2. The area for displaying the U-Haul vehicles would not hold more than eight (8) vehicles,

1. CALL THE MEETING TO ORDER: The meeting was called to order by Chair HOWARD
at 7:30 p.m. on March 23, 2000 in the Council Chambers of the Municipal Building, 7500 West

The following is the official set of Board of Adjustment minutes for the Public Hearing of March 23, 2000.
A set of these minutes is retained both in the office of the City Clerk and in the Department of Planning and
Development of the City of Wheat Ridge.

It was moved by Board Member MAURO and seconded by Board Member MONTOYA

There was no one signed up to speak.
5. PUBLIC HEARING
A. Case No. TUP-00-01: (continued from February 24, 2000) An application filed by BGT
Enterprises for approval of a temporary use permit to maintain existing storage of RV's at 10165
West 49th Avenue (Lot 3) and to allow commercial vehicle display and storage at 10145 West
49th Avenue (Lot 1) without lot improvements. Said properties are zoned Commercial-One.
This case was presented by Alan White. He reviewed the staff report, presented slides and
overheads of the subject property and entered all pertinent documents into the record which were
accepted by Chair HOWARD. He advised that all notification and posting requirements had been
met and there was jurisdiction for the Board to hear the case. He answered the five criteria used in
evaluating a request for a temporary use permit. Staff recommended denial of the application for
reasons outlined in the staff report.
Board Member ECHELMEYER expressed concern that there has been a temporary use on this
site since 1987. Mr. White stated that staff shared that concern as well as the concern that no
outside storage, other than the allowed RV storage, should occur in this area.
In answer to a question from Chair HOWARD, Mr. White stated that the applicant has not been
operating without a TUP since 1986, although there have been several TUP's granted over this
period of time.

Mr. Oman, the applicant, was sworn in by Chair HOWARD. He stated he purchased the
property four and a half years ago and has spent considerable funds to improve the property. He
noted that the overhead was taken at the time he bought the property and therefore does not show
the improvements. At the time of purchase, the entire area was RV storage. Since that time the
property was divided in to five lots, three of which have been sold to and developed by Foothills
Bank, Burger King and Amoco Oil. RV storage is now confined to a portion of the two remaining
lots which are being marketed. He has also begun road improvements which will be completed
upon the sale of those lots. He would like to keep the RV storage and U-Haul business for cash
flow until the lots are sold. He stated that it is not his intent to keep renewing the TUP. He would
rather have the U-Hauls on the triangular portion of the property rather than placing all RV's in that
area with screening. He would like to display eight vehicles in the subject area which is visible
from the street. Other U -Haul vehicles would be placed north of his office which would not be
visible from the street. He commented that this is the third time the U-Haul location has been
changed but the first time it has become a problem.
In response to a question from Board Member MAURO, Mr. Oman stated that he intends to
keep gravel in the area where the U-Hauls are displayed.
Board Member MONTOYA asked if the applicant had the right to store RV's in the area where
the U-Haul vehicles are presently displayed. Mr. White replied there is no evidence that RV
storage would not be permitted in the area.
Board Member Echelmeyer requested that Alan White read into the record a memo dated January
11, 2000 to Meredith Reckert, Senior Planner from Martin Omer, Economic Development
Specialist. Mr. White read the letter as follows:

"Thank you for the opportunity to comment on this application. This is a request for a
Temporary Use Permit to allow the uses of outdoor vehicle storage on Lot 3 and truck and
trailer rental on Lot 4 of the Bluegrass Terrace subdivision. The properties are generally
located just west of Kipling Boulevard and north of Interstate 70. Economic Development
staff opposes the permitting of these uses on these properties. Staff worked with the
property owner in December of 1998 for the erection of a sight obscuring fence surrounding
the storage lot (Lot 3) In discussions with the property owner, staff was told that the
storage lot was to be a temporary land use until the property, which was being actively
marketed, was sold. There was no discussion about truck and trailer rentals on Lot 4. The
property owner did attach screening material to the chain link fence, as agreed, although
equipment and vehicles are still visible from 49th Avenue and Kipling Boulevard. Recently,
the property owner has begun to use Lot 4 for parking and display of rental trucks and
trailers. In the last year, Planning staff has not been contacted by anyone expressing
interest in purchasing either of these properties or development for more permanent land
uses. Economic Development Staff is concerned that outdoor storage lot and rental truck
and trailer businesses may, by default, evolve into the permanent land uses for these
properties. Permitting the continued use of these properties for storage and rental uses
would be a negative influence on surrounding property values. In 1998, the City Council
expressed its desire to upgrade the visual quality of the area surrounding the Kipling/I-70
intersection. In the same year, the residents of the city voted to increase the lodging tax to
address crime and visual issues associated with the Kipling/I-70 intersection area.
Permitting the marginal land uses associated with this application would be counter
productive to the City Council's goals for the area by frustrating the development of higher
quality land uses. Economic Development staff recommends denial of the application, and
looks forward to quality permanent land uses on the property which will benefit the
surrounding property owners/businesses and the long term improvement to this area of the
city.
Chair HOWARD asked if anyone wished to speak to this matter. There was no response and no
one had signed the public hearing roster.
Board Member MONTOYA asked if he should vote on this matter since it was continued from
the February meeting before he was a member of the Board. Chair HOWARD advised that he
could vote because the matter was not discussed at the February meeting.
Upon a motion by Board Member HOVLAND and second by Board Member the
following resolution was stated:

