1. CALL THE MEETING TO ORDER: The meeting was called to order by Chair
HOWARD at 7:30 p.m. on June 28, 2001 in the Council Chambers of the Municipal
Building, 7500 West 29th Avenue, Wheat Ridge, Colorado.

The following is the official set of Board of Adjustment minutes for the Public Hearing of June
28, 2001. A set of these minutes is retained both in the office of the City Clerk and in the
Department of Planning and Development of the City of Wheat Ridge.

4. PUBLIC HEARING .
A. Case No. WA-01-03 - (continued from May 24, 2001) An application filed by
Compass Montessori for approval of a 1.5-foot front yard setback variance from
the required 30-foot front yard setback resulting in a proposed 28.5-foot front yard
setback for property located at 10399 West 44' Avenue and zoned Restricted-
Commercial (R-C).
The case was presented by Meredith Reckert. She reviewed the staff report, presented
slides and overheads of the subject property and reviewed variance evaluation criteria.
All pertinent documents were entered into the record and accepted by Chair BROWN.

She advised the Board that there was jurisdiction to hear the case. Staff recommended
approval of the request for reasons outlined in the staff report.
Board Member MONTOYA commented that the one protest received by telephone was
based upon an objection to the addition itself rather than the setback so, therefore, the
protest did not appear to be valid in this case.

Mr. O'Hara, representing Compass Montessori, was sworn in by Chair BROWN. He
stated that an error occurred in the survey and the plans that led to the building exceeding
the setback by 1.5 feet.

Mr. Munger was sworn in by Chair BROWN. He serves on the governing board of
Compass Montessori and has been involved in the building process. He stated that it was
not intended to exceed the setback and it was his understanding that it resulted from a
mathematical error in the plans.
Upon a motion by Board Member MONTOYA and second by Board Member
HOWARD, the following resolution was stated:
Whereas, the applicant was denied permission by an administrative officer; and
Whereas, Board of Adjustment Application Case No. WA-01-03 is an appeal to this
Board from the decision of an administrative officer; and
Whereas, the property has been posted the fifteen days required by law, and in
recognition that there was one protest delivered by telephone and that protest was
against the building addition rather than the setback;
Whereas, the relief applied for may be granted without detriment to the public
welfare and without substantially impairing the intent and'purpose of the
regulations governing the City of Wheat Ridge.
Now, therefore, be it resolved that Board of Adjustment Application Case No. WA-
01-03 be, and hereby is, APPROVED.
For the following reasons:
1. The encroachment of the new addition would not alter the essential character
of the neighborhood.

2. The requested variance would not impair the adequate supply of light and
air to adjacent properties.
3. It would not be detrimental to the public's welfare or injurious to other
properties in the area.
Type of Variance: A 1.5 foot front yard setback variance from the 30-foot front
yard setback required in an A-1 zone reducing the setback to 28.5 feet. The purpose
of the variance is to allow the existing building to remain in its present location.
When construction of the building was finished, it encroached upon the 30-foot
front-yard setback by 1.5 feet.
Board Member ECHELMEYER stated that, while he would support the motion, he
would like to see situations concerning setbacks incorporated into fixture city inspections.
The motion passed 6-0 with Board Members ABBOTT and YOUNG absent.
B. Case No. WA-01-07 - (continued from May 24, 2001) An application filed by
Abundant Grace Fellowship for approval of a waiver to the parking lot buffer
requirement on the northern parking lot of property located at 4535 Wadsworth
Boulevard and zoned Residential-Two (R-2).
The case was presented by Travis Crane. He reviewed the staff report, presented slides
and overheads of the subject property and reviewed variance evaluation criteria. All
pertinent documents were entered into the record and accepted by Chair BROWN. He
advised the Board that there was jurisdiction to hear the case. Staff recommended denial
of the request for reasons outlined in the staff report.
In response to a question from Board Member DRDA as to why a solid fence was not
also required along the west side of the property, Alan White explained that a solid fence
is required next to properties that are low and medium density. The property to the west
is a multi-family property that does not fit into this requirement.
Board Member HOVLAND referred to a letter from the adjacdnt neighbor who was in
favor of the variance and suggested the possibility of installing a gate in the fence to
allow the neighbor to have access to his garden area.

