Supersession Clause. The property is approximately 20.3 acres in size. This property was recently annexed into the City of Wheat Ridge by City Council action on November 10, 2008. By state statute, zoning must be approved within 90 days of the annexation. The applicant is requesting an interim zoning of A-1 as there is currently no specific development proposal for the property. The annexation agreement anticipates that a Planned Commercial Development zoning application with accompanying Outline Development Plan will be submitted by the property owner or upon conveyance, a new owner. Planning Commission reviewed this request and recommended approval at a public hearing held on December 18, 2008. COMMISSION/BOARD RECOMMENDATION: This case was reviewed by Planning Commission at a public hearing held on December 18, 2008. A recommendation of approval was given for the following reasons: 1. Zoning must be in place within 90 days of annexation. 2. There will be no detrimental impact on properties in the area due to the A-1 zoning. STATEMENT OF THE ISSUES: Notice of this public hearing was published in the Wheat Ridge Transcript on December 11, 2008. The property is currently vacant and is located to the south of SH 58, north of Clear Creek and immediately west of property annexed in 2005 as part of the 2005 Coors/Cabela's development plan approvals. A three-lot subdivision plat for the property was approved by City Council on November 24, 2008, subsequent to annexation into the City on November 10, 2008. The rezoning request for A-1 (Agricultural-One) zoning is being considered an interim zoning as no specific development proposals have been provided. When the current or a future property owner brings forward a specific development request, that application will be subject to City review as a planned development rezoning. During the review of the specific development proposals during the ODP and FDP processes, additional land subdivision and easement and ROW dedication may be required. The property is designated as Business Park in the City's Urban Growth Area Plan which was adopted as an addendum to the Comprehensive Plan. Although the proposed A-1 zoning is not consistent with the land use category suggested by the Comprehensive Plan, Staff recognizes that this is an interim situation and the approved annexation agreements anticipate a PCD zoning designation in the future. The application has been through a standard City and outside agency referral process. No issues of concern have been raised. FINANCIAL IMPACT: One-time fees for the annexation and zone change were submitted with the application. The property is approximately 20.7 acres in size. (Exhibit 2, Vicinity Map) This property was recently annexed into the City of Wheat Ridge by City Council action on November 10, 2008. The annexation became effective on November 21 when the annexation plat and ordinance were recorded with the Jefferson County Clerk and Recorder. By state statute, zoning must be approved within 90 days of the annexation. The applicant is requesting an interim zoning of A-1 as there is currently no specific development proposal for the property. It is anticipated that a Planned Commercial Development zoning application with accompanying Outline Development Plan will be submitted by the property owner or upon conveyance, a new owner. The A-1 zone district allows large lot single family residential and agricultural uses such as farming, fish hatcheries and public stables. (Exhibit 3, A-1 use chart) Planning Commission reviewed and recommended approval of a three lot subdivision for the property on October 16, 2008. The plat was approved by City Council on November 24, 2008 (Exhibit 4, plat). Excluding a privately-owned train spur, utility structures and trails, the property is devoid of any permanent structures. II. NEIGHBORHOOD MEETING A neighborhood meeting recap with is attached. There were no attendees from the neighborhood. (Exhibit 5, Neighborhood Meeting Recap and Sign-up Sheet) III. ZONE CHANGE CRITERIA Staff has the following comments regarding the zone change criteria. The Planning Commission shall base its recommendation in consideration of the extent to which the applicant demonstrates the following criteria have been met: 1. The existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is in error; The official city maps have not yet been updated to reflect the annexation parcel. However, the Jefferson County zoning maps reflect the property as being zoned I-2. Planning Commission 2 WZ-08-08/Coors 2. A change in character in the area has occurred due to installation of public facilities, other zone changes, new growth trends, deterioration, or development transitions, The property is adjacent to land annexed in 2005. An Outline Development Plan (ODP) for all 198 acres and a Final Development Plan (FDP) and plat were approved for development of a Cabela's retail center. The 198 acres has not been developed but many of the infrastructure improvements associated with the project have. Those improvements include the widening and improvement of Youngfield Street, the W. 40`h Avenue/I-70 underpass from Youngfield and the relocation of a portion of the Clear Creek greenbelt trail. There have also been improvements funded by CDOT for interchange movements between State Highway 58 and I-70. This is an area in transition which, upon development, will end up being a major commercial center in the western metropolitan region. Although interim A-1 zoning is being requested, future commercial development is intended for the property. Staff concludes that this criterion has been met. The