Specialist's conclusion that this property, if given a Temporary Use Permit for a
year, would present a traffic hazard to the area; it would have a blighting effect on
the area, which is blighted to a degree now; and it would be detrimental to the
program that the City Council has outlined, even to the point of asking for
contributions to improve this particular site area for the betterment of the
community.
The motion died for lack of a second.
Upon a motion by Board Member MAURO and second by Board Member BROWN, the
following resolution was stated:

B. Case No. WA-00-02: (continuedfrom February 24, 2000) An application filed by Trailer
Source, Inc. for an interpretation of allowed uses as listed in their Planned Commercial
Development (Tabor Development Planned Commercial Development Outline Development
Plan.) Said property is located at 4651 Tabor Street and zoned PCD.
This case was presented by Alan White. He reviewed the staff report, presented slides and
overheads of the subject property and entered all pertinent documents into the record which were
accepted by Chair HOWARD. He advised that all notification and posting requirements had been
met and there was jurisdiction for the Board to hear the case. Staff recommended denial of the
application for reasons outlined in the staff report. He entered a letter dated March 14, 2000 from
Kenneth G. Brengle, Jr., President of the West Chamber indicating his support for the applicant's
request. The letter was made a part of the case file.
Board Member BROWN asked the staff's reason for the opinion that the sale of all-terrain
vehicles (ATV's) and snowmobiles should not be allowed. Mr. White explained staff s
interpretation is that there is nothing similar to ATV's or snowmobiles in the list of permitted uses
for this development.
Mr. White requested that staff be given the opportunity for a closing statement before a motion is
considered.

JURISDICTION:
The property is within the City of Wheat Ridge, and all notification and posting requirements have been met,
therefore, there is jurisdiction to hear this case.
I. REQUEST
The applicant requests approval of a temporary use permit on C-1 zoned property. Although
published as two separate properties requiring temporary use approval (10165 and 10145 W. 49th
Avenue), staff subsequently determined that the property at 10165 W. 49`h Avenue does not require
Board of Adjustment approval (see section II of this report).
Therefore, the request is reduced to a temporary use permit (TUP) to allow commercial vehicle
display and storage without lot improvements for property located at 10145 W. 49`h Avenue. The
owner, BGT Enterprises, has requested the TUP to allow them to utilize the property for U-Haul
display and storage while the property is being marketed for sale and eventual development.
II. CASE HISTORY
In 1984, the land located at the southwest cornet of W. 50' Avenue (extended) and Kipling was
rezoned from A-1, R-1 and R-IA to C-1. Uses deemed not to be in character with the Kipling
Activity Center were excluded. Uses not allowed included rental agencies having outside storage and
vehicle sales lots.
Subsequent permits and modifications were approved as follows:
On August 27, 1987, a request for a TUP to allow outside storage of boats and RV's
was approved by the BOA. This approval was based on the use being interim until the
site could be sold.
- In July of 1988, the TUP was renewed and expanded to allow outside storage and lease
of U-Haul vehicles.
- In September of 1988, the BOA approved a request to expand the TUP to allow the
sales of boats and RV's.
- In February of 1989, approval was granted to expand the approved uses to allow
vehicle parts and accessory sales.
- In March of 1990, a final temporary use was approved.
- In 1990, a rezoning was approved which removed prior conditions relating to outside
storage.
The property was then subdivided into five parcels to accommodate future sales and development
pursuant to Case MS-96-6 (Exhibit `A'). The plat also reflected the relocation of the I-70 Frontage
Road and a small piece of excess right-of-way which was vacated back to the owner. A site plan was
approved, (attached as Exhibit `B'), with restrictions placed on allowed uses and a provision for the
"grandfathering" of the existing RV storage as follows (see City Council minutes attached as Exhibit
C
1. Auto, RV, boat and camper sales, or rental for same, semi-truck parking, and any other
use that requires outside storage, display, or operations, shall be excluded as a
permitted use.
2. No billboard signs may be permitted.

