Dear Mr. Page, I have completed the second review of the Final Plat for the Hartung Amended LLA located at 3978 Harlan Street and 5965-75 W. 39th Place received on January 27, 2009, and I have the following comments: Land Surveying Comments There are a three minor changes that need to be addressed prior to Mylar®: a. There is a bearing in need of correcting in the Legal Description. It reads N89°59'22"W, and it should read N89°59'22"E. b. Please correct the typo in the Jeffco Clerk and Recorder block. C. Please remove the PLS license number from the Section Corner/Quarter-Corner symbol in the Legend. The way it appears it implies that all found corners were set by the same PLS. All other previous comments have been addressed. The plat is hereby approved for Mylar® upon completion of the above-mentioned minor changes. Therefore, the proposed lot line adjustment on the south side of the garage must accommodate a 10' setback from the south wall of the garage to the revised lot line. Maintaining the proposed 5' setback would require a variance. The proposed lot line running vertically through the framed garage and shop will not be allowed under current conditions. At one point, you had discussed with the Chief Building Official the ability to separate the shop from the garage which would require a "tear down" and reconstruction of outside walls. Keep in mind that the setback for both structures from the common lot line would be 10' if the structure is over 8 `in height. Please respond as to the intent for this building. Public Works strongly recommends that the City of Wheat Ridge no longer allow any plats to be recorded where no title research has been done. All existing and proposed easements along with proper ownership should always be shown. Therefore, I strongly recommend Note 5 be stricken from this plat, and that the Applicant be directed to have either the surveyor perform the research or provide a reference to a title policy number from the title company who performed the research. 2. Thoroughly check the Legal Description, as several portions of it do not match the rest of the plat. For example, the Basis of Bearing does not match either the graphical portion or the Section Tie Diagram. 3. Need to correct the reception number in the subtitle. 4. On the graphical portion: a. Remove the ambiguity arising from the way the 30.00' distance (from the section line to the property line) is shown.
