The property in question is located at 5055 Tabor Street and is zoned I (Light Industrial). It is my understanding that the property was originally used residentially but was converted to a commercial trucking operation after you purchased it. This included conversion of the home into a business office and the paving of a parking area for vehicle storage. You have indicated that you have a potential purchaser who would like to construct an additional building on the property to perform automotive repair. Automotive repair, including body and paint work, is an allowed use in the Light Industrial zone district. Without the submittal of a survey with site plan for the proposal, it is difficult for Staff to ascertain the extent of the improvements required with construction of a new building. The property appears as if it may be substandard with today's Code of Laws for the City of Wheat Ridge relative to paving, site access and landscaping. While a non-conforming property can remain "as is" indefinitely, when a new structure is proposed, the City can re-evaluate improvements on the property and require compliance. A building permit will be issued for new construction if the following requirements can be met: All zoning standards including building setbacks and height restrictions Submittal of a grading and drainage report Installation of commercial landscaping along the street frontage and interior of the property Installation of a new curb cut for access The paving of drive and parking areas associated with the automotive repair, including employee and customer parking and a screened area where vehicles being worked on are stored The dedication of right-of-way for Tabor Street including the installation of public improvements including curb, gutter and sidewalk and street widening The building will have to meet all requirements of the 1997 Uniform Building and Fire Codes The individual water, sanitation and fire districts requirements for taps, line upgrades and possible fire hydrant installation Because only one building per lot is allowed in Wheat Ridge, you will be required to subdivide the property into two parcels or pursue approval of a planned building group plan to allow two structures on a single parcel. Attached are appropriate sections of the zoning codes related to planned building groups, development standards, parking and landscaping. There may be other requirements not addressed or issues unforeseen at this time. The provisions and regulations set forth in this section are generally applicable throughout the various zone districts. Furthermore, these regu- lations are in addition to any regulation, standard or requirement specifically set forth in any other section of this Zoning Ordinance or any other section of the Wheat Ridge Code of Laws. (A) Storage of Flammable Liquids or Gases: No aboveground storage of flammable liquids or gasses in excess of two thousand (2,000) gallons shall be permitted in any district other than the Industrial District unless approved as a special use and in conformance with the Uniform Fire Code and other applicable laws. § 26-30 (B) Building Lots: Every building or structure hereafter erected within the City of Wheat Ridge shall be located on a lot, as defined herein, and in no instance shall there be more than one (1) main building on one (1) lot except as permitted within a Planned Development District as set forth in section 26-25, or as permitted by the Planned Building Group (PBG) provisions set forth below. (C) Planned Building Groups (PBG) (1) Purpose. The primary purpose of this pro- vision is to allow flexibility and diversifi- cation in the location of structures and the design and land use of a lot held under single or common ownership by permit- ting more than one (1) main structure to be constructed thereon. It promotes better overall utilization of a building site by promoting improved vehicular and pedes- trian circulation and access, more effi- cient layout of parking and a better over- all landscape and architectural design scheme for the total site, while at the same time ensuring adequate standards relating to public health, safety, welfare and convenience in the use and occupancy of buildings and facilities in planning build- ing groups. (2) Scope and limitations. The procedures and provisions set forth in this section shall be applicable to all zone districts except Planned Development zone dis- tricts as those district regulations provide for multiple main structures on a lot un- der different procedures and provisions. It is not intended for this provision to be used to circumvent the requirements of the Zoning Ordinance for lot perimeter setbacks, lot coverage, residential density or any other provisions for the Zoning Ordinance except the requirement that only one (1) main building is permitted on one (1) lot. It also shall not be construed to waive any provisions of the subdivision regulations. Any subsequent division of a lot developed in accordance with the pro- visions set forth herein shall be required to meet all subdivision requirements.
