SUBJECT: 5521 W. 27th Ave — Development Potential and Future Platting/Rezoning
The property at 5521 W. 27th Avenue is located on Lots 13, 14, and 15, Block 11 of Prince's
Resubdivision of Blocks 11 and 12, Lakeside. The Prince's Resubdivision of Blocks 11 and 12
was platted in 1889 and largely untouched since that date. Each lot within the subdivision was
platted at 25 feet wide unless otherwise noted on the plat. Lots 13, 14, and 15 were platted at 25
feet wide, totaling 75 feet wide.
Zoning and Use: The property is currently zoned Residential -One C (R-1C) and contains a
single -unit home built in 1914. The surrounding properties are primarily zoned Residential -Three
(R-3) but the property to the west and some properties to the south across 27th Avenue are also
zoned R-IC.
The owner of the property previously approached the City to rezone the property to R-3 in 2008.
Staff was supportive of that rezoning but the applicant ultimately did not complete the rezoning
process. Staff continue to be supportive of a rezoning given the properties adjacency to R-3
zoning and the fact that most of the properties within a two -block radius are zoned R-3. A
rezoning could facilitate future redevelopment of the property into a duplex. The current R-1C
zoning would only allow one single -unit home (plus ADU) on the property.
Platting and Pro e� Size: The Prince's Resubdivision shows a total of 75 feet of lot width as
platted, which would allow a duplex under the potential future R-3 zoning. A land survey plat
provided by the current owner of the property completed in 2009 shows the lot at approximately
74.75 feet wide. It contains the proper legal description but does not include a title search nor
compatibility with the adjacent parcels. The owner expressed concern that this survey could
potentially prevent a duplex from being built under the potential R-3 zoning.
The City has determined that if future development were to occur under the potential R-3 zoning,
the "as -platted" width of 75 feet would be honored. There is no indication in historical records or
documents provided by the applicant that indicated a shift in lot lines to reduce the width of the
property. Absent any explanation for the discrepancy between the "as -platted" and "as -surveyed"
dimensions, the City will honor the "as -platted" dimension.
If the property is successfully rezoned to R-3, a consolidation plat will be required prior to
construction of new improvements (such as a duplex) and a plat note may be added stating the
original width as platted by the Prince's Resubdivision was 75 feet wide.
Adjacent Right -of -Way to East: The Prince's Resubdivision and 2009 survey show a 10-foot
alley to the east of the property dedicated as right-of-way. The City's maps also indicate this 10-
foot alley as right-of-way. Although platted in 1889, neither Jefferson County at the time nor the
City of Wheat Ridge has constructed an alley within the right-of-way. An existing fence is
located within the right-of-way. It is possible that improvements to properties to the east, such as
2755 Chase Street, may potentially encroach into the alley right-of-way.
The City is supportive of vacating this right-of-way to the adjacent property owners, and this
process is best achieved during redevelopment of 5521 W. 27th Avenue. The encroachment of
improvements would complicate the vacation effort if the buildings on the east pass the halfway
point of the alley. Right-of-way vacations result in a 50/50 split between adjacent property
owners, which would require the cooperation of the three adjacent owners: 5521 W. 27th Ave,
2709 Chase St, and 2755 Chase St.

NOTICE
The property owner, and all current occupants, are hereby notified that the undersigned
Building Official of Wheat Ridge, Colorado, has found the building located on the above
described real property to be a Dangerous Building within the meaning of Section 302 of
the Uniform Code for the Abatement of Dangerous Buildings, 1997 edition, as adopted
by the City of Wheat Ridge, Colorado ("Code"), as more particularly set out below:
The building is being used for dwelling purposes and is in violation of the Uniform Code
for the Abatement of Dangerous Buildings, sections in bold are the sections that this
property is in violation of.
SECTION 301- GENERAL,
For the purpose of this code, certain terms, phrases, words and their derivatives shall be construed as
specified in either this chapter or as specified in the Building Code or the Housing Code. Where terms are
not defined, they shall have their ordinary accepted meanings within the context with which they are used.
Webster's Third new International Dictionary of the English Language, Unabridge, copyright 1986, shall
be construed as providing ordinary accepted meanings. Words used in the singular masculine gender
include the feminine and the feminine the masculine.
BUILDING CODE is the International Code Council, as adopted by this jurisdiction.
DANGEROUS BUILDING is any building or structure deemed to be dangerous under the provisions of
Section 302 of this code.
HOUSING CODE is the Uniform Housing Code promulgated by the International Conference of building
Officials, as adopted by this jurisdiction.
INTERNATIONAL PROPERTY MAINTENANCE CODE is the 2003 International Property
Maintenance Code promulgated by the International Code Council, as adopted by this jurisdiction.
