At the Planning Commission public hearing on October 7, 2004, a two lot minor subdivision involving the subject lot was approved with the following condition: • That a note be added on the plat as follows: "Lot 7 shall only be used as accessory to the multi-family structure at 3851 Otis Street as long as the multi-family structure is in existence. In the event that the use changes at 3851 Otis Street or if parking for the apartments is acquired elsewhere, Lot 7 can be developed in accordance with applicable zoning regulations". Attached are the minutes from this public hearing with this condition, as well as the above mentioned Anel Subdivision plat that was recorded with Jefferson County on October 18, 2004 with the above mentioned language as approved. Per Sec. 26-421 (D) subdivisions with new residential development can be charged a parkland dedication fee. It was determined at a staff meeting how this applies to this case, and that determination is as follows. When a subdivision creates new lots we charge a parkland dedication fee, however with this application it is not creating two new lots, there are two existing and it just changes the configuration of them. A comparable case (MS-03-01) took place in which a parkland dedication fee was assessed. It was referred to the parks and recreation department and it appears they made this determination. It was determined at the staff meeting that this fee should not have been assessed because new lots were not created, they were two existing lots (like MS-04-07). At the date of this memo, no building permits had been applied for per MS-03-01 so the parkland dedication fee has not been collected yet. The following information must be on the plat for it to be recorded: 1. A condition of approval for the subdivision, to be on the plat is as follows: "Lot 7 shall only be used as accessory to the multifamily structure at 3851 Otis Street as long as the multifamily structure is in existence. In the event that the use changes at 3851 Otis Street or if parking for the apartments is acquired elsewhere, Lot 7 can be developed in accordance with applicable zoning regulations". Include this specific language under "General Notes" on the plat. 2. The easement language (General Note #2) is inconsistent with what is on the plat. The note states that 10 foot easements are granted on both the front and rear property lines, however the plat shows a 5 foot easement on the rear property line of both lots. 3. The plat must be signed and notarized by the property owner, Barbara Coltrin as personal representative of the Estate of Pete and Rosemary Ricci. Please make these changes and submit a blueline (paper) copy of the subdivision plat prior to printing the mylar. Once the paper copy of the plat has been reviewed, you may submit a blackline photgraphic mylar for recording with Jefferson County. The fees for recording with Jefferson County are $11 per page. Case No. MS-04-07: An application filed by Keith Gantenbein for approval of a two- lot minor subdivision plat for properties located at approximately 3821 and 3841 Otis ~~~111 Street. The case was presented by Jeff Hirt. He entered all pertinent documents into the record and advised the Commission there was jurisdiction to hear the case. He reviewed the staff report and digital presentation. The purpose of the subdivision is to allow for adjustment of a lot line by two feet to allow construction of a two-family dwelling on one of the lots (lot 6). The second lot (lot 7) is presently used as a parking lot for the adjacent apartment building. It is possible to place as a condition of approval that lot 7 can only be used as parking for the adjacent apartment building in the future. Staff recommended approval of the application for reasons, and with conditions, outlined in the staff report. In response to a question from Commissioner WESLEY, Mr. Hirt explained that, under present zoning, a single family home could be built on lot 7 which would leave the apartment building without a parking lot. Commissioner CHILVERS commented that he lives in this neighborhood and looks forward to the improvement this application will bring. He asked if curb and gutter would be required. Mr. Hirt explained that curb and gutter for Lot 6 would be required when development occurs on Lot 6. Commissioner STEWART asked if the city could require the parking lot to be paved. Alan White replied that, because the apartment building and parking lot were constructed prior to the city's incorporation, it would not be possible to require paving at this time. However, if "site development" as defined in the code should occur in the future, pavement could be required at that time. Keith Gantenbein 8106 Druhill Road, Golden Mr. Gantenbein explained that the lot size insufficiency came to light as the result of a survey. If the application is approved, he plans to build a two-family dwelling on Lot 6 and the city will require curb and gutter at the time of development. In response to a question from Commissioner WESLEY, Mr. Gantenbein stated there would be off-street parking for his proposed development. He showed the Commissioners elevations of a similar duplex he recently completed in Golden. Art & Barbara Coltrin Mr. and Mrs. Coltrin own the subject property. Mr. Coltrin stated that, as soon as weather permits, Lot 7 would be graded. Lot 6 is for sale because it serves no purpose to the apartment building. He further stated that he is upgrading the existing apartment building. Chair PLUMMER asked if there were anyone