3. Current RV storage use may be allowed on site, except upon full build out of site plan
4. An island or median be constructed between Lot 1 and 2 to prevent left-hand turns.
5. A drainage plan be filed and accepted by Public Works before building permits are
issued, ensuring adjacent properties protection from additional run-off.
Of the four lots affected by the site plan approval, Lot 1 has been redeveloped into a Foothills Bank
facility. A fast food restaurant was built on Lot 2. Lot 3 is being used for RV storage and has a
permanent cell tower on it along with a small building used as the office for the RV storage and U-
Haul rental. Street A was extended between W. 50`h Avenue and W. 49`h Avenue. Upon permanent
development of Lot 3, W. 50' Avenue will be built to the western edge of the property and Street B
extended to connect with Street A. Lot 4 is the subject of this TUP request.
While RV storage is allowed as an interim use on the vacant parcels until they are sold and
developed, the display and storage of U-Haul rentals is not. There are roughly 15 U-Hauls (motorized
and non-motorized) parked on the north portion of Lot 4 (10145 W. 49' Avenue) with the office
located in the same building as the RV storage office (across the street at 10165 W. 49' Avenue).
Access to the U-Haul storage area is by way of a curb cut on W. 49" Avenue. There is curb and
gutter installed around the perimeter of the lot. If zoning permitted the use and this were converted to
a permanent use, paving of the display area would be required plus the installation of permanent
landscaping meeting the commercial standards. Because this is in interim use, no permanent
improvements are proposed.
The applicant has submitted information regarding the request attached as Exhibit `D'.
III. AGENCY REFERRALS
Public Works Traffic and Survey Divisions have no comments at this time.
Arvada Fire Protection District can service the U-Haul display from the street. There are adequate
hydrants in place to serve the property.
The City's Economic Development Specialist has submitted comments attached as Exhibit `E'. Staff
would once again point out that the interim RV storage was permitted by City Council pursuant to
subdivision and site plan approval. The TUP for the display and storage of U-Hauls on the southern
property is the only issue under consideration.
IV. EVALUATION CRITERIA
Staff has the following comments relative to the criteria used to evaluate a temporary use permit.
1. Will the temporary use have a detrimental effect upon the general health, welfare,
safety, and convenience of persons residing or working in the neighborhood of the
proposed use; and,

Because the vehicles are parked on an unpaved surface, there could be negative affects to the
general health, safety and welfare due to oils and other residue from the vehicles saturating
into the ground. There are negative aesthetic implications to the general health and welfare of
this area as a result of the unscreened vehicle storage.
2. Will the temporary use adversely affect the adequate light and air, or cause significant
air, water, or noise pollution, or cause drainage problems for the general area; and
No additional buildings are proposed with the temporary use application, therefore, there
should be no affect on the amount of light and air to adjacent owners. Staff is concerned
regarding oils and residues from vehicles saturating into the ground. There are also concerns
for dust and soil erosion.
3. Will the temporary use result in undue traffic congestion and traffic hazards, unsafe
parking, loading, service or internal traffic conflicts to the detriment of persons whether
on or off the site; and,
The applicant has indicated that traffic generated by the U-Haul business constitutes roughly
25 - 30 trips per week. Staff believes that traffic implications of the temporary use are
minimal. The U-Hauls are parked on the northwestern corner of the property. Although the
road curves at this location, there are no adjacent driveways where sight distance could be
blocked.
4. Will the temporary use be appropriately designed, including setbacks, heights, parking,
bulk, buffering, screening, and landscaping, so as to be in harmony and compatible with
character of the surrounding areas and neighborhood, especially with adjacent
properties; and,
No improvements are proposed with the temporary use. Staff is concerned about the
aesthetics of the area and the blighting appearance of the trailer display. At the time of this
writing there were 15 units being stored/displayed on the property. Staff believes that it
should be adequate to have a few on display adjacent to the small office so that passers-by
know they're available with the rest stored behind the screened RV storage area.
5. Will the temporary use not overburden the capacities of the existing streets, utilities,
parks, schools, and other public facilities and services.
There should be no affect on streets, utilities, parks, schools or other public facilities. Staff is
primarily concerned with the negative effect on the visual appearance of this area.
V. STAFF CONCLUSIONS AND RECOMMENDATION
Although there are no real safety issues or traffic hazards associated with the request, staff believes
this temporary land use has a blighting affect on the area. This is crucial as this is an area which the
City has targeted for visual improvements. In addition, the site plan approval conditions specifically

excluded auto boat and camper rentals as a permitted use. This prohibition would reasonably extend
to the rental of other vehicles, namely trucks and trailers. The approval of this TUP would
circumvent the use restrictions of the site plan and permit a use not permitted under the conditions of
approval of the site plan. Since there are other options for display and storage of the U-Hauls on Lot
4 (10165 W. 49' Avenue) and the evaluation criteria does not support approval, a recommendation
of Denial is given for Case No. TUP-00-01.

