CALL THE MEETING TO ORDER: The meeting was called to order by Chair HOWARD at 7:30 p.m. on July 27, 2000 in the Council Chambers of the Municipal Building, 7500 West 29th Avenue, Wheat Ridge, Colorado. 2. A set of these minutes is retained both in the office of the City Clerk and in the Department of Planning and Development of the City of Wheat Ridge. 3. PUBLIC FORUM There was no one signed up to speak. 4. PUBLIC HEARING A. Case No. TUP-00-03 - A application filed by Beth Eden Centenary Baptist Church for approval of a temporary use permit for two office trailers to accommodate church staff during construction of the new church office building for property zoned R-2 and located at 2700 Wadsworth Boulevard: This case was presented by Mary Austin. She reviewed the staff report, presented slides and overheads of the subject property and entered all pertinent documents into the record. She advised the Board that there was jurisdiction to hear the case and then reviewed the criteria used to evaluate a TUP request. Staff gave a recommendation of approval for reasons outlined in the staff report. Board Member ABBOTT inquired about restroom facilities. Ms. Austin replied that one of the trailers will have restroom facilities. Board of Adjustment Page I 07/27/00 Roger Vauter 3605 West 94th Avenue, Westminster Mr. Vauter, representing the applicant, was swom in by Chair HOWARD. He explained that the two temporary trailers are necessary to house the church office and staff while a new church office is being constructed. In response to a question from Chair HOWARD, Mr. Vauter stated that construction should be completed in eight or nine months if there are no serious construction delays. Board Member ABBOTT inquired about heating for the trailers. Mr. Vauter replied that the trailers are self contained and will have electric heat. Sign at Vern's Restaurant - In response to the Board's request at its last meeting regarding the Vern's Restaurant sign, Alan White distributed copies of the minutes from the meeting where the sign was approved. He explained that no request for historic designation for the sign has taken place as of this date. Such designation can take place at the request of the land owner, the Historical Society or the City Council. Board Member ABBOTT requested that the staffbring the matter of historical designation before the City Council NEW BUSINESS A. Appointee to the Board of Adjustment - Alan White informed the Board that Kent Young (District IV) has been appointed to the Board and will be present at the next meeting. B. I. REQUEST The property in question is located at 2600 Wadsworth Blvd. and is currently used for Beth Eden Baptist Church and School. The property is zoned R-2, Residential-Two. The applicant is requesting approval of a temporary building permit to place 2 office trailers on-site to accommodate church staff during construction of the new church office building. (Exhibit 2, Application, Exhibit 3, Deed). The duration of the temporary building permit is for up to one-year. II. CASE HISTORY The property is nearly square in shape and is relatively flat. It has frontage on both Wadsworth Blvd. (west) and 26' Ave. (south). In the R-2 district, churches and schools are permitted as a conditional use. A Conditional Use Permit was granted to Beth Eden Baptist church in 1995. The operation of the church and school on the property conforms to the approved Conditional Use Permit. A building permit has been issued to allow construction of a 6,961 square foot addition. The displaced offices due to the construction will be housed in the proposed temporary office trailers. The proposed plan locates the temporary office trailers along the west side of the existing parking lot. (Exhibit 4, Site Plan) The trailers will occupy 7 parking spaces, including 4 handicapped spaces. While the office trailers are in place, the handicapped parking will be temporarily relocated to nearby spaces to the east. These are the closest available parking spaces near the entrance. The 2 office trailers will face towards each other and will be connected by a wood deck. (Exhibit 5, Layout) The parking lot for the current operation exceeds the parking requirements in the City's Code of Laws. Based on the size of the church and school, a total of 239 parking spaces are required. The parking lot contains a total of 265 parking spaces. Therefore, the temporary loss of 7 parking spaces will not result in a substandard parking allowance. Staff has received no public comment or objection regarding this temporary building permit thus far. III. EVALUATION CRITERIA Staff has the following comments regarding the criteria used to evaluate a temporary use permit request: Will the temporary building have a detrimental effect upon the general health, welfare, safety, and convenience of persons residing or working in the neighborhood of the proposed-use; and, The temporary office trailers should not have any adverse impact on the health, safety, welfare and convenience of persons in the neighborhood. The proposed structures will be housing the office use that is currently accommodated on-site. 2. Will the temporary building adversely affect the adequate light and air, or cause significant air, water, or noise pollution, or cause drainage problems for the general Board of Adjustment Page 2 TUP-00-03/Beth Eden area; and The proposed temporary office trailers are to be located in an interior corner of the existing parking lot and will meet all required setbacks. There will be no impact to the amount of light and air to adjacent properties. Since all proposed structures are to be located on a portion of the existing paved parking lot, there will be no increase in the amount of impervious surface. Therefore there should be no impact on pollution or drainage. 3. Will the temporary building result in undue traffic congestion and traffic hazards, unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site; and, The proposed temporary buildings are merely a temporary relocation of church staff who are currently accommodated in offices on-site. The temporary use will not result in increased traffic onto the site. The parking lot is of sufficient size to enable on-site traffic circulation with the placement of the trailers in the parking lot. The placement of the trailers is such that off-site traffic circulation will not be impacted. 4. Will the temporary building be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening, and landscaping, so as to be in harmony and compatible with character of the surrounding areas and neighborhood, especially with adjacent properties; and, As shown on the site plan, the temporary trailers will be positioned well within required setbacks of the R-2 district. Even with the loss of 7 parking spaces, parking is sufficient to meet parking regulations. 5. Will the temporary building not overburden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. The office trailers are temporarily relocating an existing church operation during construction. The request does not involve additional office space nor will it accommodate any additional staff beyond the current staffing level of the church. Therefore, there should be no affect on streets, utilities, parks, schools or other public facilities. VI. STAFF CONCLUSIONS AND RECOMMENDATION Upon review of the above request, staff concludes that the request is consistent with the intent of a temporary building permit and the above criteria are supportive of this temporary building permit request. Therefore, staff recommends APPROVAL for the following reasons: 1. It will not have a detrimental effect on the general health, safety and welfare of persons residing or working in the neighborhood. 2. It will not impact the light and air to adjacent properties. 3. It will not result in undue traffic hazards or congestion. 4. It will not adversely impact the capacities of the streets, utilities and public facilities or services.