present who wished to address this matter. There was no response. Planning Commission Page 2 October 7, 2004 Commissioner WESLEY commented that he would support approval of the application because it presents an improvement to the area. In response to a question from Commissioner McNAMEE, Mr. Hirt replied that no comments have been received from the neighbors regarding the application. She expressed concern that the application would probably result in more rental property in Wheat Ridge. Mr. Coltrin commented that many rental units already exist in the area. It was moved by Commissioner McMILLIN and seconded by Commissioner WESLEY to approve a lot size variance of 562 square feet and a lot width variance of 8.95 feet to the R-3 development standards for 3841 Otis Street, or Lot 7 of the Anel Subdivision, for the following reasons: 1. Lot 7 is currently used as parking for the multi-family structure to the north at 3851 Otis Street. The decrease in square footage as a result of this request for Lot 7 will not impact the parking required for this building. 2. The City will impose a condition of approval on the plat regarding Lot 7 in order to restrict the ability to develop this parcel relative to its use as parking for a multi-family structure located to the north. 3. It is the opinion of staff that an incentive to develop this vacant unmaintained lot would be beneficial. 4. The variance to allow a duplex on Lot 6 will not negatively impact the character of the neighborhood. The motion passed 8-0. It was moved by Commissioner McMILLIN and seconded by Commissioner STEWART to approve Case No. MS-04-07, a two-lot minor subdivision plat for property located at approximately 3821 and 3841 Otis Street, for the following reasons: 1. All requirements of the City's Subdivision Regulations have been met. 2. The minimum lot size and lot width requirements for the lot to be developed meets the R-3 zone district requirements because the variances were approved. 3. Based on the wide variety of land uses in the immediate area, a duplex will not be out of character with the neighborhood. 4. The City will impose a condition of approval on the plat regarding Lot 7. It will be beneficial to restrict the ability to develop this parcel for anything other than its use as parking for the multi-family structure located to the north. 5. It is the opinion of staff that an incentive to develop this vacant unmaintained lot would be beneficial. The motion passed 8-0. B. Case No. ZOA-03-18: An ordinance amending Chapter 26 of the Wheat Ridge Code of Laws pertaining to signage. The case was presented by Meredith Reckert. She distributed a proposed amendment by staff regarding reader-board menus. She reviewed the staff report containing proposed amendments to the sign code. Previous suggestions made by the Commission were incorporated into the proposed amendments. In response to a question from Commissioner McMILLIN regarding the length of life for cabinet signs, Ms. Reckert stated that in talking with a sign company representative, she learned that the life depends upon the quality of construction. Nonconforming signs can stay until changes are requested. Commissioner SCEZNY questioned the value of making a differentiation between natural causes or vandalism in the destruction or removal of more than 50% of a nonconforming sign. There was discussion regarding a possible requirement to replace nonconforming signs regardless of the reason they are destroyed. There was a consensus of the Commission that it is very important to consider sight triangles when placing signs at signalized intersections. During discussion of banner regulations, Commissioner McMILLIN commented that there have been no comments from the business community regarding limitation on banners. Chair PLUMMER invited comments from those in attendance. Milton Tedford Mr. Tedford expressed concern about rental property which he constructed about twenty years ago south of 44th on Moore. The city granted a temporary sign permit and, for the past twenty years he has had a sign on private property located at 441i and Moore. He has an agreement with the property owner for placement of the sign. He stated the sign is crucial in obtaining tenants for his 52 rental units on Moore. On August 3, 2004, he received notification from the city that the sign was in violation because it was an off-premises sign. His suggestions to remedy the situation included: (1) that his sign be grandfathered; (2) that the sign code allow property within 100 yards of a main arterial street to have off-premises signage; and (3) twenty years with the sign in the same place should be supported under the statute of limitations. He submitted photos of his property and other off-premises signs along West 44th Avenue. Ms. Reckert commented that while there was evidence that a temporary sign permit was issued in 1985, there are no records showing that it was ever renewed. Lot 7 is currently used as parking for the multifamily residential structure to the north at 3851 Otis Street that is also under ownership of the estate. Conveyance of the 2 feet to Lot 6 will not result in the creation of an inadequate parking area for this multifamily residential structure. The purpose of the subdivision is to allow for the adjustment of a lot line to bring an existing lot into conformance with the R-3 development standards to allow for a two family dwelling. The lot in question (Lot 6) is currently 8,794 square feet, making it 206 square feet short of the required 9,000 square