Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide upon applications for administrative special use approval, without requirement for a public hearing, provided the following conditions are met: 1. A completed application package has been submitted and fee paid. 2. The Community Development Department has notified adjacent property owners by letter notice and the site has been posted for at least ten (10) days. 3. No written objections have been received in such ten-day period. 4. The Community Development Director concludes that the criteria for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; or, 2. Whether the SUP is personal to the applicant and mayor may not be inherited; and/or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section. The applicant has submitted a site plan, which shows the location of the building, parking stalls for customers and display areas for vehicles. With the exception of clarifying parking and display areas, no physical changes are proposed for the property. This application includes a request for a second special use permit to allow an automotive sales lot that is located within 1,500 feet of another similar sales lot. Pursuant to section 26-628 of the Code of Laws, a 1,500 linear foot separation must occur between automotive sales lots. FINDINGS OF FACT: 1. The property has been historically used for auto sales and automotive related uses. As recently as six months ago, a motorcycle sales shop was located on this property. 2. Automotive sales lots with outdoor display areas, as defined in Section 26-123 of the Wheat Ridge Code of Laws, is a special use in the C-1 zone district. 3. Adjacent property owners were notified by certified mail of the application, and no written objections were received. 4. The applicant, Lloyd Kiper, has the ability to continuously meet the conditions of the special use permit. 5. The proposed special use will not have a detrimental effect upon the general public health, welfare, and safety. 6. The proposed special use will not result in traffic congestion nor overburden the capacities of the existing streets and utilities. 7. The proposed special use will not adversely affect the light and air to adjacent properties as no physical changes are proposed to the structure or the property. This request for an administrative special use meets all applicable conditions as required by Section 26-114 of the City of Wheat Ridge Code of Laws. Staff has not received written comments in opposition to this request from the adjacent property owners. Therefore, Case No. SUP-04-02 is hereby APPROVED with the following conditions: 1. The special use shall be a grant of use to applicant, Lloyd Kiper, and shall expire upon sale or transfer of the property to another owner. 2. The use of 4601 Harlan Street shall remain consistent with the site plan contained in the case file. 3. There shall be a maximum number of seventeen (17) automobiles located onsite. 4. Loud speakers or external paging systems shall not be utilized. 5. There shall not be any type of vehicle repair beyond normal maintenance and washing of display vehicles. I attended your meeting on June 23`d, 2004. At that time you requested written feedback once the address posted the notice of intent to do business. You indicated that concerns to ensure community "quality of life" would be given consideration for inclusion in the contract with the city. As there have been several businesses at that location, the following items are of concern related to the proposed use permit, they are: The Use Permit would be limited to Kiper sales and not to the building itself. In the event that Kiper sales departs from the site, the permit would revert to the original definition of usage for the property. That Mr. Kiper do business as he stated at the meeting, for example: limiting the number of auto's to approximately 20 cars on the lot; no automotive repairs be performed on the property and no salvage cars to be sold. Mr. Kiper appears to be a considerate individual and I do appreciate his efforts to communicate with the neighborhood. Any auto dealership in the Commercial One zone district requires approval of a special use permit. The City of Wheat Ridge has adopted a requirement that prior to any application for Special Use Permits an applicant must notify all residents and property owners within 600 feet and invite them to a Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to present his proposal to the neighborhood and to give the neighborhood a forum to express their concerns, issues and desires. A Staff Planner will attend the meeting to discuss City policies and regulations and the process involved, however, the Planner will remain impartial regarding viability of the project. Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as testimony, it is the public hearings in front of the Planning Commission and City Council where decisions are rendered. A 10 foot landscape buffer will be required along Harlan Street and along 46th Avenue for those areas where inventory is adjacent to the right-of-way. This buffer is required to be completely within the property boundaries, although there can be additional landscaping in the area between the front property line and the street improvements if approved by the public works director. Any signage for the proposed use on the property in question shall be in conformance with the sign code. If it is determined that existing signage on the property is nonconforming, any replacement or reconstruction of the existing signage will not be permitted unless such sign is brought into conformance with the sign code. Landscaping shall consist of at least 20 percent of the lot area. Within the minimum required setback, one street tree for every 30 feet of street frontage is required. A site plan "to scale" shall be submitted with the application. The site plan should illustrate, at minimum, existing and proposed structures, existing and proposed signage, and the location of striping for customer, employee and display parking all in relation to the property lines. In addition, the site plan should illustrate the aforementioned lan scape requirements. The Community Development Department will initiate the 600' radius property owner search for the neighborhood meeting notice. There is a $100 fee for the neighborhood meeting that needs to be received on or before the date of the meeting. After the neighborhood meeting is held, a formal application for a special use permit may be submitted. Upon receipt of the application the proposal will be referred to the necessary outside agencies for review and comment for a period of 15 days. After the review process is complete, the Community Development Department shall notify adjacent property owners by certified letter and posting of the site for 10 days. If no written objections directly related to the special use request are received within this 10-day period, the Community Development Director can approve, approve with conditions or deny the special use. Upon receipt of any, written objections by an adjacent property owner or upon appeal by an applicant of a decision by the Community Development Director, the special use request will be scheduled for public hearing in front of City Council.
