They are just to call out and clarify the lot lines created and removed - I know which ones they are but someone else might not later on. Also, the date of city comments (although I know it took a long time) doesn't need to be included. We don't need to record the legal and exhibit on our end so I'm assuming you're doing that for your needs. You can go ahead and submit the mylar for us to record whenever you're ready. Just make sure its signed by you and the property owner and in indelible (not ball point pen) ink. Also, we just need $11 for the recording fee for the one page. I'll look for that and get it recorded shortly after. If you'll recall, showing all easements was one of the comments from the first submittal of the plat. In talking with Dave Brossman, our surveyor, we are OK with not showing any easements. But, there should be a note that any easement not shown shall remain in perpetuity - specifically related to the electrical lines shown on the plat. It sounds like the title work did uncover an easement(s) here. I'm not sure how it is described - verbally or graphically - but however you want to show this on the plat is fine. If you do not want to show the easement from the title work graphically on the plat please insert the following language (or whatever you feel is appropriate to convey this message): "An existing electrical line crosses the property at this location. Any easements associated with this line shall remain in perpetuity". If you do want to show the easement uncovered from the title work, that of course is fine. Once you get the plat finalized you can either send it to us for a review prior to creating the mylar for recordation, or if you're comfortable with it you can bring in the mylar. I'd be glad to review a plat (hard copy or electronically) before you run the mylar. Let me know if you have any questions. Dear Mr. Page, I have completed the first review of the above referenced LLA Plat for the parcels located at 3846 Chase Street and 5455 W. 38th Avenue received on June 24, 2008, and I have the following comments: Land Surveying: 1. Need to include a Date of Preparation/Revision. 2. The subtitle needs to reflect the correct'/4 Section (southeast 1/4, not the southwest 1/4 of Section 24). 3. All adjoining subdivisions and their respective zoning need to be shown. If the adjoining land is unplatted, it shall be shown as such. 4. Show the lot line along the easterly side of 3846 Chase Street as "Lot Line Hereby Removed by This Plat". 5. Show the newly created lot line as "Lot Line Hereby Created by This Plat". (Add the word hereby to what is currently shown). 6. Need to provide the following (minimum) margins: i. 2" along the left-hand side (City requirement). ii. 1"along the top (County requirement) iii. %z" along the remaining sides. 7. Need to provide a "more particularly described as" metes and bounds portion in the Legal Description. The Legal Description shall use bearings consistent with the City datum and include the section ties, per Section 26-407 of the Municipal Code of Laws. 8. Show the Point of Commencement and True Point of Beginning on the graphical portion of the plat. 9. If there are any existing easements, such as along the existing electrical lines, these need to be shown on the plat. 10. Need to show the following on the graphical portion: i. Identify the Point of Commencement and True Point of Beginning. ii. Show adjoining subdivisions or as unplatted. iii. Show all zoning, both on-site and for adjoining properties. 11. There are no structures or other improvements on the parcel of land to be conveyed. Ms. Duncan would like to purchase the land and incorporate it into her lot as she has been taking care of the lot and cleaning it up for the past several years. Existing Site Conditions: The properties in question are located at the northeast corner of W 38th Ave and Chase St. 5455 W 38th Ave (Chase Plaza) is located directly on the corner and has frontage along W 38th Ave. It has C-1 zoning and the land use is consistent with the properties in the area as W. 38th is a major commercial corridor through the City of Wheat Ridge. The plaza currently has 74,242 square feet. Chase Plaza does own a small vacant tract of land which is approximately 8,242 directly to the north of the shopping center which is zoned R-1A. The zoning on this tract of land is consistent with that of the property of the of 3846 Chase. 