Case No. SUP-04-02 is an application by Lloyd Kiper requesting approval of an administrative
special use permit to allow automobile sales without an outside display area on Commercial-One
property located at 4601 Harlan Street.
Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide
upon applications for administrative special use approval, without requirement for a public hearing,
provided the following conditions are met:
1. A completed application package has been submitted and fee paid.
2. The Community Development Department has notified adjacent property owners by letter
notice and the site has been posted for at least ten (10) days.
3. No written objections have been received in such ten-day period.
4. The Community Development Director concludes that the criteria for approval, as set forth
below, are substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval,
which may include physical design, operational, and maintenance considerations to ensure
compliance with the criteria for review.
The Community Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity; or,
2. Whether the SUP is personal to the applicant and mayor may not be inherited; and/or,
3. Whether the SUP is granted only for a defined period, after which time the special use shall
expire unless renewed subject to all of the requirements of this section.
The applicant has submitted a site plan, which shows the location of the building, parking stalls for
customers and display areas for vehicles. With the exception of clarifying parking and display
areas, no physical changes are proposed for the property. This application includes a request for a
second special use permit to allow an automotive sales lot that is located within 1,500 feet of
another similar sales lot. Pursuant to section 26-628 of the Code of Laws, a 1,500 linear foot
separation must occur between automotive sales lots.
FINDINGS OF FACT:
1. The property has been historically used for auto sales and automotive related uses. As
recently as six months ago, a motorcycle sales shop was located on this property.
2. Automotive sales lots with outdoor display areas, as defined in Section 26-123 of the Wheat
Ridge Code of Laws, is a special use in the C-1 zone district.
3. Adjacent property owners were notified by certified mail of the application, and no written
objections were received.
4. The applicant, Lloyd Kiper, has the ability to continuously meet the conditions of the special
use permit.
5. The proposed special use will not have a detrimental effect upon the general public health,
welfare, and safety.
6. The proposed special use will not result in traffic congestion nor overburden the capacities
of the existing streets and utilities.
7. The proposed special use will not adversely affect the light and air to adjacent properties as
no physical changes are proposed to the structure or the property.
This request for an administrative special use meets all applicable conditions as required by Section
26-114 of the City of Wheat Ridge Code of Laws. Staff has not received written comments in
opposition to this request from the adjacent property owners.
Therefore, Case No. SUP-04-02 is hereby APPROVED with the following conditions:
1. The special use shall be a grant of use to applicant, Lloyd Kiper, and shall expire upon sale
or transfer of the property to another owner.
2. The use of 4601 Harlan Street shall remain consistent with the site plan contained in the
case file.
3. There shall be a maximum number of seventeen (17) automobiles located onsite.
4. Loud speakers or external paging systems shall not be utilized.
5. There shall not be any type of vehicle repair beyond normal maintenance and washing of
display vehicles.

I am writing regarding the Special Use Permit request, Case SUP 04-02. for 4601 Harlan
Street, in the city limits of Wheat Ridge.
I attended your meeting on June 23`d, 2004. At that time you requested written feedback
once the address posted the notice of intent to do business. You indicated that concerns
to ensure community "quality of life" would be given consideration for inclusion in the
contract with the city.
As there have been several businesses at that location, the following items are of concern
related to the proposed use permit, they are:
The Use Permit would be limited to Kiper sales and not to the building itself. In
the event that Kiper sales departs from the site, the permit would revert to the
original definition of usage for the property.
That Mr. Kiper do business as he stated at the meeting, for example: limiting the
number of auto's to approximately 20 cars on the lot; no automotive repairs be
performed on the property and no salvage cars to be sold.
Mr. Kiper appears to be a considerate individual and I do appreciate his efforts to
communicate with the neighborhood. In addition, I also appreciate his expression of
concern to enhance not degrade the community.

This letter is in response to your request for confirmation of the availability of sanitary sewer
service for the above parcel. By supplying this information, the Wheat Ridge Sanitation District
is not liable for the misidentification or misrepresentation of the subject lot. The location of the
subject lot is based solely on the description provided by the requestor, and the Wheat Ridge
Sanitation District is not responsible for the way in which this information is used or
disseminated.
The subject lot at the address referenced above is entirely within the boundary and service area
of the Wheat Ridge Sanitation District. Treatment of sewage generated within;the Wheat Ridge
Sanitation District is provided by the Metro Wastewater Reclamation District (Metro). Wheat
Ridge; Sanitation District facilities in this area consist of an 8 inch sanitary sewer main within
Harlan Street east of the subject property. An 8 inch sanitary sewer main also lies at the
intersection of W. 46th Avenue and Ingalls Street west of the property.
This parcel is subject to the assessment of both Wheat Ridge Sanitation District and Metro tap
charges. The subdividers and/or developers may be required to extend sewer lines to their
project sites and/or share in the cost of providing additional capacity to serve their projects.
In addition, you should be aware that the District requires approval of plans for sewer main
construction, sewer service connections, determination and payment of tap fees, as well as
inspection of construction by the District's Engineer.

