At its meeting of December 10, 2001, the City Council approved your request for a special use permit to allow
a drive-up coffee kiosk on property zoned Planned Commercial Development located at 7340 West 44"
Avenue for the following reasons:
1. There will be no detrimental effect on the surrounding neighborhood.
2. The use will not contribute to blight in the neighborhood.
3. The use will not adversely affect the supply of light or air to adjacent property, nor cause
significant air, water or noise pollution.
4. The use is consistent with the Comprehensive Plan.
5. The use will not result in traffic congestion or unsafe parking or loading. There will be
minimal traffic conflicts.
6. The use will not overburden utilities.
7. The number of parking spaces which could.be impacted by this use does not decrease the
required parking below the City's standard.
8. It could fill a need for this kind of service for customers of the antique store and travelers
along 44' Avenue.
With the following conditions:
1. The special use permit be a personal grant of use to Mile High Java.
2. Directional pavement arrows and lane lines be affixed to the pavement to guide vehicles.
3. Hours of operation be limited to Monday through Friday, 6:00 a.m. to 9:00 p.m., Saturday from
7:00 a.m. to 9:00 p.m., and Sundays from 7:00 a.m. to 7:00 p.m.
4. Signage on the building facades shall remain unlighted when the kiosk is closed.
5. Directional arrows or pavement markings will be affixed to the two closest access points; one
from Upham and one from 44' Avenue.
6. The term of the Special Use Permit shall be indeterminate and shall expire upon the
occurrence of one of the following events:

Item 4 was introduced by Mr. Mancinelli, who also read the title and summary.
Willis Wodnik, representing the applicant, was sworn in by the Mayor. He stated that their
building is brought in by a flatbed truck and is completely self-contained, so there will be no
overhead lines.
Meredith Reckert was sworn in by the Mayor and presented the staff report. She passed out
pictures of the proposed kiosk. Staff supports this application.
Motion by Mr. Mancinelli to approve Case No. SUP-01-03, a request for a special use. permit

Mr. Edwards cannot support this application, although he has no problems with the applicant.
This land has just been brought back within the Urban Renewal Area, with the goal to
redevelop that entire site. Urban Renewal Authority is working in this direction after we pass
the amended Urban Renewal Plan.. It would not be prudent to add an additional use at this
time, namely this special use, that then makes it more difficult for the Urban Renewal Authority
to deal with leases on this site for an overall redevelopment.
Motion by Mr. Edwards to deny this application based upon other factors relevant to the
application stated in Section 26-114 D. 11. Of the Code of Laws; seconded by Ms. Figlus.
Motion by Mr: Gokey to continue this Item to December 10, 2001; seconded by Mr. Edwards;
carried 8-0.
ORDINANCES ON FIRST READING
Item 5. Council Bill 27-2001 - An Ordinance directing disposal by demolition of a City-
owned building located at 9130 West 44" Avenue, Wheat Ridge, Colorado.
Council Bill 27-01 was introduced on first reading by Mr. DiTullio. Mr. DiTullio passed this
Ordinance on to Lena Rotola, since this is in her district.
Motion by Mrs. Rotola that Council Bill 27-2001 be approved on first reading, ordered
published, and set for consideration and public hearing on second reading on December 10,
2001 at 7:00 p.m. in City Council Chambers, Municipal Building, and take effect immediately
upon passage; seconded by Mr. Gokey; carried 8-0.

CITIZENS' RIGHT TO SPEAK
Katherine Seikkula, 4509 Robb Street, requested a traffic study for the area at 44' Avenue
and Prospect Park entrance; perhaps some light or traffic crossing could be installed to allow
children, horseback riders, bikes, etc. to safely cross the street and get into the park.

Item 2 was introduced by Mr. Schneider, who read the title, summary and background.
Brenda Godfrey, representing the applicant, was sworn in by the Mayor. She explained that
Walgreen's lease in Applewood Shopping Center is expiring and they want to build a beautiful
building in the same neighborhood This would also redevelop a blighted area. Delivery hours
will be restricted from 7:00 a.m. to 7:00 p.m. There will be no signage on the south side or
east side. Pharmacy drive-through will be on the east side of the building. They estimate 30 -
50 drive-through customers. Entrywill'be at the north-west corner of the building.
Alan White, Director of Planning, was sworn in by the Mayor and presented the staff report.
Don Peterson, 9945 West 34th Drive,.was sworn in by the Mayor. He is concerned about
traffic and the fact that there is a left.turn onto 3211; there should be signage to direct people to
the Youngfield exit. He was concerned about.the lack of landscaping on the east side and
toward Youngfield. The cedar fence will let carbon monoxide through it and he suggested a
concrete block/brick fence.

