SUBJECT: Daughenbaugh Letter of Credit
Dear Meredith,
This memo is to inform you that the Letter of Credit in the amount of $13,778.00 for the Daughenbaugh
development located at 4240 Kipling will expire on November 1, 2003.
I spoke with Greg Sinn, CDOT Permit Coordinator/Inspector, who is the CDOT inspector assigned to this
development and he stated he has not accepted the public improvement work along the Kipling Street
frontage due to fact that the developer has not completed the work behind the curb and gutter (e.g., the
sidewalk) that lies within the CDOT Right-of-Way.
The developer needs to be made aware of the pending expiration of the current Letter of Credit, and have
their bank re-issue a new LOC extending the expiration date. The new expiration date for the LOC extension
depends upon the amount of work remaining to be completed (typically 1-year).
Upon completion of the work, the developer needs to request a "Letter of Completion" from CDOT, and
forward a copy of the letter to the City. Upon receipt of the Letter of Completion, the original (extension)
Letter of Credit will be released. A new Letter of Credit shall be provided at that time by the developer for
the required 2-year Warranty Period. The Warranty Period will commence on the day of acceptance by
CDOT, and expire on the 2"d anniversary of that date.

Case No. WA-03-18 is an application by Janet Daughenbaugh requesting approval of a
determination of similar uses within the Janet D. Minor Subdivision, Filing No. 2 Planned
Commercial Development located at 4240 Kipling Street. The proposed uses under consideration
are massage therapy offices and fitness gyms.
Pursuant to Section 26-307 of the Zoning and Development Code, the Community Development
Director has the ability to decide upon and allow uses not specifically listed as permitted uses in a
planned development district, without requirement for a public hearing, provided the following
conditions are met:
1. A completed application package has been submitted and fee paid.
2. The Community Development Department has notified adjacent property owners by
letter notice and the site has been posted for at least ten (10) days.
3. No written objections have been received in such ten-day period.
4. The Community Development Director concludes that the criteria for approval, as set
forth below, are substantially complied with and support the request.
FINDINGS OF FACT:
1. The proposed additional uses will be compatible in character and impact with permitted uses
in the planned development.
2. The proposed additional uses will be consistent with the intent of the planned development.
3. The proposed additional uses will not create impacts of odor, dust, fumes, gas, noise,
radiation, heat, glare, vibration, traffic generation, parking needs, and outdoor storage.
4. The proposed additional uses will not be hazardous to the health and safety due to fire danger
or explosion.
5. The property was posted the minimum required 10 days.
6. Adjacent property owners were notified by certified mail.
7. No written objections were received.
This request for an administrative determination of similar use meets all applicable conditions as
required by Section 26-307 of the City of Wheat Ridge Code of Laws.
Therefore, Case No. WA-03-18 is hereby APPROVED with the following conditions:
1. The additional permitted uses are massage therapy offices and fitness gyms.
2. The use of the property shall remain in compliance with the recorded PCD final
development plan.
3. The additional uses shall be recorded as an affidavit of amendment to the Janet D. Minor
Subdivision, Filing No. 2 Planned Commercial Development outline and final
development plans.
