Board Member MONTOYA wanted the record to reflect that he recognizes a medical
hardship in this case.
Chair HOWARD advised the applicant that approval of the request would require six
affirmative votes.
The motion failed by a vote of 5-2 with Board Members ECHELMEYER and
HOWARD voting no.
Chair HOWARD advised the applicant that the request for a variance had been denied.
B. Case No. TUP-01-01 - An application filed by Wal-iVlart for a 30-day temporary
use permit for the purpose of conducting an outdoor garden sale at the property
located at 3600 Youngfield Street and zoned Planned Commercial Development
(PCD).
Since no representative for Wal-Mart had appeared by 8:45 p.m., it was moved by
Board Member BROWN and seconded by Board Member ECHELMEYER that
Case No. TUP-01-01 be postponed until the May Board of Adjustment meeting.
The motion passed 6-1 with Board Member HOVLAND voting no.
In response to a question from an individual in the audience, Alan White advised that the
sign posted on the property would be changed to reflect the new hearing date; however,
because it has been postponed to a date certain, it would not be necessary to send out new
letters of notification.
C. Case No. WA-01-04: - An application filed by Tom and Debra Static, for approval
of a 22-foot front yard setback variance from the required 30-foot front yard
setback requirement resulting in a proposed 8-foot front yard setback and a 1-foot
side yard setback variance from the required 15-foot combined side yard setback
resulting in a proposed 14-foot combined side yard setback for the purpose of
constructing a detached garage for property located at 6295 West 42nd Avenue and
zoned Residential-Two.
The case was presented by Mary Austin. She reviewed the staff report, presented slides
and overheads of the subject property, and reviewed variance request evaluation criteria.
All pertinent documents were entered into the record and accepted by Chair HOWARD.
She advised the Board that there was jurisdiction to hear the case. Staff recommended
denial of the application for reasons outlined in the staff report.

for his desire to build a garage is to get his vehicles off the street. Because he lives on a

The property is within the City of Wheat Ridge, and all notification and posting requirements have been met,
therefore, there is jurisdiction to hear this case.
I. REQUEST
The property in question is located at 3600 Youngfield Street and is currently used for Commercial
purposes. The property is zoned PCD, Planned Commercial Development (Exhibit 1, Zoning Map).
The applicant, Wes Lane, is representing Wal-Mart and requesting a temporary use permit for the purposes
of conducting an outdoor garden sale for thirty days (Exhibit 2, Application and Exhibit 3, Applicant
Request). This application was originally an administrative review, however, staff received four objections
from adjoining neighbors (Exhibit 4, Neighborhood Objections). Pursuant to Section 26-115 (D)(2) of the
Wheat Ridge Code of Laws, if any one of the conditions for approval are not met, the Director of Planning
must deny the application (Exhibit 5, Administrative Denial). The applicant then has the right to appeal the
Director's decision to the Board of Adjustment.
II. SITE PLAN
The applicant has submitted a site plan detailing the proposed location for the temporary garden sale, as well
as the locations of all equipment and materials appurtenant to the sale (Exhibit 6, Site Plan and Exhibit 7,
Planned Development). The site plan shows the temporary sale to be located on the northwest corner of the
building occupying the small employee parking lot. The flared sidewalk on the west side of the building
directly adjacent to the parking lot would contain a temporary a 20 x 60 foot greenhouse used to store and
sell plants which require shelter from the elements. All requirements for handicapped accessibility on the
sidewalk will be maintained. The employee parking lot will be used to store materials such as bedding
plants, trees and shrubs. There will not be any parking allowed in this area for the duration of the sale. The
only vehicular access in this parking lot will be the loading of heavy materials into customer cars. A
temporary post and rope will block any access to this lot.
Staff has received objections to and public comment regarding this variance request. A total of five phone
calls were made to the City to complain about this proposed Temporary Use. Three of the respondents
were concerned about late night deliveries and trucks idling behind the store very late at night. Two of the
respondents were concerned about the trash behind the development.
III. TEMPORARY USE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a Temporary Use request.
The proposed temporary use :
Will not have a detrimental effect upon the general health, safety or welfare and
convenience of persons residing or working in the neighborhood of the proposed use, and
The potential temporary use would not be detrimental to the public welfare or injurious to other
properties in the area. The adequate supply of light and air would not be compromised as a result of
this temporary garden sale. This sale would not increase congestion in the streets or parking lot.
There would still be sufficient parking for customers and none of the drive aisles would be blocked

