Board Member HOVLAND offered a friendly amendment to add another condition as follows: 3. The fence and gates must be in compliance with sight distance triangles. This amendment was accepted by Board Members SCHULZ and BLAIR. Chair HOWARD stated he would vote against the motion because no hardship had been demonstrated. The applicant could build a 6-foot fence with a 30-foot setback without need for a variance. Chair DRDA reminded those present that a super majority vote of six affirmative votes was required for passage of the motion. The motion failed 5-3 with Board Members DRDA, HOWARD and ROLLINS voting no. Chair DRDA advised the applicant that his request was denied. L'AXAF C. Case No. WA-03-07: An application filed by A-I Pattern for approval of an increase of non-living landscaping, not to exceed 50%, as described in Section 26- 502 (Landscape Requirements) for property zoned Industrial and located at 4860 Van Gordon Street. The case was presented by Travis Crane. He entered all pertinent documents into the record and advised the Board there was jurisdiction to hear the case. He reviewed the staff report and digital presentation. Staff recommended approval of the application for reasons outlined in the staff report. Meredith Reckert informed the Board that the City of Wheat Ridge as well as several other Colorado municipalities is currently reviewing landscaping regulations in light of the drought and also in a long-term effort to conserve water. Consideration is being given to doubling the allowed amount of non-living landscaping. Steven Aberle 4860 Van Gordon Street Mr. Aberle, the applicant, was sworn in by Chair DRDA. He stated that his request is based upon futuristic, realistic landscaping to cut back on irrigated surfaces. His Board of Adjustment Page 6 03/27/03 company does work for the Denver Water Board and DWB directors have indicated they will be asking cities to cut back on irrigated surfaces by fifty percent over the next five years. He explained that vegetation will eventually cover eighty or ninety percent of the rock used in the hardscaping. This vegetation is, for the most part, native to the area, requires little water and grows to a height of only two to three feet. In response to a question from Board Member HOWARD, Mr. Aberle stated that the islands in the parking lot would be filled with junipers, mulch and wildflowers. Board Member ROLLINS commended the applicant for taking this proactive step in water conservation. The Board also expressed a desire to spend more time with the city attorney in a question/answer session in the near future. 7. NEW BUSINESS A. Approval of minutes - It was moved by Board Member HOWARD and seconded by Board Member HOVLAND to approve the minutes of February 27, 2003 as presented. The motion passed unanimously. 8. I. REQUEST The property in question is located at 4860 Van Gordon Street, and is currently an office/warehouse facility. The property is zoned Industrial (Exhibit 1, Zoning Map). The applicant and owner, Steve Aberle, is requesting a variance to increase the amount of non-living landscaping on the subject property (Exhibit 2, Letter of Request). The building has been constructed and a certificate of occupancy was issued late last year. Upon completion of the building, the owner supplied the City with a landscape escrow that allowed occupancy without the completion of landscaping. All of the tree and shrub quantities shown on the site plan have been installed. The ground cover was not installed due to winter weather conditions. The owner has since reevaluated the amount of sod proposed for this property, in light of the drought conditions. H. SITE PLAN The applicant is requesting an increase to the amount of non-living landscaping on the property. The Code of Laws states that a maximum of twenty percent of the total landscaped area may be non-living landscaping, such as bark or rock. The applicant wishes to increase the amount of non-living landscaping to a total of 36% of the landscaped area (Exhibit 3, Site Plan). In no instance can the Board of Adjustment approve an increase to non-living landscaping to more than fifty percent of the total landscaped area. The existing building was reviewed and constructed under the previous Code of Laws and is approximately 28,800 square feet in size. The previous Code of Laws stated that a minimum of 10% of the lot be landscaped. The site plan details over 13% of the lot to be landscaped, a total of 8,535 square feet of landscaped area. Of this, 3,068 square feet is proposed to be rock area. All of the required street tree and additional tree and shrub quantities have been met, and have been installed. The previous Code stated that one street tree must be planted for every 30 feet of street frontage. This lot has 195 feet of street frontage adjacent to Van Gordon Street. Given this standard, seven street trees would be required. The property meets this requirement. In addition to the required street trees, a total of one tree or shrub is required for every 1,000 square feet of lot area. Given a lot size of 64,350 square feet, 65 additional trees and/or shrubs would be required. The site plan details a total of 109 total trees and shrubs. Both the required street tree count and additional tree and shrub quantities have been met, as defined by the previous Code of Laws. III. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance request: Board of Adjustment WA-03-07/Aberle 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the request is denied, the property may still receive a reasonable return in use. The property is currently utilized as an office warehouse, and this use may continue, regardless of the outcome of the variance request. 