SUBJECT: Glory of God Church Landscape
I have received a request from Scott, 303-755-7395, an architect working with the Glory of
God Church. His requeot was the status of the three trees within the footprint of the addition
to the rear of the building. The concern was not being able to find a contractor to move the
trees within a workable schedule. I gave Scott the number of a contractor the City has used in
the past.
After checking the project file from two years ago, I made a site vloit to inspect the trees.
There are three treeo involved, two Auotrian Pine (Pinus nigra) and one Autumn Purple Aoh
(Fraxinus americana). I meaoured the trees and performed a condition rating on each tree.
The findingo are ao follows:
Tree #1 Austrian Pine (eaotern of the two pineo) Measured nine (9) inched at four and
one-half (4 Yz) feet, twenty one (21) feet tall. Condition value lo seventy five (75)
percent. Buyout value for this tree io $1,225.00.
Tree #2 Auotrian Pine (western of the two pines). Measured eleven (11) incheo at four
and one-half (4 1/2) feet, twenty three (23) feet tall. Condition value lo ninety (90)
percent. Buyout value for this tree io $1,613.00.
Tree #3 Autumn Purple Ash. Measured oeven and one-half (7 %z) inched at four and one-
half (4 Y2) feet, twenty one (21) feet tall. Condition value io ninety (90) percent. Buyout
value for this tree lo $1,535.00.
The buyout value of the trees io only if the treeo need to be removed due to conotruction
scheduling. They may aloo look at replacement with like oize trees on the property. In either
cane, I notified Scott that I would need to be contacted before a final decioion io made. If you

It was moved by Commissioner DUNN and seconded by Comn.i.,sioner COLLINS to
approve the minutes as presented. The motion carried by a vote of 5-0 with Commissioner
SHOCKLEY abstaining and Commissioner BRINKMAN absent.

There was no one signed up to speak before the Commission.
7. PUBLIC HEARING
A. Case No. CUP 98-02:. A request by Glory of God Lutheran Church for approval
of a conditional use permit to allow a 4,000 square foot expansion for the property
located at 12200 West 38th Avenue.
This case was presented by Meredith Reckert. She presented overhead projections of the
site plan and slides of the subject property. She entered the zoning ordinance, case file,
packet materials and exhibits into the record which were accepted by Chair THOMPSON.
She informed that the property was within the City of Wheat Ridge, all notification and
posting requirements had been met and there was jurisdiction to hear the case.
Ms. Reckert informed that the applicant applied for the conditional use review to allow for
expansion of the nursery, Sunday school rooms and storage. She informed that all public
improvements, access and parking were in place; that no changes would occur to the rear
portion of the property; and that all minimum requirements for a conditional use in the R-1
zone district had been met. She stated that a neighborhood meeting was held on March 17,
1998 and that, although the meeting was well publicized, there was no one from the
surrounding neighborhood in attendance.
Ms. Reckert reviewed the agency referrals and informed that all agencies could serve the
property. She informed that comments from the Wheat Ridge Police Department regarding
crime prevention were forwarded to the applicant, and that the Wheat Ridge Public Works
Department approved a revision to the drainage report and required no additional public
improvements. She stated that the applicant will be meeting with the city forester to move
two mature specimen trees on the property.
Ms. Reckert reviewed the conditional use permit criteria and informed that, because the
expansion would have minimal impact on the surrounding neighborhood and the proposal
far exceeded the zone district development standards, it was staff s conclusion and
recommendation that the request be approved.
Questions and discussion followed. Chair THOMPSON asked if there was an alternative to
moving the trees if it presented a financial hardship to the applicant. Ms. Reckert replied
that moving the trees was not a requirement of the conditional use, however, the City
Forester had visually inspected the property and felt that the two trees in question were
worth saving.

