A set of these minutes is retained both in the office of the City Clerk and in the Community Development Department of the City of Wheat Ridge. PUBLIC FORUM No one indicated a desire to speak at this time. PUBLIC HEARING A. Case No. WA-04-05: An application filed by Jefferson County Housing Authority for approval of a waiver of Section 26-502.E.1 (landscaping buffering for parking lots), specifically the requirement of a six-foot-high view-obscuring fence on property zoned Commercial-One (C-1) and located at 7490 West 45" Avenue. The case was presented by Travis Crane. He advised the Board there was jurisdiction to hear the case. He entered all pertinent documents into the record Board of Adjustment - 1 - 07/22/04 and reviewed the staff report and digital presentation. Staff recommended approval of the variance for reasons outlined in the staff report. Waiving the requirement for a 6-foot view-obscuring fence would allow views into the adjacent Apel Bacher Park as well as allow pedestrian access into the park from the applicant's parking lot. The applicant has offered to allow use of their parking lot to park visitors during non-business hours and would also allow the nearby church to use the lot for overflow parking on Sundays. In response to a question from Board Member BLAIR concerning access to the park, Mr. Crane stated that low growing shrubs planned for the six-foot landscape buffer would allow spaces for pedestrian access through the buffer into the park. Board Member ABBOTT suggested that a formal sidewalk be installed for pedestrian access. Board Member BELL commented that the open landscape buffer would provide greater safety in terms of views into the park for law enforcement purposes. Board Member HOVLAND commended the applicant for offering parking for park visitors and did not believe the Board should impose a condition requiring construction of a sidewalk. Alan Feinstein DRAFT 7770 West 110th Avenue, Westminster Mr. Feinstein, Director of Jefferson County Housing Authority, was sworn in by Chair BLAIIL He stated that, in addition to allowing use of the parking lot by park visitors and church attendees, the building's meeting room will be available for use by community groups. In response to a question from Board Member HOWARD, Mr. Feinstein stated the building would house fifteen employees. In response to a question from Board Member DRDA, Mr. Feinstein stated that landscaping plans call for low-growing shrubs with enough space in between for pedestrian access. Board Member ABBOTT discussed placing a condition of approval to guarantee that the applicant would always allow access to the park from the parking lot. Board Member BELL stated that the benefit of having no fence far outweighs any other matters in this case and she did not believe such a condition should be placed on the applicant. Board of Adjustment - 2 - 07/22/04 Board Member DRDA stated that he would favor Board Member ABBOTT, s suggestion for a condition in order to provide perpetuity as long as the Jefferson County Housing Authority is in this location. Board Member HOVLAND commented that the issue at hand does not involve access to the park, but only whether or not the fence requirement should be waived. Chair BLAIR asked if there were any present who wished to address this matter. There was no response. Case No. WA-04-06: An application filed by Joe Stout for approval of a 23 1/2 foot side yard setback variance from the 30 foot side yard setback requirement when adjacent to a public street resulting in a 6 1/2 foot side yard setback for property zoned Residential-Two and located at 6400 West 46`s Avenue. The case was presented by Jeff Hirt. He advised the Board there was jurisdiction to hear the case. He entered all pertinent documents into the record and reviewed the staff report and digital presentation. Staff recommended approval of the variance for reasons outlined in the staff report. Joe Stout DRAFT 6400 West 46`s Avenue Mr. Stout was sworn in by Chair BLAIIL He explained that the variance would allow him to build a garage without removing shade trees and also preserve space in the back yard. He stated that this is the only house in the neighborhood without a garage and that all of his neighbors have expressed their approval of his plans. Board Member BELL commented that the proposed garage would be in character with other homes in the area and would, in fact, be an improvement since the garage is planned to be set back a way from the corner. Board Member BLAIR commented that the garage would be an improvement over the 6-foot fences placed very close to the street in the area. Chair BLAIR asked if there were any present who wished to address this matter. There was no response. Board Member DRDA commented that there are other locations on the property to build a garage without the need for variance. He stated that he could not find a hardship in this case. Board of Adjustment WA-04-05/Jefferson County I. REQUEST The applicant (owner) is requesting a waiver of Section 26-502 (E)(1), specifically, the requirement for a six-foot fence between a parking area on a commercial property and a property zoned as residential. (Exhibit 1, Letter of Request). The property is currently zoned Commercial One (C-1), and is in the process of being developed. The C-1 zone district allows a wide variety of commercial uses. The property is 25,100 square feet in size, has a rectangular shape and is relatively flat (Exhibit 2, Landscape Plan/Site Plan). There is no minimum lot size for a C-1 property, provided all setbacks and development standards can be met. All other development standards will be met. II. CASE ANALYSIS The applicant wishes to construct a new building on the property. A building permit has been reviewed and approved by the City. The site plan shows a six-foot fence on the eastern property line; however, this was an early submittal document during the building permit stage. During the building permit review process, the applicant requested a waiver of the buffering requirement along the eastern property line. Section 26-502(E)(1) of the Code of Laws (Landscape