According to the information you provided to me recently, after the purchase of right- of-way from CDOT, the lot is still about 25 square feet short of the required lot size of 12,500 square feet for a two-family dwelling. I am expressly prohibited from administratively approving a variance that results in an additional dwelling unit being permitted for the lot. You have stated that you did not wish to pursue a variance. The other available option is to adjust the lot lines between 4695 Wadsworth and an adjacent lot. Normally, this could be accomplished through an administrative lot line adjustment, but this process cannot be used if an additional unit would be permitted on one of the lots. Therefore, the two lots in question must be re-subdivided. This essentially entails the preparation of a final plat and review by the Planning Commission at a pubic hearing. In making 4695 Wadsworth conforming to the lot size requirement, the re-subdivision must not make the other lot in question non-conforming in size, width, or lot coverage, or make the other structure non-conforming with respect to any setback. Since I don't know which lot you are looking at, I won't speculate on whether non-conformities would be created or not. The re-subdivision requires a pre-application meeting and neighborhood meeting prior to submittal of the application. It will also require the services of a surveyor to prepare the plat. Department fees will be approximately $1,250 to process the re-subdivision. The maximum fee for a variance is $390. I hope this letter provides you the information you need. I would like to discuss the zoning and briefly recount the events of the last year, as it relates to the subject property. The property is currently zoned Residential-Two (R-2). This zone district is intended to be a low-density classification. This district can accommodate a single family home provided a minimum lot size of 9,000 square feet and 75-foot lot width is met. The zone district will allow a duplex provided the lot is at least 12,500 square feet in size, and has a 100-foot lot width. On April 25, 2002, the Board of Adjustment denied your request for a variance to the minimum 12,500 square foot lot requirement to allow an additional dwelling unit on property zoned Residential-Two at 4695 Wadsworth Blvd. This case was revisited at a rehearing held on June 27, 2002, where it was denied again. At the time of original application, the Community Development Department requested a copy of a survey to verify existing property size. Because you could not provide one, we estimated your lot size based on the existing deed for the property. The Community Development Department has recently received a deed conveying 602 square feet of excess right-of-way from the Colorado Department of Transportation to you. Please submit a survey document or improvement location certificate to ensure that you do meet the 12,500 minimum lot size requirement for a duplex in the R-2 zone district. This survey or I.L.C. should be prepared and stamped by a licensed surveyor. Until such document is provided that verifies a compliant lot size, a permit will not be issued for conversion of the single-family residence to a duplex. Rehearing of Case No. WA-02-02 - An application submitted by Jeff Petty for approval of a 600-square-foot variance from the 12,500-square-foot minimum lot area requirement to allow an additional dwelling unit on property zoned Residential-Two (R-2) and located at 4695 Wadsworth Boulevard. This case was presented by Mike Pesicka. He reviewed the staff report which contained new evidence submitted by the applicant. New photos of the property were also presented during the staff report. In response to questions from Board Member ABBOTT, Alan White explained that even though there are three kitchens in this structure, the property is zoned R-2 which would not allow a triplex. The maximum use for the structure could only be a duplex. Further, the city traffic engineer has reviewed the parking situation and determined there is adequate parking space for a duplex and there is also sufficient room between the driveway and Wadsworth. Jeff Petty Mr. Petty, the applicant, was sworn in by Chair MONTOYA. At the previous hearing, there was much opposition from the neighbors regarding the parking, condition of the property and a desire that a duplex not be allowed in the subject location. Since that time, Mr. Petty has cleaned up the property, installed new landscaping, etc. He spoke with surrounding neighbors who indicated they are pleased with the improvements and, with the exception of one neighbor, now have no objections to his request to use the property as a duplex. He agreed with closing the curb cut onto Wadsworth and the request to pave the first 25 feet of his driveway. His research also revealed several duplexes as well as apartment buildings exist in the surrounding neighborhood. Board Member ABBOTT asked if people were living in the structure at present. Mr. Petty replied that two people are presently living in the structure. One of the people is living there while he is working on the property and is paying no rent. Board Member DRDA asked if Mr. Petty would be agreeable to permanently closing the garage door which presently faces Wadsworth. Mr. Petty indicated he would be agreeable to this to prevent ingress/egress from Wadsworth. Board of Adjustment 06/27/02 In response to questions from Board Member HOWARD, Mr. Petty explained he plans to have two living