Please be advised that at its meeting of July 24, 2003, the Board of Adjustment APPROVED your request for
approval of a variance to Section 26-709 of the Wheat Ridge Code of Laws (Sign Code) to allow an increase
in the maximum sign area allowed to 216 square feet for a freestanding sign on property zoned Planned
Industrial Development (PID) and located at 10601 West 1-70 Frontage Road North for the following reasons:
1. If the variance were granted, the essential character of the neighborhood would not likely be
altered. The sign in question already exists, but the area the applicant is proposing to use
would result in a total sign area of 216 feet. It is currently a blank face that the applicant is
proposing for use in advertising.
2. The area surrounding the property is predominantly occupied by light industrial activities.
Most of the surrounding businesses have signs of similar size and height. The previous
tenant, Volant Ski's, used the entire sign as it exists today prior to their closing.
3. The request would not be detrimental to the public welfare or injurious to other properties in
the area. The request would most likely not have a detrimental effect on property values in
the neighborhood.
4. Arguably, a hardship has occurred due to lack of notice of code changes affecting the existing
sign to the building's owner.
With the following conditions:
The existing freestanding signage may not be extended above the existing height into the
allowable 50-foot height.
The variance shall be applicable to the current applicant or their corporate successors only
and shall not "run with the property."

decision which became effective the date of the meeting, July 24, 2003. This variance shall automatically

For the following reasons:
1. The two-story addition directly abuts closely only a few feet of the existing
dwelling on the property immediately adjoining on the south.
2. The architect has made an effort to design an addition which is compatible
aesthetically with the existing structure and is compatible with the existing
neighborhood.
3. Structural considerations within the existing foundation prohibit the addition
of a second story to the existing foundation.
4. The second story addition will be minimally visible from the street as it
occurs primarily in the core of the structure. The proposed wood siding on
the first floor would not be significantly visible from the street view.
5. Testimony was given by some adjacent neighbors in favor of the variance.
6. Staff recommended approval of the variance.
The motion passed 7-1 with Board Member DRDA voting no.
Chair DRDA advised the applicants that their request for variance was approved.
C. Case No. WA-03-16: An application filed by ARC Wireless Solutions for
approval of a variance to Section 26-709 of the Wheat Ridge Code of Laws (Sign
Code) to allow an increase to the maximum sign area allowed for a freestanding
sign on property zoned Planned Industrial Development (PID) and located at
10601 West I-70 Frontage Road North.
This case was presented by Mike Pesicka. He entered all pertinent documents into the
record which were accepted by Chair DRDA. He advised the Board there was
jurisdiction to hear the case and reviewed the staff report and digital presentation. Staff
recommended denial of the case for reasons outlined in the staff report.
In response to a question from Chair DRDA, Mr. Pesicka stated that if the variance were
denied, the lower portion of the sign would have to be removed.
In response to a question from Board Member HOWARD, Mr. Pesicka stated that the
present sign is 216 square feet and 173 square feet is allowed under the code.
Board Member ABBOTT asked if the code would allow the subject sign to be raised to
50 feet in height. Mr. Pesicka explained that while the previous business was limited to
having a sign 32.5 feet in height, the present business could legally raise the height of the
sign to 50 feet.
Board Member PETERSON commented that the applicant would have had no way of
knowing the sign code had changed and that the existing sign was not in compliance.

In response to a question from Board Member HOWARD, Mr. Pesicka stated that no
complaints regarding the existing sign have been received by the city.

Mr. Anderson, manager of administration for ARC Wireless Communications, was sworn
in by Chair DRDA. He stated that his company signed a seven-year lease on the
building. His company has been located in Wheat Ridge for eight years, just recently
moving to the subject location in order to consolidate office, manufacturing and
warehouse areas. His company manufactures antennas to support the wireless industry
and has had very little retail sales. The company has recently acquired three additional
companies, and this site will allow greater exposure for growth to expand into other
areas. Therefore, the sign is important to the company. He also stated that his company
is mainly interested in using the illuminated portion of the sign. The owner of the
building assured Mr. Anderson that they were unaware of the sign code change.
In answer to a question from Board Member ABBOTT, Mr. Anderson stated that the
building owner has given his company limited power of attorney regarding the sign.
Board Member PETERSON inquired about retail sales. Mr. Anderson stated that a small
amount of retail is done at the site and the company would like to do more in the future;
however, there are no concrete plans for additional retail at this time. Board Member
PETERSON suggested trimming portions of the sign panels to come into compliance
with the code.
There were no other individuals present who wished to address this matter.
Board Member ECHELMEYER stated that he felt there was a hardship because the
company signed a seven-year lease for a building that offered a prominent sign for a
business they are trying to expand.
Board Member BLAIR agreed with Board Member ECHELMEYER and commented that
there are many signs along the I-70 corridor.
Board Member PETERSON stated he did not believe the situation presented a self-
imposed hardship and would favor approval of the application without conditions.
Upon a motion by Board Member ABBOTT and second by Board Member
SCHULZ, the following resolution was stated:
Whereas, the applicant was denied permission by an administrative officer; and

