Maryland Drive Lakewood, CO 80232 RE: Special Use Permit for Vehicle Sales Lot at 11085 and a Portion of 11091 W. 44" Ave. Dear Mr. Kothanek: This letter is to follow up on the special use permit that was issued for the above mentioned use on July 29, 2004. A site check on September 13, 2004 revealed the following deficiencies: 1. There is no striping of the parking spaces as shown on the site plan approved for the special use. 2. The parking of vehicles on the property on this date was not consistent with what was shown on the site plan. Please take the necessary steps to bring the property into compliance with these conditions of approval for the special use permit. Please also note that on the conditions of approval it was specified that these requirements must be met within two months of the date of approval. An inspection will be scheduled for October 8, 2004 to verify that the property is in compliance. Please be aware that the special use permit can be revoked if these conditions are not adhered to. Per the Code of Laws Sec. 26-114 (F) all conditions and stipulations imposed shall be maintained during the entire term of the special use. If at any time the stipulations or conditions are not adhered to or are found to have been altered the Community Development Department can initiate revocation of the special use permit. I did inform him that he could not use this portion of the lot for parking because it is not paved, as was discussed throughout the SUP process. Please see the attached memo that specifies this. It is important to note the conditions of approval outlined in this memo as they have to be adhered to in order for the special use permit to remain valid The conditions outlined in this memo are as follows: 1. The use of the property is for auto sales. 2. The special use permit shall run in perpetuity with the applicant, Rich Kothanek, as long as he operates the business at this location. In the event that the ownership of either property changes (11085 and 11091 W. 44`n Ave.), staff can reconsider the special use approval. 3. The use of the property shall remain consistent with the site plan contained in the case file. 4. All relevant landscaping requirements of Section 26-502 of the Code of Laws shall be met for all proposed improvements to the property. This includes a 10 foot landscape buffer along 44`h Avenue, as well as a 12 foot landscape buffer for any future parking area which is adjacent to properties zoned residential. Within the 12 foot landscape buffer for any future parking area, a 6 foot view obscuring fence shall be constructed. All landscaping required for the proposed current improvements shall be installed within two months of approval of the special use permit. 5. All vehicles stored on the property in excess of 72 hours for the purpose of being repaired must be screened from view from adjacent streets and properties by a 6 foot solid fence. 6. All signage must in conformance with the relevant sign code requirements of Article VII of the Code of Laws. 7. Hours of operation shall be 9 a.m. to 7 p.m., Monday through Friday, and 9 a.m. to 6 p.m. on Saturday and Sunday. 8. Vehicle sales shall be limited to cars, trucks and motorcycles. No RV, boat, trailer or personal watercraft sales shall occur. 9. Any additional paving on the property in the future cannot be completed without adhering to the Public Works requirements outlined in the case file. 10. All lighting on the property shall not have any negative effect on adjacent properties and shall be in compliance with Section 26-503 of the zoning and development code. Pursuant to Section 26-114 of the zoning and development code, the Community Development Director has the ability to decide upon applications for administrative special use approval, without requirement for a public hearing, provided that the following conditions are met: 1. A completed application package has been submitted and fee paid 2. The Community Development Department has notified adjacent property owners by letter notice and the site plan has been posted for at least ten (10) days, 3. No written objections have been received in such ten-day period; 4. The Community Development Director concludes that the criteria for approval are substantially complied with and support the request. Pursuant to Section 26-114 of the Code of Laws the Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; or 2. Whether the SUP is personal to the applicant and may or may not be inherited; and/or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless reviewed subject to all of the requirements of this section. The applicant has submitted a site plan showing building layout, vehicle display parking, landscaping, and proposed signage. The site plan also shows a proposed future paved lot in the rear of the property as well as a proposed addition to the sales office building in the future. A portion of the adjacent property (11091 W. 44`h Ave.) will be used for vehicle display parking. There is also a small garage on the adjacent property (11091 W. 44`h Ave.) that will be used for light reconditioning and maintenance of vehicles. All minimum commercial standards and development regulations of the Commercial-One zone district appear to be met. Findings of Fact: 1. A vehicle sales lot is a special use on C-1 (Commercial One) zoned property. 