units--one on the first floor and one on the second floor. There are separate entrances for each unit. Board Member ABBOTT asked if it would be necessary to have approval from CDOT to close the curb cut on Wadsworth. Mr. White replied that he will check with CDOT to see what the requirements are. Patricia Fisher 7609 West 47`x' Avenue Ms. Fisher was swom in by Chair MONTOYA. She asked to submit a copy of the Wadsworth Corridor Plan as well as a copy of city regulations concerning R-2 property.. Chair MONTOYA questioned whether the Board had jurisdiction to base its decision on the Wadsworth Corridor Plan which addresses right-of-way that may or may not occur. Alan White informed the Board that a decision on a variance should only be based on current conditions. Chair MONTOYA therefore disallowed submittal of the Wadsworth Corridor Plan as evidence. The R-2 zoning requirements were already a part of the staff report. She read the following statement into the record: "Our covenants state that Hillcrest Heights was a one family subdivision (R-1). Sometime over the years that was changed to R-2. Most of the homes in our subdivision now are R-2 and I don't think that was made clear at this meeting. A large number of homes already have the room to add apartments within their homes and adequate parking on their property. Once an exception is made here, many of these homeowners might also want duplex status. That would change the character of our subdivision from one family to rental. The decision here will be cited by anyone seeking a variance in the future. Jefferson County still shows this home as a one family residence. The outside entrance to the second floor of the residence was added last year. They also show the property was bought years ago by Alma and Cornelius Holden who probably were family members sharing apartments within the home. I have never known that home to be a rental. You also speak of the home next door that is zoned R-3. At one time, there was a lot over a half-acre connected to that home that was sold and 1 have never seen an `apartmentfor rent'sign on that home. It always said `house for rent'. The property does not have adequate parking on or in front of it to support duplex status. There is no parking on Wadsworth and there is a sight restriction on the 47t Avenue side. There is a single unpaved driveway that would accommodate three cars in a row at most. If the driveway were extended around the back of the home with an exit on Wadsworth, would the property then meet code? Would paving part of the lot for parking make for more code violations? This is already a very dangerous corner. The north side of 47`h Avenue across from the home has the same sight restrictions and is known as `breakdown corner' because it is the only place that disabled vehicles, cars and trucks, coming south on Wadsworth have to pull over. If this place is used for permanent parking because there is inadequate parking on Mr. Petty's property, these disabled vehicles will have no choice but to park in the middle of Board of Adjustment Page 3 06/27/02 the street, blocking the entrance to our subdivision and tying up traffic on Wadsworth. This has happened many times in the past when vehicles have parked temporarily in this area. Colorado has a full disclosure real estate law, and the Real Estate Commission stated to me that the 15 feet deeded to the state would have shown up on the title commitment unless waived. That, coupled with the fact that Jefferson County doesn't show this property as a legal duplex or multifamily should take Mr. Petty back to real estate for a release since there are severe penalties if he were not given these facts. I request that the panel review the findings of the Court of Appeals of the lawsuit I submitted at the last meeting along with the Wadsworth Corridor Plan for Hillcrest Heights and deny the variance. " Chair MONTOYA restated the jurisdiction of the Board and reminded Ms. Fisher that the property is zoned R-2 which makes a duplex legal. He asked Ms. Fisher if the new evidence presented by Mr. Petty made a difference to her. She replied it made some difference and commended Mr. Petty for cleaning up the property but expressed concern about disabled cars parking on 47th. Board Member DRDA asked about setback requirements. Alan White explained that the city cannot request setbacks to be met on an existing structure which was built in 1958. Setbacks can only be required on new construction. The setbacks were also affected by the State acquiring 15 feet of right-of-way along Wadsworth. Board Member YOUNG commented that the focus should be on whether a variance should be granted to allow Mr. Petty to do necessary remodeling to use the structure as a duplex in an R-2 zone. He asked if curbstones could be set to close the curb cut onto Wadsworth. Alan White will check with CDOT regarding curbstones as a temporary solution until final action by CDOT. Board Member ECHELMEYER stated that since Mr. Petty had addressed the neighbors' concerns by cleaning up the property and there is a long list of neighbors who are not opposed to his using the property as a duplex, he would vote in favor of the application. Chair MONTOYA stated that concerns of neighbors had also been met by eliminating the Wadsworth curb cut and permanently closing the garage door. Board of Adjustment Page 5 06/27/02 Board Member HOWARD questioned the certificate of occupancy when the structure is already occupied by two different individuals. Chair