Mr. Catlin and Mr. Scheuber were sworn by Chair THOMPSON. Mr. Catlin stated the
reason for the request was to support the current congregation in the areas of nursery and
education space.
In response to a question from Commissioner SNOW, Mr. Catlin replied that the sanctuary
will seat approximately 200 people.
In response to a question from Commissioner GOKEY, Mr. Catlin replied that it was the
applicant's intent to work with the city forester to save the two mature trees.
In response to a question from Commissioner SNOW, Mr. Catlin informed that the church
does not operate an outside nursery or daycare service nor does it rent the church for public
use. Commissioner SNOW asked if the applicant would consider adding another
handicapped parking space on the west side of the building even though the required number
of handicapped spaces were already met. Mr. Catlin replied that they would be agreeable to
adding another handicapped space.
There was no one signed up to speak before the Commission concerning this matter.
It was moved by Commissioner SHOCKLEY and seconded by Commissioner SNOW to
approve Case No. CUP-98-02, a request for a conditional use permit for property located at
12200 West 38th Avenue for the following reasons:
1. The evaluation criteria support approval of the request.
2. There will be minimal impact to the surrounding neighborhood.
3. The proposal far exceeds the zone district development standards.
With the following condition:
1. The applicant work with the City Forester to move specimen, mature trees.
The motion passed by a vote of 7-0.
B. Case No. MS-98-02: A request by C. Holstein for approval of a minor subdivision
of an R-3 zoned property into two lots. Property is located at 10911 West.44th
Place.

I. REQUEST
Pursuant to Wheat Ridge Code of Laws, Section 26-6(A)Conditional Uses are "Permitted Uses" which
are subject to review to ensure the use is properly designed so as to mitigate potential negative impacts
to the neighborhood. In accordance with these provisions, the applicant requests approval of a
conditional use permit to allow the expansion of a church in a Residential-One zone district. The
applicant in this case is Glory of God Lutheran Church at 1220 West 38th Avenue.
II. SITE PLAN
The applicant has requested the conditional use review to allow expansion of the church in two places
to accommodate expansion of the nursery, Sunday school rooms and storage. Both additions will
occur in the existing interior "courtyard" of the building and will roughly by 1,000 and 3,000 square
feet in size.
All public improvements, access and parking are in place. The parking requirement for a church is
based on the size of the sanctuary (1 space required for each 4 seats in the sanctuary). There are
currently 82 parking spaces on the property. It is typical that this type of expansion does not in itself
generate new members.
No changes will occur to the rear portion of the property which has a columbarium and landscaping on
it.
All minimum requirements for a conditional use in the R-1 zone district have been met
III. NEIGHBORHOOD MEETING
A meeting for neighborhood input was held on March 17, 1998.
Those attending included the following:

Dale Anderson - applicant
There were no persons attending from the surrounding neighborhood. Discussion centered on the
scope of the project and proposed locations for the additions.
IV. AGENCY REFERRALS
All responding agencies can serve the property.

Wheat Ridge Fire Protection District can serve the expansion as long as all building and fire codes are
met.
Consolidated Mutual Water District can serve the expansion subject to their requirement
Wheat Ridge Police Department has commented relative to crime prevention. There comments have
been forwarded to the applicant.
Wheat Ridge Public Works Department has approved a revision to the existing drainage report. No
additional public improvements will be required.
Wheat Ridge City Forester has indicated that there are mature trees which will be displaced by the
expansion. He would like to work with the applicant to have them relocated.
V. CONDITIONAL USE PERMIT CRITERIA
1. Will not have a detrimental effect upon the general health, welfare, safety and
convenience of persons residing or working in the neighborhood of the proposed use.
The proposed conditional use will allow the expansion of an existing use. The impacts to
persons residing or working in the neighborhood should be minimal as the expansions are at the
rear of the existing structures within established setback lines.
2. Will not adversely affect the adequate light and air, nor cause significant air, water or
noise pollution.
There should be no negative impact on the amount of light and air to adjacent properties as the
building additions will beat a minimum 50' away from the closet neighbor. Height of the
additional will be 15' which is consistent with the existing building and typical low density
development. Aside from the construction period, there should be minimal air, water or noise
pollution generated.
3. Is consistent with the comprehensive plan.
The Comprehensive Plan designates this area as Low Density Residential and as Single Family
Detached Residential (not to exceed 5 units per acre) on the proposed plan amendment. A

residential neighborhoods. Because the R-1 zoning will remain, there is consistency with the
Comprehensive Plan.
4. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading,
service or internal traffic conflicts to the detriment of persons whether on or off the site.