This case was continued by City Council to December 10, 2001 in order for staff to prepare an
acceptable motion. Jim Windholz, Jerry Dahl, and I discussed this matter on November 30`s and
concluded that the urban renewal plan is too vague and general to draw the conclusion that the
coffee kiosk impacts the plan. In addition, the plan will have to be modified when and if a
proposal for redevelopment is received.

The property is within the City of Wheat Ridge, and all notification and posting requirements have been
met, therefore, there is jurisdiction to hear this case.
L REQUEST
The applicant requests approval of a special use permit to allow the installation of a drive-through espresso kiosk
on property zoned PCD located at 7340 West 44' Avenue. Under Chapter 26, all uses with drive-throughs
require a special use permit.
There is an existing retail antique store containing 35,000 square feet of area on the property. Access is
provided by two curb cuts on Upham Street and one on West 44' Avenue. There is also access through the
property to the west from a common drive aisle running between West 44' Avenue and West 38' Avenue. This
interior connection runs on the east side of the First Bank building south to Time Square and continues to the
Safeway Marketplace development.
The subject property was rezoned from Restricted-Commercial to Planned Commercial Development pursuant to
Case No. WZ-77-22. Allowed uses appear to be consistent with Commercial-One with the exception that auto,
truck and trailer sales are excluded. No development plan was recorded and staff has minimal information
regarding site design and required improvements with the approved zone change t PCD. From the building
department records, staff has been able to ascertain that the property is non-conforming relative to landscaping
and residential buffering. It exceeds the current parking requirements with over 200 striped parking spaces. This
exceeds the current standard (1 space per 200 sf of floor area) by over 40 spaces (162 required parking spaces).
Attached as Exhibits `A' and `B' are copies of the site plan and elevations of the proposal. The applicant is
proposing placement of a pre-fabricated, self-contained structure 64 square feet in size. There will be drive-up
windows on both the north and south sides of the structure. No other improvements are proposed for the
property. The row of parking directly north of the kiosk and adjacent to 44' Avenue rarely has cars parked in it.
There is adequate room for maneuvering for cars patronizing the kiosk if there were vehicles parked in this area.
These spaces are not needed to meet the minimum number on the property. The proposed hours of operation are
Monday through Friday, 6 a.m. - 9 p.m. and Saturday from 7 a.m. - 9 p.m., Although the applicant is not
proposing to operate the kiosk on Sunday, PC recommended limiting the hours of operation from 7:00 a.m. to
7:00 p.m.
Water is provided in storage tanks within the structure which are filled daily. Waste water is also stored in tanks
in the structure and taken off site daily for disposal. Landscaping is proposed at the east and west ends of the
structure.
According to Chapter 26, special uses are "discretionary uses which are clearly shown to be void or deficient in
an area and which, if properly designed, developed, operated and maintained," may be approved. "The primary
issues which the planning commission and city council shall address are those related to justification of need and
those special design and operational considerations which mitigate potential detrimental impacts on the
surrounding land use, street and public services and facilities.
"The Planning Commission shall recommend and City Council shall decide whether the special use is dependent
upon design, management or operational aspects so that the SUP should be a personal grant of use to the owner
or whether the SUP runs with the land." If it is to run with the land, then the following must be decided: 1) if it is
in perpetuity, 2) if it is personal to the applicant and may or may not be inherited or, 3) if it should be granted for
a defined period of time.
When reviewed by the Planning Commission, this property was not located in an urban renewal area. It now is
located in the Wadsworth Boulevard Corridor Redevelopment Area.

H. NEIGHBORHOOD MEETING
A meeting for neighborhood input was held on July 7, 2001. Attached as Exhibits `C' and `D' are the sign up
sheet and meeting synopsis. Attached under Exhibit `E' is a letter of objection from property owners at 4320
Upham Street.
HI. AGENCY REFERRALS
Wheat Ridge Building Division will require an electrical permit for service to the building which must also be
secured to the ground. All other inspections will be completed by the state as this is a HUD approved building.
Wheat Ridge Public Works Department has requested that directional pavement arrows and lane lines be adhered
to the pavement to guide vehicles to the kiosk.
Wheat Ridge Police Department has also requested directional signing to guide traffic.
Jefferson County Department of Health and Environment will require plan review and routine inspections.
IV. SPECIAL USE PERMIT CRITERIA
Staff has the following comments regarding the criteria for evaluating the proposed special use.
1. Will meet a proven public need in that it will fill a void in necessary services, products or facilities
especially appropriate at the location proposed, considering available alternatives.
It cannot be determined whether the proposed espresso kiosk will fill a void in products and services
available in this area. There is a similar freestanding kiosk in the 4300 block of Wadsworth Blvd. which
seems to be quite successful. Traffic counts on Wadsworth in that vicinity are roughly 42,000 vehicles
per day. Vehicles per day on West 44' Avenue are one third that amount.
2. Will not have a detrimental effect upon the general health, welfare, safety and convenience of
persons residing or working in the neighborhood of the proposed use.
The proposed kiosk could contribute toward the convenience of persons living and working in the
neighborhood.
3. Will not create or contribute to blight in the neighborhood by virtue of physical or operational
characteristics of the proposed use.
The operation of the kiosk will not contribute toward blight in the neighborhood.
4. Will not adversely affect the adequate light and air, nor cause significant air, water or noise
pollution.
Because the structure is so small, there should not be any affect on light or air. There will be no increase
in impervious area with no resultant increase in water pollution.