SECTION 302-DANGEROUS BUILDING
For the purpose of this code, any building or structure which has any or all of the conditions or defects
hereinafter described shall be deemed to be a dangerous building, provided that such conditions or defects
exist to the extent that the life, health, property or safety of the public or its occupants are endangered.
1. Whenever any door, aisle, passageway, stairway or other means of exit is not of sufficient
width or size or is not so arranged as to provide safe and adequate means of exit in case of
fire or panic.
2. Whenever the walking surface of any aisle, passageway, stairway or other means of exit is so
warped, worn. Loose, torn or otherwise unsafe as to not provide safe and adequate means of exit in
case of fire or panic.
3. Whenever the stress in any materials, member or portion thereof, due to all dead and life loads, is
more than one and one half times the working stress or stresses allowed in the Building Code for
new buildings of similar structure, purpose or location.
4. Whenever any portion thereof has been damaged by fire, earthquake, wind, flood or by any other
cause, to such an extent that the structural strength or stability thereof is materially less than it was
before such catastrophe and is less than the minimum requirements of the Building Code for new
buildings of similar structure, purpose or location.
5. Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached
or dislodged, or to collapse and thereby injure persons or damage property.
6. Whenever any portion of a building, or any member, appurtenance or ornamentation on the
exterior thereof is not of sufficient strength or stability, or is not so anchored, attached or fastened
in place so as to be capable of resisting a wind pressure of one half of that specified in the building
Code for new buildings of similar structure, purpose or location without exceeding the working
stressed permitted in the Building Code for such buildings.
7. Whenever any portion thereof has wracked, warped, buckled or settled to such an extent that walls
or other structural portions have materially less resistance to winds or earthquakes than is required
in the case of similar new construction.
8. Whenever the building or structure, or any portion thereof, because of (i) dilapidation,
deterioration or decay; (ii)faulty construction; (iii) the removal, movement or instability of any
portion of the ground necessary for the purpose of supporting such buildings; (iv) the
deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to partially or
completely collapse.
9. Whenever, for any reason, the building or structure, or any portion thereof, is manifestly
unsafe for purpose of which it is being used.
10. Whenever the exterior walls or other vertical structural members list, lean or buckle to such an
extent that a plumb line passing through the center of gravity does not fall inside the middle on
third of the base.
11. Whenever the building or structure, exclusive of the foundation, shows 33 percent or more damage
or deterioration of its supporting member or members, or 50 percent damage or deterioration of its
non-supporting members, enclosing or outside walls or coverings.
12. Whenever the building or structure has been so damaged by fire, wind, earthquake or flood,
or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to
children; (ii) a harbor for vagrants, criminals or immoral persons; or as to (iii) enable
persons to resort thereto for the purpose of committing unlawful or immoral acts.
13. Whenever any building or structure has been constructed, exists or is maintained in
violation of any specific requirement or prohibition applicable to such building or structure
provided by the building regulations of this jurisdiction, as specified in the Building Code or
Housing Code, or of any law or ordinance of this state or jurisdiction relating to the
condition, location or structure of buildings.
14. Whenever any building or structure which, whether or not erected in accordance with a all
applicable laws and ordinances, has in any non-supporting part, member or portion less than 50
percent, or in any supporting part, member or portion less the 66 percent or the (i) strength, (ii)
fire-resisting qualities or characteristics, or (iii) weather-resisting qualities or characteristics
required by law in the case of a newly constructed building of like area, height and occupancy in
the same location.
15. Whenever a building or structure, used or intended to be used for dwelling purposes,
because of inadequate maintenance, dilapidation, decay, damage, faulty construction or
arrangement, inadequate light, air or sanitation facilities, or otherwise, is determined by the
health officer to be unsanitary, unfit for human habitation or in such a condition that is
likely to cause sickness or disease.
16. Whenever any building or structure, because of obsolescence, dilapidated condition,
deterioration, damage, inadequate exists, lack of sufficient fire-resistive construction, faulty
electric wiring, gas connections or heating apparatus, or other cause, is determined by the
fire marshal to be a fire hazard.
17. Whenever any building or structure is in such a condition as to constitute a public nuisance
known to the common law or in equity jurisprudence.
18. Whenever any portion or a building or structure remains on a site after the demolition or
destruction of the building or structure or whenever any building or structure is abandoned
for a period in excess of six months so as to constitute such building or portion thereof an
attractive nuisance or hazard to the public.
The 1997 Uniform Housing Codes states:
SECTION 1001- DEFINITIONS
1001.1 General. Any building or portion thereof that is determined to be an unsafe building in accordance
with Section 102 of the Building Code, or any building or portion thereof, including any dwelling unit,
guest room or suite or rooms, or the premises on which the same is located, in which there exists any of the
conditions referenced in this section to an extent that endangers the life, limb, health, property, safety or
welfare of the public or the occupants thereof, shall be deemed and hereby are declared to be substandard
buildings.
