Access. Owner agrees that the Authorized Parties may enter upon the Property to perform the Permitted Activities upon execution of this Agreement and may have access to the Property for up to 30 days. This system operates under license from the Federal government and is mandated to provide service to the general public to operate, in effect, as a public communications utility. In summary, this proposed installation would consist of wireless communications antennae (6 proposed and 6 future) mounted to an existing tower (Managed by American Tower Corp) and the support equipment will be located inside an existing building. This means the surrounding area will not be affected in any manner nor will the tower change in height. BTS UNIT: Cricket will have 5 control cabinets, which will be on an existing concrete slab inside an existing building. The approximate dimensions of the BTS units are six (6) feet tall, three (3) feet wide and three (3) feet deep. Telephone and electric connections are made from the BTS unit to existing telephone and power facilities. SITE FEATURES: The proposed Cricket installation will utilize the existing building to stealth the support equipment from the public. Therefore, we believe that local aesthetics will not be affected by this facility. The antennae array will be located at the 100-foot level while the existing Verizon antennae are at the 156-foot space and the Air Touch microwave dishes are located at the 146-foot, 141-foot, 128-foot, and 90-foot spots on the pole. The proposed wireless communications facility is unoccupied and will be visited only once a month for the first six months by a technician. Maintenance visits after the initial six months of operation are intermittent. There will be no change in existing circulation patterns within the surrounding area and the proposed Cricket facility will not impact pedestrians. The proposed use will not create sufficient demand for additional new parking spaces since site visits, as noted, will be infrequent. Cricket's limited parking needs can be met by the existing parking lot. Neither land nor water resources are affected by this construction. No effluent or emissions occur as a result of the cabinet and antenna/equipment operation. Air quality is likewise unaffected. The transmission of radio waves will not disturb other radio transmission or reception devices, as regulated by the FCC. The Cricket installation does not require sewer, water, drainage or other utilities save for electric and telephone service. The communications installation will not burden municipal services such as Town police, fire or the school system. Cricket personnel at regional switching stations will monitor the BTS equipment cabinet for malfunction or tampering. As you can see, the proposed project at 10019 West 26th Avenue falls well within the zoning ordinance of Wheat Ridge. It does so by using an existing structure and without putting any extra burdens on the public. The site will work within developing communications system being built throughout the Denver area. Applicants proposal: Collocate on existing tower at a height of 100 feet, making this a special use. There would be a total of six antennae, but only two initially. Issues discussed: Only four citizens were present (see attached sign up sheet). The main concern from all of them was that the tower is unsightly, and they were upset that the tower was originally located in their neighborhood. They complained that the tower just "showed up one day", and that it had been expanded or enlarged without any notice. One of the attendees stated he thought Cricket should be able to collocate above 50 feet, since it may increase the non conformity of the tower. The same attendee stated he would rather see six 50 foot towers than one large 150 foot tower. A few attendees asked the size of the antennae to be placed by Cricket (56" tall), and asked what other equipment would be needed. All four attendees felt this was not a horrible idea, they simply wanted to complain about the existing tower at this location, as well as the existing non conforming tower at City Hall. A. Review procedure-General. Proposed CMRS facilities in the NC, RC, C-1, C-2, I, A-1 and A-2 zone districts shall be reviewed pursuant to the following procedures: 1. Building-orstructure-mounted CMRS facilitiesshall be reviewed bythe department of planning and development for compliance with the requirements of the Zoning Ordinance. B. Freestanding MRS facilities shall be visually screened from adjacent residential development and public rights-of-way as follows: All accessory buildings and equipment cabinets shall be totally screened from view from adjacent property lines. 2. Screening, landscaping and/or exterior building finishes and colors shall be compatible with the existing character of the site and adjacent properties and shall be determined as part of the special use permit review process. C. Pursuant to Charter Section 5.10.1, and notwithstanding any other provision of this Code to the contrary, no CMRS facility shall exceed the height limit applicable to the underlying zone district in which such facility is located. D. Notwithstanding any provision of this section to the contrary, any freestanding CMRS facilities legally existing upon the effective date of these regulations: November 18, 1996, shall be considered legal nonconforming uses. Additional antennas may be permitted to be collocated upon such facilities, provided such facility is certified by a registered, professional engineer that it was originally designed and constructed, without need of structural modifications, including increased height, to handle the additional load. Any such addition to nonconforming freestanding facilities will be allowed only upon special use review and approval pursuant to Section 26-114. This provision does not apply to roof or building mounted CMRS facilities. I *wep The City of Wheat Ridge has adopted a requirement that, prior to application for rezoning of property to a higher use, or for properties in excess of one (1) acre, and for Special Use Permits which allow a special use of land, an applicant must notify all residents within 600 feet and invite them to a Neighborhood Input Meeting. The purpose for this meeting is.to allow the appl.ca.-.t to present his proposal to the neighborhood and also to aiiow the neighborhood to express directly to the applicant, their concerns issues and desires. A Staff Planner will attend the meeting to discuss City policy and regulations and the process involved, however, the Planner will remain impartial regarding viability of the project. Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as testimony, it is the public hearings in front of the Planning Commission and City Council where decisions are rendered. If you want input in the decision-making process. It is imperative that you attend the public hearings. The kinds of concerns residents normally have include the following: • Is the proposal compatible with surrounding land uses and zoning? • Are there adequate utilities and services in place or proposed to serve the project? • What is the impact on our streets? • Where will the storm drainage go? • How will the project be designed to enhance rather than detract from the neighborhood? • What specific changes can be made in the proposal to make it more acceptable to me?