MONTOYA called Mr. Petty back to the stand to explain. Jeff Petty explained that both individuals live in the downstairs portion which presently consists of two separate units with kitchens and bathrooms. He stated that the upstairs portion is unoccupied. He plans to eliminate one kitchen downstairs which will result in one 3-bedroom living unit on the lower level. Board Member ABBOTT commented that whether or not the units are occupied relates to the city's code determination and the Board's jurisdiction relates only to whether or not the variance should be granted. Chair MONTOYA agreed with Board Member ABBOTT and informed the applicant that six affirmative votes will be required under the super-majority stipulation for the variance to be approved. The motion failed by a vote of 5-2 with Board Members DRDA and HOWARD L voting no and Board Member BLAIR absent. Chair MONTOYA advised Mr. Petty that his application had been denied. C. Case No. WA-02-05 - An application filed by Jim Dent for approval of a 10-foot rear yard setback variance from the required 10-foot rear yard setback resulting in a 0-foot rear yard setback for the purpose of constructing a garage on property zoned Residential-One C (R-1C) and located at 3235 Ames Street. This case was presented by Travis Crane. He reviewed the staff report, presented photographs and layouts of the proposed application, and entered all pertinent documents into the record. He advised the Board that proper noticing and publication requirements had been met and there was jurisdiction to hear the case. He pointed out information recently received and not included in the packet, regarding the Uniform Building Code which states that any structure built on a zero setback may not have any doors or windows and the wall on the property line must be a one-hour fire wall. Staff recommended denial of the application based upon reasons outlined in the staff report. In response to a question from Chair MONTOYA, Mr. Crane stated that the UBC requirements were not brought to his attention until today and therefore the applicants were not aware of the requirements. Discussion ensued as to whether the hearing could take place based on the new information. Alan White commented there are two possibilities: (1) approve a variance that is less than advertised; (2) approve the requested variance, contingent upon approval by the building inspector. There was a consensus to proceed with the hearing. Case No. WA-02-04 (to be continued to a date uncertain) - An application filed by Victor Olson for approval of an 11-foot side yard setback variance from the required 30-foot side yard setback when adjacent to a public street, resulting in a 19-foot side yard setback for the purpose of constructing a garage on property zoned Residential-Two and located at 2620 Upham Street. Alan White informed the Board that all required information had been received from the applicant and requested that the case be continued to the next Board of Adjustment meeting to be held on June 27, 2002. Vice Chair ABBOTT opened the public hearing. There was no one signed up to speak to this matter. It was moved by Board Member DRDA and seconded by Board Member HOWARD to continue Case No. WA-02-04 to June 27, 2002. The motion passed unanimously. C. Case No. WA-02-02: Request for a rehearing of Case No. WA-02-02 which was denied by Board of Adjustment on April 25, 2002. Vice Chair ABBOTT reopened Case No. WA-02-02. Jeff Petty Jeff Petty, the applicant, was sworn in by Vice Chair ABBOTT. He requested a rehearing of his case based upon new evidence he has to present. After the last Board of Adjustment meeting, he met with neighbors in attendance who expressed concern about the condition of the property. He also met with other neighbors in the neighborhood who had the same concerns. As a result, he has worked during the past month to repaint, remove dead trees, clean the yard, and plant flowers and grass. Since this work has been Board of Adjustment Page 4 05/23/02 done, fifteen neighbors have signed a petition indicating they are in favor of a rehearing and that they are not in opposition to the structure being used as a duplex. This petition was entered into the record. The neighbors were aware that Mr. Petty would appear before the Board to request a rehearing. He stated that he plans to landscape the corner including a short fence to prohibit cars from. driving across. He testified that there is room for four cars to park in the driveway. Mr. Petty submitted photographs which showed the improvements he has made. These were entered into the record. Board Member BLAIR stated that he lives near the subject property and has noticed a significant improvement in the condition of the property. Vice Chair ABBOTT asked if the present driveway meets standards for a duplex. Alan White stated this would be evaluated and included in the staff report if a rehearing is held. The driveway as it affects the sight triangle will also be examined. Board Member HOVLAND commented that four of the reasons for denial at the last meeting were related to neighborhood opposition. Since there seems to have been a change in the neighborhood concerns, he would be in favor of a rehearing. It was moved by Board Member DRDA and seconded by Board Member ECHELMEYER to rehear Case No. WA-02-02 based upon significant new evidence presented at this meeting. The motion passed 4-1 with Board Member HOWARD voting no. Vice Chair ABBOTT advised the applicant that his case would be reheard. 