5. Is consistent with the Comprehensive Plan.
The Comprehensive Plan designates this property as Community Commercial Center and Transitional
Residential. The following are excerpts regarding these designations from the Comprehensive Plan.
Transitional Residential
Desired attributes include the following:
• well buffered and landscaped parking areas
• controlled access
• well designed and maintained
• no outdoor storage, screened trash areas
• development contains amenities including bike racks, benches, picnic tables, public art, and
pedestrian connections to surrounding neighborhoods
Desired uses include the following:
• Small convenience or specialty retail establishments (coffee shop, ice cream store, drugstore)
• Professional convenience services (e.g., beauty shops, tailor, bookkeeper, dance and/or art stores
• Daycare
• Residential
Community Commercial Center
Desired attributes include the following:
• Adequate access from regional roadways
• Uses that provide services for the traveling public
• Controlled access onto arterial and collector streets through minimal curb cuts
• A mixture of complimentary uses such as retail and office
• Compact development that is well landscaped; not outdoor storage, screened trash areas
• Pedestrian connections within the site and from the site to adjacent uses
• Uses that generate sales tax revenues in support of public services and facilities
Desired uses include the following:
• Gas stations
• Restaurants
• Destination retail
Staff concludes that the proposed use meets the intent of the Comprehensive Plan.
6. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or
internal traffic conflicts to the detriment of persons whether on or off the site.
The kiosk would be erected in an area of the parking lot which is rarely used. There is adequate
circulation space around the kiosk for vehicle stacking and maneuverability.
Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening
and landscaping, so as to be in harmony and compatible with the character of the surrounding
areas and neighborhood, especially with adjacent properties.

The proposed coffee kiosk will be located in a paved parking lot, oriented toward West 44' Avenue.
There should be no impact on adjacent properties. Land uses immediately adjacent to the kiosk include a
vacant car repair facility to the east and the rear of a family restaurant on the west.
8. Will not overburden the capacities of the existing streets, utilities, parks, schools and other public
facilities and services.
This pre-fabricated, self-contained building will have no impact on utilities. An electrical drop will be
needed for power to it. Patronage will be primarily. captured from cars passing by on West 44' Avenue
and shoppers at the antique mall. A small amount of destination oriented traffic may occur as a result of
this amenity. There is adequate capacity on West 44' Avenue to handle any additional traffic generated.
9. History of compliance by the applicant with Code requirements and prior conditions, if any,
regarding the subject property.
There has been previous zoning code enforcement action on the property. The most recent violation
(1998) was for junk behind the building which was not attributable to the tenant or property owner, but
random dumping. The applicant (Mile High Java) has had no prior involvement with the property.
10. Ability of the applicant or any permitted successor-in-interest to continuously meet the conditions
of the proposed permit.
Given the nature of the operation, there should be no problem meeting any conditions of approval.
11. Other factors relevant to the specific application.
There are no other relevant factors.
VI. PLANNING COMMISSION RECOMMENDATION
On October 4, 2001 Planning Commission voted to recommend approval of the SUP for the following reasons:
1. There will be no detrimental effect on the surrounding neighborhood.
2. The use will not contribute to blight in the neighborhood.
3. The use will not adversely affect the supply of light or air to adjacent property, nor cause
significant air, water, or noise pollution.

We are writing in regard to the proposed drive-through coffee kiosk for the Antique Mall
parking lot. We are very concerned about any venture that would increase traffic on the
six-block length of Upham between 38' and 44s' avenues.
There is already a high volume of traffic because of the middle school, fire department,
and antique mail, as well as the numerous apartment buildings. Because there are no stop
lights at either intersection, the wait to enter the Fast - West avenues is long and
sometimes hazardous. During high volume periods (most of the day), we frequently cut
through the entry directly in front of the Stage Stop to get to the stop light on Wadsworth
and Three Acre Lane. That route in itself is risky, but faster than waiting for a break in
traffic on 3e or 44'x.
In addition, our biggest anxiety is the safety of the many children who reside on Upham,
as well as those who walk along it to and from the two neighborhood schools. Because
of the number of vehicles and the speed at which they travel, we are very concerned that
a child is going to be seriously injured or killed.
We believe a more responsible approach from the City would be to investigate ways to
alleviate the incongruous uses that already exist on Upham Street rather than compound
the issues.