1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandard when they are
when they are in sanitary. Inadequate sanitation shall include, but not be limited to, the following:
1. Lack of or improper water closet, lavatory, bathtub or shower in a dwelling unit or lodging
house.
2. Lack of or improper water closets, lavatories, and bathtubs or showers per number or
guests in a hotel.
3. Lack of or improper kitchen sink in a dwelling unit.
4. Lack of hot or cold running water to plumbing fixtures in a hotel
5. Lack of hot or cold running water to plumbing fixtures in a dwelling unit or lodging house.
6. Lack of adequate heating facilities.
7. Lack of or improper operation or required ventilating equipment.
8. Lack of minimum amounts of natural light and ventilation require by this code.
9. Room and space dimensions less than required by this code.
10. Lack of required electrical lighting.
11. Dampness of habitable rooms.
12. Infestation of insects, vermin or rodents as determined by the health officer.
13. General dilapidation or improper maintenance.
14. Lack of connection to required sewage disposal system.
15. Lack of adequate garbage and rubbish storage and removal facilities as determined by the
health officer.
1001.3 Structural Hazards. Buildings or portions thereof shall be deemed substandard when they are or
contain structural hazards. Structural hazards shall include, but not be limited to, the following:
1. Deteriorated or inadequate foundations.
2. Defective or deteriorated flooring or floor supports.
3. Flooring or floor supports of insufficient size to carry imposed loads with safety.
4. Members of walls, partitions or other vertical supports that split, lean, list or buckle do to defective
material or deteriorations.
5. Members of walls, partitions or other vertical supports that are of insufficient size to carry
imposed loads with safety.
6. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that sag,
split or buckle due to defective material or deterioration. _
7. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are
of insufficient size to carry imposed lads with safety.
8. Fireplaces or chimneys that list, bulge o settle due to defective material or deterioration.
9. Fireplaces or chimneys that are of insufficient size or strength to carry imposed loads with safety.
1001.4 Nuisance. Buildings or portions thereof in which there exists any nuisance as defined in this
code are deemed substandard buildings.
1001.5 Hazardous Electrical Wiring. Electrical wiring that was installed in violation of code
requirements in effect at the time of installation or electrical wiring not installed in accordance with
generally accepted construction practices in areas where no codes were in effect or that has not been
maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.6 Hazardous Plumbing. Plumbing that was installed in violation of code requirements in effect
at the time of installation or plumbing not installed in accordance with generally accepted
construction practices in areas where no codes were in effect or that has not been maintained in good
condition or that is not being used in a safe manner shall be considered substandard.
1001.7 Hazardous Mechanical. Mechanical equipment that was installed in violation of code
requirements in effect at the time of installation or mechanical equipment not installed in accordance
with generally accepted construction practices in areas where no codes were in effect or that has not
been maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.8 Faulty Weather Protections. Buildings or portions thereof shall be considered substandard
when they have faulty weather protections, which shall include, but not be limited to, the following:
1. Deteriorated, crumbling or loose plaster.
2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or floors,
including broken windows or doors.
3. Defective or lack of weather protection for exterior wall coverings, including lack of paint,
or weathering due to lack of paint or other approved protective covering.
4. Broken, rotted, split or buckled exterior wall coverings or roof coverings.
1001.9 Fire Hazard. Any building or portion thereof, device, apparatus, equipment, combustible
waste, or vegetation that, in the opinion of the chief of the fire department, is in such a condition as to
cause a fire or explosion or provide a ready fuel to augment the spread and intensity of fire or
explosion arising from any cause shall be considered substandard.
1001.10 Faulty Materials of Construction. The use of materials of construction, except those that are
specifically allowed or approved by this code and the Building Code, and that have been adequately
maintained in good and safe conditions, shall cause a building to be substandard.
1001.11 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead
organic matter, debris, garbage, offal, rat harborages, stagnant water, combustible materials, and
similar materials or conditions on a premises constitutes fire, health or safety hazards that shall be
abated in accordance with the procedures specified in Chapter 11 of this code.
1001.12 Inadequate Exits. Except for those buildings or portions thereof that have been provided
with adequate exit facilities conforming to the provisions of this code, buildings or portions thereof
whose exit facilities were installed in violation of code requirements in effect at the time of their
construction or whose exit facilities have not been increased in number or width in relations to any
increase in occupant load due to alterations, additions or change in use or occupancy subsequent to
the time of construction shall be considered substandard. Notwithstanding compliance with code
requirements in effect at the time of their construction, buildings or portions thereof shall be
considered substandard when the building official. finds that an unsafe condition exists through an
improper location of exits, a lack of an adequate number or width of exits, or when other conditions
exist that are dangerous to human life.