The motion died for lack of a second.
A vote was taken on the Board Member ABBOTT'S motion which passed 8-0.
L-, Chair DRDA advised the applicant that his request for variance was approved.
5. CLOSE THE PUBLIC HEARING
Chair DRDA closed the public hearing.
6. OLD BUSINESS
Non-operative Vehicles - In response to questions from the Board, Mr. Pesicka stated
that, in the future, all requests for additional non-operative vehicles above the number
allowed by code will come before the Board. Each additional non-operative vehicle will
require a separate application.
NEW BUSINESS
It was moved by Board Member HOWARD and seconded by Board Member
BLAIR to approve the minutes of June 26, 2003. The motion passed unanimously.
8. ADJOURNMENT
It was moved by Board Member HOWARD and seconded by Board Member
BLAIR to adjourn the meeting at 9:45 p.m.

The property is within the City of Wheat Ridge, and all notification and posting requirements have been met,
therefore, there is jurisdiction to hear this case.

I. REQUEST
The property in question is located at 10601 W. I-70 Frontage Road North, and is currently used for office/
warehouse purposes. The property is zoned Planned Industrial Development (PID)(Exhil3tt 1, Zoning Maps.
The applicant, ARC Wireless Solutions, is requesting approval of a variance to Section 26-709 of the Wheat
Ridge Code of Laws (Sign Code) to allow an increase to the maximum sign area allowed for a freestanding sign
in the Commercial-One zone district-Mobif2 Letter;ofReques .
The total freestanding sign area that presently exists is 216 square feet. The present building was constructed in
1977; at that time the sign code allowed for a bonus of 1'/2 times the allowable area for a freestanding sign if your
business was located within mile of an interstate highway. Under the current Code of Laws there is no square
footage bonus for proximity to an interstate highway. The total allowable square footage for this property is 173
square feet. In 1995, variances for sign setback and height were approved for this location.
Volant Skis had occupied the building previously, but the building has been vacant for longer than 60 days.
Pursuant to Section 26-707(A)(2) "In the event the use of a nonconforming sign is discontinued for a period of
sixty (60) consecutive days, the nonconforming sign shall thereafter conform to the provisions of the zoning
district in which it is located or be removed. For the purpose of this section, the term "discontinued" shall apply
to uses which customarily operate on a continuous basis versus a seasonal basis. Seasonal uses shall be subject to
a twelve-month period of nonuse prior to requiring full compliance with these regulations."
If the applicant is not granted the variance, the portion of the existing sign that is now being used is in compliance
for square footage, but not for setback. However, as stated above, the property was granted a setback variance in
1995.
The applicant also advertises on a large wall sign that is in compliance with the Code of Laws.
II. SITE PLAN
The applicant has submitted a site plan showing the location of the existing freestanding sign (Exliibzt;3,
Site Plan). The sign does not meet setback standards for the zone district, but a variance for setback was
approved in 1995.
The property has frontage along I-70 Frontage Road North, and is within a quarter mile of Interstate 70 to
the south. Pursuant to Section 26-709D.1. Retail and service businesses that are located within one
quarter mile of an interstate highway are permitted one freestanding sign up to 50 feet in height. The
existing freestanding sign is 32.5 feet in height (Exhibif 4 PI}oto,Sirrulatton).
III. VARIANCE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a variance request:
Can the property in question yield a reasonable return in use, service or income if permitted
to be used only under the conditions allowed by regulation for the district in which it is
located?