At its meeting of October 4, 2001, the Planning Commission has RECOMMENDED that the City Council
approve your request for a special use permit to allow a drive-through espresso kiosk on property zoned
Planned Commercial Development located at 7340 West 44' Avenue for the following reasons:
1. There will be no detrimental effect on the surrounding neighborhood. It could fill a need for
this kind of service for customers of the antique store and travelers along 441 Avenue.
2. The use will not contribute to blight in the neighborhood.
3. The use will not adversely affect the supply of light or air to adjacent property, nor cause
significant air, water or noise pollution.
4. The use is consistent with the Comprehensive Plan.
5. The use will not result in traffic congestion or unsafe parking or load. There will be minimal
traffic conflicts.
6. The use will not overburden utilities.
7. The number of parking spaces which could be impacted by this use does not decrease the
required parking below the City's standard.
With the following conditions:
1. The special use permit be a personal grant of use to Mile High Java.

had jurisdiction to hear the case. Staff recommended approval of the application with
conditions as outlined in the staff report.
In response to a question from Chair McNAMEE, Mr. White stated that the applicant did not
wish to operate his kiosk on Sundays.
Commissioner BRINKMAN expressed concern about the visibility of the curb cuts on 44th
Avenue as well as on Upham. She suggested painting the curb cuts or delineating them in
some way.
Commissioner COOPER asked what would happen to the kiosk if the property should be
developed. Alan White stated that this would be a matter between the owner of the property
and the applicant. He also stated that the kiosk should not result in increased traffic in the area.

kiosk would have pressurized tanks for fresh water and tanks to hold gray water. Arrangements
have been made with the Stage Stop Antique Mall for kiosk employees to use the Mall's

In response to a question from Commissioner SNOW regarding landscaping, Mr. Wodnik
stated there would be small pine trees placed in front of the kiosk.
In response to a question from Commissioner BRINKMAN regarding a power source for the
kiosk, Mr. Wodnik explained that power would be pulled from the power pole and trenched to
the kiosk.
In response to Commissioner BRINKMAN's concerns about the curb cuts, Mr. Wodnik stated
he would apply directional arrows to the curb cuts.

2. The use will not contribute to blight in the neighborhood.
3. The use will not adversely affect the supply of light or air to adjacent property, nor
cause significant'air, water or noise pollution.
4. The use is consistent with the Comprehensive Plan.
5. The use will not result in traffic congestion or unsafe parking or load. There will
be minimal traffic conflicts.
6. The use will not overburden utilities.

Commissioner SNOW offered an amendment to the reasons: (1) It could fill a need for this
kind of service for customers of the antique store and travelers along 44th Avenue. The
amendment was accepted by Commissioner COOPER.

Commissioner BRINKMAN offered an amendment to the conditions as follows: Some kind
of directional arrows or markings will be affixed to the two closest access points; one from
Upham and one from 44th Avenue. The amendment was accepted by Commissioners
COOPER and SNOW.
The motion passed 7-0 with Commissioner WEISZ absent.
C. Case No. ZOA-01-06: An ordinance amending Section 26-628.1) of the Wheat Ridge
Code of Laws pertaining to the 1500 feet minimum separation between any motor
vehicle, farm implement, recreational vehicle, mobile or modular home, motorcycle,
boat, trailer and equipment sales, rental and storage lots in the City.
This case was introduced by Alan White. He stated that a temporary use permit was provided
to a certain landowner several years ago for the purpose of storing some vehicles on an adjacent
piece of property that he owned. The Board of Adjustment granted the TUP in order for the
owner to come in and apply for rezoning of the A-1 zoned property. A change, was made to
Chapter 26 over a year ago that deleted the ability to get a one-year temporary use permit. Last
year, during the rewrite of Chapter 26, the 1500 limit was extended from automobiles to other
uses as listed above. This prevented the landowner from applying for rezoning. There is also
another person interested in rezoning in the same situation. City Council discussed this matter
at a study session and directed staff to write an ordinance which would address this situation.
At its last meeting, Planning Commission indicated a strong desire to leave the code as it is
presently written.
In answer to a question from Commissioner SNOW, Alan White stated that the land owner in
question is Ketelsen Campers. There is another possible situation on the east side of 35th and
Wadsworth. It is proposed to repeal portion of the ordinance relating to the storage of
recreational vehicles for a period of time and then revert back to the original code.
In answer to a question from Chair McNAMEE, Alan White stated that the temporary use for
Ketelsen Campers was issued in 1996, however the TUP was not renewed each year even
though the property was used for storage.
Commissioner SNOW asked if the city receives sales tax from recreational vehicles. Alan
White stated that the city only receives sales tax on non-licensable recreational vehicles.
Commissioner THOMPSON asked if there were any consequences for the landowner when
vehicles were being stored illegally. Alan White stated that monitoring was infrequent due to a
high turnover in staff during that time. Commissioner THOMPSON expressed concern about
relaxing the code for certain individuals especially when illegal storage has occurred.

