This project is also known by the Planning and Development Commission as Case No. MS-00-02. Regarding the above described project and property this notice serves to document and communicate our a) Opposition to and disapproval of the project b) Disappointment regarding the general handling of this project by the City of Wheat Ridge, and c) Request for contact and follow up regarding issues presented in this letter. Statement of Basis for Objection: This project affects us in many ways, both directly and indirectly. We own and live in the property at 6209 West 261h Avenue, at the corner of Kendall and 26`h. We have lived here for almost 6 years. Our property is just to the south, and borders a portion of the development project, specifically, the new sewer line being installed along Kendall Street. We believe this development project was not conducted in compliance with City of Wheat Ridge and/or State of Colorado requirements and generally not in good faith because we were not made aware of the project by the City of Wheat Ridge or the Developer. It also violates the City of Wheat Ridge's "Comprehensive Plan for the Area". When we first observed the commencement of physical site activities, approximately June 18th, we initiated contact with the City and the Developer. It was then already a full month after the public hearing and many months after initial City awareness that we learned of the development project. We take issue with this project for several reasons, which are itemized below. Issues: 1. We were not notified concerning this case or the public hearing of 5-18-2000. We believe it is a legal requirement to notify us via certified letter. (Supposedly, the MetroScan database used to identify us was incorrect, although Jefferson County records are correct and other City of Wheat Ridge agencies regularly communicate with us.) 2. Construction activities will be conducted along the border of our property. Common courtesy dictates that we should be contacted during the planning process. 3. The Planning Commission's response thus far is unacceptable to us. When we inquired regarding the project and lack of contact, we were told in summary "Sorry, it's a done deal". There should be recourse or procedures to address instances where proper requirements are not met, despite the fact that it was unintentional. What is the procedure for handling failures to comply with the requirements related to public hearings? We believe these procedures should be implemented to determine whether it is appropriate and fair to cease and desist this development project. 4. This project violates the City of Wheat Ridge's Comprehensive Plan for the Area, which is Single Family Residential (no more than four dwelling units per acre). Although the Comprehensive Plan specification is in the Staff Report, violation of the Plan is not mentioned in the report's Staff Conclusions and Recommendation and it is not entered into the record. The Comprehensive Plan was neither mentioned in the public hearing minutes nor entered into its record. What is the value of the City of Wheat Ridge's Comprehensive Plan if it is not followed? 5. We were denied permission for a second dwelling unit to include an existing building on our property, which is larger than either of these two lots. 6. It has been stated in recent years by the City of Wheat Ridge Planning and Development personnel that development would not be allowed along Kendall Street without an intergovernmental agreement between the City of Edgewater and the City of Wheat Ridge. Kendall Street is a short, dead-end street servicing more than 220 dwelling units in Edgewater and Wheat Ridge. Police jurisdiction and traffic issues have been a problem along this portion of Kendall Street. This development compounds these known issues, and the need was again mentioned during the 5-18-2000 public hearing, yet this project was approved without an intergovernmental agreement. 7. Another issue related to the one above is traffic management on Kendall Street. The City of Edgewater does not have a comprehensive Neighborhood Traffic Management Program as the City of Wheat Ridge does. 8. Many very old and irreplaceable trees were destroyed by the Developer without contacting the City or the affected property owners. Two years ago, a new sewer line was installed along Kendall Street without damaging or removing these trees. We are concerned that our trees and other property may be removed or otherwise damaged. Will new trees be planted to replace those destroyed in the right- of-way/easement? Conclusion: We fully support the rights of property owners to make changes within the bounds of community plans, regulations and neighborhood cooperation. However, several aspects of this development project violate these principles. Had we been informed of this development project, we would have objected to the project because it violates the City of Wheat Ridge's Comprehensive Plan, which specifies "Single Family Residential (four dwelling units per acre)". An intergovernmental agreement between the City of Edgewater and the City of Wheat Ridge needs to be created. We would like the City of Wheat Ridge Planning Commission to arrange a meeting where we can discuss each of the above issues with someone authorized and qualified to address them. PUBLIC FORUM There was no one signed up to speak before the Commission on unscheduled matters. PUBLIC HEARING A. Case No. MS-00-02: Request for a two-lot minor subdivision to move a lot line to create two lots of equal size at 2651 and 2661 Kendall. The case was presented by Mary Austin. She reviewed the staff report and presented slides and overheads of the subject property. She entered all pertinent documents into the record and advised the Commission that there was jurisdiction to hear the case. Staff recommended