The following requirements are made under the 1997 Uniform Fire Code
adopted by the City Council of the City of Wheat Ridge, Colorado.
i. Gas meter shall be protected with bollards when exposed to vehicle
traffic.
2. All changes to the existing building shall require the proper building
permits from the City of Wheat Ridge as well as The Fire District.
3. A Fire extinguisher with a minimum rating of 2 A 40BC shall be
placed within 75 foot travel distance with in the store.
4. Storage of all chemicals shall have all MSDS, in addition shall have
containment areas for all vehicle fluids to be stored in an approved
Flammable Cabinet.
5. All changes in wiring and lighting shall comply with the N.E.C
(National Electrical Code) and the City of Wheat Ridge Building
Department.

have a one hour fire rating on all walls five feet or less from the property

Issues discussed: There were two attendees and one applicant at this meeting. The attendees
were not at the previous meeting held 23 June 2004. This meeting was
held because of an error in the software that details the notification radius.
An attendee asked if the applicant would sell used cars, and if any auto
repair would occur in conjunction with auto sales. Another question was
asked regarding a mature tree in the median of Harlan Street, and if the
City was going to remove said tree. A final inquiry was raised about the
existing freestanding sign, and if it was to be utilized.

NOTICE OF NEIGHBORHOOD INPUT MEETING

THE DATE AND TIME OF THE MEETING is Thursday, July 1, 2004 at 6 p.m.
THE LOCATION OF THIS MEETING IS 7500 West 29 h Avenue (City Hall), second floor
conference room
THE PURPOSE FOR THIS PROPOSAL IS to discuss issues and the impact of an auto dealer in
this location, as it relates to the surrounding neighborhood. Any auto dealership in the
Commercial One zone district requires approval of a special use permit.
The City of Wheat Ridge has adopted a requirement that prior to any application for Special Use
Permits an applicant must notify all residents and property owners within 600 feet and invite
them to a Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to
present his proposal to the neighborhood and to give the neighborhood a forum to express their
concerns, issues and desires.
A Staff Planner will attend the meeting to discuss City policies and regulations and the process
involved, however, the Planner will remain impartial regarding viability of the project.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be
entered as testimony, it is the public hearings in front of the Planning Commission and City
Council where decisions are rendered. If you want input in the decision-making process, it is
imperative that you attend the public hearings.
The kinds of concerns residents normally have include the following:
• Is the proposal compatible with surrounding land uses and zoning?
• Are there adequate utilities and services in place or proposed to serve the project?
• What is the impact on our streets?
• How will this proposal affect my property?
• Where will the storm drainage go?
• How will the project be designed to enhance rather than detract from the neighborhood?
• What specific changes can be made in the proposal to make it more acceptable to me?

Dear Property owner/tenant:
You may have received a letter regarding a neighborhood meeting that was to be held on Thursday,
June 23. This meeting was regarding the potential for location of an auto dealership at 4601 Harlan
Street. The Wheat Ridge Code of Laws specifies that all property owners and tenants within a 600-
foot radius of the subject property must be notified of a neighborhood meeting. At the meeting, it
was clear that several attendants did not receive proper notice of the neighborhood meeting.
It was later learned that the neighborhood list supplied to the applicant, Mr. Lloyd Kiper, was
faulty. Many of the adjacent neighbors did not receive proper notice of the neighborhood meeting. I
would like to stress that the error in noticing was not made by Mr. Kiper, rather an oversight by
City staff. Due to this error, staff has scheduled another neighborhood meeting to give all neighbors
and tenants the opportunity to discuss the proposal. Attached is a notice for neighborhood meeting
for Thursday, July 1.

Issues discussed: There were several attendees and two applicants at this meeting. There
were some questions regarding ownership of the property, and the volatile
nature of the property. Several attendees commented that this property has
changed ownership and use many times. They felt a more stable business
would benefit the neighborhood. There were questions about the type,
number and location of the autos to be sold on the property.
There were a few questions regarding the exterior of the building, and if
anything would be done to improve the property. A question was asked
regarding the construction of additional buildings. An attendee remarked
that this dealership was in close proximity to another dealership, and
thought that a distance of 1,500 feet had to separate dealerships. There
were several concerns regarding the parking situation in the neighborhood,
specifically in regard to the property directly across 46th Ave. The neighbor
directly to the west of the subject property did not want any patrons to park
on his lot.
Several attendees commented that they did not receive the notice of
neighborhood meeting, despite the fact that they lived within 100 feet of
the property.

