CALL THE MEETING TO ORDER: The meeting was called to order by Chair HOWARD at 7:30 p.m. on June 22, 2000 in the Council Chambers of the Municipal Building, 7500 West 29th Avenue, Wheat Ridge, Colorado. 2. A set of these minutes is retained both in the office of the City Clerk and in the Department of Planning and Development of the City of Wheat Ridge. 3. PUBLIC FORUM There was no one signed up to speak. 4. PUBLIC HEARING A. Case No. WA-00-04: - An application filed by Michael H. Milby for approval of a one-foot rear yard setback variance from the five-foot rear yard setback requirement for the purpose of building a detached garage for property located at 5506-5520 West 28th Avenue and zoned Residential-Three. Board of Adjustment Page t 06/22/00 This case was presented by Mary Austin. She reviewed the staff report, presented slides and overheads of the subject property and entered all pertinent documents into the record. She advised the Board that there was jurisdiction to hear the case and then reviewed the ten criteria used to evaluate a variance request. Staff gave a recommendation of approval. Two letters were entered into the record and made a part of the case file. The first letter was from Leander L. Urmy stating that he had no objections to the application The second letter was from Dorothy L. Archer who stated she did not "give her permission" for approval of the application. Alan White stated that both of these property owners did receive notice of the hearing and advised the Board that Dorothy Archer is an absentee owner. In response to a question from Board Member ECHELMEYER, Ms. Austin stated that staff had discussed with Mr. Milby that a variance would not be necessary if he reduced the size of his garage to 21 feet. In response to a question from Board Member MONTOYA, Meredith Reckert replied that garages are typically 22 to 24 feet in depth. Chair HOWARD inquired about the location of the garage in relation to the addresses of the property owners who sent letters. Mary Austin estimated a distance of 500 feet between the two locations. All neighbors within a 600-foot radius received notification of this public hearing. In answer to a further question, Ms. Austin stated that the alley behind the subject property is dedicated to the City of Wheat Ridge; however, it was her understanding that the alley has not been maintained in recent years. Michael Milby 5510 West 28th Avenue Mr. Milby, the applicant, was sworn in by Chair HOWARD. He stated he has owned the property for over twenty years and the reason for building the garage is to provide additional offstreet parking for his rental units. He has received complaints from neighbors who object to his tenants parking along the street. In reply to a question from Chair HOWARD, Mr. Milby stated that the alley has encroached onto his property line over the years. Board Member HOVLAND commented that the location would cause difficulty in entering and exiting the garage. He also expressed concern that the garages could be used for storage and therefore would not alleviate the parking problem. Mr. Milby stated that, if the Board desired, he would write a clause into the lease to require that the garage could only be used for parking of an automobile. Board of Adjustment Page 2 06/22/00 Board Member ECHELMEYER stated that he would support the application because the property is very well maintained and the variance would not cause a disturbance to yards of adjacent neighbors. Board Member MONTOYA stated that he would also support the application based upon staff s recommendation and the fact that the only letter of objection was received from a property owner located approximately 500 feet away. Chair HOWARD expressed concern that the width of the alley would not allow sufficient room for vehicles to turn in and out of the garage. Case No. WA-00-05: An application filed by Ralph Walker for Airtouch Cellular for approval of a five-foot height variance to the fifty-foot maximum height allowance in a Planned Commercial Development zone district located at 4056 Youngfield Street prescribed by Section 5.10.1(e) of the City Charter. This case is being processed in conjunction with Case No. WZ-00-03 to allow a freestanding CMRS tower at the property referenced above within the Youngfield Plaza Planned Commercial Development. Meredith Reckert informed the Board she had received a verbal request from the applicant earlier in the day that the case be continued. Chair HOWARD questioned the reason for this application to be heard by the Board of Adjustment when it was in conjunction with an amendment to a Planned Commercial Development zone district. Alan White explained that the Board of Adjustment is the only body that can rule on a height variance. No action was taken on the matter. 