REGARDING ROOF VENTILATION: Roof ventilation shall comply with IBC Sec. 1203.2 or IRC Sec. R806. The installation of ridge venting requires the installation or existence of soffit venting. For calculation purposes, one hat or turtle vent equal to one-half of one square foot of opening. Effective December 1, 2014, asphalt shingle installations require an approved midroof inspection, conducted when 25-75 percent of the roof covering is installed, prior to final approval. Installation of roof sheathing (new or overlay) is required on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and mid -roofs may be called in at the same time, one hundred percent of the sheathing must be complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave and secured in place is required to be provided for all roof inspections. Roof ventilation is required to comply with applicable codes and/or manufacturer installation instructions, whichever is more stringent. The manner in which the property is to be divided and the intentions of the parties relating to the division of the disputed property has not been agreed upon, despite the Stipulations. The intentions and understandings of the parties appear to differ. 4. Karsten deeded the real property described in Exhibit 2, again specifically excluding the Strip of Land, to Daniel Gregg Danner and Suzanne Boline Danner pursuant to deed dated September 23, 1988, recorded with the Clerk and Recorder of Jefferson County, Colorado on September 26, 1988, at Reception No. 88093712; a copy of said warranty deed is attached hereto, incorporated herein by referenced and marked Exhibit 6. 11. Since prior to 1973, Frickey and plaintiffs openly, exclusively and continuously occupied, possessed and used said Strip of Land as their own, constructing a fence and other improvements thereon. 12. Said possession of the Strip of Land by plaintiffs and their predecessor has been exclusive and uninterrupted for more than 18 years, and in particular since at least 1973. 13. Through what appears to have been inadvertence, mistake or oversight, the ownership interest of Leggetts in and to said Strip of Land was not conveyed by written deed to Frickey. 14. Plaintiffs have paid all taxes accruing upon the Strip of Land since 1975 by paying said taxes on October 7, 2003, pursuant to Certificate of Redemption, a copy of which is attached hereto, incorporated herein by reference and marked Exhibit 7. 15. On April 5, 2004, without any right or title whatsoever, defendant caused to be recorded with the Clerk and Recorder of the County of Jefferson, State of Colorado, a warranty deed from Doris O. Leggett to defendant for the Strip of Land; a copy of said deed is attached hereto, incorporated herein by reference and marked Exhibit 8. 16. Since April 5, 2004, without any right, title or interest thereto, defendant has removed a portion of the fence constructed on the Strip of Land by plaintiffs or their predecessors and has placed stakes and no trespassing signs on the Strip of Land and claimed ownership thereof. FIRST CLAIM (Adverse Possession) 17. Plaintiff incorporates herein by reference the General Allegations set forth above. 18. Based on the actual adverse, hostile, exclusive and uninterrupted possession of the Strip of Land by plaintiffs and their predecessors since 1973, plaintiffs have adversely possessed said Strip of Land for more than 18 years. 19. Plaintiffs are entitled to an Order quieting title to the Strip of Land in plaintiffs, free and clear of any claims of defendant therein, and declaring the deed from Leggett to defendant marked Exhibit 8 null and void and of no effect. WHEREFORE, plaintiffs respectfully pray this Court for judgment against defendant declaring that plaintiffs are the owners of the Strip of Land described in paragraph 3 above and quieting title in plaintiffs, free and clear of any liens, claims or ownership interest of defendant therein, for an Order declaring the warranty deed marked as Exhibit 8 null and void and of no effect, for costs and for such other and further relief as to this Court may seem just and proper. SECOND CLAIM (Trespass and Ejectment) 20. Plaintiffs incorporate herein by reference plaintiffs' General Allegations and First Claim as if fully set forth herein. 21. Without permission, authority or right, defendant has trespassed upon the property of plaintiffs, including the Strip of Land, destroying a portion of the fence constructed by plaintiffs and their predecessor thereon, and placing stakes and no trespassing signs upon the property of plaintiffs. 22. Plaintiffs are entitled to an Order prohibiting and enjoining defendant, together with his licensees, agents, employees, successors and assigns, from trespassing upon the property of plaintiffs and destroying the property of plaintiffs. 23. Plaintiffs have been damaged as a result of defendant's destruction of the property of plaintiffs while trespassing upon the property of plaintiffs. WHEREFORE, plaintiffs respectfully pray this Court for judgment in an amount equal to the cost of replacing the fence destroyed by defendant and for removing the no trespassing signs and stakes, for an Order enjoining defendant from trespassing upon the property of plaintiffs, for costs and for such other and further relief as to this Court may seem just and proper. Ernest, Jefferson County District Court Case No. 04 CV 1481, Division 11 (CONFIDENTIAL CRE 408 SETTLEMENT NEGOTIATIONS) Dear John: My client has carefully considered the possibility of working out a negotiated settlement with your clients despite the fact that we feel quite confident that if the matter proceeds to trial that the Porters will be unsuccessful in proving a claim for adverse possession. Obviously as far record ownership is concerned, clearly Mr. Forest would prevail on that issue. Without waiving my client's claims and defenses should this matter not be settled, I have been authorized to offer to your client settlement on the following basis: 2. 1. My client would be willing to covey to your client the Southern 3.5 feet of the 4.5 foot disputed Strip of Land except for where the existing current Last West fence line may vary or meander to the South. In that portion, the conveyance would be 1 foot South of the current fence line. In your clients' consideration of this matter, be advised that the City of Wheat Ridge has indicated that they will allow my client to construct an engineered 6 foot retaining wail built out of railroad ties to the current level of land on the South property of the 4.5 foot Strip of Land and then back-:fill the area with fill dirt which would bring the area to a level elevation with the house at 2670 pierce Street. Then upon the new ground level, construction would be permitted for a 6-foot high fend , the net effect to 2660 Pierce Street (your clients' property) is that there; would be a 12 foot high barrier located approximately 3.5 feet from the douse and approximately 6 inches to 1 foot from the shed- Even in a worst-case scenario, if my client did not prevail on the matters before the Court the +all and fence will be built as described. No award for adverse possession could include the lands from the street to the existing fence (which have never been occupied by fence or otherwise) and land directly North of the shed. As an additional condition for the settlement page I of 2 My client would agree not only to convey the property described in paragraph I above, but would agree not to construct the fence and barrier wall. 3. As consideration for the above my client would require your client's payment of the sum $30,000.00 in good funds and the parties would execute a mutual release and settlement agreement, each party to be responsible for their own attorney's fees and costs. Regardless of whether your clients prevail or not in the pending litigation, the agreement by my client not to construct the fence as described above would seemingly be as important to your client as the actual land conveyance. Inasmuch as we have a trial, which is scheduled to take place very shortly, my client has agreed to leave this offer open for acceptance until noon on Wednesday, November 10, 2044. Please advise.
