FOR THE FOLLOWING REASONS: 1. The home is currently in possession of an attached single car garage on the west side. 2. Approval of this request could potentially alter the essential character of the neighborhood. As evidence, there is one known front yard setback encroachment in this neighborhood, a variance of 18 feet into the front yard setback was. approved by the Board of Adjustment in 1997 for the property at 6150 West 42"d Avenue. That property, as such, was subject to a 30-foot setback and had no garage. The visual impact as a result of an 18-foot variance is considerable causing significant impact upon the neighborhood view plane. 3. The placement of a permanent structure within 8 feet of the property line for an interior lot in a single family residential neighborhood could potentially have an impact on adjacent property values. 4. Construction of a detached garage would not produce significant benefit or contribution to the neighborhood or community. 5. Chair HOWARD advised the applicant that approval of the request would require six affirmative votes. The motion failed by a vote of 5-2 with Board Members ECHELMEYER and HOWARD voting no. Chair HOWARD advised the applicant that the request for a variance had been denied. B. Case No. TUP-01-01 - An application filed by Wal-Mart for a 30-day temporary use permit for the purpose of conducting an outdoor garden sale at the property located at 3600 Youngfield Street and zoned Planned Commercial Development (PCD). Since no representative for Wal-Mart had appeared by 8:45 p.m., it was moved by Board Member BROWN and seconded by Board Member ECHELMEYER that Case No. TUP-01-01 be postponed until the May Board of Adjustment meeting. The motion passed 6-1 with Board Member HOVLAND voting no. In response to a question from an individual in the audience, Alan White advised that the sign posted on the property would be changed to reflect the new hearing date; however, because it has been postponed to a date certain, it would not be necessary to send out new letters of notification. C. Case No. WA-01-04: - An application filed by Tom and Debra Stano for approval of a 22-foot front yard setback variance from the required 30-foot front yard "~F setback requirement resulting in a proposed 8-foot front yard setback and a 1-foot side yard setback variance from the required 15-foot combined side yard setback resulting in a proposed 14-foot combined side yard setback for the purpose of constructing a detached garage for property located at 6295 West 42nd Avenue and zoned Residential-Two. The case was presented by Mary Austin. She reviewed the staff report, presented slides and overheads of the subject property, and reviewed variance request evaluation criteria. All pertinent documents were entered into the record and accepted by Chair HOWARD. She advised the Board that there was jurisdiction to hear the case. Staff recommended denial of the application for reasons outlined in the staff report. Tom Stano 6295 West 42"d Avenue Mr. Stano, the applicant, was sworn in by Chair HOWARD. He stated one of the reasons for his desire to build a garage is to get his vehicles off the street. Because he lives on a Board of Adjustment Page 5 04/26/01 precarious corner, he has sustained major damage on six different occasions either to vehicles parked on the street or to his landscaping from other vehicles missing the corner and driving into his property. He expressed concern that he or a family member may be struck when entering or exiting their vehicles parked on the street. Building the garage in the back of his property would cause drainage problems for the neighbors and there is not sufficient room to build on the other side of the house. Other variances have been granted in the neighborhood and he did not believe his proposed garage would negatively affect the character of the neighborhood. The proposed garage would allow him to get all of his vehicles off the street. In response to a question from Board Member ECHELMEYER, Mr. Stano stated that there have been three reportable accidents on his property during the past nine years he has lived there. Board Member ECHELMEYER suggested that Mr. Stano contact the city in regard to street safety issues. Mr. Stano commented that speeding motorists cannot be completely alleviated although he agreed Mr. Echelmeyer's suggestion was valid. Board Member BROWN inquired as to the possibility of extending the present garage. Mr. Stano explained that existing easements would prevent this option. Board Member HOVLAND expressed concern with the size of the requested variance and would be more inclined to vote for a lesser variance. Mr. Stano suggested that he could move the front yard setback a few feet. Debra Stano 6295 West 42nd Avenue Ms. Stano was sworn in by Chair HOWARD. She stated that building a garage in the back yard would destroy the ambience for all of the adjacent neighbors. Board Member DRDA commented that he believed the proposed structure would significantly change the look of the neighborhood. Board Member BROWN shared concern about the large size of the structure which would be too close to the street. I. REQUEST The property in question is located at 6295 W. 42nd Ave. and is currently being used for single family residential. The property is zoned R-2, Residential-Two. (Exhibit 1, Zoning Map). The applicant (owner) is requesting approval of a 22' front yard setback variance from the 30' front yard setback requirement and a 1' side yard setback variance from the 15' combined side yard setback requirement in the Residential-Two zoning district. (Exhibit 2, Application and Exhibit 3, Deed). The purpose of the variance request is to allow for the construction of a detached garage on the southwest side of the residence. II. SITE PLAN The applicant is proposing construction of a detached garage between the street and the existing single family residence. Pursuant to Section 26-209 (B), of the Wheat Ridge Code of Laws, a one-family dwelling within the Residential-Two zoning district must maintain a minimum 30' front yard setback and a 15' combined side yard setback. The requested variance would result in an 8' front yard setback and a 14' combined side yard setback The applicant has submitted a site plan showing the proposed location for the attached garage (Exhibit 4, Site Plan). The variance requested by the applicant would permit placement of the detached garage 8 feet from the property line at the street and 5' from the west property line (side yard). The home currently has an attached single car garage on the west side. The doors of the proposed detached garage would face to the east and access would be from the existing driveway that serves the attached single car garage. The applicant has also submitted a letter to the Board of Adjustment outlining the reasons for the requested variance (Exhibit 5, Applicant Letter). Staff has received no objection to or public comment regarding this variance request thus far. III. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance request: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the request is denied, the property may yield a reasonable return in service and income. The property is currently used as a single family residence and this use may continue on the property regardless of the outcome of the variance request. Board of Adjustment Page 2 WA-01-04 / Stano 2. If the variance were granted, would it alter the essential character of the locality? Approval of this request could potentially alter the essential character of the neighborhood. The surrounding neighborhood on W 42"d Ave. is currently developed with single family residential homes. The requested variance would substantially reduce the front yard setback from 30 feet to 8 feet. There is one known front yard setback encroachment in this neighborhood. A variance of 18' into the front yard setback was approved by the Board of Adjustment in 1997 for the property at 6150 W. 42nd Ave. That property is a corner lot and, as such, was subject to the 30' setback on two sides and the dwelling had no garage. 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The lot in question meets the minimum lot size requirements of the R-2 district and is relatively flat. The lot has an irregular shape. The shape, however, does not lead to a unique or particular hardship for this property. There is adequate room for a vehicle to access the rear yard along the west side of the existing structure. Therefore, there may be other alternatives for locating a detached garage in the rear of the property. Other alternatives may simply not be as convenient to the owner. 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The applicant, who has sole interest in the property has created a self-imposed hardship through the desire to construct a detached garage to accommodate additional vehicles, a boat and a trailer. The required setbacks of 30' in the front yard and 15' combined side yard were in effect when the home was purchased by the applicant in 1991. 5. Would the granting of the variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? The requested variance, if approved, would permit the detached garage to be located 8' from the front property line instead of the required 30'. The placement of a permanent structure within 8 feet of the front property line for an interior lot in a single family residential neighborhood could potentially have an impact on adjacent property values. Since the use of the property will remain as single family residential, it would not increase congestion in the streets. Board of Adjustment Page 3 WA-01-04 / Stano 6. If criteria a through a are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The construction of the detached garage would result in an individual benefit to the property owner and would not produce a benefit or contribution to the neighborhood or community. Approval of this request would not result in the reasonable accommodation of a handicapped person. VI. STAFF CONCLUSIONS AND RECOMMENDATION Upon review of the above request, staff concludes that the above criteria do not support the variance request. Staff has found that there are no unique circumstances attributed to this request that would warrant approval of a variance. Therefore, staff recommends DENIAL for the following reasons: 1. The plight of the owner is not due to unique circumstances. 2. The conditions involving the property have not resulted in a particular hardship upon the owner, but are a mere inconvenience. 3. The hardship has been self-created by the property owner. 4. The placement of a detached garage within 8 feet of the front property line could alter the essential character of the neighborhood.