approval of the application for reasons outlined in the staff report. In response to a question from Commissioner THOMPSON, Ms. Austin stated that no response had been received from certified public notices sent to neighboring property owners within a 600-foot radius of the subject property. In response to Commissioner SNOW, Greg Knudson stated that the entire subdivision plat had been reviewed and approved by the city surveyor. He also explained that because the right-of- way on Kendall is owned by the City of Edgewater, no request was made for dedication of curb, gutter and sidewalk. An intergovernmental agreement between Edgewater and Wheat Ridge would probably be required if future improvements are ever considered for Kendall Street. Cy Butte 12846 Grape Street, Thornton Mr. Butte, representing T. C. Properties, was sworn in by Vice Chair SNOW. Commissioner THOMPSON asked how many entrances were planned from Kendall Street. Mr. Butte replied there would be four. Vice Chair SNOW asked if there were any others present who wished to address the Commission regarding the case. There was no response. The motion passed 5-0 with Commissioners COLLINS, GOKEY and MACDOUGALL absent. 8. CLOSE PUBLIC HEARING Vice Chair SNOW declared the public hearing closed. 9. OLD BUSINESS A. Zoning Amendment - PCD's - After, the Planning Commission public hearing regarding a proposed code change to eliminate the one-acre minimum size required for rezoning to PCD, Alan White spoke with the City Attorney regarding the Commission's request to include in the ordinance another amendment which would enable the City to require more stringent standards than in regular zone districts. The City Attorney concluded that this ability is already included in the code and, therefore, an ordinance will not be forthcoming. > 10. NEW BUSINESS A. DRCOG/APA Planning Conference - There was discussion regarding this conference which was attended by Commissioners COOPER, McNAMEE and THOMPSON. Commissioner THOMPSON indicated she would like to see more control given to the Planning Commission in cases where commercial property is adjacent to residential property. She also asked if an ordinance could be brought before Planning Commission and City Council every couple of months to address some of these situations. Alan White stated that City Council's top three priorities are (1) similar uses, (2) temporary uses, and (3) spacing requirements for private schools. Commissioner SNOW stated that she would like to explore the possibility of expanding the authority of the Planning Commission and City Council in rezoning cases. She would also like to see a requirement for site plans on all buildings except for single family homes. Planning Commission Page 3 May 18, 2000 Alan White commented that the City Attorney is working on a proposal to revamp the zoning regulations and suggested that many of these areas could be considered at that time. Design standards were discussed at the workshop. Commissioner COOPER suggested that design standards would prevent development coming into Wheat Ridge that is not allowed in surrounding communities. Alan White informed the Commission that the request for proposal for a consultant to do a streetscape plan will be rewritten to include architectural guidelines as well. It was moved by Commissioner THOMPSON and seconded by Commissioner COOPER that Planning Commission recommend to City Council that they consider, as their fourth priority, a review of ordinances to include a site plan and regulation of uses and placement of uses and other issues on all but R-1 zone categories. The motion carried 5-0 with Commissioners COLLINS, GOKEY and MACDOUGALL absent. There was a consensus of Commission members to have an annual tour of projects that have been approved by the Planning Commission. The tour is tentatively planned for August. Commission members will make suggestions to staff for possible sites to visit. B. Public Hearing Notification - Alan White suggested that the Commission reconsider the requirement to notify all property owners within a 600-foot radius whenever there is any public hearing. This requirement has significantly increased the cost to the applicant for sending certified letters. It was decided that the Commission will take the matter under advisement. C. Economic Development Commission - The Planning Commission chairman is to appoint a representative to the newly formed Economic Development Committee. The first meeting of the Commission is planned for May 30. Alan White requested that Commissioners interested in serving on this Committee contact Don MacDougall, Planning Commission Chair. 11. X1 I. REQUEST The applicant is requesting approval of a two lot minor subdivision for property located at 2651 and 2661 Kendall Street. The property is zoned R-2, Residential-Two (Exhibit 1, Zoning Map) and is currently vacant. II. CASE HISTORY / SUBDIVISION DESIGN The property was rezoned in 1984 from R-1, Residential-One to R-2, Residential-Two. R-2 remains as the current zoning on the property. Pursuant to Section 26-14 of the Wheat Ridge Code of Laws, the R-2 zone district allows the permitted principles uses of single family dwellings and duplexes. The current lot area of the parcels would permit a maximum development of 3 housing units. The configuration of the parcels is such that a duplex structure would be permitted on the northern parcel and a single family home on the southern parcel. The minor subdivision will move an existing lot line to create two uniform lots. Lot 1 and Lot 2 will be rectangular shaped parcels of equal size at 17,341.5 square feet each. Each new lot with this minor subdivision plat will contain enough land area to allow for the construction of a duplex structure. Easements have been reserved adjacent to the property lines as