JURISDICTION:
The property is within the City of Wheat Ridge, and all notification and posting requirements have been
met. Therefore, there is jurisdiction to hear this case.
I. REQUEST
The applicant requests approval of a special use permit to allow the installation of a drive-through espresso kiosk
on property zoned PCD located at 7340 West 44' Avenue.
There is an existing retail antique store containing 35,000 square feet of area on the property. Access is
provided by two curb cuts on Upham Street and one on West 44`r Avenue. There is also access through the
property to the west from a common drive aisle running between West 44' Avenue and West 38th Avenue. This
interior connection runs adjacent to the First Bank building south to Time Square and continues to the Safeway
marketplace development.
The subject property was rezoned from Restricted-Commercial to Planned Commercial Development pursuant to
Case No. WZ-77-22. Allowed uses appear to be consistent with Commercial-One with the exception that auto,
truck and trailer sales are excluded. No development plan was recorded, therefore, staff has minimal information
regarding site design and required improvements with the approved zone change. From the building department
records, staff has been able to ascertain that the property is non-conforming relative to landscaping and
residential buffering. It exceeds the current parking requirements with over 200 striped parking spaces. This
exceeds the current standard (1 space per 200 sf of floor area) by over 40 spaces (35,882 sf x 90% usable area =
32,294 sf / 200 = 162 required parking spaces).
Attached as Exhibits `A' and `B' are copies of the site plan and elevations of the proposal. The applicant is
proposing placement of a pre-fabricated, self -contained structure 64 square feet in size. There will be drive-up
windows on both the north and south sides of the structure. No other improvements are proposed for the
property. The row of parking directly north of the kiosk and adjacent to 44`s Avenue rarely has cars parked in it.
There is adequate room for maneuvering for cars patronizing the kiosk if there were vehicles parked in this area.
These spaces are not needed to meet the minimum number on the property. The kiosk will be open Monday
through Friday, 6 AM - 9 PM and Saturdays from 7 AM - 9PM.
Special uses are "discretionary uses which are clearly shown to be void or deficient in an area and which, if
properly designed, developed, operated and maintained," may be approved . "The primary issues which the
planning commission and city council shall address are those related to justification of need and those special
design and operational considerations which mitigate potential detrimental impacts on the surrounding land use,
street and public services and facilities."
The Planning Commission shall recommend and City Council shall decide whether the special use is dependent
upon design, management or operational aspects so that the SUP should be a personal grant of use to the owner
or whether the SUP runs with the land. If it is to run with the land, then the following must be decided: 1) if it is
in perpetuity, 2) is personal to the applicant and may or may not be inherited or, 3) it if should be granted for a
defined period of time.
When the zoning code was rewritten earlier this year, all "drive-through" uses became special uses. Because of
the impermanent nature of the building, staff is processing this as a special use rather than a PCD final
development plan amendment.
This property is not located in an urban renewal area
II. NEIGHBORHOOD MEETING
A meeting for neighborhood input was held on July 7, 2001. Attached as Exhibits `C' and `D' are the sign up
sheet and meeting synopsis.
Attached under Exhibit `E' is a letter of objection from property owners at 4320 Upham Street.
Ill. AGENCY REFERRALS
Wheat Ridge Building Division will require an electrical permit for service to the building which must also be
secured to the ground. All other inspections will be completed by the state as this is a HUD approved building.
Wheat Ridge Public Works Department has requested that directional pavement arrows and lane lines must be
adhered to the pavement to guide vehicles to the kiosk.
Wheat Ridge Police Department has also requested directional signing to guide traffic.
Jefferson County Department of Health and Environment will require plan review and routine inspections, plus a
plan for the disposal of waste water.
IV. SPECIAL USE PERMIT CRITERIA
Staff has the following comments regarding the criteria for evaluating the proposed special use.
Will meet a proven public need in that it will fill a void in necessary services, products or facilities
especially appropriate at the location proposed, considering available alternatives.
Staff cannot determine whether the proposed espresso kiosk will fill a void in products and services
available in this area. There is a similar freestanding kiosk in the 4300 block of Wadsworth Blvd. which
seems to be quite successful. Traffic counts on Wadsworth in that vicinity are roughly 42,000 vehicles
per day. Vehicles per day on West 441 Avenue are one third that amount.
2. Will not have a detrimental effect upon the general health, welfare, safety and convenience of
persons residing or working in the neighborhood of the proposed use.