as a result of this sale. The sale would not increase the danger of fire. Dave Roberts of the Wheat
Ridge Fire Department indicated that this garden sale would not affect fire protection for this site.
2. Will not adversely affect the adequate light and air, nor cause significant air, water or noise
pollution, or cause drainage problems for the general area; and
The adequate supply of light and air would not be compromised as a result of this temporary garden
sale. There should not be any pollution of air, water or noise in the area. The drainage should remain
unaffected by this garden sale.
3. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading,
service or internal traffic conflicts to the detriment of persons whether on or off site; and
The proposed temporary use will not increase traffic congestion or traffic hazards. There would still
be sufficient parking for customers and none of the drive aisles would be blocked as a result of this
sale. The garden sale will occur in the small employee parking lot on the northwest side of the
building and on the flared sidewalk on the west side of the building. The parking area will be closed
to vehicular traffic by a temporary barrier. This area will only be accessed by vehicles for the
purpose of loading large quantities of materials into customer cars. The internal flow of the parking
lot will not be impacted by this temporary garden sale.
4. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering,
screening and landscaping, so as to be in harmony and compatible with the character of the
surrounding areas and neighborhood, especially with adjacent properties; and
The character of the shopping center would not be altered. These type of garden sales are very
common in large shopping centers such as this one. Wal-Mart currently stores and displays
merchandise on the sidewalk within ten feet of the building, which is permitted in the PCD. This
temporary garden sale will allow Wal-Mart to expand this outside display area while capitalizing on
the pleasant weather. All setbacks, height restrictions, requirements for parking will be met. The
merchandise should reach any height above six feet. The setbacks will remain unaffected, and
parking quantities will still suffice for this development.
5. Will not overburden the capacities of the existing streets, utilities, parks, schools, and
other public facilities and services.
The potential temporary use would not be detrimental to the street capacities, nor overburden any
utilities, parks, or schools.

VI. STAFF CONCLUSIONS AND RECOMMENDATION
Upon review of the above request, staff concludes that the above criteria are supportive of the temporary
use request. Staff has found that there are unique circumstances attributed to this request that would warrant
approval of a temporary use. Therefore, staff recommends APPROVAL for the following reasons:
1. Approval of the temporary use would not alter the essential character of the locality.
2. Approval of the request would not impair the adequate light and air to adjacent properties.
3. Approval of the temporary use would not be injurious to other properties in the
neighborhood.

On 3/20/01, I received a call from Gary McCulloch of 3395 Wright St. regarding the notice he
received for Case No. TUP-01-01. His concerns were mainly code related. In fact, his wife had
called into the Code Dept. two weeks prior to complain about the trash and rats behind Walmart.
Petsmart and King Soopers. It was mainly Petsmart's trash (pet food) that attracted the rats.
He also commented about the "trucks" delivering too early, too late, all the time and trucks idling
too long. I asked him to clarify whether they were garage trucks or delivery trucks, but it didn't
seem to matter to him what they were.
On 3/23/01, I received the following calls regarding Case No. TUP-01-01:
George Schreiber
3375 Wright St.
Mr. Schreiber is against the TUP due to the already excessive traffic behind Walmart.
Dick Culna
3803 Wright St.
Mr. Culna has no problem with the TUP; however, he does have a problem with the trash
(Walmart bags) that blows on his property and the trucks delivering late at night (12-1 a.m.) and
running all night.
Ralph Santangelo
3801 Wright Ct.
Mr. Santangelo is opposed to the TUP. He also went before City Council on 3/19/01 to publicly
voice his opposition.
On 4/17/01, I received another call from Dick Culna at 3803 Wright St. regarding Case No. TUP-
01-01:
Mr. Culna has a problem with the trucks delivering late at night (12-1 a.m.) and running all night.

