on before 9:00 a.m. and must be shut off at 7:00 p.m. every night, including
weekends and during Sunday services for the church across the street.

D. Case No. WA-00-03: An application filed by Daniel Grantham for approval of a 12-foot side
yard setback variance from the 15-yard side yard setback requirement for the purpose of a garage
addition for property located at 2970 Upham Street and zoned Residential-One.
This case was presented by Mary Austin. She reviewed the staff report, presented slides and
overheads of the subject property and entered all pertinent documents into the record which were
accepted by Chair HOWARD. She advised that all notification and posting requirements had
been met and there was jurisdiction for the Board to hear the case. The ten criteria used in
evaluation of a variance request were reviewed and she noted that the city had not received any
objections to the application. Staff recommended denial of the request for reasons outlined in the
staff report.
Board Member MONTOYA expressed concern that the slides indicated there is a shadow line
from Mr. Grantham's structure on the property line and extending the garage would shade a
portion of the neighbor's property.

Mr. Grantham was sworn in by Chair HOWARD. He stated, for the record, that he was not
aware of the staff s recommendation for denial until the day before the hearing and was therefore
unable to contact his neighbors. In regard to establishing a hardship, Mr. Grantham stated that he
purchased the property under the impression that the previous owners had received approval to
build a garage. The house to the north would be twenty-two feet from the proposed addition and,
therefore, would not alter the character of the neighborhood. He stated he would be willing to
reduce the size of his garage from twelve feet to ten feet. The only alternative to this plan would be
to build an additional garage in the back of the property which he felt would not be in keeping with
other homes in the area and would present an inconvenience. He believed the proposed addition
would also increase property values in the area.
Upon a motion by Board Member ECHELMEYER and second by Board Member
BROWN, the following resolution was stated:

I. REQUEST
The property in question is located at 2970 Upham Street and is currently being used for single family
residential. The property is zoned R-1, Residential-One. (Attachment 1, Zoning Map).
The applicant (owner) is requesting approval of a 12' side yard setback variance from the 15' side yard
setback requirement in the Residential-One zoning district. (Attachment 2, Application and
Attachment 3, Deed). The purpose of the variance request is to allow for the construction of an
attached garage on the north side of the residence.
II. SITE PLAN
The applicant is proposing construction of an attached garage addition on the north side of an existing
single family residence. Pursuant to Section 26-10 (F), of the Wheat Ridge Code of Laws, a one-
family dwelling within the Residential-One zoning district must maintain a minimum 15' side yard
setback. The variance requested by the applicant would permit placement of the north wall of the
attached garage within 3' of the north property line (side yard).
The applicant has submitted a site plan showing the proposed location for the attached garage
(Attachment 4, Site Plan). The home currently has an attached single car garage on the north side. The
requested variance would allow an addition to the existing one-car garage, expanding it to the
capacity of a two-car garage. The submitted elevations illustrate the garage expansion as it relates to
the existing structure (Attachment 5, Elevations).
The applicant has also submitted a letter to the Board of Adjustment outlining the reasons for the
requested variance (Attachment 6, Applicant Letter).
Staff has received no objection to or public comment regarding this variance request thus far.
III. VARIANCE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a variance request:
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district in
which it is located?
Yes. If the request is denied, the property may yield a reasonable return in service and
income. The property is currently used as a single family residence and this use may
continue on the property.
2. Is the plight of the owner due to unique circumstances?

