FOR THE FOLLOWING REASONS: The physical surroundings and topographical conditions of the area have created a hardship in that the apartment structure adjacent to this property, and sharing this property line, sits with only a 6-foot setback from this affected property line thereby not offering 3739 Chase the normal relief provided by normal setbacks. The apartment structure adjacent to this property and sharing this property line sits on a lot elevated considerably from 3739 Chase. 2. The request would not alter the essential character of the locality. Case No. WA-02-12: An application filed by Christopher Murray for approval of a 3-foot 9-inch fence height variance to the 6-foot maximum height allowed resulting in a 9-foot 9-inch high fence on property zoned Residential One B (R- 1B) and located at 3739 Chase Street. The case was presented by Mike Pesicka. He reviewed the staff report and entered all pertinent documents into the record. A digital presentation was given. Staff recommended approval of the application for reasons outlined in the staff report. Christopher Murray 3739 Chase Street Mr. Murray, the applicant, was sworn in by Chair MONTOYA. He explained that, if granted the variance, he plans to build a wooden fence in front of an existing concrete wall which varies in height. The purpose of the fence would be to provide privacy to his back yard which faces the back of an apartment building. He stated he plans to use metal poles to support a fence. The proposed fence would extend six-feet in height from the top of the concrete wall of the adjacent apartment building. Board member ECHELMEYER noted that this request would be in keeping with the rest of the neighbors who have used different means such as garages and tall fences to screen their property from the apartment complex. Case No. WA-02-14: An application filed by Burger King for (A) approval of a 6-foot setback variance from the required 10-foot setback for a freestanding sign, resulting in a 4-foot setback; (B) a request for a 2-foot setback variance from the required 5-foot setback for a second freestanding sign resulting in a 3-foot setback; and (C) a request for a 9-foot sign height variance from the maximum allowable 15-foot sign height resulting in a 24-foot high sign for property zoned Commercial One (C-1) and located at 3800 Wadsworth Boulevard. The case was presented by Travis Crane. He reviewed the staff report and entered all pertinent documents into the record. A digital presentation was given. Staff recommended approval of the application for reasons outlined in the staff report. Since the request is located in the urban renewal area, it was reviewed by the Wheat Ridge Urban Renewal Authority. Mr. Crane distributed copies of the review made by the Authority which found that the application should have negligible impact on the urban renewal area. Staff recommended approval of all three variance requests for reasons outlined in the staff report. Concern was expressed by members of the Board about the necessity to remove trees when the sign is moved. L REQUEST The property in question is located at 3739 Chase Street, and is currently a single-family residence. The property is zoned Residential-One B (R-1B). (Exhibit 1, Zoning Map). The applicant (owner), Christopher Murray (Exhibit 2, Deed), is requesting approval of a 3 foot9 inch fence height variance to the 6' maximum (Exhibit 3 Application). Pursuant to Section 26-603A "Generally, no divisional fence, wall or hedge above the height of forty-eight (48) inches shall be permitted within a minimum. required front yard, or above the height of six (6) feet in instances not otherwise specified. Applicant is proposing a 7.5-foot high fence post on the south end of the fence and a 10.5-foot high fence post on the north end (Exhibit 4, Applicant Letter). Pursuant to Section 26-603C "Support columns, poles or posts shall be permitted to be constructed up to one (1) foot higher than the permitted fence heights". II. SITE PLAN The applicant has submitted asite plan showing the location for the proposed fence (Rxhib*&j Site Plan). At approximately. 10,890 square feet the property exceeds the minimum lot area, requirement for a single-family home in the R-113 zone district. The property has lot frontage of 75 feet, which exceeds the minimum lot width requirement for a single-family home in the R-1B zone district. III. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance request: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the requests are denied, the property may still receive a reasonable return in use. The property is currently utilized as a single-family residence, and this use may continue. 2. If the variance were granted, would it alter the essential character of the locality? The variance would most likely not alter the essential character of the locality. The property that abuts the rear yard has a concrete pad that is raised approximately 2 to 4 feet above grade, and a four-foot chain link fence rests on top of the concrete pad. Applicant is requesting that his rear fence match the height of the concrete pad and chain link fence. The proposed fence would not alter the character of the locality since it will only match what already exists on an adjacent property. Board of Adjustment 2 Case no./Name 3. Does the particular physical surrounding, shape or topographical condition of the specific property" involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The lot does not have a unique shape, and is rectangular in shape. At approximately 10,890 square feet, the lot exceeds the minimum lot size requirement in the R-113 zone district. The property does slope from south to north. This has created a need for the fence to increase in height moving from south to north so it will be level. 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The applicant has not created a self-imposed hardship. The existing concrete pad and fence - that abut the applicant's rear yard have created a unique condition; the entire property has been built above the natural existing grade of the area. The applicant's house was built in 1952 and has remained unchanged. The apartment complex to the west was built in 1985, and on a higher grade than the surrounding area. The result is the apartment complex sits three to four feet above the applicant's property. The rear yard setback for the apartment building is approximately 9 feet off of the property line. 5. Would the granting of the variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? The requests would not be detrimental to the public welfare or injurious to other properties in the area. The adequate supply of light and air would not be compromised as a result of these requests. The requests would not increase congestion in the streets, nor increase the danger of fire. The requests would most likely not have an effect on property values in the neighborhood. 6. If criteria 1 through 5 are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The requests would not result in a contribution or benefit to the neighborhood, and would merely be a convenience for the property owners. The requests would not result in a reasonable accommodation of a person with disabilities. Board of Adjustment Case no./Name IV. STAFF CONCLUSIONS AND RECOMMENDATIONS Upon review of the above requests, staff concludes that the above criteria are supportive of the variance requests. Staff has found that there are unique circumstances attributed to these requests that would warrant approval of a variance. Therefore, staff recommends APPROVAL for the following reasons: 1. The physical surrounding and topographical conditions of the area have created hardship. 2. Request would not alter the essential character of the locality.. 3. Request would not be detrimental to the public welfare. With the following conditions: 1 Limit the fence to `a maximum height of 9 feet 9 inches. 2. A chain link fence will not be permitted.