1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. Buildings or portions there of shall
be considered substandard when they are not provided with the fire-resistive construction or fire-
extinguishing systems or equipment required by this code, except those buildings or portions thereof that
conformed with all applicable laws at the time of their construction and whose fire-resistive integrity and
fire-extinguishing systems or equipment has been adequately maintained and improved in relation to any
increase in occupant load, alteration or addition, or any change in occupancy.
1001.14 Improper Occupancy. All buildings or portions thereof occupied for living, sleeping, cooking
or dining purposes that were not designed or intended to be used for such occupancies shall be
considered substandard.
The following is a list of items that shall be fixed to meet code:

3. Trash needs to be cleaned out.
4. Building shall be boarded up to prevent illegal entry.
5. Bedroom windows shall meet egress per code.
6. Need hardwired smoke detectors through out house.
7. Fix broken windows.
8. Cleanup site.
9. Human waste has been placed in trash bags and has filled the
bathtub above capacity.
10. Used Toilet paper is higher than the toilet.
11. Trash filled house shall be cleaned out for safety.
12. The structure shall be engineered out to meet a 30 lb snow
load.
13. Paint is peeling.
14. House is an attractive nuisance since it is abandoned.
15. House needs water for sanitation reasons.
16. The house at 5521 w. 27`t' is a hazardous and unsanitary home
that need to be cleaned up as a bio-hazard and shall be tested
by an industrial hygienist for meth at clean up.
17. NOTE: There maybe more items that need to be addressed the
owner shall set up a time with the City of Wheat Ridge
Building Division for a through inspection of this building.
ORDER
1. The City of Wheat Ridge Building Official has determined the building
referenced above to be a Dangerous Building. The Building Department will
post the building as a Dangerous Building due to the amount of life safety issues.
Pursuant to Code all occupants shall be required to vacate the property
immediately.. This is therefore required in order to protect life, health and safety
of the public.
II. The owners are ordered to pull a building permit to fix the deficient items. The
Building Department will post the building as a Dangerous Building due to the
amount of life safety issues. Pursuant to Code all occupants shall be required to
vacate the property. This is therefore required in order to protect life, health and
safety of the public. The property shall be brought to code by December 1, 2006
or the City of Wheat Ridge will start the Abatement process at the owners
expense.
III. If the structure has not been brought to code or demolished by December 1,
2006. Section 801 in the Uniform Code for the Abatement of Dangerous
Buildings states, "801.1 Procedure. When any work of repair or demolition is to
be done pursuant Section 701.3, Item 3, of this code, the building official shall
issue an order thereof to the director of public works and the work shall be
accomplished by personnel of this jurisdiction or by private contract under the
direction of said director. Plans and specifications therefore may be prepared by
said director, or the director may employ such architectural and engineering
assistance on a contract basis as deemed reasonably necessary. If any part of the
work is to be accomplished by private contract, standard public works contractual
procedures shall be followed." Section 801.2 states, "801.2 Costs. The cost of
such work shall be paid from the repair and demolition fund, and may be made a
special assessment against the property involved, or may be made a personal
obligation of the property owner, whichever the legislative body of this
jurisdiction shall detennine is appropriate:"
The property owner and all occupants are hereby ORDERED TO CEASE AND
DESIST occupancy and use of the above described building. The Building Official
shall cause the property to be posted with the attached Notice and shall take action
to remove all future occupants from the building until the building is brought up to
code.
REMEDIAL ACTION
The property owner must apply for and obtain a City of Wheat Ridge building permit
to correct any deficiencies.
IV. All deficiencies shall be fixed but are not limited to the items on this list.
APPEAL OF THIS NOTICE AND ORDER
Any person having record title or other legal interest in the above described premises may
appeal this Notice and Order or any action of the Building Official to the Building Code
Advisory Board or known as the Board of Appeals pursuant to section 112 of the Code,
provided that the appeal is made in writing as provided in the Code and filed with the
Building Official within ten (10) days from the date of service of this Notice and Order.
Failure to appeal will constitute a waiver of all rights to an administrative hearing and
determination of this matter. FILING OF AN APPEAL SHALL NOT STAY THE
EFFECTIVENESS OF THIS NOTICE AND ORDER.
It is a misdemeanor to occupy this building, or to remove or deface this notice.

On 1.27.2008 Crystal Clean Decontamination LLC (CCD) began the clean up of the
subject property, All work was completed using a minimum of level C PPE,
The property is ..• ory ranch style home with two bedrooms and one
bathroom, The majority of the clean up consisted of the removal of trash, chattel and
general filth. However the bathroom was a little more involved. The bathtub and toilet
were filled with human waste, The waste had been in place for a minimum of a year
and was devoid of all moisture. All surfaces of bathroom were misted with a

blood born pathogens, None were detected. The waste was then removed and
disposed of as solid waste. The bathroom was then cleaned and disinfected using
an industrial detergent, disinfectant and equipment. This was repeated three times.