No. There are no unique circumstances attributed to this property. At approximately 14,000
sq. ft., the parcel exceeds the minimum lot area requirements of the R-1 district. The
property has a lot width of 96 feet which is slightly less than the 100 foot minimum lot width
required in the R-1 district. However, an additional 4 feet of lot width would not allow
expansion of the attached garage as proposed.
3. If the variation were granted, would it alter the essential character of the locality?
Yes. Approval of this request could possibly alter the essential character of the
neighborhood. The surrounding neighborhood on Upham St. is currently developed with
single family residential homes. There are currently no encroachments into side yard
setbacks in this neighborhood. The requested variance would substantially reduce the side
yard setback from 15 feet to 3 feet. It should be noted, however, that the property across the
street (west) is zoned R-IA for smaller lot residential which has a minimum side yard
setback of 5' on one side.
4. Would the particular physical surrounding, shape or topographical condition of the
specific property involved result in a particular hardship (upon the owner) as
distinguished from a mere inconvenience if the strict letter of the regulations were
carried out?
No. The lot in question has a typical rectangular shape and is relatively flat. The
inconvenience relating to this, property seems to come from the home being positioned
toward the north side of the lot. Had the structure been more centered on the lot or
constructed nearer the southern side yard setback line, there would have been adequate room
for a garage addition within the required setback. This situation, however, does not result in
a unique or particular hardship for this property.
5. Would the conditions upon which the petition for a variation is based be applicable,
generally, to the other property within the same zoning classification?
Other property owners in the same zoning classification may request the same type of
variance. However, each application is reviewed on a case-by-case basis and evaluated based
on the circumstances pertaining to each request. Therefore, the outcome may be different.
6. Is the purpose of the variation based exclusively upon a desire to make money out of
the property
No. The property is currently being used as single family residential. The purpose of the
request is to expand an existing attached garage which only has capacity for a single car.
Has the alleged difficulty or hardship been created by any person presently having an
interest in the property?
Yes. The applicant, who has sole interest of the property, has created a self-imposed

hardship through the desire to expand the existing attached garage. The required side yard
setback of 15 feet was in existence when the home was purchased by the applicant in 1997.
There may be other alternatives for locating some type of garage structure on the property.
8. Would the granting of the variations be detrimental to the public welfare or injurious
to other property or improvements in the neighborhood in which the property is
located?
No. Although there are no other side yard encroachments in the neighborhood, approval of
this variance should not be detrimental to the public's welfare or injurious to other property
or improvements in the area.
9. Would the proposed variation impair the adequate supply of light and air to adjacent
property or substantially increase the congestion in the public streets or increase the
danger of fire or endanger the public safety or substantially diminish or impair
property values within the neighborhood.
Yes. The requested variance, if approved, would permit the detached garage to be located 3'
from the north (side) property line instead of the required 15'. This shortened separation from
the adjacent property could potentially impact the amount of light and air to the adjacent
property. The placement of a permanent structure within 3 feet of the property line in a single
family residential neighborhood could potentially have an impact on adjacent property
values.
10. If it is found in criteria 8 and 9 above that granting of the variation would not be
detrimental or injurious to other property or improvements in the neighborhood, and
it is also found that public health and safety, public facilities and surrounding property
values would not be diminished or impaired, then would the granting of the variance
result in a benefit or contribution to the neighborhood or the community as
distinguished from an individual benefit on the part of the applicant, or would
granting of the variance result in a reasonable accommodation of a person with
disabilities?
No. The expansion of the attached garage would result in an individual benefit to the
property owner and would not produce a benefit or contribution to the neighborhood or
community. Approval of this request would not result in the reasonable accommodation of a
handicapped person.
VI. STAFF CONCLUSIONS AND RECOMMENDATION
Upon review of the above request, staff concludes that the above criteria do not support the
variance request. Staff has found that there are no unique circumstances attributed to this
request that would warrant approval of a variance. Therefore, staff recommends DENIAL
for the following reasons:

2. The conditions involving the property have not resulted in a particular hardship upon the
owner, but are a mere inconvenience.
3. The hardship was self-created by the property owner.

To Whom It May Concern:
We are writing to request consideration for a variance on the set back requirement for a
garage addition to our home at 2970 Upham Street.
We currently have a small one-car garage and would like to widen it 1216". And replace
the entire current driveway. We wish to do this addition for the gecurity and safety of our
second vehicle, for additional storage space and for a work shop area. This addition will
add greatly to the overall livability, convenience and enjoyment of our home. This would
put the North facing garage wall 37" from the property line. As the neighbors home is
approximately 20' from the line there would be no light, view, or air easement issue. We
feel this addition would not increase congestion on the street or endanger the public
safety in any way.
The addition will conform to the current brick style and add to the feel of the
neighborhood. Please refer to the elevation drawings. We feel the addition would not
alter the essential character of the locality and would add to the neighborhoods property
values.
We feel this is the only possible location for the addition. We feel a carport would not
provide adequate protection from storms that tend to blow in from the Northwest.