Mr. Crook, representing the applicant, was sworn in by Chair BROWN. He was in
agreement with the staff report and stated that he would abide by the Board's decision.
He stated that he did not realize at the time the original permit was issued that he had the
option of requesting a variance. Because of the location of the residence, he did not
believe lights from cars in the parking lot would be a problem. He stated the main
purpose for the request was to save money for the church by not having to erect a fence.

The property is within the City of Wheat Ridge, and all notification and posting requirements have been met,
therefore, there is jurisdiction to hear this case.
I. REQUEST
The property in question is located at 10399 West 44`h Avenue and is currently being used for a Public
Charter School. The property is zoned R-C, Restricted Commercial (west) and A-1, Agricultural One
(east) (Exhibit 1, Zoning Map).
The applicant (owner) is requesting approval of a 1.5' front yard setback variance from the 30' front
yard setback requirement in an A-1 zone, reducing the setback to 28.5'. (Exhibit 2, Application). The
purpose of the variance request is to allow for an existing building addition to remain in its present
location. When construction of the building was finished it encroached upon the 30' foot front yard
setback by 1.5'.
II. SITE PLAN
The property is nearly square in shape and has frontage on both W. 44`h Ave. (south) and Miller St.
(west). In May, 2000, a Conditional Use Permit was granted to Compass Montessori for an expansion
of approximately 10,300 square feet for the school. The approved site plan for the Conditional Use
Permit showed the new addition in compliance with the 30 foot front yard setback.
The addition was not built to plan specification, and upon completion, it was discovered that the
foundation wall of the building encroached by 1.5 feet into the required front yard setback. The applicant
has submitted a site plan showing the current location of the new building and the 28.5' foot front yard
setback. (Exhibit 3, Site Plan).
The applicant has also submitted a letter outlining the reasons for the requested variance (Exhibit 4,
Applicant Letter). If the variance is denied the applicants have stated that renovations would delay the
start of school in the fall, and could drastically affect the school's income. The variance is a result of
errors made by the architect and general contractor.
Because the encroachment is less than 10%, this case was originally processed as an administrative
review. Pursuant to Section 26-115 (C) the Director of Planning and Development may act on a minor
variance provided that no protests are received within the ten day period following notification. Staff
received one objection via a telephone call from a property owner in the adjacent Ptarmigan
Condominium development. The call was taken by the Senior Secretary from a owner who expressed
opposition to the school addition altogether. The Director of Planning and Development, Alan White,
would have given administrative approval to the variance request had not a protest been received.
III. VARIANCE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a variance request:
Can the property in question yield a reasonable return in use, service or income if

permitted to be used only under the conditions allowed by regulation for the district in
which it is located?
If the variance is denied the use of the property for a school could still continue. However,
denial of the variance request would force the school to relocate the exterior wall of the new
addition 1.5 feet to the north in order to come into compliance with the 30' front yard setback.
The renovation process would temporarily displace students and faculty.
2. If the variation were granted, would it alter the essential character of the locality?
Approval of this request would not alter the essential character of the neighborhood. The 1.5'
encroachment is on the south side of the school in the front yard setback, which fronts West
44th Avenue. The encroachment is minor and would have no impact on surrounding
properties.
3. Would the particular physical surrounding, shape or topographical condition of the
specific property involved result in a particular hardship (upon the owner) as
distinguished from a mere inconvenience if the strict letter of the regulations were
carried out?
The lot in question has a typical rectangular shape and is relatively flat. It has not resulted in a
particular hardship for the owner.
4. Has the alleged difficulty or hardship been created by any person presently having an
interest in the property?
The applicant, who has sole interest of the property, has created a self-imposed hardship due
to construction error when building the addition. The addition was originally planned to be built
in compliance with the 30' setback required in the A-1 zone. However, an error in the actual
placement of the building at the time of construction has resulted in the 1.5 foot encroachment
into the 30' front yard setback.
5. Would the granting of the variance be detrimental to the public welfare or injurious to
other property or improvements in the neighborhood in which the property is located,
by, among other things, impairing the adequate supply of light and air to adjacent
property, substantially increasing the congestion in public streets or increasing the
danger of fire or endangering the public safety, or substantially diminishing or
impairing property values within the neighborhood?
The requested variance would permit the new addition to be located 28.5 feet from the front
property line instead of the required 30' minimum setback. Since the encroachment is into the
front yard toward W 44th Ave., it would not impair the adequate light and air to adjacent
properties. The encroachment does not impact any required sight distance triangles, therefore it