required by the City's Subdivision Regulations for utilities and access. Minor subdivisions without public street dedication require Planning Commission action only. All requirements of the Subdivision Regulations have been met. Staff has received no objection to or public comment regarding this minor subdivision thus far. III. AGENCY REFERRALS All service agencies can serve the property when developed. Public Service Company can serve the property with requested utility easements adjacent to the front and rear lot lines for the installation and maintenance of utilities. These easements are depicted graphically on the plat document. Wheat Ridge Fire District will provide service to the property. The existing right-of-way for Kendall St. is within Edgewater city limits. The City of Edgewater Public Works Department has commented that construction of public improvements (curb, gutter, sidewalk) along the property's frontage are not required. The City Surveyor has reviewed the final plat document for completeness and has indicated that it is in compliance with the City's Subdivision Regulations. The drainage improvements shall be constructed in conformance with the approved drainage plan and will be inspected and approved prior to issuance of a Certificate of Occupancy. IV. STAFF CONCLUSIONS AND RECOMMENDATION Upon review of the above request, staff concludes that the applicant is subdividing two unequal parcels into two parcels of equal size. The requirements of the Subdivision Regulations have been met and the parcels exceed the lot area requirements of the R-2 zoning district. Therefore, staff recommends APPROVAL for the following reasons: All requirements of the City's Subdivision Regulations have been met. Unless otherwise designated, all referenced specifications, standards or policies shall be the latest edition as revised or updated by approved supplements published and issued prior to the date of the building permit. REQUIREMENTS All materials sampling and testing shall be performed by certified, experienced and qualified materials testing technicians who work under the supervision of a registered professional engineer in the State of Colorado. All materials sampling and testing equipment shall be serviceable and calibrated. Soil classifications and moisture-density curves shall be provided to the Department of Public Works inspector prior to in-place density testing. Materials testing technicians shall furnish copies of failed test results to the inspector promptly as the results become available. All mature trees to be trimmed of branches up 6'-8' from the ground to allow for natural visual observation from surrounding areas to the parking lots and building. 2. All shrubs and bushes mature height to not exceed 36". This height reduces the risk of persons hiding. It also allows for natural visual observation onto the property both for the parking lot and building. 3. Plants/landscape immediately next to the building should be low-growing ground cover, not to exceed 18" mature height to allow for maximum natural visual observation and eliminate concealment for potential offenders. 4. There should be minimal landscaping immediately next to parking areas and sidewalks. Landscaping near vehicles and pedestrian areas often raises the perception of criminal activity. 5. Ground cover should not include rock material. Rocks can be used to break windows in the buildings and cars. BUILDINGS: 1. The building finish should be with an anti-graffiti paint or sealant. 2. It is unknown from the plans where the buildings have entrances and windows. Provided that there are several entrances and windows that would allow for consistent observation of the parking areas normal users and traffic, the parking layout appears to be adequate. If there are places around the buildings that do not allow for observation, the parking areas should be reconfigured to reduce the risk of criminal activity to persons and property. 3. From the site plan, it is not possible to review the interior layout of the building for any crime prevention recommendations. Page 1 of 2 FENCING: 1. The fence illustrated in the south elevation should not be constructed of a solid material. Any solid privacy fencing/walls should be avoided as they provide cover and concealment, raising risk and fear of crime. Fences should be constructed of material or in a manner that allow s for observation through. Material or a design such as wrought iron provides visibility and discourages and prevents climbing over. 2. Fencing should be sealed or finished with an anti-graffiti paint/sealant to aid in the ease of clean up. SITE: 1. During construction, the property should be clearly posted with "No Trespassing" signs. This may help deter trespasses, and allow the Police Department to cite offenders with the crime along with any others offenses that may be committed by trespassers. LIGHTING: 1. Exterior lighting around the buildings and in parking lots should be a minimum of 1.5 candle minimum maintained. This will provide for brightly lit areas that discourages criminal activity due to the illusion/perception of observation and recognition. 2. Interior halls of building should be lit with a minimum of three foot candle minimum maintained. Brightly lit accesses and passage ways, discourage criminal activity due to the illusion/perception of observation and recognition. thus giving a higher sense of security for the normal users. From these plans, I have no further recommendations at this time. Revisions in the plans, may alter my recommendations. While my recommendations do not guarantee a crime-free environment, it has been experienced that application of the concept of Crime Prevention Through Environmental Design (CPTED) will reduce the opportunity for crime to occur and will enhance the quality of life.
