I-70 Frontage Road South/SUP-04-06 Case No. SUP-04-06 is an application by Todd Brummond for Trisimo Motel Development Company, LLC requesting approval of an administrative special use permit to allow an expansion to the existing Super-8 Motel on Commercial-One property located at 10101 West 170 Frontage Road South. Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide upon applications for administrative special use approval, without requirement for a public hearing, provided the following conditions are met: 1. A completed application package has been submitted and fee paid. 2. The Community Development Department has notified adjacent property owners by letter notice and the site has been posted for at least ten (10) days. 3. No written objections have been received in such ten-lay period. 4. The Community Development Director concludes that the criteria for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review, The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; or, 2. Whether the SUP is personal to the applicant and may or may not be inherited; and /or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section. The applicant has submitted a site plan, which shows the area of addition. The addition will be approximately 1,000 square feet in size, and will be used as a small eating area for patrons. No other physical additions are proposed for the property. FINDINGS OF FACT: 1. The property has been historically used as a motel. 2. Motels and hotels, as defined in Section 26-123 of the Wheat Ridge Code of Laws, are a special use in the C-1 zone district. 3. Adjacent property owners were notified by certified mail of the application, and no written objections were received. 4. The applicant, Todd Brummond, has the ability to continuously meet the conditions of the special use permit. 5. The proposed special use will not have a detrimental effect upon the general public health, welfare, and safety. 6. The proposed special use will not result in traffic congestion nor overburden the capacities of the existing streets and utilities. 7. The proposed special use will not adversely affect the light and air to adjacent properties as no physical changes are proposed to the structure or the property. This request for an administrative special use meets all applicable conditions as required by Section 26-114 of the City of Wheat Ridge Code of Laws. Staff has not received written comments in opposition to this request from the adjacent property owners. Therefore, Case No. SUP-04-06 is hereby APPROVED with the following conditions: 1. The special use shall be a grant of use to the property owner and any future property owner (s) of 10101 W. 170 Frontage Road South. 2. A neighborhood input meeting will be held on Thursday, November 4'h at 6pm. The meeting will be held in the 2°" floor conference room of the Wheat Ridge City Hall located at 7500 West 29" Avenue. The City of Wheat Ridge has adopted a requirement that prior to any application for Rezoning of property and for Special Use Permits an applicant must notify all residents and property owners within 600 feet and invite them to a Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to present his proposal to the neighborhood and to give the neighborhood a forum to express their concerns, issues and desires. A Staff Planner will attend the meeting to discuss City policies and regulations and the process involved, however, the Planner will remain impartial regarding viability of the project. Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as testimony, it is the public hearings in front of the Planning Commission and City Council where decisions are rendered. If you want input in the decision-making process, it is imperative that you attend the public hearings. The kinds of concerns residents normally have include the following: • Is the proposal compatible with surrounding land uses and zoning? Are there adequate utilities and services in place or proposed to serve the project? What is the impact on our streets? How will this proposal affect my property? When I talked with Allen White he said we would do everything possible to speed this process along and mentioned the need to hold the neighborhood input meeting and assuming there was no objection following the 10 day comment period that he would ok the permit. Based off your e-mail we have further items that need to be taken care of such as contacting fire, water, sanitation etc. Based off the schedule you are proposing, we are back to your initial comment of a 1 1/2 month process. Has anyone reviewed what we are proposing? Due to the fact we are reducing the number of guestrooms the demand on utilities will be drastically reduced even with the addition. Also, the fees due change each time I speak with someone. I was first told it was a $200 application fee. Your e-mail shows $300 plus $300 per acre. Which is correct? Where did the $100 fee come from? If an input meeting is required then that fee should be part of the application process. I will go along with the "policies" if the City is willing to work with us in this process, but if we must go through a long drawn out process then I would like to see everything in writing. Earlier today you mentioned that if something is not in the codes then you would tell me it is your departmental policy. If it is policy, it needs to be in writing. I'm sure you realize you cannot arbitrarily make up policies as you go. I am not in any way a difficult person to get along with, in fact you can check with Sparky at the fire department or the city code enforcement officer for hotels and I'm sure they will tell you we do and have for 15 years everything they ask of us. I simply want everyone to apply some common sense to this request. We all know of the dire financial condition of the City and it is in everyone's best interest to make it as user friendly as possible to further development in order to increase the tax base. I have attached the letter you requested and assuming everything is ok, I will send it out on Wednesday. I will personally deliver the required copies to the rental occupants of the Camelot Club in addition to the listed ownership you provided. Thanks for your help.
