Approval of an amended planned building group plan. Medved Autoplex (Case No. PBG-98-01) Motion by Mrs. Dalbec to approve Case No. PBG-98-01, a request for approval of an amendment to the existing planned building group plan fort he Medved Autoplex located at 11201 West 1-70 Frontage Road North, for the following reasons: 1. An amended plan is required to achieve the proposed increased development on the property in an efficient and orderly manner. 2. All requirements of the C-1 zone district regulations have been met or exceeded. 3. The plan is consistent with adjacent zoning and land use. With the following conditions: Lighting be shielded to minimize effects on nearby residential properties. 2. Construction or employee parking be allowed on Parfet Street only during construction to the north driveway and not adjacent to the residential properties alongside there. Any additional accesses on Parfet Street to the property be located south of the existing residential properties that are on the east side by 30 feet; seconded by Mr. DiTullio; carried 8-0. Item 3. A. Reconsideration of Case No. MS-98-01. An application submitted by the Public Service Company for approval of a re-subdivision plat to allow for a lot line adjustment for the relocation of a Public Service Company natural gas regulator facility. Motion by Mr. Eafanti to change the motion of June 22, 1998 to delete the words "from adjacent property" from condition 2.; seconded by Mr. Siler; carried 4-3 with Councilmembers Shaver, Worth, and Dalbec voting no and Mr. Donnelly abstaining. Item 3.6. (formerly Item 8.) Traffic calming request for Gray Street between 26th and 29th Avenue. Mr. DiTullio introduced Item 3.13. Mr. Middaugh presented his memo attached to the Agenda and recommended that Council do not approve traffic calming measures on Gray Street at City's expense. Mr. DiTullio rebutted with the comment that there are 402 apartments in Terra Village with people moving in and out every six months and that the studies do not reflect everything. WHEAT RIDGE CITYINCIL MEETING: JUNE 22,199: PAGE -6- Original motion carried 6-1 with Mr. DiTullio voting no. ITEM 5. (Case No. MS-98-01) Item 5 was introduced by Mr. Siler, title read by the Clerk. Marjorie and Vernon Vohoska, owners of the property at the corner of West 44" Avenue, were present and sworn in. Mrs. Vohoska made comments explaining the subdivision plans and asked for Councils' approval. Alan White, Wheat Ridge Planning Director, was present and sworn in. Mr. White presented the staff report. Mr. White mentioned a correction he would like to make under the Dedication statement and add it as a condition of approval. He would like it to read, "installing sanitary sewers, street pavement, curbs, gutters, sidewalks and other utilities shall not be guaranteed and paid for by the City of Wheat Ridge." Motion by Mrs. Worth to suspend the rules to allow Mrs. Shaver to continue the conversation; seconded by Mrs. Shaver; failed 4-3 with Councilmembers Siler, Mancinelli, and DiTullio voting no (takes 5 votes to pass). Odarka Figlus was sworn in by the Mayor; she is part owner of the property at 7741 t West 44' Avenue, which is directly adjacent to Mr. Vohoska's property; she is glad the property is being redeveloped; objects to numbering the parcel on the West end, which is requested to be 7605 West 44`" Avenue; this implies that the building is actually on the corner of 44" and Wadsworth; the building is actually a block west of Wadsworth; the building directly across the street from the building under construction, is 7700, which is 100 numbers of from 7605 and her building, which is right next door, is 7741; this will be confusing. She asked that the number remain 7701 to provide consistency and avoid confusion. Motion by Mr. Siler that Case No. MS-98-01, a request for approval to resubdivide a plat on property located at 7605 West 44"Avenue and 4401 Wadsworth Boulevard, be approved for the following reasons: 1. It is required to allow the redevelopment of this property. 