The lot does not have a unique shape. It is relatively flat and rectangular shape. There are no unique topographical conditions that exist on the property that render any portion of the lot as unbuildable. 3. Granting of the request would appear to not result in a significant contribution or benefit to the general neighborhood. 4. There are no unique circumstances attributed to this request. Asst. DRAFT The following is the official set of Board of Adjustment minutes for the Public Hearing of April 24, 2003. A set of these minutes is retained both in the office of the City Clerk and in the Community Development Department of the City of Wheat Ridge. 3. PUBLIC FORUM There was no one signed up to speak. 4. PUBLIC HEARING A. Case No. WA-03-08: An application filed by Harold & Wilma Lamm for approval of a 3-foot side yard setback variance from the 5-foot side yard setback requirement resulting in a 2-foot side yard setback for property zoned Residential- One C (R-1C) and located at 3710 Marshall Street. The case was presented by Meredith Reckert. She entered all pertinent documents into the record and advised the Board there was jurisdiction to hear the case. She reviewed the staff report and digital presentation. Staff recommended denial of the application for reasons outlined in the staff report. Harold Lamm 3710 Marshall St. Mr. Lamm, the applicant, was sworn in by Chair DRDA. He stated the additional three Board of Adjustment Page 1 04/24/03 feet on the south would allow a straight drive into the garage and also prevent the necessity of having to remove two mature trees. He stated that his neighbor to the south at 3700 Marshall has written to the City indicating he is in favor of the application. He also stated that there are about thirteen homes in his neighborhood with garages in the rear of the property. In response to a question from Board Member ABBOTT, Ms. Reckert stated the other garages in the neighborhood, while built in the rear yard, do not encroach into the required setback. In response to a question from the Board, Mr. Lamm stated that the trees would be located about 4.5 feet from the proposed location for his driveway. In response to a question from Board Member ECHELMEYER, he stated that a smaller garage would not be feasible because he would like to have a work area in his garage. Allan Jorgensen 3725 Marshall St. Mr. Jorgensen, a neighbor of the applicant for the past five years, was sworn in by Chair DRDA. He spoke in favor of the application. He did not believe the supply of adequate light and air would be compromised if the application were approved. He also stated the Lamm's take very good care of their property and he was confident they would build an attractive quality structure. Ms. Reckert explained that staff is concerned about structures built so close to the property line that they produce a "canyon like" effect. Board Member HOVLAND stated that, even though the proposed structure would be of quality design and materials, he did not see a.unique aspect to the case which would justify a variance. Board Member ABBOTT agreed with the above statement and further stated that the applicant has the option of building a smaller two-car garage which would not require a variance. A vote was taken on the motion for denial. The motion passed 7-0 with commissioner ROLLINS absent. Chair DRDA advised the applicant that his request had been denied. 5. REQUEST The property in question is located at 3710 Marshall Street, and is currently used as a single-family residence. The property is zoned Residential-One C (R-1C) (Exhibit 1, ZoniirgMap). The applicant (owner), Harold Lamm, is requesting approval of a 3 foot side yard setback to the 5 foot side yard setback requirement in the R-1C zone district, resulting in a 2 foot side yard setback for the purpose of constructing a detached garage. (Exhibit 2; Letter ofRequest). Board of Adjustment WA-03-08/Lamm II. SITE PLAN The applicant has submitted a site plan showing the required setback of 5 feet, and the proposed setback of 2 feet. (Exhibit 3, Site Plan, Exhibit 4, Survey): Exhibit 4 shows an existing 5 foot utility easement that runs parallel to the southern property line. The proposed detached garage would encroach onto this easement by 3 feet. If the variance were approved, the applicant would need to submit letters of approval from Xcel Energy and Qwest Communications at the time of building permit. An existing shed has been relocated to a temporary location on the property and will be torn down when the garage is completed. Pursuant to Section 26-208(B) Development Standards, a single-family residence in the R- 1C zone district is allowed 400 square feet for a storage shed. The proposed garage is 24' by 24'. There is no other covered parking space on the property. It would appear that an altered single car garage was converted to living space prior to purchase by the owner. The lot in questions is rectangular in shape and relatively flat. At approximately 8,400 square feet the property exceeds the minimum requirement for a single-family home in the R-1C zone district. The property has 60 feet of lot frontage, which exceeds the minimum lot frontage requirement for a single-family home in the R-1 C zone district. If the detached garage is built, the property will not exceed the 40% maximum allowable building coverage in the R-1C zone district. M. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance request: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the request is denied, the property may still receive a reasonable return in use. The property is currently utilized as a single-family residence, and this use may continue on the property. 2. If the variance were granted, would it alter the essential character of the locality? If the garage is built, the essential character of the locality could be altered. No other properties in the area have detached garages in the rear yard, and this proposal places the detached garage only 2 feet from the property to the south. 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The lot does not have a unique shape. It is relatively flat and rectangular in shape. There are no unique topographical conditions that exist on the property that render any portion of the lot unbuildable. The house was constructed in 1956, and has remained relatively unchanged since that time. It appears that a single car garage was converted to living space at some time, but there are no building records to document this conversion. Board of Adjustment 2 WA-03-08/Lamm 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The applicant, who has sole interest in the property, has created a self-imposed hardship by proposing to build a structure that does not meet setbacks. The applicant has stated that two mature trees would need to be removed if the garage is located farther to the north. Currently, there is no garage space on the property. 5. Would the granting of the variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? The request would not be detrimental to the public welfare or injurious to other properties in the area. The adequate supply of light and air could be compromised as a result of the request because the garage will be placed only 2 feet from the property to the south. The request would not increase congestion in the streets, nor increase the danger of fire. The request would not have a negative effect on property values in the neighborhood. 6. If criteria 1 through 5 are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The request would not result in a contribution or benefit to the neighborhood, and would merely be a convenience for the property owners. The request would not result in a reasonable accommodation of a person with disabilities. IV. STAFF CONCLUSIONS AND RECOMMENDATIONS Upon review of the above request, staff concludes that the above criteria are not supportive of the variance request. Staff has found that there are not unique circumstances attributed to the request that would warrant approval of a variance. Therefore, staff recommends DENIAL for the following reasons: 1. The hardship was self-created by the property owner. 2. There are no unique circumstances attributed to this request. 3. The conditions involving the property do not result in a particular hardship upon the owner. 4. The adequate supply of light and air to adjacent properties could be compromised. 5. The variance will not result in the reasonable accommodation of a person with disabilities.
