Please be advised that at its meeting of May 22, 2003, the Board of Adjustment APPROVED your
request for approval of a 5-foot side yard setback variance from the 5-foot side yard setback
requirement resulting in a 0-foot side yard setback AND a 1-foot side yard setback from the 5-foot
side yard setback requirement resulting in a 4-foot side yard setback for property zoned Residential-
Two (R-2) and located at 4676 Upham Street for the following reasons:
1. Granting of the request would not alter the essential character of the locality.
2. The majority of the Board finds that a hardship occurs related to the intent of the
ordinance in that the lot is substandard to lot size and lot width requirements of the R-2
zone district.
3. The applicant is limited in alternative placements due to existing structural
improvements and mature landscaping.
4. The request will not impair adequate supply of light and air to neighboring properties.
5. Granting of the request will not increase congestion in the public streets nor increase
fire danger to adjacent properties.
6. Letters in favor of the proposed variance have been submitted by neighbors
immediately adjacent.
7. Although no precedent, in the legal sense of the word, has been established, according
to the city's land use atlas there have been other side yard setback variances granted in
the vicinity over the years.
8. The requested side yard setback of the storage structure will be an improvement from
the existing 2-foot setback of the existing storage structure.
Enclosed is a copy of the Certificate of Resolution, as well as a draft copy of the minutes, stating the
Board's decision which became effective the date of the meeting, May 22, 2003. This variance shall
automatically expire within one hundred eighty (180) days of the date it was granted, November 18,
2003, unless a building permit has been submitted.

The following is the official set of Board of Adjustment minutes for the Public Hearing of May
22, 2003. A set of these minutes is retained both in the office of the City Clerk and in the
Community Development Department of the City of Wheat Ridge.

4. PUBLIC HEARING
A. Case No. WA-03-10: An application filed by David and Marilyn Roll for
approval of a 5-foot side yard setback variance from the 5-foot side yard setback
requirement resulting in a 0-foot side yard setback AND a 1-foot side yard
setback from the 5-foot side yard setback requirement resulting in a 4-foot side
yard setback for property zoned Residential-Two (R-2) and located at 4676
Upham Street.
Prior to presentation of the case, Board Member HOWARD informed the board that the
applicants were his sister and brother-in-law and that he had not discussed the case with
them. He stated that he had no financial interest in the application. There was a

consensus of the Board that there was no conflict of interest and Board Member
HOWARD could hear the case.
The case was presented by Meredith Reckert. She entered all pertinent documents into
the record which were accepted by Chair DRDA. She advised the Board there was
jurisdiction to hear the case and reviewed the staff report and digital presentation. Staff
recommended approval of the application for reasons outlined in the staff report

Mr. Roll, the applicant, was sworn in by Chair DRDA. He stated that he would like to
replace his existing deteriorating storage shed which requires a variance for its location.
Chair DRDA asked if there were any individuals present who wished to address this case.
There was no response.
Upon a motion by Board Member ABBOTT and second by Board Member BLAIR,
the following resolution was stated:

Chair DRDA advised the applicant that his request had been approved. u "
B. Case No. WA-03-11: An application filed by Starbucks for approval of a partial
waiver of Section 26-501 (Parking Requirements) for property zoned
Commercial-One (C-1) and located at 3795 Kipling Street.
The case was presented by Travis Crane. He entered all pertinent documents into the
record which were accepted by Chair DRDA. He advised the Board there was
jurisdiction to hear the case and reviewed the staff report and digital presentation. Staff
recommended approval of the application for reasons outlined in the staff report. One
letter of objection from Elaine Gendron, 10005 West 34th Avenue, was received and
copies were included in the Board's packet material. He submitted copies of an e-mail
(dated May 21, 2003) sent to the Community Development Department from Ken Dahlin,
10045 West 34th Avenue indicating support of the application. This e-mail was reviewed
by the Board and made a part of the official record. He stated the owner of the Family
Thrift Store to the south of the applicant's location verbally indicated to staff that he was
opposed to the application.
In reply to a question from Board Member ABBOTT, Mr. Crane stated that the
handicapped access aisle could not be counted toward the total number of parking spaces.

JURISDICTION:

therefore, there is jurisdiction to hear this case.

I. REQUEST
The property in question is located at 4676 Upham and is currently utilized as a single-family residence.
The property is zoned Residential-Two. (Exhibit 1, Zoning Map).
The applicants (owners), David and Marilyn Roll, (Exhibit 2, Application), are requesting the following:
(request A): a five foot side yard setback variance from the required 5' side yard setback resulting in a 0'
setback on the north; and (request B): a 1' side yard setback variance to the required 5' side yard setback
resulting in a 4' setback on the south. Purpose of the variances is to allow construction of a shed in the
back yard. (Exhibit 3, Applicant's Explanation)
II. SITE PLAN
The property contains 8629 square feet with 72' of lot width; both of which are less than the
minimums of 9000 square feet of area with 75' of lot width required for an R-2 single-family lot.
Although the property is substandard in size, it is regular in shape except it has a 29' x 12' piece that
extends farther to the east. It is in this extension that the existing shed is located. The applicant
proposes the new shed in the same approximate location. (Exhibit 4, Site Plan).
The side yard setbacks for the house are nonconforming as the required combined side yard setback is
not 15', but 12'.
Extending from the house is a large deck, which has been built around a mature, black walnut tree. This
deck built in 1985, measures roughly 800 square feet (20' x 40'), and takes up much of the back yard. A
six-foot high fence runs along the north and south sides of the property. An 8' high fence runs along the
rear property line and the south boundary of the lot extension. A variance for the fence was granted
pursuant to Case No. WA-89-07. Alternate locations in the yard, which could accommodate a shed, are
landscaped.
The existing shed has a 0' setback on the north side, a 2' setback on the south and a 6' setback on the
rear. It measures 10'x 13'and has been in this location since the late 1960's. The owner has indicated
that the existing shed is no longer structurally maintainable. He has been bracing the roof with vertical
supports in the interior.
The proposed shed measures 8' x 16'. If the variances are granted, it will be placed with a 0' side setback
on the north and 4' side setback on the south. The shed will meet the required rear setback.
On the proposed site plan (Exhibit 4), the proposed shed location is superimposed over the existing shed.
The new shed is depicted by pink shading.
The current property owners have been living at this location since 1965. Letters of support have been
submitted from adjacent property owners of 4670 Upham, 4680 Upham and 4635 Teller Street (Exhibit
5, Letters). At the time of this writing, staff has received no other comments or objections.