Case No. TUP-01-01 is an application by Wes Lane, representing Wal-Mart, to request a temporary
use permit for the purposes of conducting an outdoor garden sale for thirty (30) days. The property is
located at 3600 Youngfield Street and is zoned Planned Commercial Development (PCD).
Pursuant to Section 26-115 (D) of the Wheat Ridge Code of Laws, the Zoning Administrator is
empowered to decide upon applications for a thirty (30) day temporary use permit, without
requirement of public hearing, provided that the following conditions are met:
1. The duration of the building, use or sign shall not exceed one (1) month.
2. No other temporary permit has been issued within the previous one (1) year for the same or
similar building, use or sign on the same premises.
3. The director of planning and development has noticed adjacent property owners in a form and
manner as required for minor variances and waivers as set forth in Section 26-109, and has
received no objections.
4. The owner or owner's agent approves in writing of the proposed temporary use, building or
sign.
If all the conditions above are met, the director of planning and development may issue a one month
temporary permit, provided the findings of fact below are met:
Findings of Fact: The proposed temporary use, building or sign :
1. Will not have a detrimental effect upon the general health, safety or welfare and convenience of
persons residing or working in the neighborhood of the proposed use; and
2. Will not adversely affect the adequate light and air, nor cause significant air, water or noise
pollution, or cause drainage problems for the general area; and
3. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service
or internal traffic conflicts to the detriment of persons whether on or off site; and

Notice is hereby given that a Public Hearing is to be held before the City of Wheat Ridge
BOARD OF ADJUSTMENT on April 26, 2001, at 7:30 p.m. in the City Council Chambers of
the Municipal Building at 7500 West 29th Avenue, Wheat Ridge, Colorado. All interested
citizens are invited to speak at the Public Hearing or submit written comments. The following
petitions shall be heard:
Case No. TUP-01-01: An application filed by Walmart for a 30-day temporary use
permit for the purpose of conducting an outdoor garden sale at the property located at
3600 Youngfield Street and zoned Planned Commercial Development (PCD).
Case No. WA-01-01: An application filed by Shayne Ankoviak for approval of a 12 foot
side yard setback variance from the required 15 foot side yard setback resulting in a
proposed 3 foot side yard setback for the purpose of constructing a garage addition for
property zoned Residential-One (R-1) and located at 12141 West 32"d Drive.
Case No. WA-01-04: An application filed by Tom & Debra Stano for approval of a 22
foot front yard setback variance from the required 30 foot front yard setback resulting in a
proposed 8 foot front yard setback and a 1 foot side yard setback variance from the
required 5 foot minimum side yard setback and required 15 foot combined side yard
setback resulting in a proposed 4 foot side yard setback and 14 foot combined side yard

Mr. Culna has no problem with the TUP; however, he does have a problem with the trash
(Walmart bags) that blows on his property and the trucks delivering late at night (12-1 a.m.) and
running all night.
Ralph Santangelo
3801 Wright Ct.
Mr. Santangelo is opposed to the TUP. He also went before City Council on 3/19/01 to publicly
voice his opposition.

On 3/20/01, I received a call from Gary McCulloch of 3395 Wright St. regarding the notice he
received for Case No. TUP-01-01. His concerns were mainly code related. In fact, his wife had
called into the Code Dept. two weeks prior to complain about the trash and rats behind Walmart,
Petsmart and King Soopers. It was mainly Petsmart's trash (pet food) that attracted the rats.
He also commented about the "trucks" delivering too early, too late, all the time and trucks idling
too long. I asked him to clarify whether they were garage trucks or delivery trucks, but it didn't
seem to matter to him what they were.

placement of nursery stock in the front parking lot adjacent to their garden center.
This morning I discussed the proposed TUP with Dave Roberts of the Wheat Ridge Fire
Protection District. Mr. Roberts indicated that the stand pipe for the building is located at the
northeast corner of the building. Restricted access to this small parking area would not
negatively affect fire protection for the store.

BEST VALUE EVERYDAY.
BAGGED GOODS AND OTHER CONSUMABLE MERCHANDISE WILL BE KEPT IN THE
PARKING LOT FOR CUSTOMER CONVENIENCE. LIVE GOODS AND NURSERY STOCK WILL
BE MAINTAINED ON THE SIDEWALK ALONG WITH A GREENHOUSE. THE GREENHOUSE
WILL MEASURE 21 FEET WIDE BY 60 FEET LONG.