5. Variance Decisions - Board Member DRDA questioned whether or not cases should be decided on whether or not neighbors like or dislike a certain project. Alan White commented that findings should be based upon facts and evidence presented during the hearing and public comment should be considered based upon relevance to the variance criteria. B. 2941 Chase Street - Board Member ECHELMEYER asked about the status of the house at 2941 Chase Street. Alan White explained they have worked with the owner and the project is in compliance with code. PUBLIC FORUM There was no one signed up to speak. 4. PUBLIC HEARING A. Case No. WA-02-02: An application submitted by Jeff Petty for approval of a 600 square foot variance from the 12,500 square foot minimum lot area requirement to allow an additional dwelling unit on property zoned residential- two (R-2) and located at 4695 Wadsworth Boulevard. This case was presented by Mike Pesicka. He reviewed the staff report and presented slides and overheads of the subject area. All pertinent documents were entered into the record. He also entered legal documents and real estate documents just received from a neighbor in the area. The documents resulted from a lawsuit initiated in the area several Board of 04-25-02 'RA years ago. Staff recommended approval of the variance with conditions as outlined in the staff report. Carmen Berry, of the city attorney's office, advised that the legal documents entered into the record had no bearing on this hearing. This hearing involves public zoning issues while these documents relate to covenants which are private restrictions and should not be considered by the Board. In reply to a question from Board Member ECHELMEYER, Mike Pesicka explained that the owner of the property, Morton Silverman, gave power attorney to Jeff Petty to represent him at this hearing. He also explained that, in 1959, owners of the property conveyed 2100 square feet of the lot to be used for highway right-of-way. Jeff Petty Jeff Petty, the applicant, was sworn in by Chair MONTOYA. He stated the property was purchased as a duplex and possibly a triplex. The realtor, Jim Urban of i irhan Companies, presented the property as a duplex with the potential to be used as a triplex. He also stated that he is aware that the property may only be used as a duplex since it is zoned R-2. He submitted a letter he received from Michael C. Buttes, conservator of the estate for the wife of the builder. He read the letter into the record as follows: Please accept this letter as confirmation of our telephone conversation regarding the above property. As I indicated to you, as the Jefferson County Public Administrator, I am the court-appointed conservator for Cornelia D. Colden who may also have been previously known as Alma Dodson Colden as well as Alma Dodson. As part of my assistance to Cornelia, I marketed and sold her home at 4695 Wadsworth, Wheat Ridge, Colorado, to Ronald W. Rice on October 31, 2000. At the time of sale, the configuration of the home was as follows: The southern portion of the main floor consisted of two bedrooms, a bath, a kitchen and a living area. The northern portion of the main floor consisted of what I would call a studio area including kitchen facilities and bath area. The upper floor consisted of a third studio area consisting of a living area, kitchen facilities, bedroom area and 1 do not recall if a bathroom area is included. (Mr. Petty stated that there is an existing bathroom in the area.) I recall the basement of the property being an unfinished open space area. Mr. Petty inquired of me as to the length of time the Colden's owned the property and, although I cannot give you a complete answer, I do have a deed from Ms. Colden's husband dated May 11, 1972 to Cornelia Colden. It is my belief that the Colden's built the current structure on the property many years prior to that and that the 1972 deed was merely an infra family conveyance. I hop6 you find this information helpful. Mr. Petty stated that the main floor studio area is handicapped accessible. He stated that fifteen years ago, two different families lived there and as recently as three years ago. Presently, there is only one address. In the past two years, there has been a renter in the downstairs apartment and Ron Rice and his partner were living in the other side of the Board of Adjustment Page 04-25-02 R q :s property. The appraisal stated that the property was zoned R-2 and therefore, the third kitchen should be removed. Mr. Petty submitted the MLS information which stated the property was a two-family and possibly three-family income property as well as a copy of the purchase contract. He stated that he has invested approximately $60,000 in the property including $30,000 to renovate the inside of the house and he has plans to clean up the outside of the property. He further stated that a hardship exists if this property must be used as a single-family residence. He plans to use the main floor and the upstairs as separate living units. The upstairs unit has a separate outside entrance. He further stated that when Morton Silverman purchased the property, the question arose as to whether it was a legal nonconforming duplex. Chair MONTOYA asked to hear from those who signed the public hearing roster. Patricia Fisher 7609 West 47th Avenue Ms. Fisher was sworn in by Chair MONTOYA. She stated that when Mr. Rice bought the property, there was extensive remodeling during which time the separate entrance for the second