Dear Mr. Kothanek:
This letter is to follow up on the special use permit that was issued for the above mentioned use on July 29,
2004. A site check on September 13, 2004 revealed the following deficiencies:
1. There is no striping of the parking spaces as shown on the site plan approved for the special use.
2. The parking of vehicles on the property on this date was not consistent with what was shown on the
site plan.
Please take the necessary steps to bring the property into compliance with these conditions of approval for
the special use permit. Please also note that on the conditions of approval it was specified that these
requirements must be met within two months of the date of approval. An inspection will be scheduled for
October 8, 2004 to verify that the property is in compliance.
Please be aware that the special use permit can be revoked if these conditions are not adhered to. Per the
Code of Laws Sec. 26-114 (F) all conditions and stipulations imposed shall be maintained during the entire
term of the special use. If at any time the stipulations or conditions are not adhered to or are found to have
been altered the Community Development Department can initiate revocation of the special use permit.

I informed Rich Kothanek of BSM Cars today that he did not have to construct a six foot view
obscuring fence on the portions of the property adjacent to residentially zoned property because he is
not currently using the rear portion of the lot as parking. I did inform him that he could not use this
portion of the lot for parking because it is not paved, as was discussed throughout the SUP process.
I informed him that if he were to use that portion of the lot for parking it would have to be paved,
and we would require notification and a permit for that, as well as the landscape buffer and fence
that was discussed and specified in the conditions of approval.

Dear Mr. Kothanek:
This letter is to inform you that your application for a special use permit for the above mentioned use has been approved as of
July 29, 2004 and is effective immediately. Please see the attached memo that specifies this. It is important to note the
conditions of approval outlined in this memo as they have to be adhered to in order for the special use permit to remain valid
The conditions outlined in this memo are as follows:
1. The use of the property is for auto sales.
2. The special use permit shall run in perpetuity with the applicant, Rich Kothanek, as long as he operates the business
at this location. In the event that the ownership of either property changes (11085 and 11091 W. 44`n Ave.), staff can
reconsider the special use approval.
3. The use of the property shall remain consistent with the site plan contained in the case file.
4. All relevant landscaping requirements of Section 26-502 of the Code of Laws shall be met for all proposed
improvements to the property. This includes a 10 foot landscape buffer along 44`h Avenue, as well as a 12 foot
landscape buffer for any future parking area which is adjacent to properties zoned residential. Within the 12 foot
landscape buffer for any future parking area, a 6 foot view obscuring fence shall be constructed. All landscaping
required for the proposed current improvements shall be installed within two months of approval of the special use
permit.
5. All vehicles stored on the property in excess of 72 hours for the purpose of being repaired must be screened from
view from adjacent streets and properties by a 6 foot solid fence.
6. All signage must in conformance with the relevant sign code requirements of Article VII of the Code of Laws.
7. Hours of operation shall be 9 a.m. to 7 p.m., Monday through Friday, and 9 a.m. to 6 p.m. on Saturday and Sunday.
8. Vehicle sales shall be limited to cars, trucks and motorcycles. No RV, boat, trailer or personal watercraft sales shall
occur.
9. Any additional paving on the property in the future cannot be completed without adhering to the Public Works
requirements outlined in the case file.
10. All lighting on the property shall not have any negative effect on adjacent properties and shall be in compliance with
Section 26-503 of the zoning and development code.

Case No. SUP-04-01 is an application by Rich Kothanek of BSMCARS requesting approval of an
administrative special use permit to allow a vehicle sales lot on C-1 (Commercial One) zoned property
at 11085 and a portion of 11091 W. 44`h Avenue.
Pursuant to Section 26-114 of the zoning and development code, the Community Development Director
has the ability to decide upon applications for administrative special use approval, without requirement
for a public hearing, provided that the following conditions are met:
1. A completed application package has been submitted and fee paid
2. The Community Development Department has notified adjacent property owners by letter notice
and the site plan has been posted for at least ten (10) days,
3. No written objections have been received in such ten-day period;
4. The Community Development Director concludes that the criteria for approval are substantially
complied with and support the request.
Pursuant to Section 26-114 of the Code of Laws the Community Development Director can impose
conditions or stipulations upon the approval, which may include physical design, operational, and
maintenance considerations to ensure compliance with the criteria for review.
The Community Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity; or
2. Whether the SUP is personal to the applicant and may or may not be inherited; and/or,
3. Whether the SUP is granted only for a defined period, after which time the special use shall expire
unless reviewed subject to all of the requirements of this section.
The applicant has submitted a site plan showing building layout, vehicle display parking, landscaping,
and proposed signage. The site plan also shows a proposed future paved lot in the rear of the property as
well as a proposed addition to the sales office building in the future. A portion of the adjacent property
(11091 W. 44`h Ave.) will be used for vehicle display parking. There is also a small garage on the
adjacent property (11091 W. 44`h Ave.) that will be used for light reconditioning and maintenance of
vehicles. All minimum commercial standards and development regulations of the Commercial-One
zone district appear to be met.
Findings of Fact:
1. A vehicle sales lot is a special use on C-1 (Commercial One) zoned property.
2. Adjacent property owners were notified by certified mail of the application.
3. No written objections were received.
4. The applicant, Rich Kothanek of BSMCars, has the ability to continuously meet the conditions of
the special use permit.
5. The proposed special use permit will not have a detrimental effect upon the general public
health, welfare, and safety.
6. The proposed special use will not result in traffic congestion nor overburden the capacities of the
existing streets and utilities.
This request for an administrative special use meets all applicable conditions as required by Section 26-
114 of the City of Wheat Ridge Code of Laws. Staff has not received written comments in opposition to
this request from the adjacent property owners.
Therefore, Case No. SUP-04-01 is hereby APPROVED with the following conditions:
1. The use of the property is for auto sales.

