As the fee simple owner of Lot 2 Garramone Gardens, I support Compass Montessori
School's request for a Conditional Use Permit, to allow for a playground on a portion of
this property. Compass Montessori is under contract to purchase the adjoining Lot 1, for
the purposes of a Jefferson County Charter School. I believe that a school and
playground are appropriate uses in this neighborhood.
Therefore, I am granting to Compass Montessori School, Inc, Katy Myers, President, and
a limited Power of Attorney to make application for this permit. Compass Montessori
School will have all responsibility for costs and fees associated with this application. If
the Conditional Use Permit is approved, Compass Montessori School will enter into a
land lease for this property.
This limited power of attorney shall expire April 23, 1998.

Business: (1) Discussion of property on Xenon Street; and (2) discussion of the emergency
phone verification system.
The amendment was accepted by Commissioner SNOW.
The motion carried by a vote of 6-0, with Commissioners COLLINS and THEANDER
absent.
5. - APPROVAL OF MINUTES
The minutes of the March 19, 1998, Wheat Ridge Planning Commission were presented for
approval.
It was moved by Commissioner BRINKMAN and seconded by Commissioner DUNN to
approve the minutes as submitted. Motion carried 5-0 with Commissioner THEANDER
absent; and Commissioners GOKEY and SNOW abstaining.
6. PUBLIC FORUM
There was no one signed up to speak before the Commission.

PUBLIC HEARING
Chair THOMPSON declared the public hearing open.
A. Case No. CUP-98-1: An application from Compass Montessori School for
approval of a conditional use permit to allow use of property zoned Agricultural-One
and located at 10351 West 44th Avenue as a playground area for a private school.
Sean McCartney presented the case stating the name of the applicant as Compass Montessori
School and the name of the property owner as Kathleen Garramone. He reviewed the staff
report and entered the case file, packet materials, zoning ordinance and exhibits into the
record. He informed that since the property was within the City of Wheat Ridge and all
notification and posting requirements had been met, there was jurisdiction to hear the case.
Mr. McCartney presented an overhead projection of the site plan showing the proposed
playground which would be located in the rear portion of the property presently owned by
Kathleen Garramone. He stated that the Compass Montessori School planned to purchase

the subject property in the future for the purpose of expanding the school and, at that time,
another conditional use permit or zone change to Restricted Commercial One would be
necessary.
Mr. McCartney informed that the playground is planned to support children from ages three
to twelve years and would be used only during school hours. The playground would be
located eighteen feet from the northern property line and twenty feet from the eastern
property line extending west to abut the Montessori School building, with an existing six-
foot solid fence along the perimeter of the property. The proposal included plans to erect
temporary gazebo-type structures on the playground; however, there were no plans to build
any permanent structures on the site. He stated that a neighborhood meeting was held on
February 18, 1998 with residents from the adjoining Ptarmigan Apartments who indicated
they were in favor of the proposed use.
Mr. McCartney reviewed the criteria for granting conditional use permits, and informed that
it was staff s conclusion that the request should be approved. He noted that a completed
Building and Dumping/Landfill permit would be required prior to construction of the
playground.
Questions and discussion followed. Alan White advised the Commission that, since the
school is under the jurisdiction of Jefferson County School District, it is exempt from local
requirements as far as building permits and inspections are concerned; however, the City
does have jurisdiction regarding drainage.
Chair THOMPSON asked if the residence driveway would also be used for access to the
school. Mr. McCartney informed that the Commission could make a condition to the
approval that the residential driveway not be used for access to the school.
Following further discussion, the applicants appeared before the Commission

Ms. Otten was sworn by Chair THOMPSON. She explained that the Montessori School is a
Jefferson County charter school which was approved by the Jefferson County School
District in December, 1997 and purchased the Garramone property to establish the school.
She informed that the preschool is privately funded, and kindergarten though sixth grade
classes are funded by the School District. She stated that they have an option to purchase
the remaining Garramone property within the next two years, and are aware that they will
have to apply for a rezoning in order to use that additional property for school use.