feet minimum lot size to construct a two family dwelling in R-3. Adjusting the lot line 2 feet to the north along the boundary of Lot 6 and Lot 7 will increase the square footage of Lot 6 to 9,042 square feet, thus making a two family dwelling allowable on the lot a b t : B atal Adjusting the lot line 2 feet will result in a decrease in lot size and lot width for Lot 7. Lot 7 will decrease from 7,194 square feet to 6,938 square feet, and the lot width will decrease from 53.05 feet to 51.05 feet. At 7,194 square feet, Lot 7 is currently 306 square feet short of the required 7,500 square feet minimum lot size for a one family dwelling in R-3. At 53.05 feet in lot width, Lot 7 is 6.95 feet short of the required 60 foot minimum lot width for a one family dwelling. This request will create a larger deficiency in accordance with the R-3 development standards for Lot 7, therefore a variance to lot size and lot width will need to be processed concurrently with the subdivision request. If Lot 6 were developed with the current zoning, a one family dwelling would be allowed. Lot 7 as it is now could not be developed under the current zoning for anything other than it's current use as parking area. Per the City's regulations regarding nonconforming lots, lots that are nonconforming with continuous street frontage in single ownership cannot be developed. However, if Lot 7 were sold to a different entity, a single family residence could be built on it. If this were to happen, the parking for the apartments at 3851 Otis would be displaced. There are no requirements in the planning and development code for the applicant to submit specific architectural and/or site plans for improvements to the property. The applicant has only requested a minor subdivision for a two-family dwelling unit to be allowed on Lot 6, in addition to the required variances to lot size and lot width. The area surrounding the properties in question for the minor subdivision and variances is a mix of two-family and multifamily dwellings, commercial uses and single-family dwellings. Adjacent properties include the parking lot and multifamily structure to the north, a two-family dwelling to the west, and a parking lot and commercial uses (dentists office, auto sales) to the south. Directly across Otis Street to the east, there are single famil homes extending north, and there is a multifamily structure across Otis Street to the south Me 'a ' e'n Planning Commission 2 Case MS-04-07/Gantenbein H. CASE HISTORY Lot 6 and Lot 7 combined encompass 15,980 square feet, and they are both zoned Residential-Three (R-3). Both lots are generally rectangular in shape, with Lot 6 having a distinct curvilinear eastern property line. On June 24, 2004, the applicant came before the Board of Adjustment to request a lot size variance of 206 square feet from the 9,000 square foot minimum to allow for construction of a two family dwelling on Lot 6. The request was denied based on the fact that the property can continue to have a viable use, and that there is a means to acquire the additional 206 square feet because there is a common owner of the subject lot and the lot to the north (Lot 7). A recommended means of ac wiring this additional square footage was a lot line adjustment ' ' r A o~Ad~ prenn - At the time of this Board of Adjustment public hearing, Staff was not aware that the size and width of Lot 7 were deficient. After being denied for the variance on June 24, 2004, the applicant then made an application for a lot line adjustment to acquire the additional square footage to allow a two family dwelling on Lot 6. Per the Code of Laws, lot line adjustments can be reviewed administratively, meaning that the request does not have to go to a public hearing. However, there is the stipulation that the lot line adjustment cannot result in the creation of additional units. This request will result in the creation of an additional dwelling unit, therefore it must be processed as a minor subdivision and reviewed at a Planning Commission hearing. The case was originally scheduled for the September 16, 2004 Planning Commission hearing, however the disclosure of new information required the postponement of this hearing to the October 7, 2004 hearing. The original plat submitted did not show the dimensions and size of Lot 7, and after publishing for the September 16 hearing a new plat submitted illustrated that Lot 7 was of deficient size and width, therefore a variance request had to be processed concurrently with the subdivision request, and had to be published as such. M. SUBDIVISION PLAT This minor subdivision will not create any new lots. The purpose of the subdivision is to reconfigure the existing northern lot line of Lot 6 to bring the lot into compliance with the R-3 development standards to allow for construction of a two family dwelling. The multifamily residential structure to the north of lots 6 and 7, located at 3851 Otis Street contains seven units according to the Jefferson County Assessor's records. This structure was built in 1951, and there are no records in the City's building files of its construction, or any renovations done on the building. This structure currently sits on two parcels per the Jefferson County Assessor's parcel maps, with the lot line going through the building. The City's current zoning regulations specify that 3,630 square feet of lot area is required for each unit in the R-3 zone district. As the multifamily building sits on two parcels, and lot 7 is used as parking for this building, the use