Planning Commission shall also find that the evidence supports the finding of at least four of the following: a. The change of zone is in conformance, or will bring the property into conformance, with the City of Wheat Ridge comprehensive plan goals, objectives and policies, and other related policies or plans for the area; The property is designated as Business Park in the City's Urban Growth Area Plan which was adopted as an addendum to the Comprehensive Plan. The following are excerpts from the Land Use chapter of the Comp Plan addressing this land use category. Desired Character and Location Characteristics: • Land located north (in proximity) of I-70 which easy access to the interstate or other transportation modes. • Well planned and landscaped business or industrial parks Desired Attributes: • Well buffered to minimize negative impacts to adjacent neighborhood and residential uses. • Pedestrian connections within site and from site to adjacent uses. • Connections to local and regional bicycle path systems • Businesses that require shipping or deliveries by semi-trucks. Desirable Uses: • Light manufacturing and assembly • Research and development facilities • Offices and supporting uses • Professional services The property in question was identified in the City's urban growth area boundary as a potential area of expansion. Although the proposed A-1 zone district is not consistent with the land use category Planning Commission WZ-08-08/Coors suggested by the Comprehensive Plan, Staff recognizes that this is an interim situation and the approved annexation agreement anticipates a PCD zoning designation in the future. Staff concludes that this criterion has been met. b. The proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived; Abutting the property to the west is property owned by Coors located in unincorporated Jefferson County and to the south are Clear Creek and the open space trail corridor on property also owned by Coors. The subject site recently annexed and platted is accessed via the State Highway 58 frontage road off of McIntyre to the west. No commercial development of the property can occur without a Planned Development approval. Based on the low intensity uses permitted in the A-1 zone district, Staff concludes there will be no impact on the surrounding area. Staff concludes that this criterion has been met. C. There will be social, recreational, physical and/or economic benefits to the community derived by the change of zone; The city is obligated to zone the property within 90 days of annexation. Although there will be no social, recreational, physical or economic benefits derived from the interim zone change, anticipated commercial development of the property will produce property tax and potentially, sales tax revenues. Staff concludes that this criterion has been met. d. Adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity; All agencies can serve the property with upgrades required upon development. Staff concludes that this criterion has been met. e. The change of zone will not adversely affect public health, safety or welfare by creating excessive traffic congestion, creating drainage problems, or seriously reducing light and air to adjacent properties; As the A-1 zoning will not foster development of the site, there will be no impact on traffic congestion, drainage in the area or the amount of light and air to adjacent property. There will be no negative impact to the public health, safety and welfare as a result of the A-1 zoning. Staff concludes that this criterion has been met. 3. The application is in substantial compliance with the applicable standards set forth in the Architectural and Site Design Manual Planning Commission WZ-08-08/Coors As there are no structures proposed for the property, the commercial/industrial design standards in the Architectural and Site Design Manual cannot be applied. Staff concludes that this criterion is not applicable. V. AGENCY REFERRALS All affected service agencies were contacted regarding the ability to serve the property. Colorado Department of Transportation: No response. Consolidated Mutual Water: Can serve. Fairmount Fire: No objections. Jefferson County Planning and Zoning: No comment at this time. The County will want to review any formal proposal for development. West Table Mountain Sanitation District: No response. Wheat Ridge Public Works: The Public Works Department has no problems with the interim zone change. Because there is no accompanying development proposal, preliminary drainage and traffic information has not been required. VI. STAFF CONCLUSIONS AND RECOMMENDATION Staff has concluded that in order to comply with State statutes regarding annexation, the property must be zoned within 90 days. As there is no specific commercial development proposal at this time, interim zoning of the property as A-1 is appropriate. Because there will be no detrimental impact on properties in the area, a recommendation of approval is given for Case No. WZ-08-08. IX. The property is approximately 20.7 acres in size. (Exhibit 2, Vicinity Map) This property was recently annexed into the City of Wheat Ridge by City Council action on November 10, 2008. The annexation became effective on November 21 when the annexation plat and ordinance were recorded with the Jefferson County Clerk and Recorder. By state statute, zoning must be approved within 90 days of the annexation. The applicant is requesting an interim zoning of A-1 as there is currently no specific development proposal for the property. It is anticipated that a Planned Commercial Development zoning application with accompanying Outline