In response to a question from Commissioner SNOW, Ms. Otten replied that the property is
owned by Compass Montessori, Inc., but the school is funded by Jefferson County. She also
noted that they plan to enroll 150 children and that there is capacity for 180 children.
Patricia Trapp

Ms. Trapp was sworn by Chair THOMPSON. -
Ms. Trapp described the construction of the playground stating that they do not plan to
change the irrigation on the site and that a chain link fence would be constructed between the
playground and the Garramone residence. She informed that the playground must meet
requirements set forth by the Department of Social Services and that she was agreeable to
considering a single access from Miller Street into the school.
Commissioner GOKEY expressed concern about the increase in traffic which would result
from transporting 150-180 children to and from the school and asked if a traffic impact study
had been completed. Bob Goebel replied that the traffic engineer had assessed the situation
and felt it was advisable to close the access from 44th Avenue because of the heavy traffic
on that street.
Ms. Trapp informed that starting times would be staggered and that school parking exceeded
Jefferson County school standards. She also noted that the parents and directors of the
school are very concerned about traffic safety.
Commissioner COLLINS asked what the intended use of the Garramone residence would
be. Ms. Trapp replied that, if they are able to purchase that additional property, the
playground would be expanded and the house would become a part of the school.
Commissioner GOKEY expressed concern that the School District is not accountable to the
City as far as building permits, inspections, etc. are concerned.
Chair THOMPSON asked why the school was requesting the conditional use permit instead
of the Garramone's who presently own the land in question. Mr. McCartney explained that
the applicants have a power of attorney from the Garramone's.

Mr. Ulrich was sworn by Chair THOMPSON. He stated that he represented the
homeowners association at Ptarmigan Condominiums and had been contacted by several

homeowners who were concerned that they had not received notification of the February
meeting. He stated that none of the homeowners were opposed to the playground.

mother, Helen Newdorp, who was concerned about the use of the playground during times
the school was not in operation. She stated that, after hearing testimony, she was satisfied
that it would not.
It was moved by Commissioner BRINKMAN and seconded by Commissioner SHOCKLEY
that Case No. CUP-98-1, a request for approval of a Conditional Use Permit for a
Montessori School playground at 10351 West 44th Avenue be APPROVED for the
following reasons:
The criteria used to evaluate a Conditional Use permit supports approval of the
request; and
2. Staff recommends approval.
With the following condition:
The limited power of attorney letter be renewed to contain a much later expiration
date than April 1, 1998.
The motion passed by a vote of 6 to 1, with Commissioner GOKEY voting no; and
Commissioner THEANDER absent.

B. Case No. ANX-98-3 and Case No. WZ-98-8: An application from Tom Hartley
for approval of an annexation of the area approximately located at 13500 West 44th
Avenue in the county of Jefferson and initial zoning of the area to PID.
The case was presented by Martin Orner who stated that the applicant was requesting
annexation to the City of Wheat Ridge of approximately 51 acres of undeveloped land
located in Jefferson County. He informed that the applicant has requested zoning of Planned-
Industrial District with a provision for two acres of commercial/retail land use.