encompasses three parcels `x ft 5 q . an Under current conditions, 5 units could be built on the three combined lots. The Wheat Ridge density standards for residential development were amended in 1997 to the current density standard of 3,630 square feet per unit for R-3 multi-family development. The prior density standard was 21 units per acre or one unit for 2,074 square feet of land area. The "old" standard was adopted by the City from Jefferson County standards upon incorporation. Based on the old standard, a seven unit apartment structure would require 14,518 square feet of total lot area. The two lots which the apartment is located on have a combined square footage of 14,600 square feet. Staff therefore concludes that when the apartments were built, they were conforming and did not require the land area from Lot 7 to meet the density standard. If this structure were destroyed, it could be rebuilt in it's current configuration. Planning Commission 3 Case MS-04-07/Gantenbein There is the option of placing a condition of approval on the subdivision and variance requests relative to the current and future use of Lot 7. As Lot 7 is currently used as parking for the multifamily residential structure to the north, and it is a separate parcel, a condition on the plat can specify that Lot 7 cannot be developed for anything other than it's current use. The condition can also specify that Lot 7 can be developed only if the use changes on the parcels to the north (encompassing the multifamily residential structure) or if parking for the apartment building is provided elsewhere. The estate's representatives have agreed to this condition. If the subdivision with variances is approved, Lot 6 will increase in size from 8,794 square feet to 9,042 square feet and will exceed the minimum lot width of 75' for a duplex. Lot 7 will decrease in size from 7,194 square feet to 6,938 square feet, and decrease in lot width from 53.05 feet to 51.05 feet. Both lots have frontage on Otis Street. Each lot has 5 foot utility easements on the east/west property lines, and 10 foot utility easements on the north/south property lines. General note number 2 contains the City's standard language for these easements. IV. AGENCY REFERRALS All agencies are currently able to serve the property and can continue to do so with the proposed minor subdivision. Any service upgrades required by the referral agencies will be addressed when the applicant submits for a building permit. V. STAFF CONCLUSIONS AND RECOMMENDATIONS FOR MINOR SUBDIVISION REQUEST The requirements of the Subdivision Regulations have been met and if the variances are approved, the parcel to be developed meets the lot area and lot width requirements for a two family dwelling in the R-3 zone district. Therefore, staff recommends APPROVAL for the following reasons: I. All requirements of the City's Subdivision Regulations have been met. 2. The minimum lot size and lot width requirements for the lot to be developed meet the R-3 zone district requirements if the variances are approved. 3. Based on the wide variety of land uses in the immediate area, a duplex will not be out of character with the neighborhood. 4. The City can impose a condition of approval on the plat regarding Lot 7. It would be beneficial to restrict the ability to develop this parcel for anything other than it's use as parking for the multifamily structure located to the north. 5. It is the opinion of staff that an incentive to develop this vacant, unmaintained lot would be beneficial. With the following condition: A note be added as follows: Lot 7 shall only be used as accessory to the multifamily structure at 3851 Otis Street as long as the multifamily structure is in existence. In the event that the use changes at 3851 Otis Street or if parking for the apartments is acquired elsewhere, Lot 7 can be developed in accordance with applicable zoning regulations. Planning Commission 4 Case MS-04-07/Gantenbein VI. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance request: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? Currently Lot 7 is a substandard lot and cannot be developed due to the fact that it is under the same, adjacent ownership. If it were sold to a different entity, a single family dwelling could be built on this lot. Lot 6 can be used as a single family dwelling in it's current state. 2. If the variance were granted, would it alter the essential character of the locality? The proposed use of Lot 6 as a two family dwelling would be compatible with the surrounding area as it has a mix of single-family dwellings, duplexes, multifamily and commercial land uses ee" Tfb @X1al~ c* I y ylau . If the variance were granted for Lot 7, it would not negatively effect the character of the area, nor impact it's use as a parking lot. 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? There are no unique conditions related to physical surrounding, shape or topography that render any portion of Lot 6 (the lot of the proposed two family dwelling) unbuildable. The property is generally of a rectangular shape with a curvilinear eastern property line. There is no grade change on the property. Lot 7 could be developed as a single family residence if it were under separate ownership. 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The applicant, acting on behalf of the owner, has created his own hardship by requesting a minor subdivision and consequently a variance from the R-3 development standards. Even as R-3 allows for one, two and multifamily dwellings, Lot 6 does not meet the minimum lot area requirement by 206 square feet per the Code of Laws to construct a two-family dwelling unit. Had Staff been aware of the lot deficiencies to the north, the Board of Adjustment may not have concluded that there were subdivision options available to the applicant. 