Technologies, Inc. (ET) requests a variance to Section 26-218 B.6.b of the City of Wheat Ridge Code to decrease the required 30 ft side yard setback for the referenced site. The Tuff Shed will be a temporary structure to house equipment for a soil and groundwater remediation system. These systems typically remain in place for 1-3 years, with 2 years being the average duration. The system will be decommissioned upon closure approval from the Colorado Department of Labor and Employment - Division of Oil & Public Safety. The Tuff Shed could be moved in the event that Vivian Street is to be widened or otherwise modified during the life of the remediation system. Some of the difficulties in meeting the 30 ft side yard setback from public streets are: • There are residences along the south and west property perimeters - potential noise associated with the equipment in the shed could impact residential owners. • To locate the shed immediately south of the existing retail store would place it over the underground storage tanks. • To locate the shed immediately west of the existing retail store would block restrooms. • To locate the shed immediately east of the existing retail store would block handicapped parking spaces. The purpose is to allow the construction of a canopy. The subject property is located at 12300 West 44th Avenue. At the present time there is a Vickers Service Station on the site. The applicant has proposed the construction of a canopy which will be pl!ced in the front yard of the site ( see Exhibit "A"). The City considers the canopy a structure and therefore requires that the structure meet all pertinent setbacks. As per Section 17.D.3.. the minimum front yard of all buildings shall be 50 feet when adjacent to a dedicated public street. If parking is located other than in the front yard. and said front ya^d is completely landscaped the minimum depth of the front yard may be reduced to 30 feet. Because the front yard is not completely landscaped a minimum of 50 feet is the required width of front yard on this site. As per the Wheat Ridge Zoning Ordinance, to be allowed a fuel filling station, the site must have Commercial-One zoning and an. approved Special Use Permit. This site is presently zoned Restricted Commercial. Because the use on the site has existed prior to the adoption of the Ordinance, the use is legally nonconforming. Under Section 25, a norconformino use is allowed tc continue if the use is not increased or the structure which contains it is not enlarged, extended, or reconstructed. The City has concluded that canopies are structures and therefore enlargement 64 the existing structures i, occuring. The front yard setback requirements are the same both the Restricted Commercial anti Commercial-One Zones. Sin=e a Variance runs with the land and rezoning this site to Commercial-One will not increase the amount of Variance requested, the Board can hear this case.