5. CLOSE THE PUBLIC HEARING Chair HOWARD declared the public hearing closed. I. REQUEST The property in question is located at 5506-5520 West 28th Ave and is currently being used for multi- family residential. The property is zoned R-3, Residential-Three. (Exhibit 1, Zoning Map). The applicant is requesting approval of a 1' rear yard setback variance from the 5' rear yard setback requirement in the Residential-Three zoning district. (Exhibit 2, Application and Exhibit 3, Deed). The applicant has received power of attorney from the property owner to pursue the requested variance. The purpose of the variance request is to allow for the construction of a detached garage on the south side of the property. II. SITE PLAN The applicant is proposing construction of a detached garage to be accessed from the alley at the rear (south side) of the property. Pursuant to Section 26-16 (F), of the Wheat Ridge Code of Laws, a detached garage within the Residential-Three zoning district must maintain a minimum 5' rear yard setback. The variance requested by the applicant would permit placement of the garage within 4' of the south property line (rear yard). The applicant has submitted a site plan showing the proposed location for the attached garage and an elevation sketch (Exhibit 4, Site Plan and Exhibit 5, Elevation). The property fronts on West 28th Ave. Alleys surround the property on the other three sides. The new garage is proposed for the back of the property (south side). The property currently accommodates eight dwelling units. A single family home was built on the property in 1939. A tri-plex structure was built in 1952. A 4-unit structure was added to the site in 1965. The single family structure has a small parking area for 2 cars along the east side of the building. The other 7 dwelling units are served by 7 off-street parking spaces and 3 on-street parking spaces. Under today's standards, the development would be required to provide 18 on-site parking spaces. Although it would not bring the number parking spaces to that level, the new garage would improve the parking by contributing an additional 3 spaces. The detached garage will be placed with the minimum separation distance of 3 feet from the existing 4-unit building. This 3 foot separation is the minimum required by building code. This required separation from the existing structure causes an encroachment into the required setback. Staff has received no objection to or public comment regarding this variance request thus far. III. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance request: 1. Can the property in question yield a reasonable return in use, service or income if Board of Adjustment WA-00-04/Milby permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the variation were granted, would it alter the essential character of the locality? Would the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? i There is nothing unique about the shape of the lot or the topography of the site which would cause a hardship. The difficulty is related to the age of the development and the inadequate parking situation. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification? Other property owners in the same zoning classification may request asimilar variance. Each application is reviewed on a case by case basis and evaluated based on the circumstances pertaining to each request. 0,V\ 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property fi vt The purpose of the request is not based on a desire to make money out of the property. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The hardship was not created by any person presently having an interest in the property. The development of the property as multi-family was completed prior to purchase by the present owners. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? The welfare of the public would not be impacted by granting of the variation nor would it be injurious to other property or improvements in the area. The requested setback variance is adjacent to the alley on the south side of the property. All other setbacks, height, and building coverage.requirements will be met. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood. The proposed detached garage structure will not impair the adequate light and air to adjacent properties, nor endanger public safety. The structure will be located near the right-of-way for the alley. The requested variance does not involve additional housing units therefore will not increase traffic. The proposed garage will augment the parking situation. 10. If it is found in criteria 8 and 9 above that granting of the variation would not be detrimental or injurious to other property or improvements in the neighborhood, and it is also found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then would the granting of the variance result in a benefit or contribution to the neighborhood or the community as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The proposed garage could have the effect of being beneficial to the surrounding neighborhood by increasing off-street parking opportunities for the multi-family development. It would not result in the reasonable accommodation of a person with disabilities. VI. STAFF CONCLUSIONS AND RECOMMENDATION Upon review of the above request, staff concludes that the above criteria are supportive of the variance request. My agent may forgive, demand, sue for, recover, collect, receive, hold all such sums of money, debts, dues, commercial paper, checks, drafts, accounts, deposits, legacies, bequests, devises, notes, stock certificates, bonds, dividends, certificates of deposit, annuities, pension, profit sharing, retirement, social security, insurance and other contractual benefits and proceeds, and all property and property rights, real or personal, intangible and tangible, now or hereafter owned by me and payable to me or in which I have an interest; my agent may take all lawful means and equitable and legal remedies and proceedings in my name for the collection and recovery thereof, and to adjust, sell, compromise, and agree for the same, and execute and deliver for me, on my behalf, and in my name, all endorsements, releases, receipts, or other sufficient discharges for the same. 4. Power to Acquire and Sell. My agent may acquire, purchase, exchange, grant options to sell, and sell and convey real or personal property, tangible or intangible, or interests therein on such terms and conditions as my agent shall deem proper. 