West 38th Avenue is classified as a Class V street (minor neighborhood collector) with
adequate public improvements in place. The proposed expansion will not generate additional
traffic to and from the site. Parking, loading and circulation already is place is sufficient for a
church of this size.
5. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering,
screening and landscaping, so as to be in harmony and compatible with character of the
surrounding areas and neighborhood, especially with adjacent properties.
The proposed expansion by far exceeds the minimums for a conditional use I the R-1 zone.
Because the additions will occur where there is the least impact to the neighborhood. Where
possible, mature trees should be moved.
6. Will not overburden the capacities of the existing streets, utilities, parks, schools and
other public facilities and services.
All responding agencies can provide service to the property. Improvements on 38th Avenue are
already in place. There should be no negative impact on parks or schools.
VI. STAFF CONCLUSIONS AND RECOMMENDATIONS
Staff has concluded that a conditional use approval is required to allow expansion of a church.
Because the expansion will have minimal impacts to the surrounding neighborhood and the proposal
far exceeds the zone district development standards, Staff concludes that the evaluation criteria support
approval of the request. Therefore, a recommendation of approval is given with the following
condition:
The applicant work with the City Forester to move specimen, mature trees.
VII. RECOMMENDED MOTIONS
Option A: I move that Case No. CUP-98-02, a request for approval of a conditional use permit for
property located at 12200 W. 38' Avenue, be recommended to the. City Council for approval for the
following reasons:
1. The evaluation criteria support approval of the request.
2. There will be minimal impact to the surrounding neighborhood.
3. The proposal far exceeds the zone district development standards.
With the following condition:

The original church was constructed in 1973. An addition was constructed in 1985 to house the new
kitchen, fellowship hall and sanctuary. Since that time, the church population has grown and the
need for additional administration space, nursery space and Sunday School classrooms has
occurred.
The proposed 1,033 s.f. expansion of the 1985 addition will house the new church nursery and
additional storage. The proposed 2,992 s.f. addition to the original church structure will house eight
new Sunday school classrooms, storage and restrooms for the classrooms.
These improvements are necessary for the church to maintain their current membership and to
attract new members.

Notice is hereby given that a Public Hearing is to be held before the City of Wheat Ridge
PLANNING COMMISSION on June 18, 1998 at 7:30 p.m. at 7500 West 29th Avenue, Wheat
Ridge, Colorado. All interested citizens are invited to speak at the Public Hearing or submit
written continents. The following petitions shall be heard:

described as follows:
Beginning at a point 551.57 feet North and 421.3 feet West of the southeast comer of said
northwest one-quarter of the Northeast one-quarter of said Section 29; thence West
345.12 feet, thence North 381.37 feet, more or less, to the center line of Prospect Avenue
(now West 38" Avenue), thence Northeasterly along the center line of said Prospect

This letter is in regard to your request for conditional permit approval for expansion of your facility
at 12200 West 38th Avenue.
I have reviewed your submittal and have the following comments:
1. It is difficult to tell where the walls of the existing structure are in reference to the proposed
additions. I believe this is due to the amount of information being shown ( contour lines,
relocated transformer and electrical line, etc.). Perhaps the utility information could be
removed so it is less difficult to read.
2. Please add a site data breakdown for the existing and amended plan including the following
information in both square footages and percentages of total site: total site, building coverage
hard surfaces coverage and landscaped coverage, maximum building height, number of
parking spaces. .
3. Please add a north arrow.
4. Please add property dimensions.
Attached are referral responses received from other City departments and outside agencies. This
case is tentatively scheduled for public hearing in front of Planning Commission on June 4, 1998.
Fifteen sets of folded, revised plans need to be submitted to this office no later than May 26, 1998.
There is also an outstanding fee due for public noticing in the amount of $115. This balance due
should be taken care of as soon as possible. Non-payment could result in delay of the public hearing
schedule.