JURISDICTION:
The property is within the City of Wheat Ridge, and all notification and posting requirements have been
met. Therefore, there is jurisdiction to hear this case.
I. REQUEST
The applicant is requesting approval of a Conditional Use Permit to allow for the development of a
children's playground on property zoned Agricultural-One. The playground will be used by the
Compass Montessori School which will be occupying the existing Garramone Market building to the
west of said property. The school is in the preliminary planning stages and is scheduled to open in June,
1998.
Currently, the property located at 10351 West 44' Avenue is being used as a single family residence.
The owner of the property, who previously owned the Garramone's Market property, has agreed to allow
the Montessori School to utilize the rear portion of the property as a children's playground which will be
supported as an accessory use for the Montessori School. Pursuant to Section 26-18(D)(1), of the Wheat
Ridge Code of Laws a conditional use permit is required when any portion of an Agricultural-One
property is to be used for public or private school purposes.
Staff has been informed that the Compass Montessori School would like to purchase said property and
expand the school uses in.the future. Staff would like to note that future use of said property for school
purposes would require another conditional use permit or a change of zone to at minimum Restricted-
Commercial One.
II SITE PLAN
The applicant has submitted a site plan proposal which shows the scope of the work requested by the
conditional use permit. The Montessori School will offer studies for ages 3-12 years (preschool-6 grade)
and therefore the playground is designed to support activities for children of different ages.
As the site plan shows, the playground will be located in the rear of the property, extending from just
north of the existing detached garage to within 18' from the northern property line and 20' from the
eastern property line. The playground will extend west to abut the Montessori School building (existing
Garramone Market).
There won't be any new structures proposed for the playground. However, there will be concrete plazas,
pathways and an asphalt play area. The rest of the site will consist of an irrigated play field, deep sand
or pea gravel play pit and landscape planters.
Access to the play areas will be from the Montessori School grounds along the west side of the
playground.
There is also an existing 6' solid fence located along the perimeter of the property
Hl NEIGHBORHOOD REFERRAL
A neighborhood meeting was held on Wednesday February 18, in the second floor conference room of
the Wheat Ridge City Hall. Neighbor's from the adjoining Ptarmegin Apartments were present and
were in support of the request.
IV AGENCY REFERRALS
Valley Water will require increased service lines to adequately service the school.
Wheat Ridge Public Works will require a drainage report, erosion control plan and a completed
Dumping / Landfill permit. Also, the driveway fronting West 44`" Avenue will need to be closed off due
to the close proximity to the Miller Street intersection and crosswalk.
All other agencies were notified and can serve with appropriate service upgrades.
V. CRITERIA
Before a Conditional Use Permit is approved, the applicant shall show and the Planning Commission
shall find that the proposed Conditional Use:
1. Will not have a detrimental effect upon the general health, welfare, safety and convenience
of persons residing or working in the neighborhood of the proposed use.
The addition of the playground should not have a detrimental effect on the neighborhood in that this is
intended to be an accessory use for the Montessori School and adequate parking will be supplied on the
adjacent site. Also, because the playground will be used by daytime school children, there should not be
any detrimental effects of light or noise following normal school hours.
2. Will not adversely affect the adequate light and air, nor cause significant air, water or noise
pollution.
The addition of the playground will not affect the adequate light and air or cause any type of pollution
for the adjacent properties because the playground will retain a more than adequate setback from
adjacent property lines and there aren't any structures proposed for the site. Also, because there is an
existing 6' cedar fence located on the perimeter of the site, staff believes there will be adequate screening
of the playground.
3. Is consistent with the Comprehensive Plan.
The Wheat Ridge Master Plan designates desirable land use as high-density residential. Staff concludes
a private school would be incompatible with the desired land use. However, because the proposed use
for this site is an accessory use for a permitted principal use, and the applicant is not proposing to
construct any permanent structures, staff believes the playground would be consistent and compatible
with the existing surrounding land uses.
4. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading,
service or internal traffic conflicts to the detriment of persons whether on or off the site.
The proposed playground will not result in undue traffic congestion, traffic hazards or unsafe parking,
loading and service because this use is an accessory use for the Montessori School, which is a use by
right in the Restricted-Commercial zone district. Parking, loading and internal traffic will all be
reviewed when the Montessori School applies for a building permit to upgrade the property.
5. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering,
screening and landscaping, so as to be in harmony and compatible with the character of the
surrounding areas and neighborhood, especially with adjacent properties.
The playground addition will be designed to be in harmony and compatible with the character of the
surrounding areas and neighborhood. The applicants are proposing to utilize much of the existing
character and infrastructure of the existing Garramone Market.
6. Will not overburden the capacities of the existing streets, utilities, parks, schools and other
public facilities and services.
The development will not overburden the parks as they are providing their own playground facility. All
other public facilities will be serviced by outside agencies.
VI CONCLUSIONS AND RECOMMENDATIONS
Staff concludes that the above criteria supports approval of this request. A completed Building and
Dumping / Landfill permit is required prior to construction of the playground.
VII RECOMMENDED MOTIONS
Option A: "I move that case no. CUP-98-1, a request for approval of a Conditional Use Permit for a
Montessori School playground at 10351 West 44`h Avenue, be APPROVED for the following reasons:
1. The criteria used to evaluate a Conditional Use Permit supports approval of the request; and
2. Staff recommends approval.
With the following condition:
1. A completed Building and Dumping / Landfill permit be applied for prior to construction.."

