FOR THE FOLLOWING REASONS:
There are unique circumstances because the applicant will be replacing two
nonconforming structures with one nonconforming structure which is architecturally
compatible.
2. It would not be detrimental to the public's welfare or injurious to other property or
improvements in the area.
It would not impair the adequate supply of light or air to adjacent properties.

4. There will be visual buffering with a fence, trees and a grade change for the
properties most impacted as the structure will sit approximately four feet below the
29th Avenue roadway.

parking lot.
7. It appears to not be practical to attach the proposed garage due to the alignment of
the outside walls on the east side of the existing dwelling causing a
driveway-garage door alignment problem.
8. There appears to be no practical alternative location for a garage on this site.
9. Staff recommended approval.

C. Case No. WA-00-08 - Application by Robert Alldredge for approval of a 20-foot
side yard setback variance to the required 30-foot side yard setback for the
purpose of constructing an attached garage on property located at ;1890 Lamar
Street and zoned Residential-One (R-1).
The case was presented by Mary Austin. She reviewed the staff report and presented
slides and overheads of the subject property. All pertinent documents were entered into
the record and Ms. Austin stated there was jurisdiction for the Board to hear the case.
Staff recommended approval of the application for reasons outlined in the staff report.
In response to a question from Board Member ECHELMEYER, Ms. Austin stated there
would be eleven feet between the applicant's property line and the church parking lot. A
five-foot setback is required.
Robert Alldredge

Mr. Alldredge, the applicant, was sworn in by Chair HOWARD. He stated that he
applied for a variance about a year ago with an intent to build a two-car garage behind
and north of the existing house to provide a straight driveway from Lamar into the
garage. The dimensions at that time were 24 feet wide and 26 feet deep. When this
variance was granted, the dimensions were turned around to 26 feet wide and 24 feet
deep. However, he didn't realize that would cause part of the overhead garage door to be
located behind the existing structure necessitating a jog in the driveway. He further
discovered the fence line on 29th Avenue is 18 inches into the roadway which would
cause the garage to be moved 18 inches further to the south. He stated that the proposed
garage would be built to match the house with the same roof pitch and matching siding.
He also noted that, due to the slope of the lot, the garage would be four feet below the
roadway causing the garage to be four feet less than the maximum height limitation

required by the city. There are several blue spruce trees which will provide a noise and
sight buffer.
Chair HOWARD asked if there were others present who wished to address this matter.
There was no response.
Upon a motion by Board Member ABBOTT and second by Board Member
ECHELMEYER, the following resolution was stated:

D. Case No. WA-00-09 - Application by Sandra Thompson for approval of a 27%
landscape variance to the landscape area requirement of 80% living material,
reducing the living material to 53% of the total landscaped area. Said property is
located at 9461 West 37th Place and is zoned Residential-Two (R-2).
The applicant did not meet the posting requirement for the property. Therefore, staff
recommended continuance of this application to the next Board of Adjustment meeting.
Board Member BROWN moved and Board Member YOUNG seconded that Case
No. WA-00-09 be continued to the October 26, 2000 Board of Adjustment meeting.
The motion passed 7-0 with Board Member HOVLAND absent.
E. Case No. WA-00-10 - Application by Monica Cordell for approval of a 7-foot
front yard setback variance to the 30-foot front yard setback requirement for the

