 space per 200 square feet of first floor area plus 1
space per 300 square feet for all other floors. Handicapped parking spaces also must be
provided at a rate of one handicapped parking space for every 25 overall parking spaces
Any variance or waiver to any development standard on this property, such as parking,
cannot be processed administratively as part of the special use permit. A public hearing
is required if this is necessary as part of the application.
If the property is deficient pursuant to the City's current development standards for
landscaping, an increase in landscaped area will be required. Per Sec. 26-502 (C) of the
Code of Laws, landscaping in addition to existing landscaping shall be required on a
percentage basis determined either according to square footage added, or substantially
altered, or value added to the premises by proposed improvements, whichever is higher,
up to the maximum required for that district. Existing valuation and valuation of proposed
changes shall be based on valuation tables within the adopted building code. The term
"substantially altered" means that the value of remodeling excess fifty (50) percent of the
value of the building prior to such improvements.
The property will be subject to the city's sign code. Freestanding signs are subject to
height, size and setback restrictions, and wall signage is subject to size restrictions as
well. Signage, both wall and freestanding, is allowed at a rate of one per street frontage.
Now that a pre-application meeting has been held, a neighborhood meeting must be held.
The neighborhood meeting has been scheduled for Wednesday, August 31, 2005 at 6:00
p.m. at the subject property (10900 West 44th Ave. The applicant is responsible for giving
adequate notice to all property owners and tenants. There is a $100 fee for the
neighborhood meeting that needs to be received on or before the date of the hearing.
After the neighborhood meeting is held, a formal application for a special use permit may
be submitted. Upon receipt of the application the proposal will be referred to the
necessary outside agencies for review and comment for a period of 15 days.
After the review process is complete, the Community Development Department shall
notify adjacent property owners by certified letter and posting of the site for 10 days. If no
written objections directly related to the special use request are received within this 10-
day period, the Community Development Director can approve, approve with conditions
or deny the special use. Upon receipt of any relevant written objections by an adjacent
property owner or upon appeal by an applicant of a decision by the Community
Development Director, the special use request will be scheduled for public hearing in front
of City Council. If approved, either by the Community Development Director or by the

As discussed with Harold Ovsiowitz I am attaching for your information two letters in
support of our contention that you should classify American Real Estate College as a
college under the Zone District Regulations.
The first letter is from the Appraisal Foundation in Washington, D.C., authorized by
Congress as the source of Appraisal Standards and Qualifications. The program
administrator has confirmed that the American Real Estate College offers courses which
are considered higher education and that from January 1, 2008 the courses will also
include Economics, Finance and Law at college and/or university level.
The second letter is from the State of Colorado, Department of Higher Education. In this
letter the program supervisor, Valorie Briggs, confines that the American Real Estate
College is approved under CRS 12-59-107 as a private school an/or college offering
higher education and is a post-secondary institution operating under approval certificate
2084.
We contend that the school designation under which you have placed us is for
trade/professional vocations such as beauty schools, driving schools and other similar
schools where the training is primarily in manual skills rather than intellectual skills.
Please give us a final opinion at your earliest convenience, as we are under contract and
must rescind the contract timelessly in order to avoid any financial liability.

proprietary school, American Real Estate College, LLC (school), 2930 W. 72nd Avenue,
Westminster, CO 80030. The school is approved and regulated by the Colorado Department
of Higher Education, Private Occupational School Board, as required in Colorado Revised
Statute 12-59-101.
To operate In Colorado, private schools and colleges offering occupational education and
associate degrees at the post-secondary level are required to comply with Colorado's Private
Occupational Education Act of 1981, cited in C.R.S. 12-59-107.
The school was initially approved to operate on June 12, 1986, under the name "A.J.
Educational Services, Inc." On August 20, 2001, the school officially changed its name to
American Real Estate College, LLC. The school Is currently operating in good standing

I am writing on behalf of American Real Estate College, regarding zoning for their
new business location. The Appraisal Foundation is an umbrella organization for
the Appraiser Qualifications Board (AQB) and the Appraisal Standards Board
(ASB). The AQB and ASB develop both educational and professional standards for
members of the appraisal profession, which includes, but is not limited to, real
property, personal property, and rural appraisers.
As Publications and Programs Administrator of The Appraisal Foundation, I work
closely with both AQB Certified USPAP Instructors and Educational Providers
who offer the National USPAP Courses developed by the AQB. Since January
2003,1 have had many opportunities to work with Mr. Harold Ovsiowitz and Mr.
James McCloskey, as they are both AQB Certified USPAP Instructors. It is also my
understanding that American Real Estate College offers appraisal courses,
including the National USPAP Course. American Real Estate College is, in fact,
listed on our website as an educational provider of the National USPAP Courses.

Real property appraisal is a profession regulated at both the state and national
level. Real property appraisal courses needed for pre-licensure and continuing
education are offered not only at proprietary schools, but also at community
colleges and universities and thus are considered higher education. Beginning
January 1, 2008, appraisers will not only need courses in standards and ethics, but
will also have to take courses in economics, finance, and business law, all of which
are recognized as higher education courses at any university.
My professional dealings with Mr. Ovsiowitz, Mr. McCloskey and American Real
Estate College have all been most satisfactory; they are excellent representatives of
the mission of The Appraisal Foundation, which is the advancement of professional
valuation.
