RE: Subdivision Plat/4365 & 4385 Reed Street
Dear Mr. Wilhelm:
I have completed my second review of the submitted subdivision plat for the properties located at 4365
and 4385 Reed Street, and I have the following comments:
1. As was mentioned in the review comments dated 28 March 2006, the new lot line will conflict
with an existing garage directly to the west of lot 1. The new lot line must be at least ten feet
from the existing structure. I have included a red-lined copy of a site plan which illustrates the
conflict. You have the option of applying for a variance to allow the reduced setback. This will
require an additional fee of $480 and will entail a public hearing before Planning Commission.
2. Please see the attached comments from David Brossman, Development Review Engineer. One
correction is required to the legal description.
There are two options for proceeding with this application. The first option is to move the lot line
identified on the site plan, make the correction as noted by the Public Works Department and produce a
signed mylar for recordation. The mylar must be signed by the surveyor and each property owner. Please
be aware that an indelible marker must be used (the mylar may not be signed in ball point pen). The
signed mylar and a check for $11.00 must be submitted to the Community Development Department. The
$11.00 fee is for recordation with the County. The case planner will gather required City signatures and
record the mylar with the Jefferson County Clerk and Recorder.
The second option is to keep the lot line in the current location and request a variance to setback for the
existing garage. If this is the preferred option, please submit one 11" x 17" copy of the improvement
location certificate and a check for $480.00. A Planning Commission hearing will be scheduled, which
you must attend.

Surveying Comments
The following two corrections/additions need to be made prior to the creation of the Mylar®:
1. Per Section 26-412 of the Municipal Code of Laws, the Legal Description shall include the section tie
information, including the Point of Commencement.
2. Include the plat revision information.
Upon completion of the above two comments the Final Plat will be approvable and the Mylar® may be submitted
for signatures.

Dear Mr. Wilhelm:
I have completed my initial review of the submitted subdivision plat for the properties located at 4365 and
4385 Reed Street, and I have the following comments:
General:
A. I have included all comments received from external agencies. Please direct any questions
to the agency which generated said comment.
B. The application fee has not been submitted to date. Please remit $300.00 to the City of
Wheat Ridge upon resubmittal. The review process will not proceed without the
application fee.
C. Please submit a copy of a deed for 4385 Reed Street. The deed must be a recorded
document in the Jefferson County Clerk and Recorder's office.
D. Please submit an improvement location certificate with the next submittal. This
improvement location certificate will detail the location of each existing structure and the
existing and proposed lot lines. Of particular concern is an existing structure located on the
western half lot 4. It should be noted that the existing structure must meet all applicable
setbacks in the R-2 zone district. In this case, the structure must be at least five feet from
the new property line.
E. Please submit documentation from the property owner at 4365 Reed Street acknowledging
this subdivision process, and expressly giving consent to the property owners at 4385 Reed
Street to act on their behalf. Jefferson County lists Tracy Levstik as the owner of 4365
Reed Street.
2. Plat Review:
A. Please include a metes and bounds legal description for the properties.
B. Please add a case history box which includes the case number "LLA-06-01
C. Please add zoning to all lots shown on the plat. The entirety of the area is zoned
Residential Two (R-2).
D. Please reword the City Certification block to read: Approved this day of
2006 by the City of Wheat Ridge.
E. Please label the lot line to be dissolved as being "hereby removed by this plat".
Please make all required corrections prior to the next submittal. Please submit four full size (24" x 36")
folded copies of the revised plat for the second review. Once all corrections have been made, a full size

(24" x 36") mylar copy must be produced, in conformance with Jefferson County standards, and
submitted to the Community Development Department along with a recording fee of $11.00. The.mylar
must be signed in indelible ink by all property owners and the surveyor. The Community Development

Recorder.

Surveying Comments
1. Show all zoning, both for the 2 lots in the Replat and also for adjoining parcels.
2. Modify the text currently shown as "FORMER LOT LINE BETWEEN LOTS 4 AND 511, to "LOT LINE
HEREBY REMOVED BY THIS PLAT".
3. Rename the plat to: "Reed Street Subdivision, Replat No. 1".
4. Per Section 26-412 of the Municipal Code of Laws, the Legal Description shall include a metes and
bounds description with section tie(s) on the current City Datum. Along those same lines, the following is
to be included on the plat:
a. The Basis of Bearing statement needs to be a section or quarter section line, and use a city-based
bearing.
b. Point of Commencement.
c. True Point of Beginning.
5. Please modify all property and subdivision boundary lines to be on city-based bearings.
6. Show the Reed Street "CL" of ROW (and width), with a distance to the True Point of Beginning as
indicated on the redlined plat.
7. Need to include a Case History Box (see redlined plat).
8. Include the Dates of Preparation and Revision.

