As you know, your client received a variance for the construction of the sunroom at the August 28, 2003, Board of Adjustment meeting. The following were conditions of approval attached to the variance for Ms. Orcholoski: 1. The proposed sunroom shall be constructed out of materials that remain in character with surrounding properties. 2. The addition shall be limited to the dimensions shown (10'x 15'). 3. There be a foundation addition or trim to make every effort to make the addition consistent with the style of the house. Although not specifically addressed in the minutes, the design shown by the representative from your company was substantially different than what was submitted for the building permit application. I believe that the Board of Adjustment was more inclined to grant the variance based on the photographs shown by your company's representative. All of the example photographs shown included a two- three foot high stem or cripple wall on which the windows were placed integrating the sunporches into the design of the existing structure. We still believe this design allows some architectural consistency as it matches the footer treatment on the existing house. These photographs, which were entered into the record at the public hearing, are available for your inspection in our office. Please discuss this issue with your client. To deviate from the conditions of approval would require a revised application to the Board of Adjustment. If you have any additional questions, do not hesitate to contact me at 303-235-2848. Case No. WA-03-17: An application filed by Jan ina Orcholski for approval of a r 10-foot front yard setback variance from the 30-foot front yard setback requirement resulting in a 20-foot front yard setback for property zoned Residential-One B (R-113) and located at 10595 West 38ffi Place. This case was presented by Mike Pesicka. He entered all pertinent documents into the record which were accepted by Vice Chair HOVLAND. He advised the Board there was jurisdiction to hear the case and reviewed the staff report and digital presentation. Staff recommended approval of the case for reasons outlined in the staff report. Board Member ECHELMEYER stated that he recalled this case was presented to the Board five or six years ago. Mr. Pesicka stated that a thorough check of records indicated that this is the first such request for this property. Vice Chair HOVLAND stated that he recalled a similar case in this neighborhood. Vice Chair HOVLAND asked to hear from the applicant. Adam Orcholski Mr. Orcholski appeared on behalf of his mother, Janina Orcholski (the applicant) because she does not speak English. He was sworn in by Vice Chair HOVLAND. Roger Weis Champion Contractors Mr. Weis, representing the contractor, was sworn in by Vice Chair HOVLAND. He stated that he had nothing to add to Mr. Pesicka's presentation. He submitted photos of sunrooms similar to the one planned to be built for Ms. Orcholski. In response to a question from Board Member ECHELMEYER, Mr. Orcholski stated that his mother has lived in the present location for the past ten years. He further stated that this is the only application for a variance that his mother has submitted to the city. In response to a question from Board Member BLAIR, Mr. Weis stated that the proposed addition would absorb the present entryway. Board of Adjustment Page 2 08/28/03 T Board Member ABBOTT asked the reason for requesting a sunroom rather than a regular room. Mr. Weis explained that the proposed addition would be a prefabricated sunroom. Board Member SCHULZ asked if the room would be used primarily during the summer. Mr. Weis replied that the applicant could use the room year-around because full-code electric is planned to be installed which would allow the applicant to install electric baseboard heating. In response to a question from Board Member ABBOTT, Mr. Pesicka stated that there is nothing unique to Wheat Ridge in the requirements for a sunroom addition other than that the structure would have to pass city building code inspections. Further, there will be no gable on the roof of the addition. In response to a question from Board Member HOVLAND, Mr. Weis stated the roof would be fabricated from 4-inch foam sandwiched between heavy gauge aluminum. Panels would be three feet wide with heavy duty aluminum I-beams installed every three feet. Board Member HOVLAND commented that he found it difficult to find a hardship in this case even in light of the house being located on a comer lot. Board Member BLAIR commented that there did not seem to be an alternative location for this addition and it would not be inappropriate to the neighborhood. Board Member ECHELMEYER commented that he didn't believe the addition would present a conflict for the neighborhood. There are six houses in the neighborhood with similar additions. CLOSE THE PUBLIC HEARING Chair DRDA closed the public hearing. 