III. VARIANCE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a variance request:
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district
in which it is located?
If the requests are denied, the property may still receive a reasonable return in use. The
property is currently utilized as a single-family residence, and this use may continue.
2. If the variance were granted, would it alter the essential character of the locality?
The proposed shed (128 sf) will be similar in size as the existing shed (130 sf) but with
somewhat different dimensions. It will be located in the approximate area as the existing
shed. The proposed setback on the south side will be larger than what currently exists.
Impact to the area, if any, would have occurred with the existing shed. The existing shed
with smaller setbacks (0' on the north and 2' on the south) can remain in perpetuity;
however, the property owner has indicated that it is dilapidated beyond repair.
According to the city's land use atlas, there have been other side yard setback variances
granted in the vicinity over the years.
3. Does the particular physical surrounding, shape or topographical condition of the
specific property involved result in a particular and unique hardship (upon the
owner) as distinguished from a mere inconvenience if the strict letter of the
regulations were carried out?
The property is smaller than the minimum requirements for a single-family lot in the R-2
zone district. There are few alternatives to placement of a new shed given house and
deck location and mature landscaping on the property.
4. Has the alleged difficulty or hardship been created by any person presently having
an interest in the property?
The applicant, who has sole interest in the property, has created a self-imposed hardship
by proposing a structure that does not meet the setback requirements for district. The
existing shed on the property is in the general location as the new shed.
5. Would the granting of the variance be detrimental to the public welfare or injurious
to other property or improvements in the neighborhood in which the property is
located, by, among other things, impairing the adequate supply of light and air to
adjacent property, substantially increasing the congestion in public streets or
increasing the danger of fire or endangering the public safety, or substantially
diminishing or impairing property values within the neighborhood?

The requests would not be detrimental to the public welfare or injurious to other
properties in the area. The adequate supply of light and air would not be compromised as
a result of the requests. The requests would not increase congestion in the streets, nor
increase the danger of fire. The requests would most likely not have an effect on property
values in the neighborhood. '
6. If criteria 1 through 5 are found, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or the community, as distinguished
from an individual benefit on the part of the applicant, or would granting of the
variance result in a reasonable accommodation of a person with disabilities?
The requests would not result in a contribution or benefit to the neighborhood, and would
be a convenience for the property owners. The requests would not result in a reasonable
accommodation of a person with disabilities.
IV. STAFF CONCLUSIONS AND RECOMMENDATIONS
Upon review of the above, staff concludes that the evaluation criteria are supportive of
the variance requests. Staff has found that there are unique circumstances attributed to
these requests that would warrant approval of the requested variances.
Therefore, staff recommends APPROVAL of Request A, a five foot side yard setback
variance from the required 5' side yard setback resulting in a 0' setback on the north, for
the following reasons:
1. Granting of the request would not alter the essential character of the locality.
2. There is a hardship as the lot is substandard to the lot size and lot width
requirements of the R-2 zone district.
3. The applicant is limited in alternative placements due to existing improvements
and mature landscaping.
4. The request will not impair the adequate supply of light and air.
5. Granting of the request will not increase congestion in the public streets, nor
increase danger of fire.
Staff also recommends APPROVAL of Request B, a F side yard setback variance to the
required 5' side yard setback resulting in a 4' setback on the south, for the following
reasons:
1. Granting of the request would not alter the essential character of the locality.
2. There is a hardship as the lot is substandard to the lot size and lot width
requirements of the R-2 zone district.
3. The applicant is limited in alternative placements due to existing improvements
and mature landscaping,
4. The request will not impair the adequate supply of light and air.
5. Granting of the request will not increase congestion in the public streets, nor increase
danger of fire.

LETTER OF REQUEST
My lot has a 29.12 ft. by 12 ft corner, which is fenced. It has a metal shed 10 ft. by 13 ft.
which is deteriorating and an eyesore. The metal shed is about 1 ft. from each side of the
fence and 6 ft. from the back to the fence.
I want to replace the 10 ft. by 13 ft. metal shed with a Tuff Shed Storage Building -
Ranch Style, which is 8 ft. wide by 16 ft. long by 8 ft. 7 in, high. The new shed will
house garden and yard and deck equipment only.
A variance is requested since the building can not meet the Minimum Side Yard Setback
of 5 feet.
The new shed will improve the looks and use of the property, replacing a shed which is
an eyesore. The place of the shed on the property makes good use of the property and is
basically out of sight by any neighbor. There is no other good place on the property to
place a storage shed.