2. Adjacent property owners were notified by certified mail of the application. 3. No written objections were received. 4. The applicant, Rich Kothanek of BSMCars, has the ability to continuously meet the conditions of the special use permit. 5. The proposed special use permit will not have a detrimental effect upon the general public health, welfare, and safety. 6. The proposed special use will not result in traffic congestion nor overburden the capacities of the existing streets and utilities. This request for an administrative special use meets all applicable conditions as required by Section 26- 114 of the City of Wheat Ridge Code of Laws. Staff has not received written comments in opposition to this request from the adjacent property owners. Therefore, Case No. SUP-04-01 is hereby APPROVED with the following conditions: 1. The existing structure on this property is to be used as an office for the proposed use. The existing paved parking area on 44 Ave. for this property is to be used for customer parking and display of vehicles. The applicant proposes using the small garage located on the adjacent property (11091 W. 44 Ave.) for light reconditioning and minor maintenance of motor vehicles. A two phase plan is proposed, first with the aforementioned uses and eventually an addition to the office and a paved area for customer parking and vehicle display to the north of the office structure. Issues Discussed: • What the request is and why we are here; car lot requires a special use permit for properties zoned C -1. • Test driving of the vehicles will follow a specified route. Cars will go from 44 Avenue west to Ward, to I -70 east to Kipling. Test driving will be done with a representative from the office. • Hours of operation? 9 a.m. to 6 p.m. on average Monday through Friday (possibly until 7 p.m.), Saturdays 9 a.m. to 2 p.m. Also by appointment. • What is the status of the lease on the property (for 11091 W. 44 Ave), and what type of relationship exists with the current owner? There currently is a three year lease. A copy of the lease will be submitted with the application. The owner of 11091 W. 44 Ave. is the same owner of 10805 W. 44 Ave. • Buffering will be required on the rear of the property (6 foot solid fence). • Code action discussed on 11091 W. 44 Avenue (dumpster screening). Code action also discussed for pawn shop to the east of proposed special use (unclear of specific address). • What type of lighting will be used? All lighting will be downcast. • Attendants expressed interest in viewing sketches of proposed changes to the existing structure and the property. The applicant informed those interested that he would mail a copy of the illustrations to them. • Why such a use along 44 Avenue and not somewhere like the Colfax corridor in Lakewood? The applicant expressed that he likes the atmosphere and character of the location of the proposed special use better than such locations as Colfax in Lakewood. A 10 foot landscape buffer will be required along 44 Avenue, and a 12 foot landscape buffer will be required for any parking lot or display lot adjoining the properties zoned Residential -Two (R -2) and Planned Residential Development (PRD) to the north. Per the Code of Laws Sec. 26 -628 (E) there shall be a minimum 10 foot landscape buffer adjacent to any public street for motor vehicle sales, rental and storage lots. Also, per the Code of Laws Sec. 26 -628 (F) whenever a parking lot or display lot adjoins property zoned for residential use, a landscape buffer of 12 feet from the lot boundary shall be required. Within the 12 foot landscape buffer, a 6 foot view obscuring fence or decorative wall shall be constructed. The property for the proposed special use (11085 W. 44 Avenue) will need to be in conformance with the City of Wheat Ridge landscaping requirements for nonresidential uses. Per the Code of Laws Sec. 26 -502 (D) one street tree for every 30 feet of street frontage is required, and landscaping shall not be less than 20 percent of the gross lot area for nonresidential uses. As the applicant has proposed using the existing garage on the adjacent property (11091 w. 44 Avenue) for light reconditioning and minor maintenance of motor vehicles, the property will be subject to the restrictions for the use of nonresidential parking areas. Per the Code of Laws Sec. 26 -501 (D)(18), for automotive repair facilities, vehicles stored on the property in excess of 72 hours for the purpose of being repaired must be screened from view from adjacent streets and properties by a 6 foot high solid fence. Please be aware that any proposed signage for the property will be subject to our sign code. It is recommended by staff that a monument -style sign be erected.