The proposed kiosk could contribute toward the convenience of persons living and working in the
neighborhood.
3. Will not create or contribute to blight in the neighborhood by virtue of physical or operational
characteristics of the proposed use.
Staff does not believe that operation of the kiosk will contribute toward blight in the neighborhood.
4. Will not adversely affect the adequate light and air, nor cause significant air, water or noise
pollution.
Because the structure is so small, there should not be any affect on light or air. There will be no increase
in impervious area with no resultant increase in water pollution.
5. Is consistent with the Comprehensive Plan.
The Comprehensive Plan designates this property as Community Commercial Center and Transitional
Residential. The following are excerpts regarding these designations from the Comprehensive Plan.
Transitional Residential
Desired attributes include the following:
• well buffered and landscaped parking areas
• controlled access
• well designed and maintained
• no outdoor storage, screened trash areas
• development contains amenities including bike racks, benches, picnic tables, public art, and
pedestrian connections to surrounding neighborhoods
Desired uses include the following:
• Small convenience or specialty retail establishments (coffee shop, ice cream store, drugstore)
• Professional convenience services (e.g., beauty shops, tailor, bookkeeper, dance and/or art stores
• Daycare
• Residential
Community Commercial Center
Desired attributes include the following:
• Adequate access from regional roadways
• Uses that provide services for the traveling public
• Controlled access onto arterial and collector streets through minimal curb cuts
• A mixture of complimentary uses such as retail and office
• Compact development that is well landscaped; not outdoor storage, screened trash areas
• Pedestrian connections within the site and from the site to adjacent uses
• Uses that generate sales tax revenues in support of public services and facilities
Desired uses include the following:
• Gas stations
• Restaurants
• Destination retail
Staff concludes that the proposed use meets the intent of the Comprehensive Plan.
6. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or
internal traffic conflicts to the detriment of persons whether on or off the site.
The kiosk would be erected in an area of the parking lot which is rarely used. There is adequate
circulation room around the kiosk for vehicle stacking and maneuverability.
Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening
and landscaping, so as to be in harmony and compatible with the character of the surrounding
areas and neighborhood, especially with adjacent properties.
The proposed coffee kiosk will be located in a paved parking lot, oriented toward West 441 Avenue.
There should be no impact on adjacent properties. Land uses immediately adjacent to the kiosk include a
vacant car repair facility to the east and the rear of a family restaurant on the west.
8. Will not overburden the capacities of the existing streets, utilities, parks, schools and other public
facilities and services.
This pre-fabricated, self-contained building will have no impact on utilities. An electrical drop will be
needed for power to it. Patronage will be primarily captured from cars passing by on West 44`s Avenue
and shoppers at the antique mall. A small amount of destination oriented traffic may occur as a result of
this amenity. There is adequate capacity on West 44' Avenue to handle any additional traffic generated.
9. History of compliance by the applicant with Code requirements and prior conditions, if any,
regarding the subject property.
There has been previous zoning code enforcement action on the property. The most recent violation
(1998) was for junk behind the building which was not attributable to the tenant or property owner, but
random dumping. The applicant (Mile High Java) has had no prior involvement with the property.
10. Ability of the applicant or any permitted successor-in-interest to continuously meet the conditions
of the proposed permit.
Given the nature of the operation, there should be no problem meeting any conditions of approval placed
by Planning Commission and City council.
11. Other factors relevant to the specific application.
There are no other relevant factors.
VI. STAFF CONCLUSIONS AND RECOMMENDATION
Staff has concluded that a special use permit is required to allow any drive-through facilities in the city
of Wheat Ridge. Staff has further concluded that the proposal will have no negative impact on the
subject property or the surrounding area. and that there is adequate room in this development to
accommodate the kiosk. For these reasons, a recommendation of approval is given with the following
conditions:
1. The special use permit be a personal grant of use to Mile High Java.
2. Directional pavement arrows and lane lines be affixed to the pavement to guide vehicles.
3. Hours of operation be limited to Monday through Friday, 6 AM - 9 PM and Saturdays from 7
AM - 9PM.
4. Signage on the building facades shall remain unlighted when the kiosk is closed.
VII. RECOMMENDED MOTIONS
Option A: "I move to recommend approval of Case No. SUP-01-03, a request to allow a drive-through espresso