The Regular City Council was called to order by Mayor
Wilde at 7:00 p.m. Councilmembers present: Teri Dalbec, Jerry DiTullio, Don Eafanti, Jean
Fields, Janelle Shaver, Ken Slier, Tony Solano, and Claudia Worth. Also present: City
Clerk, Wanda Sang;' City Treasurer, Jim Malone; City Administrator, Robert Middaugh; City
Attorney, Gerald Dahl; Director of Planning, Glen Gidley; Director of Public Works, Bob
Goebel; staff; and interested citizens.
APPROVAL, OF MINUTES of Arne 24, 1996
Motion by Mr. Slier for the approval of the Minutes of June 24, 1996 as corrected; seconded
by Mr. DiTullio; carried 8-0.
CITIZENS' RIGHTS TO SPEAK
Chuck Perrottl complained that Wheat Ridge does not have a law against putting items in
somebody else's dumpster; we also don't have an ordinance about people cleaning up after
their dogs and no noise ordinance. He also left a copy of a newspaper article "Arvada group
seeks growth cap". He feels the proportion of homes vs. businesses in Wheat Ridge is very
unequal; we need more revenue and we aren't getting it from homes.

Motion by Mrs. Worth for approval of expenditure items; seconded by Mr. Slier; carried 8-0.
Item 2.., Council Bill 28 - An ordinance providing for the approval of a right-

West 49th Avenue, City of Wheat Ridge, County of Jefferson,
State of Colorado.

Council Bill 28 was introduced on second reading by Mrs. Worth; title read by the Clerk;
Ordinance No. 1034 assigned.

Applicant, Terry Oman, 5261 South Zinnia Court, Littleton, was swom in by the Mayor. He
explained that B.G.T. Enterprises is asking Council to approve three items:
Right-of-way vacation on 49th Avenue; approval for five-lot subdivision at approximately 4951
Kipling Street; and approval of site plan. He introduced Jerry Kannapan, designer of their
site plan; Jenny Shrader, their engineer; John Felton, representing Burger King; and Bob
Murray from the Amoco Station. He explained their plans for the site and answered
questions.
Glen Gidley was swom in and presented the staff report.
The following speakers were sworn in by the Mayor:
Ramona Reed, M.D., owns business just north of the development. She is concerned about
drainage and doesn't want her parking lot to become a retaining pond.
John Felton, representing Burger King, gave reasons for the necessesity of following the site
plan in regards to Burger King and to allow the proposed curb cut.
Bob Murray, proprietor of Amoco Station, had concerns about traffic problems if he has to
share a curb cut.
John Eatwell, Architect for Burger King, stated that the best location for a curb cut is the one
they are requesting.
Jerry Kannapan, designer of the site plan, was present to answer questions. He stated that
this is a quality, community-friendly development.
Jenny Shrader, civil engineer for the project, was present to answer questions.
Motion by Mrs. Worth that Council Bill 28 be approved on 2nd reading, which if approved, will
vacate the right-of-way denoted as Tract B on the proposed plat, and located at
approximately 10051 West 49th Avenue. With the following conditions:
1. 'Tract B is not needed for public access purposes.
2. Utility easements will remain in place.
Seconded by Mr. Solano; carried 8-0.
Motion by Mrs. Worth- that-Case MS-96-6, a request for a five-lot subdivision filed under the
name of Blue Grass Terrace, located at approximately 4951 Kipling Street, be approved with
the following conditions:
1. Proposed curb cut on Kipling between proposed lot Land lot 2, be allowed.
2. That a sound barrier fence be constructed on the east side of -the Reed property;
seconded by Mr. Solano; carried 8.0.