described real property to be a Dangerous Building within the meaning of Section 302 of
the Uniforn-i Code for the Abatement of Dangerous Buildings, 1997 edition, as adopted
by the City of Wheat Ridge, Colorado ("Code"), as more particularly set out below:
The building is being used for dwelling purposes and is in violation of the Uniform Code
for the Abatement of Dangerous Buildings, sections in bold are the sections that this
property is in violation of
SECTION 301 — GENERAL
For the purpose of this code, certain terms, phrases, words and their derivatives shall be construed as
specified in either this chapter or as specified in the Building Code or the Housing Code, Where terms are
not defined, they shall have their ordinary accepted meanings within the context with which they are used,
T'Vebster's Third nein International Dictionaty, (if the English Language, Unabridge, copyright 1986, shall
be construed as providing ordinary accepted meanings. Words used in the singular masculine gender
include the feminine and the feminine the masculine.
BUILDING CODE is the International Code Council, as adopted by this jurisdiction.
DANGEROUS BUILDING is any building or structure deemed to be dangerous under the provisions of
Section 302 of this code.
HOUSING CODE is the Uniform Housing Code promulgated by the International Conference of building
Officials, as adopted by this jurisdiction,
INTERNATIONAL PROPERTY MAINTENANCE CODE is the 2003 International Property
Maintenance Code promulgated by the International Code Council, as adopted by this jurisdiction.
SECTION 302 — DANGEROUS BUILDING
For the purpose of this code, any building or structure which has any or all of the conditions or defects
hereinafter described shall be deemed to be a dangerous building, provided that such conditions or defects
exist to the extent that the life, health, property or safety of the public or its occupants are endangered.
I. Whenever any door, aisle, passageway, stairway or other means of exit is not of sufficient
width or size or is not so arranged as to provide safe and adequate means of exit in case of
tire or panic.
2, Whenever the walking surface of any aisle, passageway, stairway or other means of exit is so
warped, worn. Loose, torn or otherwise unsafe as to not provide safe and adequate means of exit in
case of fire or panic.
1 Whenever the stress in any materials, member or portion thereof, due to all dead and life, loads, is
more than one and one half times the working stress or stresses allowed in the Building Code for
new buildings of similar structure, purpose or location.
4, Whenever any portion thereof has been damaged by fire, earthquake, wind, flood or by any other
cause, to such an extent that the structural strength or stability thereof is materially less than it was
before such catastrophe and is less than the minimum requirements of the Building Code for new
buildings of similar structure, purpose or location,
S. Whenever any portion or mernber or appurtenance thereof is likely to fail, or to become detached
or dislodged, or to collapse and thereby injure persons or damage property.
6. Whenever any portion of a building, or any member, appurtenance or onlarnentation oil the
exterior thereof is not of sufficient strength or stability, or is not so anchored, attached or fastened
in place so as to be capable of resisting a wind pressure of one half of that specified in the building
Code for new buildings of similar structure, purpose or location without exceeding the working
stressed permitted in the Building Code for such buildings,
T Whenever any portion thereof has wracked, warped, buckled or settled to such an extent that walls
or other structural portions have materially less resistance to winds or earthquakes than is required
in the case of similar new construction.
& Whenever the building or structure, or any portion thereof, because of (i) dilapidation,
deterioration or decay; (h)faulty construction; (iii) the removal, movement or instability of any
portion of the ground necessary for the purpose of supporting such buildings; (iv) the
deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to partially or
completely collapse.
9. Whenever, for any reason, the building or structure, or any portion thereof, is manifestly
unsafe for purpose of which it is being used.
10, Whenever the exterior walls or other vertical structural members list, lean or buckle to such an
extent that a plumb line passing through the center of gravity does not fall inside the 'middle on
third of the base.
IL Whenever the building or structure, exclusive of the foundation, shows 33 percent or more damage
or deterioration of its supporting member or iriembers, or 50 percent damage or deterioration of its
non-supporting members, enclosing or outside walls or coverings.
12. Whenever the building or structure has been so damaged by fire, wind, earthquake or flood,
or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to
children; (ii) a harbor for vagrants, criminals or immoral persons; or as to (iii) enable
persons to resort thereto for the purpose of committing unlawful or immoral acts.
13. Whenever any building or structure has been constructed, exists or is maintained in
violation of any specific requirement or prohibition applicable to such building or structure
provided by the building regulations of this jurisdiction, as specified in the Building Code or
Housing Code, or of any law or ordinance of this state or jurisdiction relating to the
condition, location or structure of buildings.