If the request is denied, the property may still receive a reasonable return in use. The property is
currently utilized as office/warehouse, and this use may continue. Presently, this location is not
used for retail sales. The primary function of the business at this particular location is
manufacturing of cell phone accessories.
2. If the variance were granted, would it alter the essential character of the locality?
If the variance were granted the essential character would likely not be altered. The sign in
question already exists, but the area that the applicant is proposing to use would result in a total sign
area of 216 square feet. It is currently a blank face that the applicant is proposing to use for
advertising. The area surrounding the property is predominantly occupied by light industrial
activities. Most of the surrounding businesses have signs of similar size and height.
The previous tenant, Volant Skis, used the entire freestanding sign prior to their closing.
3. Does the particular physical surrounding, shape or topographical condition of the specific
property involved result in a particular and unique hardship (upon the owner) as
distinguished from a mere inconvenience if the strict letter of the regulations were carried
out?
The lot does not have a unique condition. It is rectangular in shape and relatively flat. A 15 foot
sewer easement for Clear Creek Valley Sanitation District runs parallel to the southern property
line.
4. Has the alleged difficulty or hardship been created by any person presently having an interest
in the property?
The applicant, who has sole interest in the property, has created a self-imposed hardship by
proposing to build a sign that exceeds the maximum allowed for a freestanding sign. The applicant
is utilizing the existing freestanding sign for advertising purposes. The applicant indicated that they
bought the property with the understanding that the remaining square footage of the freestanding
sign could be used as it was before, and were unaware of the new restrictions.
5. Would the granting of the variance be detrimental to the public welfare or injurious to other
property or improvements in the neighborhood in which the property is located, by, among
other things, impairing the adequate supply of light and air to adjacent property, substantially
increasing the congestion in public streets or increasing the danger of fire or endangering the
public safety, or substantially diminishing or impairing property values within the
neighborhood?
The requests would not be detrimental to the public welfare or injurious to other properties in the
area. The adequate supply of light and air would not be compromised as a result of these requests.
The requests would not increase congestion in the streets, nor increase the danger of fire. The
requests would most likely not have an effect on property values in the neighborhood.
6. If criteria 1 through 5 are found, then, would the granting of the variance result in a benefit or
contribution to the neighborhood or the community, as distinguished from an individual
benefit on the part of the applicant, or would granting of the variance result in a reasonable
accommodation of a person with disabilities?

The request would not result in a contribution or benefit to the neighborhood, and would merely be
a convenience for the property owner. The request would not result in a reasonable accommodation
of a person with disabilities.
IV. STAFF CONCLUSIONS AND RECOMMENDATIONS
Upon review of the above request, staff concludes that the above criteria are not supportive of the
variance request. Staff has found that there are no unique circumstances attributed to this request that
would warrant approval of a variance. Therefore, staff recommends DENIAL for the following reasons:
1. If the request is denied, the property may still yield a reasonable return in use and
income.
2. The applicant has created a self-imposed hardship.
3. The request will not result in the reasonable accommodation of a person with disabilities.
4. Adequate signage already exists for the property.

Dear Travis,
ARC Wireless Solutions, Inc. is a publicly traded company founded in 1989 and since
1995 has operated its manufacturing division in Wheat Ridge. This week we moved to
the above-referenced address which is a significantly larger and better facility for our
current and fixture needs. We have acquired three business entities since 2000 and remain
committed to growing our business in several ways, one of which is to try to expand our
retail product line. While we will continue to make antennas for certain well-known
companies on an OEM basis, we also have recently introduced a consumer antenna called
the Freedom Antenna'M which we believe has great promise.
As the result of our search for new quarters, we narrowed our options to two sites, one
site was in the Coors Technology Park and the other was the former Volant Ski site. We
choose the latter for a few reasons, one of which was having the opportunity for the first
time to have very good signage to help market products that will appeal to large segments
of the consumer marketplace. We committed to the property with the expectation of
being able to use the existing sign tower, which we subsequently discovered was out of
code.
We respectfully request that the Board approve a variance to the current code by allowing
us to use the existing sign tower, the effective use of which we believe will help generate
retail sales income from the sales of new consumer products, such as our Freedom
Antenna'rm

BOARD OF ADJUSTMENT on July 24, 2003, at 7:30 p.m. in the Council Chambers of the