2. If the variance were granted, would it alter the essential character of the locality? If the variance were granted, the character of the locality would not be altered. Most of the surrounding properties have, at most, ten percent of the lot landscaped. Some of the surrounding properties have little if any landscaping. The applicant has designed an attractive alternative to high-water consumption ground cover, and the proposed plan exceeds every other landscaping standard in respect to quantities and area. 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The lot does not have a unique shape. It is a rectangular shaped lot, and is relatively flat. The shape of the lot is irrelevant to this request. 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The applicant wishes to increase the non-living landscaped area on the lot to help mitigate the effects of the current drought. While the applicant has not created the drought, this request would reduce short and long term costs of landscaping maintenance, thereby saving the applicant money. 5. Would the granting of the variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? The request would not be detrimental to the public welfare or injurious to other properties in the area. The adequate supply of light and air would not be compromised as a result of the request. The request would not increase congestion in the streets, nor increase the danger of fire. The request would most likely not have an effect on property values in the neighborhood. If criteria 1 through 5 are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The request would not result in a contribution or benefit to the neighborhood, and would merely be a convenience for the property owners. The request could result in reduced outdoor water consumption, which in turn could be beneficial to the drought situation. The request would not result in a reasonable accommodation of a person with disabilities. IV. STAFF CONCLUSIONS AND RECOMMENDATIONS Upon review of the above request, staff concludes that the above criteria are supportive of the variance request. Staff has found that there are unique circumstances attributed to the request that would warrant approval of a variance. Therefore, staff recommends APPROVAL for the following reasons: 1. Approval of the request would not alter the essential character of the locality. 2. A person having interest in the property has not created the hardship. The applicant has taken a pro-active approach to reduce his outdoor watering. 3. Approval of this request would not be detrimental to the public welfare or injurious to other properties n the neighborhood. The purpose of applying for variance is to the reduce the amount of grass and to minimize the amount of water needed to keep such grass maintained. The landscaped area now is 41% rock and we feel this is a reasonable amount considering the rock area contains 75% vegetation. The request is to keep landscaped areas as they are due to the fact original landscape design was not properly engineered for the time and conditions. Landscaping at this site was re-engineered to the fact that watering of large grassy areas is becoming a thing of the past, due mainly in respect to the severe drought we are facing We feel we have generated an attractive landscaping environment around concrete building structures. We have planted all different sizes of trees ranging from 16 foot Ponderosa Pine to 3 foot Ponderosa Pine which generates a great deal of depth in the vegetation for an attractive look over a long period of time. It is our intent to engineer a minimal maintenance effect in our landscape design, which increases long term appeal. It is our opinion that over planting of vegetation soon becomes too crowded for an attractive setting under any circumstances. Being a landscape professional and landscaping for over 20 years, I believe there are several ways to achieve an attractive landscape by utilizing several types of vegetation and landscape materials, which could dramatically decrease the amount of watering on any site. This is what I tried to achieve in the landscaping design. I know this may be out of character for your criteria, however it is also aesthetically pleasing to the eye, and we all have to come up with ways to conserve water. Best regards, Steven C. Landscaping at this site was re-engineered to the fact that watering of large grassy areas is becoming a thing of the past, due mainly in respect to the severe drought we are facing We feel we have generated an attractive landscaping environment around concrete building structures. We have planted all different sizes of trees ranging from 16 foot Ponderosa Pine to 3 foot Ponderosa Pine which generates a great deal of depth in the vegetation for an attractive look over a long period of time. It is our intent to engineer a minimal maintenance effect in our landscape design, which increases long tern appeal. It is our opinion that over planting of vegetation soon becomes too crowded for an attractive setting under any circumstances. Being a landscape professional and landscaping for over 20 years, I believe there are several ways to achieve an attractive landscape by utilizing several types of vegetation and landscape materials, which could dramatically decrease the amount of watering on any site. This is what I tried to achieve in the landscaping design. I know this may be out of character for your criteria, however it is also aesthetically pleasing to the eye, and we all have to come up with ways to conserve water. Best regards, Steven C.