My name is Lloyd Kiper and I am proposing to the City of Wheat
Ridge and to you, to open a small business located at 4601 Harlan st. The
type of business is a used car lot that would accommidate approximately 20
vehicles pricing in the $2000 to $10,000 range. I want to keep the operation
small for the ease of operation. The operating hours are will be for the most
part will be between 9:00 am to 7:00 pm Monday thru Saturday. To ease
any apprehension that you may have as a neighbor I want you to know that
my intentions for this property are to have a clean operation that is
conducive to the neighborhood. I know that each of you have concerns about
your property values and it is my concern also that I do nothing to diminish
your property at all.

THE PURPOSE FOR THIS PROPOSAL IS to discuss issues and the impact of an auto dealer in
this location, as it relates to the surrounding neighborhood. Any auto dealership in the
Commercial One zone district requires approval of a special use permit.
The City of Wheat Ridge has adopted a requirement that prior to any application for Special Use
Permits an applicant must notify all residents and property owners within 600 feet and invite
them to a Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to
present his proposal to the neighborhood and to give the neighborhood a forum to express their
concerns, issues and desires.
A Staff Planner will attend the meeting to discuss City policies and regulations and the process
involved, however, the Planner will remain impartial regarding viability of the project.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be
entered as testimony, it is the public hearings in front of the Planning Commission and City
Council where decisions are rendered. If you want input in the decision-making process, it is
imperative that you attend the public hearings.
The kinds of concerns residents normally have include the following:
• Is the proposal compatible with surrounding land uses and zoning?
• Are there adequate utilities and services in place or proposed to serve the project?
• What is the impact on our streets?
• How will this proposal affect my property?
• Where will the storm drainage go?
• How will the project be designed to enhance rather than detract from the neighborhood?
• What specific changes can be made in the proposal to make it more acceptable to me?

S & O Development, LLC is proposing a Kwik Car Express Tunnel car wash on Property
located on the South East comer of 45a' and Wadsworth. The date and time of the
meeting is June 29, 2004 at 6:00 p.m. The location of this meeting is the 2nd floor City of
Wheat Ridge. The purpose for this proposal is understand any concerns in the
construction of an express tunnel car wash for the community.
The City of Wheat Ridge has adopted a requirement that prior to any application for
Special Use Permits an applicant must notify all residents and property owners within
600 feet and invite them to a neighborhood Input Meeting. The purpose of this meeting
is to allow the applicant to present his proposal to the neighborhood and to give the
neighborhood a forum to express °uieir concerns, issues and desires.
A staff Planner will attend the meeting to discuss City policies and regulations and the
process involved, however, the Planner will remain impartial regarding viability of the
project.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be

those areas where inventory is adjacent to the right-of-way. This buffer is required to be
completely within the property boundaries, although there can be additional landscaping in
the area between the front property line and the street improvements if approved by the
public works director.
Any signage for the proposed use on the property in question shall be in conformance with
the sign code. If it is determined that existing signage on the property is nonconforming,
any replacement or reconstruction of the existing signage will not be permitted unless such
sign is brought into conformance with the sign code.
Landscaping shall consist of at least 20 percent of the lot area. Within the minimum
required setback, one street tree for every 30 feet of street frontage is required.
A site plan "to scale" shall be submitted with the application. The site plan should illustrate,
at minimum, existing and proposed structures, existing and proposed signage, and the
location of striping for customer, employee and display parking all in relation to the property
lines. In addition, the site plan should illustrate the aforementioned lan scape
requirements. A data table should be included that details the amount of landscaping,
along with the size of the building and the square footage of the paved area.
once a pre-application meeting has been held, the applicant can work with staff to
schedule the required neighborhood meeting. The Community Development Department
will initiate the 600' radius property owner search for the neighborhood meeting notice.
There is a $100 fee for the neighborhood meeting that needs to be received on or before
the date of the meeting. After the neighborhood meeting is held, a formal application for a
special use permit may be submitted. Upon receipt of the application the proposal will be
referred to the necessary outside agencies for review and comment for a period of 15 days.
After the review process is complete, the Community Development Department shall notify
adjacent property owners by certified letter and posting of the site for 10 days. If no written
objections directly related to the special use request are received within this 10-day period,
the Community Development Director can approve, approve with conditions or deny the
special use. Upon receipt of any, written objections by an adjacent property owner or upon
appeal by an applicant of a decision by the Community Development Director, the special
use request will be scheduled for public hearing in front of City Council. If approved, either
by the Community Development Director or by the City Council at a public hearing, the
special use will become effective immediately.

To the City of WheatRidge Community Development Department
This is a request for a special use permit for the property located
at 4601 Harlan St. Currently the property is a motorcycle repair shop
but will be vacant soon. In the past this property has been used for a
auto repair shop, auto glass shop and car wash.
What I would like to do with your permisson is to convert the current
useof the property to accommodate the selling of approximately 20 to 25
motor vehicles,such as SUV's,automobiles,pick-up's,motorcycles,etc.
The property currently has all of the requirements needed by the
Dept of Motor Vehicle and I believe all the requirements needed by the city
The only other requirement to fit within city zoning is a variance
in the 1500ft rule between similar businesses.