14. Whenever any building or structure which, whether or not erected in accordance with a all
applicable laws and ordinances, has in any non-supporting part, member or portion less than 50
percent, or in any supporting part, member or portion less the 66 percent or the (i) strength, (it)
fire-resisting qualities or characteristics, or (in) weather-resisting qualities or characteristics
required by law in the case of a newly constructed building of like area, height and occupancy in
the same location,
15. Whenever a building or structure, used or intended to be used for dwelling purposes,
because of inadequate maintenance, dilapidation, decay, damage, faulty construction or
arrangement, inadequate light, air or sanitation facilities, or otherwise, is determined by the
health officer to be unsanitary, unfit for human habitation or in such a condition that is
likely to cause sickness or disease.
16. Whenever any building or structure, because of obsolescence, dilapidated condition,
deterioration, damage, inadequate exists, lack of sufficient fire-resistive construction, faulty
electric wiring, gas connections or heating apparatus, or other cause, is determined by the
fire marshal to be a fire hazard.
17. Whenever any building or structure is in such a condition as to constitute a public nuisance
known to the common law or in equity jurisprudence.
18. Whenever any portion or a building or structure remains oil a site after the demolition or
destruction of the building or structure or whenever any building or structure is abandoned
for a period in excess of six months so as to constitute such building or portion thereof an
attractive nuisance or hazard to the public.
The 1997 Uniform Housing Codes states:
SECTION 1001 — DEFINITIONS
1001.1 General. Any building or portion thereof that is determined to be an unsafe building in accordance
with Section 102 of the Building Code, or any building or portion thereof, including any dwelling unit,
guest room or suite or room%, or the premises on which the same is located, in which there exists any of the
conditions referenced in this section to an extent that endangers the life, limb, health, property, safety or
welfare, of the public or the occupants thereof, shall be deemed and hereby are declared to be substandard
buildings.
1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandard when they are
when they are in sanitary. Inadequate saturation shall include, but not be limited to, tile following:
1. Lack of or improper water closet, lavatory, bathtub or shower in a dwelling unit or lodging
house.
2. Lack of or improper water closets, lavatories, and bathtubs or showers per number or
guests in a hotel.
3. Lack of or improper kitchen sink in a dwelling unit.
4. Lack of hot or cold running water to plumbing fixtures in a hotel
5. Lack of hot or cold running water to plumbing fixtures in a dwelling unit or lodging house,
6. Lack of adequate heating facilities.
7. Lack of or improper operation or required ventilating equipment.
S. Lack of minimum amounts of natural light and ventilation require by this code.
9. Room and space dimensions less than required by this code.
10. Lack of required electrical lighting.
I1. Dampness of habitable rooms.
12. Infestation of insects, vermin or rodents as determined by the health officer.
13. General dilapidation or improper maintenance.
14. Lack of connection to required sewage disposal system.
15. Lack of adequate garbage and rubbish storage and removal facilities as determined by the
health officer.
1001.3 Structural Hazards. Buildings or portions thereof shall be deemed substandard when they are or
contain structural hazards. Structural hazards shall include, but not be limited to, the following:
I . Deteriorated or inadequate foundations.
2. Defective or deteriorated flooring or floor supports.
1 Flooring or floor supports of insufficient size to carry imposed loads with safety.
4. Members of walls, partitions or other vertical supports that split, ]can, list or buckle do to defective
material or deteriorations.
5. Members of walls, partitions or other vertical supports that are of insufficient size to carry
imposed loads with safety.
6. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that sag,
split or buckle due to defective material or deterioration.
7. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are
of insufficient size to carry imposed lads with safety.
8. Fireplaces or chinvicys that list, bulge o settle due to detective material or deterioration,
9, Fireplaces or chimneys that are of insufficient sire or strength to carry imposed loads with safety.
1001.4 Nuisance. Buildings or portions thereof in which there exists any nuisance as defined in this
code are deemed substandard buildings.
1001.5 Hazardous Electrical Wiring. Electrical wiring that was installed in violation of code
requirements in effect at the time of installation or electrical wiring not installed in accordance with
generally accepted construction practices in areas where no codes were in effect or that has not been
maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.6 Hazardous Plumbing. Plumbing that was installed in violation of code requirements in effect
at the time of installation or plumbing not installed in accordance with generally accepted
construction practices in areas where no codes were in effect or that has not been maintained in good
condition or that is not being used in a safe manner shall be considered substandard.
1001.7 Hazardous Mechanical. Mechanical equipment that was installed in violation of code
requirements in effect at the time of installation or mechanical equipment not installed in accordance
with generally accepted construction practices in areas where no codes were in effect or that has not
been maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.8 Faulty Weather Protections. Buildings or portions thereof shall be considered substandard
when they have faulty weather protections, which shall include, but not be limited to, the following:
1. Deteriorated, crumbling or loose plaster.
2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or floors,
including broken windows or doors.
