HomeMy WebLinkAboutWHL-01-01TITLE: AN ORDINANCE DESIGNATING THE JOY WILLIAMS BARN, LOCATED AT 11460 WEST 44T" AVENUE, AS AN HISTORIC LANDMARK IN THE CITY OF WHEAT RIDGE. WHEREAS, the City of Wheat Ridge has. been presented with an application for historic- designation for the Joy Williams Barn, located at 11460 West 44" Avenue, pursuant to Article VI of Chapter 26 of the Wheat Ridge Code of Law; and -"WHEREAS, the City Council has received and reviewed the recommendation of the Wheat Ridge Historical Society Board of Directors and has conducted a public'" bearing on the proposed designation, all in the manner required by Section 26-604 of the Wheat Ridge Code of Laws; and ..WHEREAS, the City Council is of the opinion that the Joy Williams Barn is eligible for, and should be designated as, an historic landmark in the City of Wheat Ridge: NOW, THEREFORE: Section 1. Findings of Fact. The Wheat Ridge City Council hereby finds that the property owner will retain the ability to earn a reasonable return on the property following its designation as an historical landmark in the City of Wheat Ridge. Section 2. Historic Landmark Designated. Pursuant to the authority vested in it by Section 26-605 of the Wheat Ridge Code of Laws, the Wheat Ridge City Council hereby designates the Joy Williams Barn as an historic landmark within the City of Wheat Ridge. No City of Wheat Ridge funds or manpower shall be used on this landmark so long as it remains private property, unless the City implements a future grant program for restoration of buildings in the City. Section 3. Safety Clause. The City Council hereby finds, determines, and declares.that this Ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council GED%53027\294403.01 further determines-:that the Ordinancebears a rational relation to the proper legislative object sought to be attained. Section 4 - Severability; Conflicting Ordinances Repealed. If any section, subsection or clause=of this ordinance shall be deemed to be unconstitutional or oiherwisc invalid, the validity of the remaining sections, subsections and, clauses shall not be affected thereby. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 5. Effective Date. This Ordinance shall take effect fifteen days after 'final publication, as prdvided by Section 5.11 of the Charter. Ordinance 1127was adopted in accordance with Article Vi of Chapter 26 of the Wheat Ridl~.e Code of Laws; and C. Article VI, Section 26-613 of the Code of Laws requires the city to record with the Jefferscn County Clerk and Recorder a Memorandum of Action within 15 days of Ciq- Council designation of an historic landmark. The Joy Williams Barn, (the "Barn") located at 11460 West 446 Avenue, has been designated as an Histeric Landmark by the City of Wheat Ridge; 2. 'file legal description of the property which underlies the Barn and is affected by the historic landmark designation is attached hereto is Exhibit 3. The Barn and the property described on Exhibit A attached hereto are subject to Article V1, Chapter 26 of the Wheat Ridge Code of Laws pertaining to historic landmark requirements; 4. The provisio 4i in Article VI, Chapter 26 provide, among other things, that with regard to properties which have historic designation, there are certain limitations on development, certain maintenance obligations, and certain penalties for violations of or failure of compliance with the Article; 5. This Memorandum is made solely for herein for recording purposes purposes of confirming the matters stated . Repairing the stairs and deck on the west side of the barn due to safety hazard condition, replacing with similar materials and staining to match original exterior of the barn. 3. Repairing the flooring on the bottom level of the barn by installing a new concrete floor. 4. Repairing of the barn doors with similar wood material and hardware as existing barn now has and adding locks for security. 5. The replacement of all rotted boards and materials by using materials similar in nature to the existing boards and materials. 6. Upgrading of electrical. Before notified that the property we purchased unknowingly housed a historical landmark (barn) of significance to the City of Wheat Ridge, our initial plans were, and still are, to restore the barn to a working condition since the current condition of the barn is such that it is a non-usable structure and creates a safety hazard. Rest assured it is our intention to maintain the integrity of all structures on our property as is evident in the major effort we have put forth thus far toward restoring the property from its deplorable condition when purchased. Any further additions desired will be presented to the City of Wheat Ridge Planning and Development Department as required.