would have no affect on public safety. The use of the property will remain as a school
regardless of the outcome of the variance request so it will have no impact on increasing
congestion in the streets. The requested variance should not be detrimental to the public
welfare or injurious to other property or improvements in the neighborhood.
6. If criteria a through a are found, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or the community, as distinguished from an
individual benefit on the part of the applicant, or would granting of the variance result
in a reasonable accommodation of a person with disabilities?
The requested variance would result in an individual benefit for the property owner, and would
not produce a benefit or contribution to the neighborhood or community. Approval of this
request would not result in the reasonable accommodation of a person with disabilities.
IV. STAFF CONCLUSIONS AND RECOMMENDATION
Staff has concluded that the encroachment is minor and would not have a detrimental affect on
the public's welfare. Therefore, staff recommends APPROVAL for the following reasons:
1. The encroachment of the new addition would not alter the essential character of the
neighborhood.
2. The requested variance would not impair the adequate supply of light and air to adjacent
properties.
3. It would not be detrimental to the public's welfare or injurious to other properties in the area.

Dear Mr. White:
Please accept the enclosed Land Use Processing Application. Compass Montessori
School at 10399 W. 44" Avenue is requesting a minor variance from the 30' setback
requirement along 44`h Avenue. The school is requesting an administrative variance of
28.6 feet from the required 30-foot setback.
In regard to the variance criteria: -
a. If the variance is granted, the school will not have to undertake substantial
renovations. The renovations would delay the start of school and could drastically
affect the school's income.
b. If the variance were granted, the essential character of the building and locality will
not be altered.
c. If the variance is granted, the school will be able to use the building without significant
disturbance to the structural integrity of the building. If the variance is not granted
significant renovation would be necessary and school would be delayed for several
months for approximately 40% of the school population. The renovation and
relocation of students would be an extreme hardship on the school reputation and
financial status.
d. Any person having interest in the property has not created the hardship. The setback
variance is required due to errors made by the architect and general contractor. The
school never intended to violate the setback requirements.
e. Granting the variance would not be detrimental to the public welfare or injurious to
other property or improvements in the neighborhood. The proposed variance would
not impair the supply of light or air to adjacent property. The proposed variation
would not increase the congestion in the public streets or endanger the public safety. It
would not diminish or impair property values.
f. It is our belief that the presence of the school is a benefit to the Wheat Ridge
community and will contribute to numerous community benefits, including the
presence of a well regarded school in the area.

NOTICE OF PUBLIC MEETING
Notice is hereby given that a Public Hearing is to be held before the City of Wheat Ridge
BOARD OF ADJUSTMENT on May 24, 2001, at 7:30 p.m. in the City Council Chambers of
the Municipal Building at 7500 West 29th Avenue, Wheat Ridge, Colorado. All interested
citizens are invited to speak at the Public Hearing or submit written comments. The following
petitions shall be heard:
Case No. WA-01-03: An application filed by Compass Montessori for approval of a 1.5
foot front yard setback variance from the required 30 foot front yard setback resulting in a
proposed 28.5 foot front yard setback for property located at 10399 West 44' Avenue and