5. Would the granting of the variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? Approval of the variance would not be detrimental to the public welfare or injurious to other property in the area. There may be a slight decrease in the supply of light and air as a duplex typically has more mass than a single-family residence. There may be somewhat more traffic generated by two units than one, however Otis Street is a full width street and should be able to accommodate the resultant increase in traffic. Property values should not be impacted due to the wide diversity of land uses in the immediate vicinity. Planning Commission Case MS-04-07/Gantenbein 6. If criteria 1 through 5 are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The request would not result in a substantial benefit or contribution to the neighborhood, although a relatively unmaintained vacant lot would be developed. It is the opinion of staff that development of the property would be more desirable than a vacant, relatively unmaintained lot and that granting the variance may be an incentive for development. The variance and resultant plat note will ensure that Lot 7 will be continued to be used for parking for the apartments to the north. The request would not result in a reasonable accommodation of a person with disabilities. VII. STAFF CONCLUSIONS AND RECOMMENDATIONS FOR VARIANCE REQUEST Upon review of the above request, staff concludes that the criteria are supportive of the variance requests. Staff has found that there are unique circumstances attributed to these requests that would warrant approval of the variances. Therefore, staff recommends APPROVAL for the following reasons: 1. Lot 7 is currently used as parking for the multi-family structure to the north at 3851 Otis Street. The decrease in square footage as a result of this request for Lot 7 will not impact the parking required for this building. 2. The City can impose a condition of approval on the plat regarding Lot 7. It would be beneficial to restrict the ability to develop this parcel relative to it's use as parking for a multifamily structure located to the north. 3. It is the opinion of staff that an incentive to develop this vacant, unmaintained lot would be beneficial. 4. The variance to allow a duplex on lot 6 will not negatively impact the character of the neighborhood. VIII. A set of these minutes is retained both in the office of the City Clerk and in the Community Development Department of the City of Wheat Ridge. 3. PUBLIC FORUM No one indicated a desire to speak at this time. 4. PUBLIC HEARING A. Case No. WA-04-03: An application filed by Crawford Holding Corp. The case was presented by Jeff Hirt. He advised the Board there was jurisdiction to hear the case. He entered all pertinent documents into the record and reviewed the staff report and digital presentation. Staff recommended denial of the application for reasons outlined in the staff report. for the Estate of Rosemary and Pete Ricci for approval of a 206 square foot variance from the 9,000 square foot minimum lot area requirements to allow a two-family dwelling unit on property zoned Residential-Three and located at approximately 3821 Otis Street. Board of Adjustment 1 - 06/24/04 In response to a question from Chair BLAIR, Mr. Hirt explained that staff recommended denial in this case based on the conclusion that the application presented a self-imposed hardship. The lot could be utilized for a single-family dwelling without a variance. In response to a question from Board Member ABBOTT, Ms. Reckert explained that setbacks would remain the same for either a single or two-family dwelling. Board Member DRDA commented that a two-family dwelling would violate the Comprehensive Plan. Mr. Hirt replied that the application would represent ten dwelling units per acre and the Comprehensive Plan calls for four. Keith Gantenbein 8106 Drew Hill Rd., Golden Mr. Gantenbein, was sworn in by Chair BLAIR. Mr. Gantenbein plans to purchase and develop the subject property. He submitted a copy of the plans for the two-family dwelling proposed in the application for the Board's review. He stated the reasons for requesting the variance. First of all, the location of the lot is not suitable for a single-family dwelling. There is commercial and multi-family building in the immediate area. Secondly, the option of going through the subdivision plat process would not be feasible in terms of time and money. Board Member HOVLAND asked for clarification regarding the correct lot size. Ms. Reckert stated that the correct lot size is 8,794 square feet. Board Member BELL inquired about the circumstances involved to cause Otis Street to be curved in this location. Ms. Reckert stated that this was done some time during the 1940's or 1950's before the city was incorporated and it is not known what reasoning was used at that time. A survey was requested because of the skewed size of the lot. Board Member ECHELMEYER expressed concern that the applicant could build something other than what is shown in the plans submitted during the meeting. He referred to a previous Board of Adjustment case where the Board's recommendations were not followed. Mr. Gantenbein stated that, should the variance be approved, he