Case No. WA-00-05 - Application by Ralph Walker for Airtouch Cellular for approval of a 5-foot height variance to the 50-foot maximum height allowance in a Planned Commercial Development zone district located at 4056 Youngfield Street prescribed by Section 5.10.1(e) of the City Charter. This case is being processed in conjunction with Case No. WZ-00-03 to allow a freestanding CMRS tower at the property referenced above within the Youngfield Plaza Planned Commercial Development. I. REQUEST The applicant requests approval of a 5' height variance in accordance with Section 5.10.1.(e) of the City Charter This case is being requested in conjunction with Case No. WZ-00-03 which is a request for approval of an amendment to a Planned Commercial Development final development plan to allow a Commercial Mobile Radio Service tower and ancillary equipment cabinet at 4056 Youngfield Street. Attached as Exhibit `A' is a petition in opposition to the request. H. CASE HISTORY Pursuant to Section 26-30(S) of the Wheat Ridge Code of Laws, freestanding CMRS facilities are allowed in planned development districts only if specifically listed under the allowed uses of the regulating planned development. CMRS facilities not specifically listed require an amendment to the underlying final development plan. The requested tower is not specifically listed or shown on the development plan. The development plan on the property, known as Youngfield Plaza, was approved in 1980. Lot 1 of the Youngfield Plaza PCD has on it two office/warehouse buildings containing roughly 130,000 square feet. See attached Exhibit `B'. The applicant is proposing the 55' high tower at the southwest corner of the property where there is a substantial slope to get the tower as high in the air as possible. The applicant has pursued other locations in this I-70/Youngfield corridor to no avail. Freestanding cell towers are limited to the height restriction for the particular zone district in which they are located - in this case, 50'. However, the city charter allows up to a 10% variance approvable only by the Board of Adjustment. Section 5.10.1.(e) Variances. of the City Charter provides that "the board of adjustment shall have the power to interpret terms and definition in the amendment, and to allow a variance to maximum height, not to exceed ten (10) percent, upon a finding that not granting the variance would cause an extreme hardship. The city council and other boards may not grant variances from these standards...." The grade change appears to be roughly 40' from the parking area in front of the office/warehouse buildings to the south property line. Adjacent zoning and land use include R-1 zoned property with a church and single family homes located on the "bluff' to the south of the property. The slope up to the common property line with the church and adjacent residences has existing mature trees which provide a natural buffer. As the proposed location is on the south end of the business park, the existing buildings and parking areas within the development adjoin the property to the north with an RV service facility further to the north. Abutting the property on the west is I-70 and to the east is the Clear Creek greenbelt open space. The tower and accessory cabinet box will result in a small reduction in the amount of landscaping on the property. A public hearing for Case No. WZ-00-03, the request for final development plan amendment, was held before Planning Commission on June 15, 2000. A recommendation of denial was given. The applicant has appealed the denial recommendation to City Council. The public hearing before City Council is scheduled for September 25, 2000. If the City Council denies the request for plan amendment, the public hearing in front of Board of Adjustment will not occur. Attached as Exhibit `C' is a copy of the proposed development plan to be reviewed by City Council. M. VARIANCE Staff has the following comments regarding the criteria used to evaluate a variance request: I. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? The property can still be used as an office/warehouse development if the height variance is denied. However, according to the applicant, the variance is required to allow line of sight visibility from adjacent cell towers. Denial of the variance would result in the tower not being built. 2. Is the plight of the owner due to unique circumstances? Circumstances are not unique. The City's height restrictions are applied uniformly throughout the City. There are other options for the installation of CMRS facilitates including structure-mounts and roof-top mounts. 3. If the variation were granted, would it alter the essential character of the locality? The tower is proposed to be built on the slope between the office park and the adjacent church and residential development to the south. There appears to be roughly 20' of grade difference between the proposed tower location and the church parking lot at the top of the slope. The slope is heavily wooded which creates a natural buffer for the adjacent uses to the south. 4. Would the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The topography of the office park property has a variation of about 40' from the parking lot in front of the building to the south property line. The site was chosen due to the grade change to get the tower higher into the air. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification? All variance requests are evaluated based on the specifics of each case. 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property If the variance isn't granted then the tower will not be built. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? Although the variance is not being requested by the owner of the property, the hardship is self-imposed. There are other types of installation techniques available to accommodate antennas. The applicant has indicated that other options in this corridor have been explored with all options unworkable. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? There could be visual impacts from the residential development on the bluff looking down the slope. The existing mature trees will provide a natural buffer. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood. Granting of the variance will not have an affect on light and air to adjacent properties or impact the public streets or fire safety of the area. It has been proven by the industry that the operational characteristics of cellular facilities (low power and high frequency) do not pose a health risk to persons residing or working in the vicinity. There could be potential visual impacts to the homes on the ridge. 10. If it is found in criteria 8 and 9 above that granting of the variation would not be detrimental or injurious to other property or improvements in the neighborhood, and it is also found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then would the granting of the variance result in a benefit or contribution to the neighborhood or the community as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? Approval of the variance will not result in an accommodation of a person with disabilities. IV. STAFF CONCLUSIONS AND RECOMMENDATION Staff believes it is the applicant's responsibility to provide the burden of proof as to whether denial of the variance would result in "an extreme hardship". Staff has concluded that granting of the variance should not negatively affect light and air to adjacent properties, impact the public streets or prove to be a health risk. There could be a negative affect on the visual aesthetics of the area if the tower can be seen from the ridge. Dear Ms. Reckert, I have discussed the results of our hearing last week with the staff at AirTouch and it was decided that we must appeal the decision of the Planning Commission. Please let me know what process will be so that I can prepare for the hearing. It seems that the Planning Commission's decision rested on whether we needed the site or not, since one of the members has our service and has not dropped a call along that stretch of highway. I can assure you that this site is a top priority to AirTouch. Also much was made of whether people should talk on the phone while driving. This decision should be a land use decision not a public policy debate on whether it is safe to make calls while driving. The decision was made based on two neighbors contention that they would be able to see our wood pole. I will prepare better photo simulations to show that is just not possible. We have made every attempt have this pole screened from residential areas. Thank you for your assistance in this matter, I apologize for our insistence in pursuing this site but it is very important to the success of the Verizon network of antennas.
