CALL THE MEETING TO ORDER: The meeting was called to order by Chair HOWARD at 7:30 p.m. on October 26, 2000 in the Council Chambers of the Municipal Building, 7500 West 29th Avenue, Wheat Ridge, Colorado. 2. A set of these minutes is retained both in the office of the City Clerk and in the Department of Planning and Development of the City of Wheat Ridge. 3. PUBLIC FORUM There was no one signed up to speak. 4. PUBLIC HEARING A. Case No. WA-00-09 - Application by Sandra Thompson for approval of a 27 percent landscape variance to the landscape area requirement of 80 percent living material, reducing the living materials to 53 percent of the total landscaped area. Said property is located at 9461 West 37th Place and is zoned Residential-Two (R-2). The case was presented by Mary Austin. She reviewed the staff report and presented slides and overheads of the subject property. All pertinent documents were entered into the record and Ms. Austin stated there was jurisdiction for the Board to hear the case. The criteria involved in evaluating a variance request were reviewed. Staff recommended approval of the application for reasons outlined in the staff report. Board of Adjustment Page 1 10/26/00 In response to a question from Board Member ECHELMEYER, Ms. Austin explained that the city does not require a landscaping plan to be submitted with a building permit application for single family residential and did not become aware of the landscaping issues until the owner came in for a certificate of occupancy. Since the landscaping had been completely installed at this time, the homeowner had the option of applying for a variance. Sandra Thompson 3319 Raleigh, Denver Ms. Thompson, architect for the applicant, was sworn in by Chair HOWARD. The landscaping design was part of a plan to have a home which would provide a wholly independent living situation for a person with physical disabilities. The owner was also interested in xeriscaping for the sake of water conservation. The landscaping was installed by a professional landscaper in mid-July. There was some misunderstanding about how much living plant material was required. Board Member ABBOTT inquired as to whether a variance runs with the property or with the present ownership. Alan White commented that the city has no way of knowing when property ownership changes. He will request the city attorney to give an opinion on whether or not a variance runs with the property or the ownership. This variance shall apply only as the need for accessibility and/or low maintenance is necessary due to the disability of the owner. The amendment was accepted by Board Members BROWN and ECHELMEYER. Board Member HOVLAND expressed concern that a new owner should not be required to install more landscaping and commented that xeriscaping makes a lot of sense. Board Member ABBOTT did not believe the second condition would force a new owner to change the landscaping. It would simply mean the new owner would not have the variance which would give neighbors opportunity to request more landscaping if they so desired. The motion passed 6-0 with Board Members MAURO and MONTOYA absent. Chair HOWARD advised the applicant that the request for variance was approved. B. Case No. TUP-00-04 - Application by Compass Montessori School for approval of a temporary building permit for a temporary classroom trailer during Board of Adjustment Page 3 10/26/00 ORIGINAL 5. Granting of the variance results in a benefit or contribution to the neighborhood. 6. The property immediately abutting the eastern setback for the proposed garage is a parking lot. 7. It appears to not be practical to attach the proposed garage due to the alignment of the outside walls on the east side of the existing dwelling causing a driveway-garage door alignment problem. 8. There appears to be no practical alternative location for a garage on this site. 9. Staff recommended approval. With the following conditions: 1. The existing nonconforming shed shall be removed. 2. The garage structure shall be architecturally compatible both as to design and materials with the existing dwelling. Board Member ECHELMEYER stated that he would vote in favor of the motion because he believed the proposed garage would enhance the neighborhood. The motion passed 7-0 with Board Member HOVLAND absent. Chair HOWARD advised the applicant that his request for a variance was approved. D. Case No. WA-00-09 - Application by Sandra Thompson for approval of a 27% landscape variance to the landscape area requirement of 80% living material, reducing the living material to 53% of the total landscaped area. Said property is located at 9461 West 37th Place and is zoned Residential-Two (R-2). The applicant did not meet the posting requirement for the property. Therefore, staff recommended continuance of this application to the next Board of Adjustment meeting. The applicant is requesting approval of a 27% landscape variance, reducing the amount of living material to 53% instead of the required 80%, per the Code of Laws. (Exhibit 2, Application and Exhibit 3, Deed). II. SITE PLAN The applicant is seeking approval for a 27% landscape variance, reducing the amount of living landscaped material to 53%. Pursuant to Section 26-32 (C)(1) of the Wheat Ridge Code of Laws, the landscape area requirement limits the amount of non-living material to 20%, keeping 80% of the landscaping as living material. The variance requested by the applicant would permit the living landscaping material to be reduced to 53% of the total landscaped area. The applicant has submitted a site plan showing the landscape design for the site. (Exhibit 4, site plan). The plan was referred to the City Forester for his comments. He made a site visit to inspect the finished product. He has determined that the materials have been installed according to the plan and meet criteria for water conservation design. The owner of the property is handicapped and has designed the home and the site to be fully accessible for a wheelchair. The landscaping was designed to be accessible for maintenance and includes plant materials to minimize overall water usage. Staff has received no objection to or public comment regarding this variance request thus far. III. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance request: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the request is denied the property may still yield a reasonable return in use. It can continue to be used as such, regardless of the outcome of the variance request. 2. Is the plight of the owner due to unique circumstances? There are no unique circumstances directly attributed to the property. However, there are unique circumstances due to the physical handicap of the owner and the need for low maintenance xeriscaping. Board of Adjustment Page 2 WA-00-09/Thompson 3. If the variation were granted, would it alter the essential character of the locality? There would be no negative effects upon the adjacent properties, nor would it alter the character of the existing structure. According to the City Forester the design meets criteria for water conservation. 4. Would the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The property slopes up to the north from the street. This alone does not result in a significant physical condition which would typically cause a hardship. However, with the physical limitations of the owner, there is a certain hardship involved in maintaining the landscape at the 80% living material required per the Code of Laws. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification? Other property owners in the same zoning classification may request a similar variance. Each application is reviewed on a case by case basis and evaluated based on the circumstances pertaining to each request. 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property The purpose of the request is not based on a desire to make money out of the property. It is requested to accommodate the handicapped owner in a manner so as not to disrupt the character of the neighborhood. 7. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The hardship was not created by any person presently having an interest in the property. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? The welfare of the public would not be impacted by granting of the variation nor would it be injurious to other property or improvements in the area. All other setbacks, height, and building coverage requirements will be met. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair Board of Adjustment - Page 3 WA-00-09/Thompson property values within the neighborhood? The proposed variance will not impair the adequate light and air to adjacent properties, nor endanger public safety. The landscaping is professionally designed and therefore should have no adverse impact on the property values in the neighborhood. The requested variance does not involve additional housing units therefore will not increase traffic. 10. If it is found in criteria 8 and 9 above that granting of the variation would not be detrimental or injurious to other property or improvements in the neighborhood, and it is also found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then would the granting of the variance result in a benefit or contribution to the neighborhood or the community as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The proposed variance would be beneficial to the home owner. It would result in the reasonable accommodation of a handicapped person. It is specifically designed to accommodate the owner, who is bound to a wheelchair. VI. STAFF CONCLUSIONS AND RECOMMENDATION Upon review of the above request, staff concludes that the above criteria are supportive of the variance request. Staff has found that there are unique circumstances attributed to this request that would warrant approval of a variance. Therefore, staff recommends APPROVAL for the following reasons: 1. Approval of the variance would not alter the essential character of the locality. 2. Approval of the request would not impair the adequate light and air to adjacent properties. 3. Approval would result in the reasonable accommodation of a handicapped person. Per your request, I reviewed the landscape plan for the above address submitted by Neighborhood Design, L.L.C. I also made a site visit to inspect the finished product. The purpose of this review and inspection was to determine if the property met the current city standards according to code. All materials both living and hardscape have been installed according to the plan. The purpose of the design and installation is low maintenance and water conservation. I am not aware of language in our landscaping section to allow for this type of installation. However, if the City were to address water conservation, I believe this project would fall into the criteria Oct up as a model ordinance.