Adjustable cast iron box a. ith lid was also placed for future access. _
WHERE U; at number 377 I found a '/t1" outsim diameter pipe (17" in
length), and a 3/4" diamet :r steel pin (3U" in length) approximately 0.7'
oelow 713" diameter pipe.
WHEREAS; the direction and distance from the 7/8" diameter pipe to Ere 3/4"
diameter is west, 0.25 feet.
WHEREAS; it is my belief that the 3711"-dlamet?rSte-ei-7i-rt-{-3U'-i-m- length) -
is the monument which best represents the corner as believed to have been
established by H.W. Gardner, County Surveyor, prior to 1930.
WHEREAS; at the location of found 3/4" diameter pin I placed (won umented) a

Existing Use /site conditions: Property was previously used for auto sales. The site is currently
vacant. There is an existing vacant building of roughly 530 square feet on the property that was
used as the office for the previous auto sales use.
Applicant's Proposal: The applicant proposes to use the property located at 11085 W. 44' Ave.
for used auto sales. The existing structure on this property is to be used as an office for the
proposed use. The existing paved parking area on 44 Ave. for this property is to be used for
customer parking and display of vehicles. The applicant proposes using the small garage located on
the adjacent property (11091 W. 44 Ave.) for light reconditioning and minor maintenance of
motor vehicles. A two phase plan is proposed, first with the aforementioned uses and eventually an
addition to the office and a paved area for customer parking and vehicle display to the north of the
office structure. Auto sales require a special use permit in the C -1 zone district.
Issues Discussed:
• What the request is and why we are here; car lot requires a special use permit for properties
zoned C -1.
• Test driving of the vehicles will follow a specified route. Cars will go from 44 Avenue
west to Ward, to I -70 east to Kipling. Test driving will be done with a representative from
the office.
• Hours of operation? 9 a.m. to 6 p.m. on average Monday through Friday (possibly until 7
p.m.), Saturdays 9 a.m. to 2 p.m. Also by appointment.
• What is the status of the lease on the property (for 11091 W. 44 Ave), and what type of
relationship exists with the current owner? There currently is a three year lease. A copy of
the lease will be submitted with the application. The owner of 11091 W. 44 Ave. is the
same owner of 10805 W. 44 Ave.
• Buffering will be required on the rear of the property (6 foot solid fence).
• Code action discussed on 11091 W. 44 Avenue (dumpster screening). Code action also
discussed for pawn shop to the east of proposed special use (unclear of specific address).
• What type of lighting will be used? All lighting will be downcast.
• Attendants expressed interest in viewing sketches of proposed changes to the existing
structure and the property. The applicant informed those interested that he would mail a
copy of the illustrations to them.
• Why such a use along 44 Avenue and not somewhere like the Colfax corridor in
Lakewood? The applicant expressed that he likes the atmosphere and character of the
location of the proposed special use better than such locations as Colfax in Lakewood.
Attendants expressed concern about such uses becoming common along this corridor. Staff
responding in saying that such uses would not be allowed with frequency along this
corridor.
Any signage? Maximum allowed area would allow for an approximately 5` X 7'. Most
likely a monument type sign
How will the cars for sale get there? It depends, some will be driven there, some will arrive
on a trailer.

A Staff Planner will attend the meeting to discuss City policies and regulations and the process involved, how-
ever, the Planner will remain impartial regarding viability of the project
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as testimo-
ny, it is the public hearings in front of the Planning Commission and the City Council where decisions are ren-
dered. If you want input in the decision- making process, it is imperative that you attend the public hearings.