Buffering for Parking Lots) states that: Whenever a parking lot boundary adjoins property zoned for low- or medium density residential use... a landscape buffer of six (6) feet from said lot boundary shall be required. Within the six-foot landscape buffer, a six-foot high view- obscuring fence, decorative wall or landscaped hedge with a natural height of six (6) feet shall be provided. A six-foot landscaped buffer with live plantings is proposed along the eastern property line; however, a six-foot high view-obscuring fence is not. The property directly to the east is zoned Residential Two (R-2), and is currently the Apel-Bacher Park. The site plan shows a parking lot to be constructed on the eastern property line. The site plan shows a total of 10 parking spaces on the eastern property line. There will be 4 trees and 22 shrubs located in the six-foot landscape buffer on the eastern property line. There are several existing mature trees on the western property line of the park. These trees, in tandem with the proposed planting, will create a soft buffer between the park and the subject parcel. If a formal six-foot fence were constructed on the eastern property line, the park would feel `enclosed' on the western side. An existing gazebo, located just north of the tennis courts in the park, is approximately 15 feet from the property line. The applicant has included a conceptual rendering of what the property would look like with a six-foot view-obscuring fence on the eastern property line (Exhibit 3, Conceptual Drawing). The building entrance will face the park, and this building orientation will help foster the cohesive nature of the two properties. Board of Adjustment WA-04-05/Jefferson County III. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance request: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the request is denied, the property may still receive a reasonable return in use. The property may be developed under the Commercial One development standards and guidelines. 2. If the variance were granted, would it alter the essential character of the locality? If the request were granted, the character of the locality would not be altered. Given the proximity of the park directly to the east, a fence in this location would create undesirable visual impacts and give the appearance that the park is enclosed on the western side. The existing mature landscaping in the park will create a soft buffer from the parking lot. 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The lot does not have a unique shape. It is a rectangular shaped lot, and is relatively flat. There is no minimum lot size in the C-1 zone district, provided that all other development standards can be met. 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? A person who has interest in the property has caused the hardship. The buffering requirement of parking lots is applicable to any commercially zoned property that is adjacent to a residentially zoned property. 5. Would the granting of the variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? The request would not be detrimental to the public welfare. The adequate supply of light and air would not be compromised as a result of the request. The request would not increase congestion in the streets, nor increase the danger of fire. The request would most likely not have an effect on property values in the neighborhood. 6. If criteria 1 through 5 are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from Board of Adjustment WA-04-05/Jefferson County an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The request could possibly result in a contribution or benefit to the neighborhood. If the request were granted, the park would be more visible and accessible to the neighborhood. The applicant has agreed to allow visitors of Apel Bacher Park to utilize the parking lot for access to the park during non-business hours. The request would not result in a reasonable accommodation of a person with disabilities. IV. STAFF CONCLUSION & RECOMMENDED MOTION (S) Upon review of the above request, staff concludes that the criteria are supportive of the request. Therefore, staff recommends APPROVAL for the following reasons: 1. There would be a benefit derived by the neighborhood if this request were granted. Plans and construction documents were submitted to the City of Wheat Ridge for review in May 2004. Section 26-502 of the Zoning and Development Ordinance requires a "...six foot high, view obscuring fence.." as a buffer between the existing Apel-Bacher Park and the parking area of the newly developed site. We request a waiver from the 6' solid fence requirement for the following reasons: • On August 7t°, 2003 the Wheat Ridge City Council approved the subdivision and platting for the site on which the JCHA building will be constructed. Part of the public hearing and discussions leading up to that decision was the offer from the JCHA that the on-site parking spaces could be used by park patrons during non-business hours. Parking for the park facilities is now limited to a few parking spaces on the street. A solid fence would require park users to go back out to 45v` Avenue to access the park. • A solid, six foot high fence would not only obscure the view of the park from the JCHA site, the Holy Cross church and travelers on 45`s Avenue, but severely restrict the view from the park to the west. We feel that our new JCHA development is a very attractive building with the entrance orientated toward the park and that the site is expertly landscaped (see landscape plan) and will only add to the attractiveness and open feeling of the park. • The Apel-Bacher Park is only about 100' wide on its frontage to 45s' Avenue and has an existing 6' wood fence along the east boundary. Another 6' fence on the west side would give, we feel, an uncomfortable, enclosed feeling in the picnic/gazebo area of the park. • If we receive approval to waive the requirement to construct the 6' obscuring fence, the lower height Spirea evergreen shrubs, as shown on the submitted site plan, would still remain as a buffer for the parked automobiles.