To Whom It May Concern:
We are writing in regard to the proposed drive-through coffee kiosk for the Antique Mall
parking lot. We are very concerned about any venture that would increase traffic on the
six-block length of Upham between 3e and 44' avenues.
There is already a high volume of traffic because of the middle school, fire department,
and antique mall, as well as the numerous apartment buildings. Because there are no stop
lights at either intersection, the wait to enter the East - West avenues is long and
sometimes hazardous. During high volume periods (most of the day), we frequently cut
through the entry directly in front of the Stage Stop to get to the stop light on Wadsworth
and Three Acre Lane. That route in itself is risky, but faster than waiting for a break in
traffic on 39' or 4,f.
In addition, our biggest anxiety is the safety of the many children who reside on Upham,
as well as those who walk along it to and from the two neighborhood schools. Because
of the number of vehicles and the speed at which they travel, we are very concerned that
a child is going to be seriously injured or killed.
We believe a more responsible approach from the City would be to investigate ways to
alleviate the incongruous uses that already exist on Upham Street rather than compound
the issues.

Darin Morgan informed me that in regard to the "gray water" system proposed for the case
referenced above, he would require approval letters from the Jefferson County Health
Department, the State Health Department and the State Plumbing Board. I informed the
applicant of this and he said he would call Darin to discuss his requirements.
The applicant also requested he be put on the Planning Commission agenda for October 4, 2001.
I informed him that if these plumbing issues are not resolved before the hearing, that the case
will be continued.

The Public Works Department has reviewed the Planning Department referral dated August 9, 2001 for the
above referenced site, and has the following comments:
1. The 5 car-length stacking requirement will need to be shown from the kiosk and back. This applies to both
directions.
2. Directional pavement arrows and lane lines are needed to properly guide vehicles up to the kiosk.
3. The kiosk should be placed farther back from W. W Avenue to minimize movement conflict with the
parking traffic adjacent to 44' Avenue.

• This proposed Mountain Mudd Espresso Shop will be subject to a plan
review and routine inspections by this Department. The plan review will
include calculating the total water usage requirements based on the
proposed fixtures in the kiosk. The water tanks must be sized according to
these calculations or the facility must have a plan for refilling the tanks at
sufficient intervals. Additionally, a plan for the disposal of waste water must
be in place. Please call Lyle Moore, Consumer Protection Plan Review

I have reviewed the plans for the above listed site. Please consider the following
recommendations while developing this site:
LANDSCAPE:
1. All mature trees to be trimmed of branches up 6'-8' from the ground to allow for
natural visual observation from surrounding areas to the parking lots and building.
2. All shrubs and bushes mature height to not exceed 36". This height reduces the
risk of persons hiding. It also allows for natural visual observation of the building.
3. Plants/ landscape immediately next to the building should be low-growing ground
cover, not to exceed 18" mature height to allow for maximum natural visual
observation and eliminate concealment for potential offenders.
4. Ground cover should not include rock material. Rocks can be used to break
windows in the buildings and cars. Consider using natural products such as bark or
mulch.
BUILDINGS:
1. The building finish should be with an anti-graffiti paint or sealant.
SITE:
1. During construction, the property should be clearly posted with "No Trespassing"
signs. This may help deter trespasses, and allow the Police Department to cite
offenders with the crime along with any others offenses that may be committed by
trespassers.
LIGHTING:
1. Exterior lighting around the buildings and in parking lots should be a minimum of
1.5 candle minimum maintained. This will provide for brightly lit areas that

discourages criminal activity due to the illusion/ perception of observation and
recognition.
This site will be inundated with heavy traffic, especially during rush hours in the
morning. The plans do no show clearly marked direction of travel for the customers.
Please consider placing signs and markings that will show customers the direction of
travel. Consider placing curbing to funnel cars into the drive-through and out of it.
This may reduce the potential for vehicle accidents in the parking lot and surrounding
area.
From these plans, I have no further recommendations at this time. Revisions in the
plans, may alter my recommendations.
While my recommendations do not guarantee a crime-free environment, it has been
experienced that application of the concept of Crime Prevention Through
Environmental Design (OPTED) will reduce the opportunity for crime to occur and will
enhance the quality of life. Please consider these suggestions while developing this
property.

Mile High lava is proposing a drive-through coffee Idosk (building) at the Antique Mall located at 7350
44" Avenue. The proposed building is only 64 square feet and will sit on the existing mall parking lot.
Items to be sold include specialty coffee drinks (latter; mochas, cappuccinos), Italian sodas and cold fruit
based Blushes. Hours of operation are 6 a.m. to 6 p.m. with our peak hours being 7 to 10.
The City of Wheat Ridge has adopted a requirement that prior to any application for a Special Use it,
an applicant must notify al residents and property owners within 600 feet and Invite them to a \
Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to present his proposal
to the neighborhood and to give the neighborhood a forum to express their concerns, issues and desires.