Applicant/Owner Preliminary Proposal:
The applicant proposes to use the property located at 11085 W. 44 Ave. for used auto
sales. The existing structure on this property is to be used as an office for the proposed
use. The existing paved parking area on 44 Ave. for this property is to be used for
customer parking and display of vehicles. The applicant proposes using the small garage
located on the adjacent property (11091 W. 44 Ave.) for light reconditioning and minor
maintenance of motor vehicles. A two phase plan is proposed, first with the
aforementioned uses and eventually an addition to the office and a paved area for
customer parking and vehicle display to the north of the office structure. Auto sales
require a special use permit in the C -1 zone district.
Will a neighborhood meeting need to be held prior to application submittal? YES
Planning comments:
As this a proposed multi -phase plan, all changes proposed should be included in the
application and submittal. This includes the future addition to the existing office structure
and paving for parking to the north of the office structure. Any changes to the property in
the future that were not outlined in this application and submittal will require another
special use permit.
A 10 foot landscape buffer will be required along 44 Avenue, and a 12 foot landscape
buffer will be required for any parking lot or display lot adjoining the properties zoned
Residential -Two (R -2) and Planned Residential Development (PRD) to the north. Per the
Code of Laws Sec. 26 -628 (E) there shall be a minimum 10 foot landscape buffer
adjacent to any public street for motor vehicle sales, rental and storage lots. Also, per the
Code of Laws Sec. 26 -628 (F) whenever a parking lot or display lot adjoins property
zoned for residential use, a landscape buffer of 12 feet from the lot boundary shall be
required. Within the 12 foot landscape buffer, a 6 foot view obscuring fence or
decorative wall shall be constructed.
The property for the proposed special use (11085 W. 44 Avenue) will need to be in
conformance with the City of Wheat Ridge landscaping requirements for nonresidential
uses. Per the Code of Laws Sec. 26 -502 (D) one street tree for every 30 feet of street
frontage is required, and landscaping shall not be less than 20 percent of the gross lot
area for nonresidential uses.
As the applicant has proposed using the existing garage on the adjacent property (11091
w. 44 Avenue) for light reconditioning and minor maintenance of motor vehicles, the
property will be subject to the restrictions for the use of nonresidential parking areas. Per
the Code of Laws Sec. 26 -501 (D)(18), for automotive repair facilities, vehicles stored on
the property in excess of 72 hours for the purpose of being repaired must be screened
from view from adjacent streets and properties by a 6 foot high solid fence.
Please be aware that any proposed signage for the property will be subject to our sign
code. It is recommended by staff that a monument -style sign be erected.
Please submit a copy of the lease with the adjacent property (11091 W. 44 Avenue) for
which the garage to be used is located. A copy of this lease will be necessary for the
approval of the special use permit.
Because a special use permit will be required to allow auto sales in a C -1 zone district, a
neighborhood meeting must be held. The required neighborhood meeting has been
scheduled for Wednesday, June 2 at 7:00 p.m. Once the neighborhood meeting is held,
a formal application for a special use permit may be submitted. Upon receipt of the
application the proposal will be referred to the necessary outside agencies for review and
comment.
After the review process is complete, the Community Development Department shall
notify adjacent property owners by certified letter and posting of the site for 10 days. If no
written objections directly related to the special use request are received within this 10-
day period, the Community Development Director can approve, approve with conditions
or deny the special use. Upon receipt of any written objections by an adjacent property
owner or upon appeal by an applicant of a decision by the Community Development
Director, the special use request will be heard by the City Council through a public
hearing process. If approved, either by the Community Development Director or by the
City Council at a public hearing, the special use becomes effective immediately.

1. If the site is to be paved, a Final Drainage Report and Plan (signed and sealed by a Professional
Engineer) shall be required. On -site detention is required for all commercial developments.
(Please see attached Site Drainage Requirements).
2. If the site is to be paved, a Grading & Erosion Control Plan (signed and sealed by a Professional
Engineer), including details for all BMP's to be utilized both during and subsequent to
construction. Include type of landscaping e.g., sod, or seeding type and rate of application for any
native seeding to be utilized in detention area(s).
3. If applicable, Construction Plans (signed and sealed by a Professional Engineer) for any proposed
changes/additions to the public improvements along the 44" Avenue frontage. Include any
COWR standard details for all proposed constructed items (e.g., driveway, sidewalk, etc.).
4. A professionally prepared Site Plan. The Site Plan shall include the following:
a. 24" X 36" sheet format.
b. A Vicinity Map.
c. The boundary of the site and existing and proposed lot lines are to be completely
described using bearings and distances.
d. A Legal Description of the site, including tie(s) to the Section.
e. A Basis of Bearing statement (using local City coordinate system -see Note 2 below).
f. Date of map preparation, and the name, address, and firm of who prepared the map.
g. A scale and north arrow.
h. Signed Certification from a Professional Land Surveyor licensed in the State of Colorado
(certifying the site boundary, easement, and topographic information is accurately shown
on the Plan).
i. Location of 100 -year floodplain, if applicable.
j. Existing and proposed contours at 2 -ft intervals.
k. Adjacent street(s), including Right -of -Way width(s), name(s), ROW centerline(s).
1. Location of all existing & proposed easements and rights -of -way, fences, walls,
drainageways, ditches, buildings to be developed or retained on site.