SUBJECT: Montessori School Playground/Parking Lot Addition, 10351 West 44m Avenue -
CUP-98-1
The Public Works Department has reviewed the Planning Department referral dated March 9, 1998 for the
above referenced site, and has the following comments:
1. We will need a letter, in conformance with City drainage criteria, that amends the final drainage report
approved by the City on April 29,1986, and reflects the proposed onsite modifications. A drainage &
grading plan will also need to be submitted in conjunction with this letter.
2. The proposed use is going to require that the City's standard section of curb, gutter and sidewalk (4-foot
wide)be installed for the entire property frontage along Miller Street. In addition, asphalt paving may
be required to match these new improvements to the existing asphalt surface. Finally, engineered plan
and profile construction drawings for these public improvements will need to be submitted for review
and approval.
3. We will need a completed Dumping/Landfill Permit. In conjunction with the requirements of this permit,
an erosion control plan may need to be submitted for review and approval.
4. A letter of credit will need to be submitted for the value (as determined by the cost estimate prepared by
the project's consulting engineer), of those public improvements required to be constructed per item 2
above.
7. Property has beenplatted as Garramone Gardens, Minor Subdivision, and recorded with Jefferson County
on December 4,1986. This document is acceptable if no new building are to be proposed for the property.
8. The driveway fronting West 44`h Avenue will need to be closed off due to the close proximity to the
Miller Street intersection and the crosswalk. West 44 h Avenue is currently not equipped with a left turn
lane to accommodate this access. In addition, keeping this access in use will create a traffic hazard
condition due to excessive turning movements within this short spacing distance.
9. Miller Street will need to be striped with a dedicated left turn bay so that unnecessary delay can be
minimized for drivers wanting to turn on to West 44 ° Avenue. The access closure and the proposed
striping will help the intersection operate more efficiently and safely. Please not that approximately four
parking spaces can be gained from the access closure requested.

W. 44th Avenue and offers the following comments.
Valley Water District has no concern with playground use but does offer the
following items to note regarding the Compass Montessori School building.
1. It is unknown at this time if additional public facilities will be
needed to meet Arvada Fire Protection District requirements such as fire
hydrants or fire sprinkler water main line.
2. Current service lines may need to be increased to service the school's
needs.

NOTICE OF PUBLIC HEARING
Notice is hereby given that a Public Hearing is to be held before the City of Wheat Ridge
PLANNING COMMISSION on April 2,1998, at 7:30 p.m. at 7500 West 29th Avenue, Wheat
Ridge, Colorado. All interested citizens are invited to speak at the Public Hearing or submit
written comments. The following petitions shall be heard:
Case No. CUP-98-1: An application from Compass Montessori School for approval of a
conditional use permit to allow use of property zoned Agricultural-One and located at
10351 W. 44th Avenue as a playground area for a private school. Said property is legally
described as follows:
Commencing at the center one-quarter corner of said Section 21; thence North
00 ° 03'44" West along the North-South centerline of said Section 21, a distance of
645.50 feet; thence South 89°31'06" east along aline parallel and 35.5 feet North
of the centerline of West 44th Avenue as described by a survey recorded in Plat
Book 88, page 25 and by Reception No. 86036192, a distance of 1361.12 feet to
the True Point of Beginning; thence North 44 31'06" West a distance of 5.86 feet;
thence North 00 °49'54" east a distance of 298.26 feet; thence South 89 °31'06"
east a distance of 135.86 feet; thence South 00 50'35: West a distance of 59.05
feet; thence 54" West a distance of 100.00 feet; thence North 89°31'06" West a
distance of 14.17 feet; thence South 00°50'35" West a distance of 143.35 feet;
thence North 89°31'06" West a distance of 131.63 feet to the True Point of
Beginning, containing 0.9753 acres, more or less.

at this hearing before the Planning Commission. As an area resident or interested

The Public Works Department has reviewed the Planning Department referral dated March 9, 1998 for the
above referenced site, and has the following comments:
We will need a letter, in conformance with City drainage criteria, that amends the final drainage report
approved by the City on April 29,1986, and reflects the proposed onsite modifications. A drainage &
grading plan will also need to be submitted in conjunction with this letter.
2. The proposed use is going to require that the City's standard section of curb, gutter and sidewalk (4-foot
wide)be installed for the entire property frontage along Miller Street. In addition, asphalt paving may
be required to match these new improvements to the existing asphalt surface. Finally, engineered plan
and profile construction drawings for these public improvements will need to be submitted for review
and approval.
We will need a completed Dumping/Landfill Permit. In conjunction with the requirements of this permit,
an erosion control plan may need to be submitted for review and approval.
4. A letter of credit will need to be submitted for the value (as determined by the cost estimate prepared by
the project's consulting engineer), of those public improvements required to be constructed per item 2
above.
7. Property has been platted as Garramone Gardens, Minor Subdivision, and recorded with Jefferson County
on December 4, 1986. This document is acceptable if no new building are to be proposed for the property.
8. The Traffic Division has reviewed this referral, and has no comments at this time.