3. Detective or lack of weather protection for exterior wall coverings, including lack of paint,
or weathering due to lack of paint or other approved protective covering.
4. Broken, rotted, split or buckled exterior wall coverings or roof coverings.
1001.9 Fire Hazard. Any building or portion thereof, device, apparatus, equipment, combustible
waste, or vegetation that, in the opinion of the chief of the fire department, is in such a condition as to
cause a tire or explosion or provide a ready fuel to augment the spread and intensity of fire or
explosion arising from any cause shall be considered substandard.
1001.10 Faulty Materials of Construction. The use of materials of construction, except those that are
specifically allowed or approved by this code and the Building Code, and that have been adequately
maintained in good and safe conditions, shall cause a building to be substandard.
1001.11 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead
organic matter, debris, garbage, offal, rat barborages, stagnant water, combustible materials, and
similar materials or conditions on a premises constitutes fire, health or safety hazards that shall be
abated in accordance with the procedures specified in Chapter 11 of this code.
1001.12 Inadequate Exits. Except for those buildings or portions thereof that have been provided
with adequate exit facilities conforming to the provisions of this code, buildings or portions thereof
whose exit facilities were installed in violation of code requirements in effect at the time of their
construction or whose exit facilities have not been increased in number or width in relations to any
increase in occupant load due to alterations, additions or change in use or occupancy subsequent to
the time of construction shall be considered substandard. Notwithstanding compliance with code
requirements in effect at the time of their construction, buildings or portions thereof shall be
considered substandard when the building official finds that an unsafe condition exists through an
improper location of exits, a lack of an adequate number or width of exits, or when other conditions
exist that are dangerous to human life.
1001.13 Inadequate Fire -Protection or Fire -Fighting Equipment. Buildings or portions there of shall
be considered substandard when they are not provided with the fire -resistive construction or fire -
extinguishing systems or equipment required by this code, except those buildings or portions thereof that
conformed with all applicable laws at the time of their construction and whose fire -resistive integrity and
fire -extinguishing systems or equipment has been adequately maintained and improved in relation to any
increase in occupant load, alteration or addition, or any change in occupancy,
1001.14 Improper Occupancy. All buildings or portions thereof occupied for living, sleeping, cooking
or dining purposes that were not designed or intended to be used for such occupancies shall be
considered substandard.
The following is a list of items that shall be fixed to meet code:
1. GFCl's Needed in Bathrooms and Kitchens
2. Need running water for sanitation.
3. Trash needs to be cleaned out.
4. Building shall be boarded up to prevent illegal entry.
5. Bedroom windows shall meet egress per code.
6. Need hardwired smoke detectors through out house,
7. Fix broken windows.
8. Clean tip site.
9. Hurnan waste has been placed in trash bags and has filled the
bathtub above capacity.
10. Used Toilet paper is higher than the toilet.
11, Trash filled house shall be cleaned out for safety.
12. The structure shall be engineered out to meet a 30 lb snow
load.
13. Paint is peeling,
14. House is an attractive nuisance since it is abandoned.
I S. House needs water for sanitation reasons.
16. The house at 5521 w. 27'h is a hazardous and unsanitary home
that need to be cleaned up as a bio -hazard and shall be tested
by an industrial hygienist for meth at clean up.
17. NOTE: There maybe more items that need to be addressed the
owner shall set up a time with the City of Wheat Ridge
Building Division for a through inspection of this building.
1. The City of Wheat Ridge Building Official has determined the building
referenced above to be a Dangerous Building. The Building Department will
post the building as a Dangerous Building due to the amount of lite, safety issues.
Pursuant to Code all occupants shall be required to vacate the property
immediately.. This is therefore required in order to protect life, health, and safety
of the public.
IL The owners are ordered to pull a building permit to fix the deficient items. The
Building Department will post the building as a Dangerous Building due to the
amount of life safety issues. Pursuant to Code all occupants shall be required to
vacate the property. This is therefore required in order to protect life, health and
safety of the public. The property shall be brought to code by December 1, 2006
or the City of Wheat Ridge will start the Abatement process at the owners
expense.
III. If the structure has not been brought to code or demolished by December 1,
2006. Section 801 in the Unifonii Code for the Abatement of Dangerous
Buildings states, "801.1 Procedure. When any work of repair or demolition is to
be done Pursuant Section 701.3, Item 3, of this code, the building official shall
issue all order thereof to the director of public works and the work shall be
accomplished by personnel of this jurisdiction or by private contract under the
direction of said director. Plans and specifications therefore may be prepared by
said director, or the director may employ such architectural and engineering
assistance on a contract basis as deemed reasonably necessary. If any part of the
work- is to be accomplished by private contract, standard public works contractual
procedures shall be followed." Section 801.2 states, "801.2 Costs. The cost of
such work shall be paid from the repair and demolition fund, and may be made a
special assessment against the property involved, or may be made a personal
obligation of the property owner, whichever the legislative body of this
jurisdiction shall determine is appropriate."