Development Plan will be submitted by the property owner or upon conveyance, a new owner. The A-1 zone district allows large lot single family residential and agricultural uses such as farming, fish hatcheries and public stables. (Exhibit 3, A-1 use chart) Planning Commission reviewed and recommended approval of a three lot subdivision for the property on October 16, 2008. The plat was approved by City Council on November 24, 2008 (Exhibit 4, plat). Excluding a privately-owned train spur, utility structures and trails, the property is devoid of any permanent structures. H. NEIGHBORHOOD MEETING A neighborhood meeting recap with is attached. There were no attendees from the neighborhood. (Exhibit 5, Neighborhood Meeting Recap and Sign-up Sheet) III. ZONE CHANGE CRITERIA Staff has the following comments regarding the zone change criteria. The Planning Commission shall base its recommendation in consideration of the extent to which the applicant demonstrates the following criteria have been met: 1. The existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is in error; The official city maps have not yet been updated to reflect the annexation parcel. However, the Jefferson County zoning maps reflect the property as being zoned I-2. Planning Commission WZ-08-08/Coors 2. A change in character in the area has occurred due to installation of public facilities, other zone changes, new growth trends, deterioration, or development transitions, The property is adjacent to land annexed in 2005. An Outline Development Plan (ODP) for all 198 acres and a Final Development Plan (FDP) and plat were approved for development of a Cabela's retail center. The 198 acres has not been developed but many of the infrastructure improvements associated with the project have. Those improvements include the widening and improvement of Youngfield Street, the W. 40th Avenue/I-70 underpass from Youngfield and the relocation of a portion of the Clear Creek greenbelt trail. There have also been improvements funded by CDOT for interchange movements between State Highway 58 and I-70. This is an area in transition which, upon development, will end up being a major commercial center in the western metropolitan region. Although interim A-1 zoning is being requested, future commercial development is intended for the property. Staff concludes that this criterion has been met. The Planning Commission shall also find that the evidence supports the finding of at least four of the following: a. The change of zone is in conformance, or will bring the property into conformance, with the City of Wheat Ridge comprehensive plan goals, objectives and policies, and other related policies or plans for the area; The property is designated as Business Park in the City's Urban Growth Area Plan which was adopted as an addendum to the Comprehensive Plan. The following are excerpts from the Land Use chapter of the Comp Plan addressing this land use category. Desired Character and Location Characteristics: Land located north (in proximity) of I-70 which easy access to the interstate or other transportation modes. Well planned and landscaped business or industrial parks Desired Attributes: • Well buffered to minimize negative impacts to adjacent neighborhood and residential uses. • Pedestrian connections within site and from site to adjacent uses. • Connections to local and regional bicycle path systems • Businesses that require shipping or deliveries by semi-trucks. Desirable Uses: • Light manufacturing and assembly • Research and development facilities • Offices and supporting uses • Professional services The property in question was identified in the City's urban growth area boundary as a potential area of expansion. Although the proposed A-1 zone district is not consistent with the land use category Planning Commission WZ-08-08/Coors suggested by the Comprehensive Plan, Staff recognizes that this is an interim situation and the approved annexation agreement anticipates a PCD zoning designation in the future. The proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived; Abutting the property to the west is property owned by Coors located in unincorporated Jefferson County and to the south are Clear Creek and the open space trail corridor on property also owned by Coors. The subject site recently annexed and platted is accessed via the State Highway 58 frontage road off of McIntyre to the west. No commercial development of the property can occur without a Planned Development approval. Based on the low intensity uses permitted in the A-1 zone district, Staff concludes there will be no impact on the surrounding area. Staff concludes that this criterion has been met. C. There will be social, recreational, physical and/or economic benefits to the community derived by the change of zone; The city is obligated to zone the property within 90 days of annexation. Although there will be no social, recreational, physical or economic benefits derived from the interim zone change, anticipated commercial development of the property will produce property tax and potentially, sales tax revenues. Staff concludes that this criterion has been met. d. Adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity; All agencies can serve the property with upgrades required upon development. Staff concludes that this criterion has been met. e. The change of zone will not adversely affect public health, safety or welfare by creating excessive traffic congestion, creating drainage problems, or seriously reducing light and air to adjacent properties; As the A-1 zoning will not foster development of the site, there will be no impact on traffic