~A Staff Planter will be on hand to discuss Ci policies and regulations and the process involved however,

will be rendered. If you want input in the decision-making process, it is imperative that you attend the
public hearing.

Please let this letter serve as a follow-up to our pre-application meeting of April 24, 2001.
You are interested in establishing a drive-through coffee kiosk in the city of Wheat Ridge. This
particular use would be considered an eating establishment which is an allowed use in the RC, C-l, C-2
and I zone districts within the city. However, in any of these zone districts because of the requirement
for a "drive-through" lane, a special use review is required. A special use procedure is a public hearing
process which requires public hearings in front of both Planning Commission and City Council and
includes a pre-application neighborhood meeting. This process would take up to six months to
complete. A detailed site plan is required as a component of the application submittal requirements
(see attached).
You had two prospective locations in the city that you were interested in. The first location was the
property located at the northwest corner 4111 and Kipling (approx. 4131 Kipling Street) which is zoned
Commercial-One. Aside from the special use process, a complicating factor is that the property in
question is located within the Clear Creek 100-year flood plain. Prior to erection of any additional
structures on the property, a Class II special exception to the flood plain ordinance would be required.
This would involve preparation of a hydrological analysis by an engineer specialized in this field to
determine the impacts of the proposed structure on the capacity of the flood channel and potential
effects on upstream and downstream properties. See attached copy of the flood plain zoning ordinance.
The property located at 8360 West 44" Avenue is zoned Planned Commercial Development. This
property was rezoned from Restricted-Commercial to Planned Commercial Development and allows C-
1 uses with the exception of auto, truck and trailer sales and service. Typically, any additional buildings
proposed within a planned development which are not shown on the approved development plan would
require an amendment to the development plan with public hearings in front of Planning Commission
and City Council. However, because of the lack of detail shown on the approved plan which was not
recorded, staff believes a special use process should be followed. Although it will take about the same
amount of time, the application fees and submittal requirements are substantially less than for a planned
development approval.
The Planning and Development Director does have the capability of approving a 30-day temporary use
permit, however, it is unlikely that it would be granted.
If you have alternate sites that you are considering, I would be happy to discuss those properties with
you. If you intend on pursuing either of these specific locations, please contact me so that we can
discuss the application submittal requirements and establish a date for the pre-application neighborhood

Re: Mountain Mudd Espresso
Mountain Mudd is a Montana based company which serves espresso from the
convenience of a drive-through. We plan to place 40 stores in the Denver Metro Area.
We operate out of a 8' X 8' pre-manufactured kiosk. Now, this is not some hastily
thrown together shack. This is a very well thought out, efficient, durable and extremely
attractive kiosk. We start with a 1/8" steel tube frame and then add three layers of
insulation. All of the interior cabinetry is custom made while the kiosks themselves are
each hand-assembled in Billings, MT. They are heated, air-conditioned, and with the
exception of electricity, completely self-contained. The kiosks are pre-wired for
telephone, web-cameras and security systems.
The completed kiosks are far more durable than they appear. Their finished weight of
nearly 6000 pounds allows them to stand up to virtually any onslaught that mother nature
or human nature can throw at them. Over the past seven years, our kiosks have proven
this time and time again through various mishaps. In Lewistown, MT, a Mountain Mudd
Espresso kiosk was hit by a tornado; it didn't even budge. In Billings, MT a kiosk was
struck, while occupied, by a vehicle traveling at 45 miles per hour; the kiosk attendant
was untouched. The vehicle didn't break through the kiosk wall.
The kiosk has two internal water tanks; one for fresh water and one for grey water. We
will also have a van with two tanks in it. The van will make daily servicing runs to the
kiosk in order to re-stock the supplies, fill the fresh water tank and pump out the grey
water. The fresh water used in the kiosk will be obtained from and the grey water
dumped at our warehouse location at 4420 N. Allison in Wheat Ridge.
Mountain Mudd sells coffee, coffee and only coffee. We cater to the morning commuters
on the way to work. Commuters drive-through our kiosk, pick up a latte and head off to
work, all in about 45 seconds. We are convenience. While 70% of our business is
between the hours of 7 a.m. and 10 a.m., we are open from 6a.m. to 6 p.m. except on
Sundays when we are open from 7a m. to 4 p.m. We operate the kiosk with two
employees during our busiest times and only one employee the rest of the time.
The kiosks will all be located within approximately 200' of a restroom facility. The
employees have "Be back in 5 minutes" signs that they post when they need a bathroom
break. We do not set a limit on the number of bathroom breaks allowed. We just ask for
good judgement from the employees.