5. Managem n Powers. My agent may maintain, repair, improve, invest, manage, insure, rent, lease, encumber, transfer and in any manner deal with any real or personal property, tangible or intangible, or any interest therein, in my name and for my benefit, upon such terms and conditions as my agent shall deem proper. 6. Banking Powers. My agent may make, receive and endorse checks and drafts, deposit and withdraw funds, acquire and redeem certificates of deposit, in banks, savings and loan associations and other institutions, take out loans and execute or release such deeds of trust or other security agreements as may be necessary or proper in the exercise of the rights and powers herein granted. 7. Motor Vehicles. My agent may apply for a Certificate of Title upon, and endorse and transfer title thereto, for any automobile, truck, pickup, van, motorcycle or other motor vehicle, and represent in such transfer assignment that the title to said motor vehicle is free and clear of all liens and encumbrances except those specifically set forth in such transfer assignment. 8. Business ss Interests. My agent may conduct or participate in any lawful business of whatever nature for me and in my name; execute partnership agreements and amendments thereto; incorporate, reorganize, merge, consolidate, recapitalize, sell, liquidate or dissolve any business; elect or employ officers, directors and agents; carry out the provisions of any agreement for the sale of any business interest or the stock therein; and exercise voting rights with respect to stock, either in person or by proxy, and exercise stock options. 9. Tax Powers. My agent may prepare, sign and file joint or separate income tax returns or declarations of estimated tax for any year or years; prepare, sign and file gift tax returns with respect to gifts made by me for any year or years; consent to any gift and to utilize any gift-splitting provision or other tax election; and prepare, sign and file any claims for refund of any tax. In order to assist my agent concerning these powers, I hereby authorize my accountant or any other person who has confidential information regarding my financial status to release and disclose such information to my agent. However, nothing contained herein shall be construed as a general waiver of my right to maintain this type of information as privileged and confidential. 10. Safe Deposi Boxes. My agent may have access at any time or times to any safe deposit box rented by me, wheresoever located, and to remove all or any part of the contents thereof, and 2 to surrender or relinquish said safe deposit box, and any institution in which any such safe deposit box may be located shall not incur any liability to me or my estate as a result of permitting my agent to exercise this power. 11. Gifts.. My agent may make gifts of my property and other transfers without consideration to my spouse and to my descendants in such amounts as my agent determines. All such gifts shall be treated as having been made by me and shall, if required by law, be reported on appropriate gift tax returns. 12. Power t4 Apply for Benefits. My agent may claim and apply for all benefits available to me from any governmental agency, including, but not limited to Supplemental Security Income (SSI), Medicaid, Medicare, Social Security, Colorado Old Age Pension, Colorado Supplement (CS) and to utilize all lawful means to qualify me for such benefits. The authority granted herein shall include the power to divest and/or gift assets and resources to my spouse and/or my descendants, including my attorney in fact, in order to plan for the receipt of such benefits. Any and all such gifts shall be treated as having been made by me and shall, if required by law, be reported on appropriate gift tax returns. In order to qualify me for government benefits, my attorney in fact may convert my assets into assets that do not disqualify me from receiving such benefits. 13. Third-Party Reliance. Third parties may rely upon the representations of my agent as to all matters relating to any power granted to my agent, and no person who may act in reliance upon the representations of my agent or the authority granted to my agent shall incur any liability to me or my estate as the result of permitting my agent to exercise any power. An affidavit, executed by the attorney in fact or agent, stating that he did not have, at the time of doing an act pursuant to the power of attorney, actual knowledge of the termination of the power of attorney by death is, in the absence of fraud, conclusive proof of the non-termination of the power at that time. If the exercise of the power requires execution and delivery of any instrument which is recordable, the affidavit when authenticated for record is likewise recordable. Copies of this fully- executed original power of attorney shall bear the same weight as this original power of attorney. 14. Photocopy. My agent is authorized to make photocopies of this document as frequently and in such quantity as my agent shall deem appropriate. All photocopies shall have the same force and effect as any original. 15. Durable Power 4f Attorney. This General Power of Attorney is a durable power of attorney and shall not be affected by my disability. 16. Compensation. My agent shall be entitled to reasonable compensation commensurate with the services actually performed and to reimbursement for expenses properly incurred. 17. Trust Provisions. My agent may transfer, assign, convey, and deliver any assets which I may own into or out of my revocable living trust which has been or may be created for me.