I have reviewed the plans for the above listed site. I have the following recommendations:
LANDSCAPE:
1. All mature trees to be trimmed of branches up 6'-8' from the ground to allow for natural visual
observation from surrounding areas to the parking lots and building.
2. All shrubs and bushes mature height to not exceed 36". This height reduces the risk of
persons hiding. It also allows for natural visual observation onto the property both for the
parking lot and building.
3. Plants/landscape immediately next to the building should be low-growing ground cover, not
to exceed 18" mature height to allow for maximum natural visual observation and eliminate
concealment for potential offenders. The proposed junipers on the northwest side of the
building are a potentional fire hazard. This type of plant when ignited, burns very hot and
quickly.
4. There should be minimal landscaping immediately next to parking areas and sidewalks.
Landscaping near vehicles and pedestrian areas often raises the perception of criminal activity.
5. Ground cover should not include rock material. Rocks can be used to break windows in the
buildings and cars.
SITE:
1. During construction, the property should be clearly posted with "No Trespassing" signs. This
may help deter trespasses, and allow the Police Department to cite offenders with the crime
along with any others offenses that may be committed by trespassers.
LIGHTING:
1. Exterior lighting around the buildings and in parking lots should be a minimum of 1.5 candle
minimum maintained. This will provide for brightly lit areas that discourages criminal activity
due to the illusion/perception of observation and recognition.
From these plans, I have no further recommendations at this time. Revisions in the plans, may alter
my recommendations.
While my recommendations do not guarantee a crime-free environment, it has been experienced that
application of the concept of Crime Prevention Through Environmental Design (CPTED) will reduce
the opportunity for crime to occur and will enhance the quality of life.

The original church was constructed in 1973. An addition was constructed in 1985 to house the new
kitchen, fellowship hall and sanctuary. Since that time, the church population has grown and the
need for additional administration space, nursery space and Sunday School classrooms has
occurred.
The proposed 1,033 s.f. expansion of the 1985 addition will house the new church nursery and
additional storage. The proposed 2,992 s.f. addition to the original church structure will house eight
new Sunday school classrooms, storage and restrooms for the classrooms.
These improvements are necessary for the church to maintain their current membership and to
attract new members.

Dear Mr. Knudson:
On behalf of the Glory of God Lutheran Church, Bucher, Willis & Ratliff Corporation is pleased to
submit this letter and supporting information describing grading changes at the Glory of God
Lutheran Church site located at 12200 West 38th Avenue. A building expansion to the existing
church is proposed at this site which requires regrading around the building and the detention
pond located on the east side of the building (see attached Exhibit A).
The Final Drainage Report prepared by KKBNA, Inc. approved by the City of Wheat Ridge on
November 13, 1985, indicates that the pond was designed to store required detention storage to
control developed peak flows so as not to exceed historic conditions for runoff produced by the 100-
year frequency rainfall. Calculations indicate that the historic runoff for the 100-year storm is 6.9
cfs. A v-notched weir was designed to release a flow of 6.9 cfs when the ponded depth reached the
required 100-year storage volume of 2,400 cubic feet.
The flow patterns for the regraded site have changed slightly by adding additional impervious
surface due to the building roofs of the proposed expansions. The required pond volume based on
modified roof area is approximately 2,830 cubic feet and the regraded pond volume available is
2,910 cubic feet to elevation of 5480.0 feet. The increase in pond volume from the original volume
of 2,400 cubic feet was determined assuming 100 percent of the runoff from the roof will be detained
in the pond. Rainfall intensities used for these calculations were consistent with those calculated in
the drainage report by KKBNA.
According to our recent survey of the site, the top of the weir is at elevation of 5480.0 feet and was
designed to release flows at the calculated historical rate of 6.9 cfs. The regraded pond has a 100-
year water surface of approximately 5480.0 feet which coincides with the elevation of the top of the
weir. The weir will therefore release at a rate equal to the historical release rate of 6.9 cfs when the
water surface is at the 100-year elevation of 5480.0 feet.