congestion, drainage in the area or the amount of light and air to adjacent property. There will be no negative impact to the public health, safety and welfare as a result of the A-1 zoning. Staff concludes that this criterion has been met. 3. The application is in substantial compliance with the applicable standards set forth in the Architectural and Site Design Manual. Planning Commission 4 WZ-08-08/Coors As there are no structures proposed for the property, the commercial/industrial design standards in the Architectural and Site Design Manual cannot be applied. Staff concludes that this criterion is not applicable. V. AGENCY REFERRALS All affected service agencies were contacted regarding the ability to serve the property. Colorado Department of Transportation: No response. Consolidated Mutual Water: Can serve. Fairmount Fire: No objections. Jefferson County Planning and Zoning: No comment at this time. The County will want to review any formal proposal for development. West Table Mountain Sanitation District: No response. Wheat Ridge Public Works: The Public Works Department has no problems with the interim zone change. Because there is no accompanying development proposal, preliminary drainage and traffic information has not been required. VI. STAFF CONCLUSIONS AND RECOMMENDATION Staff has concluded that in order to comply with State statutes regarding annexation, the property must be zoned within 90 days. As there is no specific commercial development proposal at this time, interim zoning of the property as A-1 is appropriate. Because there will be no detrimental impact on properties in the area, a recommendation of approval is given for Case No. WZ-08-08. IX. The property annexed contained a total of 198 acres. An Outline Development Plan (ODP) for all 198 acres and a Final Development Plan (FDP) and plat were approved for development of a Cabela's retail center None of the 198 acres has been developed to this date although many of the supporting infrastructure improvements have been completed. Those improvements include the widening and improvement of Youngfield Street, the W. 40th Avenue 1-70 underpass from Youngfield and the relocation of a portion of the Clear Creek greenbelt trail. Abutting the property to the west is property owned by Coors located in unincorporated Jefferson County and to the south are Clear Creek and the open space trail corridor on property also owned by Coors. The subject site being annexed and platted is accessed via the State Highway 58 frontage road off of McIntyre to the west. Excluding the train spur, utility structures and trails, the property is devoid of any permanent structures. A zoning process will be used to approve interim zoning on the property. Because there will be no requirement for the submittal of technical documents, the zone change can be processed relatively quickly. No additional fees will be required with the application as fees were zoning were included in the annexation fees. The first step in the rezoning began with the pre-application meeting on October 20. The second step required by the Community Development Department will be to conduct a neighborhood meeting. For this meeting, the applicant must inform all property owners within a 600 foot radius of the property via mail or hand delivery of the meeting. This meeting is scheduled for Thursday, November 13, 2008 from 6:00 PM until 8:00 PM in the police training room at the Wheat Ridge Municipal Building. The Community Development Department will provide the mailing labels and Coors must prepare a notification letter. A sample letter was provided. A staff planner will attend the meeting to discuss the zoning process as it affects the parks master planning process. Upon submittal of the land use application, the assigned staff member will refer the application to other city departments and outside agencies for their input. This referral period is usually lasts for two weeks. Once referral comments are received back and the internal planning department review is complete, a list of comments will be provided to the applicant for required revisions. If all requirements are to the satisfaction of the case planner, the application will be scheduled for a public hearing before the Planning Commission. To meet legal noticing requirements for the public hearing, a public notice will be advertised in the Wheat Ridge Transcript, letter notices will be sent to property owners within a 300' radius and the property will be posted for 15 days. The Planning Commission public hearing is scheduled for December 4, 2008. A staff report will be prepared with a recommendation of approval, approval with conditions, or denial. At the hearing, staff will present evidence to support their recommendation. The public will also be allowed to present evidence or give testimony in support or in opposition of the project. The Planning Commission will recommend approval or denial of the project based on the testimonies given by staff, applicant and the public. After the Planning Commission hearing, the case will be heard before City Council. There is a first reading of the ordinance which publically announces the hearing. The public hearing will occur at the second reading which usually occurs about a month after the Planning Commission hearing. City Council will make the final determination to approve, approve with conditions or deny the application. The City Council meeting will 2 follow the same format as the Planning Commission hearing, at which, the City Council will give a final ruling on the case. The zone change will typically be effective fifteen days after publication.