6. OLD BUSINESS There was no old business to come before the Board. Board of Adjustment WA-03-17/Orcholski The applicant/owner (Exhibit 2 Deed) is requesting approval of a 10 foot front yard setback variance from the 30 foot front yard setback requirement resulting in a 20 foot front yard setback for the purpose of constructing an attached sumoom (Exhibit 3, Letter of Request, Exhibit 4~ A~ghcarion); 11. SITE PLAN The applicant has submitted a site plan showing the location of the proposed sunroom and the existing single family residence (Exhibit 5 Site Plan). The proposed sunroom is 15 feet by 10 feet (150 square feet in area) and is to be built in the front yard setback. If approved, the addition of the sunroom will not result in the property exceeding the maximum building coverage of 40% in the R-113 zone district. The applicant has also submitted a survey showing the dimensions of the subject property. (Exhibit 6; Survey). The lot in question is rectangular in shape and relatively flat. At approximately 7,603 square feet, the property exceeds the minimum requirement of 7,500 for a single family home in the R-1B zone district. The property has frontage on W. 38`h Place as well as Nelson Street. The minimum lot width requirement for a comer lot in the R-1B zone district is 80 feet per street frontage. The property is only 64 wide along Nelson Street, which does not meet the 80 foot minimum requirement. However, pursuant to Section 26-120B "In any district in which single-family dwellings are permitted, a single-family residence and customary accessory buildings may be erected on any single lot of record, provided that the lot is in separate ownership and not of continuous frontage with other lots under the same ownership. This provision shall apply even thought the lot fails to meet the requirements of the district in which it is located for area, width, or both; provided, however, that the requirements of the district for minimum yard dimensions and lot coverage shall be met." III. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance request: Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the request is denied, the property may still receive a reasonable return in use. The property is currently utilized as a single-family residence, and this use may continue. 2. If the variance were granted, would it alter the essential character of the locality? Granting the variance may alter the character of the locality since there are no other properties in the immediate vicinity which have additions to the front of the house. A view down either Nelson Street or W. 38 h Place will reveal that the majority of the homes have the typical 30 foot front yard setback. Board of Adjustment WA-03-17/Orcholski 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The property is rectangular in shape and relatively flat. Due to the fact that the property is a corner lot, the setback from both Nelson Street and W. 38`h Place is 30 feet. Approximately 4,681 square feet (62%) of the lot is for required setbacks from public right-of-way. This setback requirement leaves little area on the lot for any type of expansion without the need for a variance. The structure was built at 31 foot setbacks, which leaves no room to expand adjacent to the main living space. 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The applicant, who has sole interest in the property, has created a hardship by proposing to build a structure that does not meet setbacks. There is adequate room on the east side of the existing house to place the sunroom, but the applicant's letter of request states that the garage area is an undesirable location for the proposed improvement. 5. Would the granting of the variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? The requests would not be detrimental to the public welfare or injurious to other properties in the area. The adequate supply of light and air would not be compromised as a result of these requests. The requests would not increase congestion in the streets, nor increase the danger of fire. The requests would most likely not have an effect on property values in the neighborhood. The proposed sunroom could have a negative affect on the overall consistency of the neighborhood in regards to buildings in the front yard setback. 6. If criteria 1 through 5 are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The request would not result in a contribution or benefit to the neighborhood, and would merely be a convenience for the property owner. STAFF CONCLUSIONS AND RECOMMENDATIONS Upon review of the above request, staff concludes that the above criteria are supportive of the variance request. Staff has found that there are unique circumstances attributed to the request that would warrant approval of a variance. Therefore, staff recommends APPROVAL for the following reasons: There is not a viable alternative location for the sunroom. 2. The proposed sunroom will not increase congestion in public streets. 3. The adequate supply of light and air will not be compromised. 4. Approximately 62% of the property is used for setbacks from public ROW. With the following conditions: 1. The proposed sunroom shall be constructed out of materials that remain in character with surrounding properties. 2. The addition shall be limited to the dimensions shown (10'x 15').