3846 Chase St is located one lot to the north of Chase Plaza and is zoned R-1A. The lot is a long and narrow lot that is 24,726 square feet. The vacant tract of land is located directly to the east of rear property line of 3846. Planning comments: The parcel on which the action is being requested is zoned both Residential One A, R-1A and Commercial One, C-1. The C-1 zone district was established to provide for areas with a wide range of commercial land uses including, office, general business, and retail sales and service establishments which are supported by the community and region. The C-1 zone district can be found along the major corridors in the city. The R-1A zone district was established to provide high quality, safe and stable low density residential neighborhoods with single dwelling units and to prohibit activities of any nature which are incompatible with low density residential character. The two properties on which the action is being requested consists of two large lots. The property on the south (Chase Plaza) has a tract of land that extends behind the shopping center and is undevelopable as a part of the shopping center as the zoning, current development of the site and its location of the land make it infeasible to do so. The open tract of land is located directly the east of the property on the north and has the same zoning as the neighborhood to the north of the shopping center. The lot line is being proposed to be moved from its current north-south orientation to an east-west orientation that will follow the zoning line and will also be consistent with the property lines that are already in place The first step in the lot line adjustment process began with the pre-application meeting on March 20, 2007. A lot line adjustment is an administrative review. This means the application will be reviewed and approved at an administrative level by the Community Development Director rather than having required public hearings before Planning Commission or City Council. The applicant must submit an application for a lot line adjustment along with all the required fees and documents associated with it to the Community Development Department. The Community Development and Public Works Departments, along with other appropriate outside agencies will review the application to identify any issues that should be addressed before a final decision is made. Changes required by any of the departments reviewing the application will need to be addressed and made. The Community Development and Public Works directors will review the final plat and approve, approve with conditions, or deny the application. If approved the plat will recorded at with the Jefferson County Clerk and Recorders Office and the transfer of property will become legal. If the application is denied, the applicant may appeal the decision of denial or any of the conditions placed upon the application to the Planning Commission. An appeal must be submitted in writing to the Community Development Director within 10 days of the administrative decision. Final Plat: A Final Plat adhering to the following: a. Must use City-based bearings/coordinates (per Section 26-407-D-6 of the Municipal Code of Laws). b. All section ties are to be to Section or'/4 Section corners or PHAC points only. (Please see attached land surveying information). c. PW submittals shall be submitted in the form of: i. 2 - 24"X36" hardcopies and ii. 1 electronic copy on CD or DVD-ROM in AutoCAD 2000-2007 dwg format. 2. Geodetic Surveying Requirements: The attached Geodetic Surveying Requirements sheet must be completed and accompany the Final Plat submittal. 3. Please be advised that the plat will not be considered under review until such time as all required items have been submitted. www.ei.wheatridge.co.us February 28, 2008 To: City of Wheat Ridge Regarding: Request for purchase of parcel of land located in Wheat Ridge This is a request to allow a transfer of property in the City of Wheat Ridge. The parcel is shown on the accompanying portion of the Wheat Ridge Zoning Map. It is presently part of the property known as Chase Plaza, owned by Donald Wieringa. There are no structures or improvements located on the subject property. The owner of the residence at 3846 Chase Street, Diana Duncan, would like to purchase the property and incorporate it into her lot. Chase Plaza appears to be zoned C-I and this parcel appears to be zoned R-l A, the same zoning as the residence at 3846 Chase Street. An agreement has been reached between the seller, Donald Wiringa and the buyer, Diana Duncan to purchase the parcel, subject to any approvals required by the City of Wheat Ridge. Kurt Linn (surveyor) has been contacted regarding a pin survey of the subject property. It is our understanding that the survey would have to include both parcels (Chase Plaza and 3846 Chase Street) to show the parcel and to provide legal descriptions. That survey has been estimated to cost $2500. That expense plus any Wheat Ridge filing fees are to be paid by the buyer, Diana Duncan. Prior to proceeding with that expense, buyer and seller need to know procedures, expenses and the position of the City of Wheat Ridge regarding the transfer. It is our understanding that the transfer can be accomplished via a Lot Line Adjustment without the need for Planning Commission and/or City Council action.