The property owner and all occupants are, hereby ORDERED TO CEASE AND
DESIST occupancy and use of the above described building. The Building Official
shall cause the property to be posted with the attached Notice and shall take action
to remove allfuture occupants from the building until the building is brought up to
code.
L The property owner must apply for and obtain a City of Wheat Midge building pe lit
to correct any deficiencies.
IV, All deficiencies shall be fixed but are not limited to the items on this list.
APPEAL OF THIS NOTICE AND ORDER
Any person having record title or other legal interest in the above described premises Inlay
appeal this Notice and Order or any action of the Building Official to the Building Code
Advisory Board or known as the Board of Appeals pursuant to section 112 of the Code,
provided that the appeal is made in writing as provided in the Code and filed with the
Building Official within, ten (10) days from the date of service of this Notice and Order.
Failure to appeal will constitute a waiver of all rights to an administrative hearing and
determination of this matter. FILING OF AN APPEAL SHALL NOT STAY THE
EFFECTIVENESS OF THIS NOTICE AND ORDER.

increase in occupant load, alteration or addition, or any change in occupancy,
1001.14 Improper Occupancy. All buildings or portions thereof occupied for living, sleeping, cooking
or dining purposes that were not designed or intended to be used for such occupancies shall be
considered substandard.
The following is a list of items that shall be fixed to meet code:
1. GFCI's Needed in Bathrooms and Kitchens
2. Need running water for sanitation.
3. Trash needs to be cleaned out,
4Building shall be boarded up to prevent illegal entry.
5. Bedroom windows shall meet egress per code.
6. Need hardwired smoke detectors through out house.

that need to be cleaned up as a bio -hazard and shall be tested
by an industrial hygienist for meth at clean up.

Building Division for a through inspection of this building.
ORDER
1. The City of Wheat Ridge Building Official has determined the building
referenced above to be a Dangerous Building. The Building Department will
post the building as a Dangerous Building due to the amount of lite safety issues,
Pursuant to Code all occupants shall b(', required to vacate the properly
immediately,. This is therefore requirt-,d in order to protect life, health and safety
of the public.
If, The owners are order ..J to pull a building permit to fix the deficient items, The
Building Departn'tent will post the building as a Dangerous Building due to the
amount of life safiety issues. Pursuant to Code all occupants shall be required to
vacate the property. This is therefore required in order to protect life, health and
safety of the public. The property shall be brought to code by December 1, 2006
or the City of Wheat Ridge will start the Abatement process at the owners
expense.
III, If the structure has not been brought to code or demolished by December 1,
2006. Section 801 in the Uniform Code for the Abatement of Dangerous
Buildings states, "801.I Procedure. When any work of repair or demolition is to
be done pursuant Section 701.3, Itenn 3, of this code, the building official shall
issue an order thereof to the director of public works and the work shall be
accomplished by personnel of this jurisdiction or by private contract tinder the
direction of said director. Plans and specifications therefore may be prepared by
said director, or the director may employ such architectural and engineering
assistance on a contract basis as deemed reasonably necessary. If any part -,)f th",
work is to be accomplished by private contract, standard public works contractual
procedures shall be followed." Section 01.2 states, "8012 Costs. The cost of
such work shall be paid from the repair and demolition fund, and may be made a
special assessment against the property involved, or may be made a personal
obligation ofthe property owner, whichever the legislative body of this
jurisdiction shall determine is appropriate."
The property owner and all occupants are hereby ORDERED TO CEASE AND
DESIST occupancy and use of the above described Lundin g.The Building Official
shall cause the property to be posted with the attached Notice and shall take action
to remove all future occupants from the building until the building is brought up to
code.
REMEDIAL ACTION
'I"'he property owner must apply for and obtain a City of Wheat Ridge building permit
to correct any deficiencies.
IV� All deficiencies shall be fixed but are not limited to the items on this list.
APPEAL OF THIS NOTICE AND ORDER
Any person having record title or other legal interest in the above described pren-lises may
appeal this Notice and Order or any action of the Building Official to the Building Code
Advisory Board or known as the Board of Appeals pursuant to section 112 of the Code,
provided that the appeal is made in writing as provided in the Code and filed with the
Building Official within ten (10) days from the date of service of this Notice and Order.
Failure to appeal will constitute a waiver of all rights to an administrative hearing and
determination ofthis matter, FILING OF AN APPEAL SHALL NOT STAY THE
EFFECTIVENESS OF THIS NOTICE AND ORDER.
It is a misdemeanor to occupy this building, or to remove or deface this notice.