Motion by Mrs_.Worth that Case No. WSP-96-1, a request for a site plan development,
located at approximately 4951 Kipling Street, be approved with the following conditions:
1. Revise note #2 to read as follows: "Auto, RV, boat, camper sales, service or rental for
same, semi-truck parking, and any other use that requires outside storage, display, or
operations, shall be excluded as a permitted use.
2. No billboard signs may be permitted.
*3. Current RV storage use may be allowed on site, except upon full built out of site plan.
4. That an island or median as the developer and Public Works worked out, be constructed
between lot 1 and 2 to prevent left-hand turns.
5. A drainage plan be filed and accepted by Public Works before building permits are
issued, ensuring adjacent properties protection from additional run-off; seconded by Mr.
Solano.
Motion by Mrs. Shaver to amend to delete stipulation No. 4; seconded by Mr. DiTullio; failed
2-6 with Mrs. Shaver and Mr. DiTullio voting yes.
Original Motion carried 8-0.
Item 3. Council Bill 30 - An ordinance submitting a proposed amendment
to the Wheat Ridge Home Rule Charter to the voters of the City
pursuant to Charter Section 16.8 (b).
Item 3 was mistakenly placed on the Agenda and will be heard July 22, 1996.
Item 4. Council Bill 25 - An ordinance providing for the approval of
rezoning from Planned Commercial Development to a revised

Dear council members,
B.G.T. Enterprises requests a SPECIAL USE PERMIT for the
6 acres of land located at 10165 & 10145 W. 49th Ave. The 6
acres has been subdivided into 6 lots; one lot has been sold
to Burger King, one to Foothills Bank, and one to Amoco corp.
One lot is being used as a cel site, the office for My Other
garage RV storage, and a U-Haul dealership. The remaining two
lots, consisting of approximately 3 acres are for sale. We
have received weekly inquiries regarding the properties with
most business interest in the auto related fielpriced Greahigh
Monkey, Big 0 tires, etc. however, the land is
for their operations. To increase the attractiveness of the
land we lowered the price per foot in January 2000.
My Other Garage has been doing business for the last 7 years
and as each lot has been sold we have downsized our business
to ensure a smooth transition out of the RV storage business
when the lots are sold. My Other Garage is necessary to continue
the cash flow necessary to service the debt of the remainin4
properties. Additional expenses such as paving and landscaping
will inhibit our ability to service the debt. We keep the
remaining lots in good repair and request we maintain the status !
quo until the remaining two lots are sold.
The traffic generated by My,other Garage and U - Haul is
minimal; approximately 50 cars a week, U - Haul generates 3
to 4 cars per day, Monday - Friday and 10 on Saturday. My
Other.Garage generates approximately 20 vehicles a week, many
days there is no traffic at all at My Other Garage.
Our hours of operation are 6:30 am to 5:30 pm Monday through
Saturday. We are closed on Sunday and Tuesday.
Fire lanes flow through all of the RV storage area. There
are no structures on the other lot. Please see enclosed map.

Thank you for the opportunity to comment on this application. This is a request for a Temporary
Use Permit to allow the uses of outdoor vehicle storage on Lot 3 and truck and trailer rental on Lot
4 of the Bluegrass Terrace Subdivision. The properties are generally located just west of Kipling
Boulevard and north of Interstate 70. Economic Development staff opposes the permitting of these
uses on these properties. Staff worked with the property owner in December of 1998 for the erection
of a sight obscuring fence surrounding the storage lot (Lot 3). In discussions with the property
owner, staff was told that the storage lot was to be a temporary land use until the property, which
was being actively marketed, was sold. There was no discussion about truck and trailer rentals on
Lot 4 The property owner did attach screening material to the chain link fence, as agreed,
although equipment and vehicles are still visible from 491h Avenue and Kipling Boulevard.
Recently, the property owner has begun to use Lot 4 for parking and display of rental trucks and
trailers. In the last year, Planning staff has not been contacted by anyone expressing interest in
purchasing either of these properties or development for more permanent land uses. Economic
Development Staff is concerned that outdoor storage lot and rental truck and trailer businesses may,
by default, evolve into the permanent land uses for these properties. Permitting the continued use
of these properties for storage and rental uses would be a negative influence on surrounding property
values.
In 1998, the City Council expressed its desire to upgrade the visual quality of the area surrounding
the Kipling/I-70 intersection. In the same year the residents of the city voted to increase the lodging
tax to address crime and visual issues associated with the Kipling/I-70 intersection area. Permitting
the marginal land uses associated with this application would be counter productive to the City
Council's goals for the area by frustrating the development of higher quality land uses.
Economic Development staff recommends denial of the application, and looks forward to quality
permanent land uses on the property which will benefit the surrounding property owners/businesses
and the long term improvement to this area of the City.

2) Dead-end fire apparatus access roads in excess of 150 feet in length shall be provided with
approved provisions for t -he t rr ng around of fire apparatus. UFC 97 902.2.2.4.
3) Fire apparatus roads shall have an unobstructed width of not less than 20 feet. UFC 97