DATE: 21 March 2001
Case No. WA-01-03 is an application by Dan O'Brien, representing Compass Montessori School, to
request an administrative variance ; a one and a half (1.5) foot variance from the required thirty (30)
foot front yard setback. The property is located at 10399 West 44"' Avenue and is zoned Restricted
Commercial (R-C) and Agricultural One (A-1).
Pursuant to Section 26-115 (C) of the Wheat Ridge Code of Laws, the Zoning Administrator is
empowered to decide upon applications for a minor variance or waiver (10% or less), without
requirement of public hearing, provided that the following conditions are met:
1. The variance or waiver does not exceed ten percent (10%) of the minimum or maximum
standard; and
2. That the Director of Planning and Development finds that the "findings of fact," as set forth
below, are substantially complied with and support the request; and
3. The Director of Planning and Development has notified adjacent property owners by letter
notice and posting of the site at least ten (10) days prior to rendering his decision, and that no
protests have been received in such ten-day period ; and
4. That no additional dwelling units would result from approval of such variance or waiver ; and
5. That the limitations of Charter Section 5. 10.1 are not exceeded.
If all the conditions above are met, the Director of Planning and Development may issue an
administrative variance provided the findings of fact below are met:
Findings of Fact: The Director of Planning and Development shall decide upon a request for a variance
or waiver, and shall base his decision in consideration of the extent to which the following facts,
favorable to the applicant , have been established by the evidence:
1. Can the property in question yield a reasonable return in use, service or income if permitted to
be used only under the conditions allowed by regulation for the district in which it is located?
2. If the variation were granted, would it alter the essential character of the locality?
3. Does the particular physical surrounding, shape or topographical condition of the specific
property involved result in a particular and unique hardship (upon the owner) as distinguished
from a mere inconvenience if the strict letter of the regulations were carried out?
4. Has the alleged difficulty or hardship been created by any person presently having an interest in
the property?
5. Would the granting of the variance be detrimental to the public welfare or injurious to other
property or improvements in the neighborhood in which the property is located, by, among
other things, impairing the adequate supply of light and air to adjacent property, substantially
increasing the congestion in the public streets or increasing the danger of fire or endangering the
public safety, or substantially diminishing or impairing property values within the neighborhood?
6. If criteria one through five are found, then would the granting of the variance result in a benefit
or contribution to the neighborhood or the community, as distinguished from an individual
benefit on the part of the applicant, or would granting of the variance result in a reasonable
accommodation of a person with disabilities?
This request for an administrative variance meets all applicable conditions as required by Section 26-
115(C) of the City of Wheat Ridge Code of Laws. Staff has not received comments in opposition to
this request from the surrounding neighbors.

This letter requests a Minor Variances from front yard setback requirements for the property at
10399 West 44" Avenue. (Legal description - Lot 1 and Lot 2, Garramone Gardens, A Minor
Subdivision, City of Wheat Ridge, County of Jefferson, State of Colorado as recorded at
Reception No. 86149360, of the Jefferson County Colorado records.)
If the variance were granted, the essential character of the locality will not be altered.
The purpose of the variation is not based on a desire to make money out of the property.
The hardship has not been created by any person presently having an interest in the property.
The granting of the variations would not be detrimental to the public welfare or injurious to
other property or improvements in the neighborhood.
The proposed variation would not impair the adequate supply of light or air to adjacent
property. The proposed variation would not increase the congestion in the public streets or
endanger the public safety. It would not diminish or impair property values in the
neighborhood.
It is also our belief that the presence of the school is a benefit to the community and will
contribute to the provision of useful community services in the neighborhood. It is also
common for the presence of a well regarded school to have a positive impact on adjacent
residential property values.

Avenue. Since the historic use of the site was a produce market and Wheat Ridge has a
significant farming history, the building design has been based on vernacular farm building
forms.
The classroom building has been developed as a barn with an attached shed roof porch area and
an adjacent silo.