AGREEMENT TO ISSUE POLICY

If the Requirements shown in the Commitment have not been met within six months after the Commitment date, our
obligation under this Commitment will end- Also, our obligation under this Commitment will end when the Policy is
issued and then our obligation to you will be under the Policy.

CONDPPIONS
1. DEFMI TIONS
(a) "Mortgage" means mortgage, deed of trust or other security instrument.
(b) "Public Records" means title records that give constructive notice of matters affecting the title
according to state law where the land is located..
(c) "Land" means the land or condominium unit described in Schedule A and any improvements on the
land which are real property.
2. INTERVENING DEFECTS
The Company hereby insures against loss or damage by reason of there being recorded any deeds, mortgages,
lis pendens, liens or other title encumbrances which first appear in the public records subsequent to the
effective Date of Commitment, but prior to the effective Date of Policy. "Public records" as used herein
means those records in which under statutes deeds, mortgages, judgment liens or lis pendens must be
recorded in order to impart constructive notice to purchasers of the land for value without knowledge.
The Company does not insure against such loss or damage if the existence of such deeds, mortgages, lis
fenders, liens or other title encumbrances is actually known to the proposed insured prior to or at the time of
closing. The closing is defined herein as being the time of the execution and delivery to the proposed of the
documents creating the interest of the proposed insure.
3. EXISTING DEFECTS
If any defects, liens or encumbrances existing at Commitment Date are not shown in Schedule B, we may
amend Schedule B to show them. If we do amend Schedule B to show these defects, liens or encumbrances,
we shall be liable to you according to Paragraph 4 below unless you knew of this information and did not tell
us about it in writing.
4. LIMITATION OF OUR LIABILITY
Our only obligation is to issue to you the Policy referred to in this Commitment, when you have met its
Requirements. If we have any liability to you for any toss you incur because of an error in this Commitment
our liability will be limited to your actual loss caused by your relying on this Commitment when you acted in
good faith to:
• comply with the Requirements shown in Schedule B - Section I or
• eliminate with our written consent any Exceptions shown in Schedule B - Section 2.
We shall not be liable for more than the Policy Amount shown in Schedule A of this Commitment and our
liability is subject to the terms of the Policy form to be issued to you.
5. CLAIMS MUST BE BASED ON THIS COMMITMENT
Any claim, whether or not based on negligence, which you may have against us concerning the title to the
(and must be based on this Commitment and is subject to its terms.
DISCLOSURES
SPECIAL TAXING DISTRICT NOTICE
The subject Ind may be located in a special taxing district; a certificate of taxes due listing each taxing jurisdictio,e-shall be
obtained from the county treasurer or the county treasurer's authorized agent; and information regarding special districts and the
boundaries of such districts may be obtained from the board of county commissioners, the county clerk and recorder, or the
county assessor.
PRIVACY PROMISE FOR CUSTOMERS
We will not reveal nonpublic personal information to any external non-affiliated organization unless we have been authorized by
the customer, or are required by law.
CONSUMER DECLARATION STATEMENT
This Commitment for Title Insurance may include a Schedule B exception reference to recorded evidence that a mineral estate
has been severed, leased, or otherwise conveyed from the surface estate. If such reference is made, there is a substantial
likelihood that a third party holds some or all interest in oil, gas, other minerals or geothermal energy in the property. The
referenced mineral estate may include the right to enter and use the property without the surface estate owner's permission. You
may be able to obtain title insurance coverage regarding any such referenced mineral estate severance and its affect upon your
ownership. Ask your title company representative for assistance with this issue.

Planning comments:
The applicant/property owner of 4385 Reed Street wishes to release the western
approximately 75 feet of his lot to the owner of the property to the south, which would
entail completing a lot line adjustment.
The subject properties are zoned Residential Two (R-2), which does allow for single and
two family dwellings depending on lot size and lot width requirements. As a result of this
request, no lots will become nonconforming in this regard, nor will there be any lots
created which would consequently allow for a two family dwelling.
The applicant must complete a lot line adjustment, which in this instance will be an
administrative process (no public hearing). The steps involved include submittal of a
signed, notarized land use application, $300 fee, proof of current ownership for both
properties involved, and submittal of a survey plat which illustrates the change in lot
configuration. Of note is that on the plat, the owners of both properties must sign in
approval of the plat. Once complete, the plat will be recorded with Jefferson County; at
this point it becomes official.