floor was added. She stated that cars park on the lawn and often drive directly from the lawn onto Wadsworth. She urged the Board to deny the request for variance and require the owners to clean up the property. She stated that she has lived in the area for 37 years and was never aware of apartments being rented in the subject structure. Chair MONTOYA reminded Ms. Fisher that Carmen Berry had earlier informed the Board that the lawsuit Ms. Fisher referred to could not be considered in this case. He also informed Ms. Fisher that she should contact the city's code enforcement office in regard to the condition of the property. Tara McAden 7650 West 47th Avenue Ms. McAden was sworn in by Chair MONTOYA. She spoke in opposition to the variance. She expressed concern about cars parked on the property as well as a dumpster which obstructs the view for drivers exiting onto Wadsworth. She submitted a photo of the dumpster into the record. Jayne McAden 7650 West 47th Avenue Ms. McAden was sworn in by Chair MONTOYA. She stated that she bought her property in 1999 at which time the subject house was used as a single-family residence. She expressed concern about a lack of parking on the property if used as a multi-family unit. She objected to the lack of maintenance of the property. She further stated that she came before the Board of Adjustment for a variance to build a garage on a half-acre piece of property she purchased adjacent to her home and was told by the Board at that time Board of Adjustment Page 3 04-25-02 she could not build any other kind of structure on the half acre. Alan White clarified that this was a condition placed by the Board of Adjustment at the time the variance was granted. JoAnn Fisher 7645 West 47th Avenue Ms. Fisher was sworn in by Chair MONTOYA. She expressed opposition to the granting of the variance. She stated that the previous owner never rented to anyone. She felt it would be too dangerous for a handicapped person to use the entrance referred to earlier by Mr. Petty because of its proximity to Wadsworth. Chair MONTOYA clarified that the possible handicapped accessible entrance was not included in staffs evaluation of the request. Steve McAllen 7650 West 47th Avenue Mr. McAden was sworn in by Chair MONTOYA. He requested that the neighborhood be designated as a single- ami y neig or oo air ONTOYA reminded Mr. McAden that the area is zoned R-2. Mr. McAden expressed concern about additional traffic that would be generated by a multi-family unit in this location as well as lack of parking on the property. He became aware that part of the house was being rented a little over a year ago. Mark Fisher 7645 West 47th Avenue Mr. Fisher was sworn in by Chair MONTOYA. He spoke in opposition to the application. He does not want to see the property used as a duplex. Shawn Steigner 7640 West 47th Avenue Mr. Steigner was sworn in by Chair MONTOYA. He spoke in opposition to the application because it would have a negative effect on surrounding properties. Jeff Petty returned to the podium for rebuttal. He stated that a lot of the traffic around the house has been due to ongoing construction. He also commented that traffic from his property is rather insignificant when compared to traffic generated by the 300 homes in the area. The back portion of the property as well as the driveway can be used for parking and he clarified that the entrance he referred to as a possible handicapped entrance is not located next to Wadsworth. He stated that he was willing to comply with the conditions set forth in the staff report. He stated there is a multi-family use next door which sets a precedent for multi-family use in the area. His plan is to use the property as a duplex, beautify the property and be a good neighbor. Chair MONTOYA closed the public hearing. Kolden (who may have also been previously known as Alma Dodson Kolden, as well as Alma Dodson). As part ofmy assistance to Cornelia, I marketed and sold her home at 4695 Wadsworth Blvd., Wheat Ridge, Colorado, to Ronald W. Rice on October 31j , 2000. At the time of sale, the configuration of the home was as follows: a_ The southern portion of the main floor consisted of two bedrooms, a bath, a kitchen, and a living area- b. The northern portion of the main floor consisted of what I would call a studio area, including kitchen facilities, and possibly a bath area. C. The upper floor consisted of yet a third studio area, consisting of a separate living area, kitchen facilities, and I believe a bedroom area. I do not recall whether than area included a baft d. I recall the basement of the property being an unfinished, open--space area. Mr. Petty, you inquired of me as to the length of time that the Koldens owned the property- Although I cannot give jou a complete answer, I do have a Deed from Ms_ Kolden's husband (dated May 11 , 1972) to Cornelia Kolden. It is my belief that the Krddens built the current structure on the property many years prior to that, and that the 1972 Deed was merely an infra-family conveyance. REQUEST The property in question is located at 4695 Wadsworth Boulevard and is currently being used as a two- family residential property. The property is zoned Residential-Two (R-2)[ (Exhibit,, Z-onirrlvla and is 11,900 square feet in area (Exhibit2, Site Plan). A two-unit structure in the R-2 zone district requires a minimum lot size of 12,500 square feet. The property does meet the minimum requirements for lot width in the R-2 zone district. The applicant is requesting