Thanks Sparky City of Wheat Ridge Community Development Department Memorandum TO: Applicant; File FROM: Alan White, Director of Community Development SUBJECT: SUP-04-07/Arrowhead Landscape Services DATE: December 15, 2004 v Case No. SUP-04-07 is an application by Kurt DeLucero of Arrowhead Landscaping Services requesting approval of an administrative special use permit to allow a landscape contractor on C-1 (Commercial One) zoned property at 10260 W. 44`h Avenue. Pursuant to Section 26-114 of the zoning and development code, the Community Development Director has the ability to decide upon applications for administrative special use approval, without requirement for a public hearing, provided that the following conditions are met: 1. A completed application package has been submitted and fee paid, 2. The Community Development Department has notified adjacent property owners by letter notice and the site plan has been posted for at least ten (10) days, 3. No written objections have been received in such ten-day period; 4. The Community Development Director concludes that the criteria for approval are substantially complied with and support the request. Pursuant to Section 26-114 of the Code of Laws the Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; or 2. Whether the SUP is personal to the applicant and may or may not be inherited; and/or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless reviewed subject to all of the requirements of this section. The applicant is not proposing any physical changes to the property. A site plan was submitted showing building layout, parking areas and existing signage. The site plan also illustrates three existing sheds on the property. All minimum commercial standards and development regulations of the Commercial-One zone district appear to be met. Findings of Fact: 1. A landscape contractor is a special use on C-1 (Commercial One) zoned property. 2. Adjacent property owners were notified by certified mail of the application, the site was posted for a period of ten days, and no written objections were received. 3. The applicant, Kurt DeLucero, has the ability to continuously meet the conditions of the special use permit. 4. The proposed special use permit will not have a detrimental effect upon the general public health, welfare, and safety. 5. The proposed special use will not result in traffic congestion nor overburden the capacities of the existing streets and utilities. 6. The proposed use will not adversely affect the light and air to adjacent properties as no physical changes are proposed on the property. This request for an administrative special use meets all applicable conditions as required by Section 26- 114 of the City of Wheat Ridge Code of Laws. Staff has not received written comments in opposition to this request from the adjacent property owners. Therefore, Case No. SUP-04-07 is hereby APPROVED with the following conditions: 1. The use of the property shall be for a landscape contractor. 2. The use of the property shall be consistent with the operational description provided. 3. The existing storage sheds may be utilized and relocated in accordance with applicable development standards, however any additional accessory buildings will require an application for a planned building group (PBG). 4. All signage must in conformance with the relevant sign code requirements of Article VII of the Code of Laws. 5. All outside storage areas shall be screened from view from adjacent properties and streets by a solid fence six feet in height. 6. If the existing separate unit on the second floor of the building is to be utilized for commercial purposes, this space must be brought into conformance with applicable commercial building code standards. 7. An inspection by the Arvada Fire Department shall take place within 30 days of approval of the business license. 8. There shall be at least one handicapped accessible parking space provided on the premises within 30 days of approval of the special use permit. 9. The date and time of the meeting is November 10, 2004 at 6 p.m.. The location of this meeting is the City of Wheat Ridge, 7500 West 29th Avenue. The purpose for this proposal is to grant a Special Use Permit for Arrowhead Landscape Services to occupy the above address. Arrowhead Landscape Services, Inc. is a small commercial landscape maintenance and landscape construction company. The largest portion of the business is commercial landscape maintenance for Townhomes, apartments and HOA's. There will be approximately twenty employees, most of which are seasonal workers. We currently run approximately six standard size pickup trucks, each equipped with a trailer and small engine mowing equipment. Arrowhead proposes to keep the property in its current state of being. No changes in office, parking or yard structure will be needed for the operation. Within the yard and current outlying sheds, there will be standard size trucks, small mowers, trailers and maintenance equipment stored. The majority of the equipment fleet is less than S' in height and will not be visible above the current perimeter fencing. Normal work hours are 7:00a.m. S:OOp.m. on weekdays. Approximately 34 employees will be staffed in the office as full time employees, so the current parking facilities are more than adequate for our needs. The crews drive the company vehicles to and from home so parking is not needed for the crews. The City of Wheat Ridge has adopted a requirement that prior to any application for Special Use Permits an applicant must notify all residents and property owners within 600 feet and invite them to a Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to present his proposal to the neighborhood and to give the neighborhood a forum to express their concerns, issues and desires. A Staff Planner will attend the meeting to discuss City policies and regulations and the process involved, however, the Planner will remain impartial regarding viability of the project. Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as testimony, it is the public hearings in front of the Planning commission and City Council where decisions are rendered. Plan: Commercial One (C-1) Village Center (VC) Applicant/Owner Preliminary Proposal: Operate a landscape maintenance and construction company on property zoned C-1. The applicant proposes no physical changes to the property. The business has approximately 20 employees, most of which being seasonal workers from April to October. The business includes the storage of standard sized trucks, trailers, mowers and maintenance equipment. This business requires a special use permit to operate at this particular location. Will a neighborhood meeting need to be held prior to application submittal? YES Planning comments: The proposed use falls under the category of "building contractor's service shop and storage yard incidental to an office/showroom principal use", which requires a special use permit in the C-1 zone district. The special use permit can be approved administratively (without a public hearing) if there are no written objections directly related to the special use request during the 10-day public notice period and if the site plan meets the requirements of the zoning and development code. Staff can impose conditions of approval of the special use permit. Such conditions can include hours of operation and that the site be brought into conformance with current landscaping and parking standards as specified below. Per the Code of Laws Sec. 26-502 (D)(3) landscaping shall be no less than 20 percent of the gross lot area, and 1 street tree, deciduous or evergreen, is required for every 30 feet of street frontage. Also per the Code of Laws Sec. 26-502 (D)(3)(d) all nonresidential uses located adjacent to residentially zoned areas shall provide a buffer consisting of either a six foot high solid fence or hedge within a 6' wide landscaped strip, or a strip of land at least 15 feet wide with a variety of vegetation. The parking area for the business as shown on the site plan is adjacent to the Newgate Apartments to the west, which is zoned Planned Residential Development, therefore this buffer will be required. Also per the Code of Laws Sec. 26-502 (D)(3) properties abutting 44th Avenue are required to have a landscaped area measuring at least 10 feet wide for the entire length of the property abutting this road. The property must have adequate parking available. The parking standards require 1 space for each company related vehicle in addition to customer and employee parking. Any signage on the property must conform to all relevant standards. It was expressed that the existing freestanding sign structure and wall signage cabinet would be utilized. Freestanding signage in C-1 must adhere to setbacks, height and size regulations. If it is determined that the existing signage does not meet any one of these regulations, it cannot be reconstructed without bringing the sign into conformance with current sign regulations. If it is considered conforming, a sign permit will be required to modify the sign. Accessory building such as sheds are not allowed in the C-1 zone district, however there are three existing sheds on the property. Due to the fact that these sheds were preexisting, they will be allowed. It was expressed that one of the sheds located on the southwest corner of the site would likely be relocated closer to the two existing sheds behind the main building. This would be allowed. Any additional accessory buildings, such as a garage, would require the applicant to apply for a Planned Building Group (PBG). The accessory building must be at least 1,000 square feet in size. This application can be approved administratively if the application is for not more than 4 main structures on the property. Per the Code of Laws Sec. 26-629 all outside storage areas must be screened from view from adjacent properties and streets by a six foot solid fence. Stacking of materials and supplies cannot exceed the height of the fence. There is an existing six foot solid fence around the perimeter of the back of the property. Any new fence will require a fence permit. Any type of lighting for the proposed business should be indirect, and have no adverse effects on adjacent properties, structures, or present any type of safety hazard for motorists or pedestrians. Per the Code of Laws Sec. 26-503 (C)(4) all exterior lighting shall be designed and situated so that all of the directly emitted light falls within the property lines. There is an existing residential unit above the bottom floor retail component of the building. It was expressed that this unit may be used for residential purposes, or it may be used as part of the commercial use in the future. If this portion of the building is to be used as part of the commercial component of the business, it will be required to be brought up to commercial building code standards. The next step would be to apply for a special use permit for the business. Now that a pre- application meeting has been held, a neighborhood meeting must be held. The neighborhood meeting has been scheduled for Wednesday, November 10, 2004, 6:00 p.m. at City Hall. The applicant is responsible for giving adequate notice to all property owners and tenants. There is a $100 fee for the neighborhood meeting that needs to be received on or before the date of the hearing. After the neighborhood meeting is held, a formal application for a special use permit may be submitted. Submittal requirements include at minimum the application, deed, site plan, survey (or improvement location certificate), letter of request and fee. Upon receipt of the application the proposal will be referred to the necessary outside agencies for review and comment for a period of 15 days. After the review process is complete, the Community Development Department shall notify adjacent property owners by certified letter and posting of the site for 10 days. If no written objections directly related to the special use request are received within this 10- day period, the Community Development Director can approve, approve with conditions or deny the special use. Upon receipt of any relevant written objections by an adjacent property owner or upon appeal by an applicant of a decision by the Community Development Director, the special use request will be scheduled for public hearing in front of City Council. If approved, either by the Community Development Director or by the City Council at a public hearing, the special use will become effective immediately.