The property is within the City of Wheat Ridge, and all notification and posting requirements have been met,
therefore, there is jurisdiction to hear this case.
I. REQUEST
The property in question is located at 2890 Lamar Street and is currently being used for single family
residential. The property is zoned R-1, Residential-One. (Exhibit 1, Zoning Map).
The applicant (owner) is requesting approval of a 20' side yard setback variance from the 30' side yard
setback requirement when property abuts a public street in the Residential-One zoning district.
(Exhibit 2, Application and Exhibit 3, Deed). The purpose of the variance request is to allow for the
construction of a detached garage on the north side of the residence.
II. SITE PLAN
The applicant is proposing construction of a detached garage on the north side of an existing single
family residence. Pursuant to Section 26-10 (F), of the Wheat Ridge Code of Laws, a one-family
dwelling within the Residential-One zoning district must maintain a minimum 30' side yard setback
when any side yard abuts a public street. The variance requested by the applicant would permit
placement of the detached garage within 10' of the north property line (side yard).
The applicant has submitted a site plan showing the proposed location for the attached garage
(Exhibit 4, Site Plan). When the home was purchased by the applicant in 1995, there were two
structures, a carport and a shed, that encroached into the 30 foot side yard setback. The
nonconforming carport was recently removed in preparation for construction of the garage. The
nonconforming shed will also be removed. The requested variance would allow these non-
conforming structures to be replaced by the detached garage. The submitted elevations illustrate the
proposed design of the detached garage with the exception that a reverse elevation is planned which
would put the service door to the right of the overhead doors (Exhibit 5, Elevations).
In October, 1999, the applicant received approval for a 17' side yard setback variance for the same
purpose of constructing a detached garage.(Exhibit 6, minutes from 10/28/99 BOA meeting). The
applicant has submitted a letter to the Board of Adjustment outlining the reasons for this new
variance application and a copy of the letter submitted with the previous application. (Exhibit 7,
Applicant Letter). The applicant states two reasons which caused this new variance situation. A 1 %2
foot error in property line measurement was made and the garage is being oriented to provide a
consistent roof-line with the home. Therefore, the applicant is requesting an additional 3 feet to the 17
feet which was approved in October, 1999.
Staff has received no objection to or public comment regarding this variance request thus far
III. VARIANCE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a variance request:
1. Can the property in question yield a reasonable return in use, service or income if

permitted to be used only under the conditions allowed by regulation for the district in
which it is located?
If the request is denied, the property may yield a reasonable return in service and income.
The use of the property for a single family residence may continue.
2. Is the plight of the owner due to unique circumstances?
The unique circumstances associated with this property involve the two nonconforming
structures. The nonconforming carport was recently removed in preparation for construction
of the garage based on the previously approved variance. The nonconforming shed will also
be removed. The new detached garage will be constructed in their place designed to be
compatible with the home and surrounding neighborhood. A slight slope in grade from the
street, an existing 6 foot high fence, and vegetation will visually buffer the structure.
3. If the variation were granted, would it alter the essential character of the locality?
With the garage being designed to match the existing home, it should not alter the essential
character of the locality. The impact to the neighborhood would be greater if the garage was
constructed to the south causing many of the existing trees to be removed.
4. Would the particular physical surrounding, shape or topographical condition of the
specific property involved result in a particular hardship (upon the owner) as
distinguished from a mere inconvenience if the strict letter of the regulations were
carried out?
The lot is regularly shaped with no unusual topography. There is no particular hardship for
this property. However, the property has many large trees which would be impacted by
positioning the garage behind the house to the south.
5. Would the conditions upon which the petition for a variation is based be applicable,
generally, to the other property within the same zoning classification?
All applications are reviewed on a case-by-case basis and evaluated based on the
circumstances pertaining to each request. Therefore, the outcome may be different.
6. Is the purpose of the variation based exclusively upon a desire to make money out of
the property?
No. The property is currently being used as single family residential. The purpose of the
request is to construct a detached garage in place of a nonconforming shed and carport.
7. Has the alleged difficulty or hardship been created by any person presently having an
interest in the property?

The applicant, who has sole interest of the property, has created a self-imposed hardship
through the desire to construct a detached.garage. However, the situation involving the
nonconforming position of the existing shed and carport was in existence when the property
was purchased by the applicant in 1995.
8. Would the granting of the variations be detrimental to the public welfare or injurious
to other property or improvements in the neighborhood in which the property is
located?
The request should not be detrimental to the public's welfare or to other properties in the
area. Granting of the variance would result in an improvement that could potentially be
beneficial to the neighborhood since the new garage would replace the shed and carport and
be architecturally compatible with the existing single family home.
9. Would the proposed variation impair the adequate supply of light and air to adjacent
property or substantially increase the congestion in the public streets or increase the
danger of fire or endanger the public safety or substantially diminish or impair
property values within the neighborhood?
The requested variance is for the north side of the property abutting West 29' Ave. right-of-
way. There is no directly adjoining property along that side lot line. The shortened setback
should have no impact on the amount of light and air to neighboring properties.
10. If it is found in criteria 8 and 9 above that granting of the variation would not be
detrimental or injurious to other property or improvements in the neighborhood, and
it is also found that public health and safety, public facilities and surrounding property
values would not be diminished or impaired, then would the granting of the variance
result in a benefit or contribution to the neighborhood or the community as
distinguished from an individual benefit on the part of the applicant, or would
granting of the variance result in a reasonable accommodation of a person with
disabilities?
The construction of the garage would provide an individual benefit to the property owner.
However, the replacement of the shed and carport with the garage could potentially result in
a benefit to the neighborhood since it would be architecturally compatible with the existing
single family home. Approval of this request would not result in the reasonable
accommodation of a handicapped person.
VI. STAFF CONCLUSIONS AND RECOMMENDATION
Upon review of the above request, staff concludes that the above criteria are supportive of
the variance request. Staff has found that there are unique circumstances attributed to this
request that would warrant approval of a variance. Therefore, staff recommends
APPROVAL for the following reasons:

5. PUBLIC HEARING
A. Case No. WA-99-22: An application submitted by Robert Alldredge for approval of a
17-foot side yard variance from the 30-foot side yard setback requirement for property
zoned Residential-One and located at 2890 Lamar Street.
This case was presented by Meredith Reckert. She reviewed the staff report, presented
slides and overheads of the subject property and answered the ten criteria involved in
granting a variance. All pertinent documents were entered into the record. She advised
that all notification and posting requirements had been met and the Board had jurisdiction
to hear the case. Staff recommended approval for reasons outlined in the staff report.
Robert Alldredge

Mr. Alldredge was sworn in by Chair HOWARD. He read the following letter into the
record. This letter, dated 9-23-99, was written by Edward Lightner, 2895 Lamar (the
neighbor directly across the street) "Dear Members of the Planning Division: In regard
to Case No. WA-99-22 which is a request for approval of a 15 foot side yard variance
from the 30 foot side yard setback requirement for property located at 2890 Lamar
Street. The writer of this letter owns 2895 Lamar, the property directly west of the above
mentioned property, and also 2801 Lamar, the property southwest of the 2890 Alldredge
property. My wife, Lani, and 1 have no objections to the proposed variance. The
Alldredge's property is well maintained and we feel confident that any addition will
reflect good architectural taste. In conclusion, the variance will provide for easy access
to the garage, and we understand the desire for this variance. " Mr. Alldredge explained
that Mr. Lightner's reference to a 15-foot variance was due to an error made in the
original publication of the request which has necessitated reposting and republication for
the hearing tonight. Mr. Lightner indicated he has no opposition to the additional two
feet.
Mr. Alldredge stated that when he purchased the property, there were two nonconforming
structures on the property which he plans to remove if the variance is approved.
Board Member ABBOTT asked the applicant if he had contacted the church next door
regarding his application. Mr. Alldredge replied that he did not personally contact them;
however, the property has been posted and the church has not responded.
In. response to a question from Chair HOWARD, Mr. Alldredge stated that he is not sure
what the height of the garage will be; however, it will be a standard height and the roof
line will be the same pitch as the house.

Chair HOWARD asked the size of the garage. Mr. Alldredge replied that it will be 624
square feet.
It was the consensus of the Board that Board Member HOVLAND should abstain from
voting on this matter because he was not present for the entire presentation.
Board Member MAURO commented that removal of the two existing nonconforming
structures and replacing them with a garage will be an aesthetic improvement. The
garage will be also be less noticeable due to the drop in grade.
Meredith Reckert stated that staff has received no negative comments regarding this
application.
Upon a motion by Board Member ABBOTT and second by Board Member BROWN, the
following resolution was stated:
Whereas, the applicant was denied permission by an administrative officer; and
Whereas, Board of Adjustment Application Case No. WA-99-22 is an appeal to this
Board from the decision of an administrative officer; and
Whereas, the property has been posted the fifteen days required by law, and in
recognition that there were no protests registered against it; and
Whereas, the relief applied for may be granted without substantially impairing the intent
and purpose of the regulations governing the City of Wheat Ridge.
Now, therefore, be it resolved that Board of Adjustment Application Case No. WA-99-
22 be, and hereby is, approved.
Type of Variance: A 17-foot side yard variance from the 30-foot side yard setback
requirement.
For the following reasons:
There are unique circumstances:
a) Shifting the structure south would create an impractical driveway
entrance.
b) The applicant will be replacing two existing nonconforming structures.
2. There will be visual buffering, including vegetation and a grade change for the
properties most impacted.