approval of a 600 square foot variance from the required 12,500 square foot minimum lot area in the R-2 zone district to allow the second dwelling unit. (Exhibit 3, Application; Exhibit 4, Deed). An administrative variance cannot be granted because the variance results in additional dwelling units. Staff was made aware of the duplex when a city Building Inspector noticed work being performed without a permit on the property in question and issued a stop work order for the property. Applicant then came in to fill out a building permit and the insufficient lot size was discovered. The property does not have a second address, and it is not known how long or if ever the property has been used as a duplex. There does appear to be two mailboxes, but staff contacted the Post Office and was told that only one delivery is made to this address. Staff contacted Wheat Ridge Water District and was informed that the property was originally serviced as a single-family home. Wheat Ridge Sanitation District was also contacted and informed staff that the property has one sewer service that was installed in 1952. The owner purchased the property on March 22, 2002 under the pretense that the property met all the requirements to allow a duplex. II. SITE PLAN The property in question is not unique in shape, has frontage on W. 47' Avenue to the north, and Wadsworth Boulevard to the east. The applicant is proposing to use the property in question as a duplex. The property is zoned R-2, but does not meet the minimum lot size requirement of 12,500 square feet for a duplex in the R-2 district. III. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance request: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the request is denied, the property may yield a reasonable return in service and income. The property can still be used as a single family residence. 2. If the variation were granted, would it alter the essential character of the locality? It could potentially alter the essential character. To the north and west are single-family homes. However, no complaints have been received by the city from adjacent property owners in respect to the subject property being utilized as a duplex. Proximity to Wadsworth of the existing structure does not serve as the most desirable location for a single-family residence. 3. Would the particular physical surrounding, shape or topographical condition of the specific property-involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The property in question has a typical rectangular shape and is relatively flat. The lot meets the minimum lot frontage requirements for a duplex in the R-2 zone district. The R-2 district requires a minimum of 100 feet of lot frontage. In addition, corner lots need a minimum lot width of 80 feet for both street frontages. 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The lot originally met all the minimum requirements for a duplex, but in 1959 the east 15 feet of the property was conveyed to the Colorado Department of Transportation by previous owners rendering the lot nonconforming for a duplex in the R-2 zone district. It is not known if the duplex existed in1959. If it had, the government action of acquiring the right-of-way would have created a legal non-conforming lot for a duplex. The current owner purchased the property presuming the lot met the minimum requirements. Early history of the structure is unknown, and the city does not have any building permit records to reflect a conversion of a single family home, or any additions to the house. 5. Would the granting of the variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? Granting of the variance would not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood. The current structure does not impair the adequate supply of light and air to adjacent properties, does not substantially increase the congestion in public streets, or increase the danger of fire or endanger the public safety. The property could possibly have an effect on property values in the area. 6. If criteria a through a are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The requested variance would result in an individual benefit for the property owner, and would not produce a benefit or contribution to the neighborhood or community. Approval of this request would not result in the reasonable accommodation of a person with disabilities. IV. STAFF CONCLUSIONS AND RECOMMENDATION Staff has concluded that the above criteria are supportive of the variance request. Therefore, staff recommends APPROVAL for the following reasons. 1. The hardship has not been created by the present owner. 2. The variance would not be detrimental to the public welfare or injurious to other properties. 3. The proposed additional unit would not impair the adequate supply of light and air to adjacent properties. 4. The proposed additional unit would not substantially increase the congestion in public streets, endanger the public safety, nor increase the danger of fire. With the following conditions: The curb cut off of Wadsworth Boulevard should be closed and access to the property shall be limited to W. 47`h Avenue. The 1959 deed provided by Jefferson County states that the dedication was for the "East 15 feet of Lot 29, Block 1, Hillcrest Heights a parcel containing (approximately) 2100 square feet." According to the original 1958 plat for Hillcrest Heights, the dimensions of Lot 29 were 140'x 100' (or 14,000 square feet). From these findings, I would conclude the following: 1.