would agree to a condition requiring the building to correspond to those plans submitted during the meeting. Board Member BELL stated that she could not find a hardship in this case because the lot is suitable for a single family dwelling and there are other avenues to pursue as far as building a two-family dwelling. Board of Adjustment - 2 - 06/24/04 In response to a question from Board Member ECHELMEYER, Ms. Reckert stated that the subject area is not in an urban renewal area. Ms. Reckert explained that a zone change would require a planned residential development to build on the property. Another option would be to adjust the lot line to enlarge the lot to allow the two-family dwelling without a variance. Board Member ABBOTT asked if irregularly shaped lots could be considered a hardship. Meredith Reckert stated that this usually applies to setback variance requests on irregularly shaped lots. Staff did not conclude that there was any problem in that regard for this application. Art Coltrin 10560 West 35th Avenue Mr. Coltrin was sworn in by Chair BLAIR. Mr. Coltrin is the present owner of the subject lot and the adjacent property to the north. He urged the Board to approve the variance. He did not believe the property is suitable for a single- family dwelling. Board Member BELL suggested that, since Mr. Coltrin owns both pieces of property, another option would be to adjust the lot line between the two lots, making the subject lot large enough for a two-family dwelling. In response to a question from Mr. Coltrin, Ms. Reckert stated that the lot line adjustment process would take approximately two months. Barbara Coltrin 10560 West 35th Avenue Mrs. Coltrin was sworn in by Chair BLAIR. She is the personal representative for the estate in which the subject property is involved. She asked the Board to approve the application. In response to a question from Board Member HOWARD, Mr. Hirt stated that no objections to the proposal have been received by the city. Upon a motion by Board Member BELL and seconded by Board Member MOLNAR the following resolution was stated: Whereas, the applicant was denied permission by an administrative officer; and Whereas, Board of Adjustment Application Case No. WA-04-03, is an appeal to this Board from the decision of an administrative officer; and Board of Adjustment - 3 - 06/24/04 Whereas, the property has been posted the fifteen days required by law, and in recognition that there were no protests registered against it; and Whereas, the relief applied for may be granted without detriment to the public welfare and without substantially impairing the intent and purpose of the regulations governing the City of Wheat Ridge. Now, therefore, be it resolved that Board of Adjustment Application Case No. WA-04-03 be, and hereby is, denied. Specifically, this letter addresses the required parking for this structure as it pertains to the request of Case No. MS-04-07, a request for approval of a 2-lot minor subdivision for Lot 6 and Lot 7 of the Anel subdivision. Case No. MS-04-07 will, if approved, result in a decrease of the square footage of Lot 7 of the Anel Subdivision from 7,194 square feet to 6,983 square feet. Lot 7 of the Anel Subdivision is currently used as parking for the multi-family residential structure at 3851 Otis Street, which according to the Jefferson County Assessor's office records contains 7 units. Of those 7 units, you informed me that 5 are 2 bedroom units, and 2 are 3 bedroom units. Per the Code of Laws Sec. 26-501 (F) the required parking for multi-family residential is 2 spaces per 2 or 3 bedroom unit, plus 1 additional space for each 10 spaces for visitor parking. The number of required parking spaces for 3851 Otis Street is therefore 15 spaces. It has been determined that the decrease in size of Lot 7 that will result from Case No. MS-04-07 (if approved) will not result in the creation of inadequate parking area as required per the Code of Laws for the multi-family residential structure at 3851 Otis Street. The structure appears to be on two parcels, having been built across and over the lot line that divides the two (see attached aerial). There are no building files, current or in the microfilm, for the construction of this building. The only permit for the property on file is for a dumpster enclosure that was issued on 12/13/02. Jefferson County Assessors records show 3851 Otis Street as "low-rise apartments", with 7 units, built in 1951. The property is shown as three lots, with a total of 14,090 square feet (see attached Jefferson County Assessors printout). Under the current density standards for R-3 zoned property, a minimum of 3,630 square feet is required per unit for multifamily buildings. Using this calculation, and applying it to the combined square footage per the Jefferson County Assessors records for both parcels in which the multi-family structure is on, the number of allowable units is 3.8, thus making the use clearly nonconforming as it is. This calculation cannot be made for each individual parcel of the two because it is unclear where the lot line falls within the footprint of the multifamily structure. A meeting with a representative for the property owners (real estate broker) took place on 9/13/04 in which concern was expressed by the broker regarding lot 7 and this requests' impact on the parking requirements for the above mentioned multi-family structure. The broker was encouraged to have the property owners pursue consolidating these two parcels in which the multi-family structure is on.
