This correspondence is in regard to your application for approval of a consolidation plat for the
Applewood Baptist Church located at 11225 W. 32"d Avenue. I have reviewed the document
and have the following comments.
PAGE ONE
1. Under the first line of the legal description, add "Subdivision", after Brookside.
2. The dedicatory language is not the City's current version. Please modify in
accordance with the attached information.
3. Add the following case numbers to the case history box: MS-04-01, CUP-97-03,
CUP-96-02, CUP-96-01, WV-93-06
4. Correct the signature block from Director of Planning and Development to
Director of Community Development
5. Add a note designating that the property is zoned R-1, Residential-One.
6. Under the Mayor's certification, remove "by motion of its City Council".
7. Under the Clerk and Recorder's Certification, change the year to 2004.
8. Add easement language, in accordance with the attached information.

1. Designate adjacent zoning on the north, east and west as R-1.
2. Add perimeter easements - 10' wide easements along the front and rear property
lines with 5' wide easements along the sides.
Attached are referral responses received from other city departments or outside agencies. All of

Dear Mr. Berling,
I have completed the first review of the above referenced documents for the proposed development located at
11225 West 32vd Avenue received on August 20, 2003, and have the following comments:
1_ Please include a "more particularly described as..." (metes and bounds) portion in the Legal Description-
2. On the graphical portion of the Plat, show the Point of Commencement, True Point of Beginning, and a
section-tie corresponding to the metes and bounds portion of the Legal Description
3. Remove the word "DAY" from the Notary Certification as indicated on the redline Plat.
4. Please change the Director of Planning and Development to The Director of Community Development
(the department name has changed).
5. Please indicate any proposed easements (e.g., utility).
6. Need to show all zoning, both on and off-site.
7. If there is a gap along the northerly Subdivision boundary, include a detail showing found pins, and other
information necessary to clearly explain.
8. Please indicate on the Plat in the form of a Note (or state in your response letter) whether there is an
easement for the ditch that flows across this property into Lena Gulch.
9. The Case Number (to be included in the Case History Box) is MS-04-0 1.

Dear Ms. Reckert:
This will acknowledge receipt of your correspondence dated January 22, 2004
regarding the above referenced property.
Please be advised that the above referenced property is in an area served by The
Consolidated Mutual Water Company by virtue of a Distributor's Contract with Denver
Water. Domestic water service may be provided to this property subject to compliance
with the Company's rules, regulations and requirements for such service as well as the
water tap allocation policies as established by Denver Water.
Our records indicate that the property addressed as 11225 West 32nd Avenue is
currently receiving domestic water from the Company through a one-inch meter
(CMWCo Tap Number 19275/Account Number B-09200) Domestic water service may
continue to be provided to this property subject to compliance with the Company's rules,
regulations and requirements for such service.
The Company requires that a new application for water service be completed by the
owner and returned to the Company at the time there is a change in use. The Company
considers a remodel or building addition as a "change of use.

The Company's rules, regulations, and requirements further state that each separate
structure be served by a separate tap and meter, and in order to receive domestic water
service, the property must also front a Company main. Consolidated further requires
that a duplex have a separate water tap and meter for each unit within the duplex,
regardless of ownership.
Fire protection requirements should be obtained from Wheat Ridge Fire Protection
District and those requirements forwarded to this office by the Fire District at the earliest
possible time. We can then determine if additional system improvements would be
required to meet the demands set forth by the Fire District.

RE: Applewood Baptist Church - Parcel Consolidation Subdivision Plat
Dear Ms. Reckert:
We have researched the history of the Church's two deeds, copies of which are attached for
your review and use, associated with the Church's property on the north side of West 32nd
Avenue. It is our opinion that the Church owns two legal parcels of ground and that an
administrative review and approval process is appropriate. We believe there are only two
parcels for the following reasons:
1. Research of the history of the two parcels indicate that each parcel has been
conveyed since at least since 1923 as two parcels, never three.
2. The parcels can only be sold as two parcels per the legal descriptions on the two
attached deeds, without going through a subdivision process per
Senate Bill 35 (May 5, 1972).
3. The legal description for both parcels, as described in the attached deeds, were
created prior to May 5, 1972, when Senate Bill 35 was implemented.
With this letter, we respectfully request that the City allow the two parcels to be consolidated
under the administrative review process.
Your timely response would be greatly appreciated; as we desire to make a submittal soon.

Dear Mr. Berling,
I have completed the first review of the above referenced documents for the proposed development located at
11225 West 32ad Avenue received on August 20, 2003, and have the following comments:
I. Please include a "more particularly described as..." (metes and bounds) portion in the Legal Description.
2. On the graphical portion of the Plat, show the Point of Commencement, True Point of Beginning, and a
section-tie corresponding to the metes and bounds portion of the Legal Description
3. Remove the word "DAY" from the Notary Certification as indicated on the redline Plat.
4. Please change the Director of Planning and Development to The Director of Community Development
(the department name has changed).
5. Please indicate any proposed easements (e.g., utility).
6. Need to show all zoning, both on and off-site.
7. If there is a gap along the northerly Subdivision boundary, include a detail to clearly explain.
8. Please indicate on the Plat in the form of a Note (or state in your response letter) whether there is an
easement for the ditch that flows across this property into Lena Gulch.