3. There will no negative effect on the public safety and welfare.
4. Placement elsewhere on the property will require removal of existing mature
trees.
5. This variance should create a benefit to the neighborhood.
6. A letter of support was given by the neighbor across the street on Lamar.
With the following conditions:
The roof structure will include dormers which will match the house and face west
as was presented to the Board.
2. All portions of the existing shed and carport will be removed.
This variance does not set a precedent for expansion of further structures.
The motion passed by a vote of 5-0 with Board Member HOVLAND abstaining, and
Board Members THIESSEN and ECHELMEYER absent.
Chair HOWARD informed the applicant that his request for variance had been granted.
B. Case No. WA-99-24: An application submitted by Stanley Dyck for approval of a 192
square-foot maximum detached garage variance from the 600 square-foot maximum
detached garage requirement for the purpose of building a 792 square-foot garage for
property zoned Residential-One C and located at 3159 Depew Street.
This case was presented by Meredith Reckert. She reviewed the staff report, presented
slides and overheads of the subject property and answered the ten criteria involved in
granting a variance. All pertinent documents were entered into the record. She advised
that all notification and posting requirements had been met and the Board had jurisdiction
to hear the case. Staff recommended approval for reasons outlined in the staff report.
Board Member MAURO commented that the sign was difficult to see from the street.

Mr. Dyck was swom in by Chair HOWARD. He stated that the garage is planned to be
architecturally consistent with the house and that the existing shed will be removed.
None of the neighbors has expressed opposition to the application for variance.

Re: Variance for a garage at the above address
The first 3 paragraphs and last paragraph of our letter dated August 27,
1999, still apply.
We are now requesting a new/ different variance for a side yard set back
of 10' from the north property line.
The reason for the new side yard set back variance is a result of two
things that happened at our initial variance approval by the Board of
Adjustment.
1. I made an error in where I thought the north property line was
located when I requested the 13' variance. Our actual property line
is about 18" closer to the'north side of our house than I thought.
This was discovered just recently when we were laying out the
foundation for the garage. This error results in the garage being
located 11/2 feet further into the back yard than we originally
planned.
2. The second thing that occurred at our original variance approval
was that the Board of Adjustment required that we turn the garage
so that the dormers faced the west. The fact that the garage
dimensions were 24" wide & 26" deep before it was turned 90
degrees caused the garage to then be 26" wide and 24" deep
and extend an additional 2" into the back yard.
The result of these two items has caused the garage to extend much
further into the back yard than planned and created a situation where
we would not be able to drive directly into the garage. The south wall of
the proposed garage would extend 9 feet past the north wall of the
existing garage wall. We would have a severe jog when pulling in or
backing out of the garage.
EXHIBIT 7
We have already moved a sprinkler system line and 5 trees to
accommodate what we thought was going to be the location of the
garage. In addition, we have torn down the entire 2-car carport that that
existed when we bought the house in 1995.
We probably could have gone ahead with the garage being located 18
inches beyond the original set back approval, but we just want to do
things correctly and not have any problems at any time in the future.
We want this entire project to fit in with the neighborhood and look like it
was built at the same time the house was built. We want to have the
same roof pitch, the same type of siding and some similar brick as the
house. Hopefully all of this can be done with your approval.
The bottom line on all of this is that we just need a variance of an
additional 3 feet of side yard set back.

Re: Variance for a garage at the above address
We are requesting that we be able to build a 2 car detached garage on
the north side of our lot that would encroach into the, side yard set back.
Please see enclosed plot plan of existing structures that currently
encroach into the side yard set back. Both the carport and the storage
building existed in their present location when we bought the property.
See enclosed Improvement Location Certificates.
I discussed with the City Building Department prior to our purchasing
the property; the concept of us building a new 2 car detached garage
some time in the future. They indicated that if we used the existing north
wall of the storage building as our northern wall of the new garage, they
felt that it would be an acceptable situation.
What we really want to do is to locate the new 2 car detached garage 13
feet from the north side of our property line. The north wall of the garage
would be in line with the north edge of the carport and therefore would
not set any closer to W 29th than currently exists. The east wall of the
new garage would be 11 feet from the rear of our property line that backs
up the church parking lot.
After the garage is built, or before if necessary, we will tear down both of
the carports and the storage shed. Part of the shed and half of the car
port has already been removed. We have already relocated 3 large pine
trees to other locations on our lot to save the trees and in anticipation or
building the garage.
We feel the new garage and the removal of the carports and storage shed
will be an attractive change to the overall looks of our home. We believe
anyone can see by the money and time we have spent on our property,
that we are interested in malting it an attractive, pleasant and
compatible property and an asset to the Wheat Ridge community.