FOR VALUE RECEIVED, each of the undersigned promises to pay to the order of the
Jefferson County Bank of Lakewood.
at its principal office in Lakewood, Colorado, the sum of FORTY THOUSA~ AND NO/100
DOLLARS,
with interest on the unpaid balance of said principal amount at the rate of -6- per cent per annum. Said principal
and interest shall be paid in monthly installments of $ 337 - 56 , or more, per month on or before the thday
of each and every calendar month hereafter, commencing December 14 , 1966 , except that, if not sooner
paid, the entire balance of principal remaining and interest accrued shall become due and payable November 14 ,
19 81 . e
It is agreed that if this note is not paid when due or declared due hereunder, the principal and accrued interest thereon shall draw interest
at the rate of Pi ght per cent per annum, and that failure to make any payment of principal or interest when due or any default under
any encumbrance or agreement securing this note shall cause the whole note to become due at once, without notice, or the interest to be
counted as principal, at the option of the holder of the note. The holder shall not, by accepting payments of principal or interest after
default or after exercising his option to accelerate maturity, be deemed to waive his right to accelerate maturity, unless such waiver be in

The makers and endorsers hereof severally waive presentment for payment, protest, notice of nonpayment and of protest, and agree to
any extension of time of payment and partial payments before, at or after maturity, and if this note or interest thereon is not paid when
due or suit is brought, agree to pay all reasonable costs of collection, including attorneys fees and also waive all exemptions in case
suit is filed.
The mortgagee may at his option collect a "late charge" not to exceed 1% of each monthly payment more than five days in arrears to
cover extra expense involved in handling delinquent payments.
This note is secured by a deed of trust of even date on real estate situate in the-
County _o( Jefferson State of Colorado, as follows, to-wit
That part of the Northwest one-quarter of the Northeast one-quarter of Section 29,
Township 3 South, Range 69 West of the 6th P.M., more particularly described as follows:
Beginning at a point 551.57 feet North and 421,3 feet West of the Southeast corner
of said Northwest one-quarter of the Northeast one-quarter of said Section 29; thence
West 345.12 feet, thence North 381.37 feet, more or less, to the center line of
Prospect Avenue (Now West 38th Avenue) thence Northeasterly along the center line of
said Prospect Avenue, a distance of 353.96 feet to a point directly North of the point
of beginning, thence South 460.80 feet to the point of beginning, EXCEPT that part of
the above described tract of land located in said Prospect Avenue (now West 38th Avenue)
County of Jefferson, State of Colorado.

The'66 fi(&!,~ 8 6f Consolidation are entered into thisPMENT OF STATE
day of January 1984 by and between Gloria Dei Lutheran Church of
Golden, Colorado, and St. Mark Lutheran Church of Wheatridge,
Colorado, each a nonprofit religious corporation organized and
existing under the provisions of Articles 20 to 29 of Title 7,
Colorado Revised Statutes of 1973.
Each of the said corporations has entered into the Plan of
Consolidation attached hereto as Exhibit "A".
Said Plan of Consolidation was approved unanimously by a
quorum of the members of each corporation at duly called meetings
held January 8, 1984 for such purpose.
Each corporation desires to place this Plan of Consolidation
into effect pursuant to the laws of the State of Colorado.
The name of the consolidated corporation shall be Glory of
God Lutheran Church.
