He inquired about the variance request to allow two recreational vehicles in the front yard of 3232 Vivian Drive. He stated that he thought the applicant should place both recreational vehicles in the back yard `like everyone else does'. I informed him that the Code of Laws allows one recreational vehicle in the front yard, and that this request was to allow a second in the front yard. I explained the applicant had one large motor home and one trailer of personal vehicles, and wanted to store each in the front yard, due to lack of accessibility to the back yard. Mr. Swanson also stated that since the applicant lives on a curve, it could create a sight distance problem for motorists. I informed Mr. Swanson that if he wanted to submit comments in writing, the deadline for doing so was at 5:00 today (Monday). I asked if he would like to fax or email in his comments, but he did not have access to either a facsimile machine or a computer. I informed him that if he wanted to come down to City Hall, I would stay late to accept his submittal. He declined the offer, and stated he did not want to object. He asked if there had been any other complaints received, and I informed him there had not. Because Mr. Swanson chose not to submit any comments in writing prior to the deadline, the variance request can still be approved administratively without need for a Board of Adjustment hearing. City of Wheat Ridge of ""EqT Community Development Department Memorandum C~~OR A~~ TO: Applicant; File FROM: Alan White, Community Development Director SUBJECT: WA-04-07/3232 Vivian Drive DATE: 30 August 2004 Case No. WA-04-07 is an application filed by James Opp and is a request for a variance to allow more than one recreational vehicle located within the front yard of the property located at 3232 Vivian Drive, and zoned Residential One-A. The property is 12,109 square feet in size. Pursuant to Section 26-621 of the Wheat Ridge Code of Laws, one recreational vehicle may be stored within the area between the street and all walls of the structure facing the street. The applicant wishes to store two recreational vehicles within the front yard. Pursuant to Section 26-621 (J) of the Wheat Ridge Code of Laws, the Zoning Administrator is empowered to decide upon applications for a variance to allow additional recreational vehicles, in accordance with Section 26-115 (C) of the Code of Laws, without requirement of public hearing, provided that the following conditions are met: 1. That the Community Development Director finds that the "findings of fact," as set forth below, are substantially complied with and support the request; and 2. The Community Development Director has notified adjacent property owners by letter notice and posting of the site at least ten (10) days prior to rendering his decision, and that no protests have been received in such ten-day period; and 3. That no additional dwelling units would result from approval of such variance or waiver; and 4. That the limitations of Charter Section 5. 10.1 are not exceeded. If all the conditions above are met, the Community Development Director may issue an administrative variance provided the findings of fact below are met: Findings of Fact: The Community Development Director shall decide upon a request for a variance or waiver, and shall base his decision in consideration of the extent to which the following facts, favorable to the applicant, have been established by the evidence: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? 2. If the variation were granted, would it alter the essential character of the locality? 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? 5. Would the granting of the variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in the public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? 6. If criteria one through five are found, then would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? This request for an administrative variance meets all applicable conditions as required by Section 26- 115(C) of the City of Wheat Ridge Code of Laws. The trailer does meet the requirement to be six feet inside the front property line and is parked on an improved surface. The second recreational vehicle, a motor home would be stored on the south side of the house. I have been storing my recreational vehicles in this format for over 20 years. I need to store them this way since I do not access to my back yard for these recreational vehicles due to the layout of the lots not allowing the vehicles to pass between the houses and the lot backs up to Lenia Gulch which does not allow access to my back yard.
