Mr. Dezman requested that the Federal Emergency Management Agency (FEMA) revise-the effective FIRM to reflect the results of a hydraulic analysis incorporating more detailed topographic information along the reach of Lena Gulch between Parfet Street and Simms Street. All data required to complete our review of this request were submitted with Mr. Dezman's July 8 transmittal and with his letters dated February 10, April 8, and May 14, 1996. We have completed our review of the submitted data and the flood data shown on the effective FIRM, and have revised the FIRM to modify the location of the stream centerline and the elevations and floodplain boundary delineations of a flood having a 1-percent chance of being equaled or exceeded in any given year (base flood) along Lena Gulch from Parfet Street to Simms Street. The width of the Special Flood Hazard Area (SFHA), the area inundated by the base. flood, decreased along the revised reach. The maximum decrease in SFHA width, approximately 750 feet, occurred approximately 300 feet upstream of Parfet Street. The use of more detailed topographic data in the hydraulic analysis resulted in increases and decreases in the base flood elevations (BFEs) compared those computed using the HEC-2 hydraulic computer model developed in support of the effective FIRM. The maximum increase in BFE, 0.8 foot, occurred approximately 1,400 feet downstream of Simms Street. The maximum decrease in BFE, 0.5 foot, occurred approximately 1,100 feet upstream of Parfet Street. The revised FIRM also includes additional BFEs to better represent the revised base flood profile. I have met with the Planning and Engineering staffs of the City of Wheatridge on this issue and they are in agreement provided they receive written agreement on this issue from you. I have indicated on the attached sketch one possible new easement boundary. On another issue, please find also attached for your information an UD&-'FC letter dated 3-11-88 and my list of items of concern as pertaining to fixture channel construction, maintenance and access to property. In particular, the access item ( # 3 ) is as was verbally agreed to between my self and Mr. Rick Minitor, the City Engineer at the time. It appears that the City actually owns a 25 foot wide strip of land that is used for the access road to the wood channel. I believe this letter. grants me access to my property from this road for both sides of the flood channel. I would appreciate any recollections you have on this matter. The property is currently vacant and the owner is trying to market the , property for construction of a single family residence. The paved portion of Quail Street ends just north of Mr. Noble's property line. Mr. Noble believes there is an agreement with the city that he will be allowed informal driveway access from the end of the paving, using an existing accessway used by UDFCD for maintenance of Lena Gulch. There is a half-width dedication of right-of-way (25') from the property owner to the east upon which this accessway is located. The paperwork that was provided by Mr. Noble references this accessway but to my knowledge, there was never anything more concrete than a "gentlemen's agreement". I spoke with a former employee regarding his knowledge of the situation and he replied as follows. There was never any "formal" access agreement recorded in perpetuity. The only thing the city needed the existing right-of-way for was access to Lena Gulch for maintenance which is why the street was never improved to a full street section. The east half was for Ernestine Williams' access; which property is now encumbered with a conservation easement. That property could still have access from the improved portion of the street, however, it is unlikely it will ever develop. He agrees with our opinion that we require Noble to dedicate the 25' and that he or the future owner sign a development covenant that states we would split the cost of the improvements since there are only the two of us who will need access. That way if Quail Street is ever developed over the Gulch we have full width right-of-way to his south property line. In the interim, the owner should be responsible to create a surface treatment for reasonable access by emergency services. The gate may have to be relocated south since it locks. The gulch access surface was created within the existing 25' right-of-way is substantial in its strength and can sustain the weight of heavy equipment. This has been tested several times when the city accessed is to remove heavy debris to maintain our CRS status requirements. The structural design of the access orad is on the Lena gulch plans if you want to look at, as well as sharing the design with emergency services.