2. All requirements of the Subdivision Regulations have been met. With the following conditions: 1. On the plat the dedication statement be corrected to include the word "not" on the 6' line above combined legal description; 2. On Note 3. , 5' line, remove the words "from adjacent property andlor"; seconded by. Mrs. Worth. f. WHEAT RIDGE CITY'"INCIL MEETING: JUNE 22, 1991 PAGE -7- Motion by Mrs. Dalbec for an amendment that Note 3 stay as is on the plat; seconded by Mrs. Shaver. Mrs. Shaver asked questions of Mr. Vohoska. Mayor Cerveny stated the question period was over and a vote was to be taken. Mrs. Shaver appealed that decision to the body. Motion carried 5-2 with Mr. Mancinelli and Mr. Eafanti voting no. Mrs. Shaverthen-continued questioning the applicants. Mr. DiTullio called for the question; seconded by Mr. Mancinelli; carried 7-0. Vote on amendment carried 4-3 with Councilmembers Siler, Mancinelli and DiTullio voting no. Mrs. Dalbec called for the question; seconded by Mrs. Worth; carried 6-1 with Mr. Eafanti voting no. Vote on original motion as amended carried 5-2 with Mr. Siler and Mr. DiTullio voting no. ITEM 6. Council Bill 20 - An Ordinance amending the Wheat Ridge Code of Laws, Section 2-53(D), concerning Voting Rules for the Board of Adjustment, City of Wheat Ridge, County of Jefferson, State of Colorado. Council Bill 20 was introduced on second reading by Mrs. Worth, who also read the title. Clerk assigned Ordinance No. 1124. Mr. Dahl explained the reasons for this Ordinance and recommended approval. Motion by Mrs. Worth that Council Bill 20 (Ordinance 1124) be adopted on second reading and take effect 15 days after final publication; seconded by Mrs. Dalbec; carried 7-0. ORDINANCES ON FIRST READING ITEM 7. Council Bill 25 - An Ordinance vacating a portion of West 52nd Avenue (Case No. WV-98-03) within the City of Wheat Ridge, County of Jefferson, State of Colorado. Council Bill 25 was introduced on first reading by Mrs. Dalbec, who also read the title and summary. A permit was issued in May of 1998, for construction of an 11,600 square foot retail/restaurant building on lot 2. Right-of-way for both West 44th Avenue and Wadsworth is being dedicated by this plat. A blanket cross access easement has been provided allowing free movement through the drive aisles and parking areas on the property. All appropriate utility service easements have been provided. All requirements of the Subdivision Regulations have been met. III. AGENCY REFERRALS Public Service Company has negotiated the new lot 3 and easements shown on the Plat. Separate documents have conveyed the easements to Public Service Company. They are in support of this Plat. Colorado Department of Transportation has approved the right-of-way width for dedication . An access permit has been already approved. Public Works has approved the drainage report and plan. They are working with the applicant to resolve public improvement requirements. IV. PLANNING COMMISSION ACTION Planning Commission reviewed this request at a public hearing held on March 5, 1998. A recommendation of approval was made for the following reasons: 1. Meredith Reckert presented an overview of the case stating that the owners of this property are V&M Rentals and Public Service Company of Colorado. The owners have requested a resubdivision of approximately 2.8 acres at the northwest corner of West 44th Avenue and Wadsworth Boulevard. She presented a map and slides of the property, and entered into the record the subdivision regulations, case file, packet materials and exhibits. She advised that the property is within the City of Wheat Ridge, all notification and posting requirements have been met and there was jurisdiction to hear the case. She stated there are currently two structures on four parcels of property (Vern's Restaurant and Lounge on parcel one and the Public Service Company gas regulator structure on parcel four) and that the primary reason for the request was to move the Public Service Company gas regulator structure to the back of the property to allow redevelopment to take place. Ms. Reckert advised that the right-of-way for both West 44th Avenue and Wadsworth is being dedicated by this plat and a blanket cross access easement has been provided allowing free movement through the drive aisles and parking areas on the property. Commission GOKEY asked if the staff could look into the possibility of implementing fly control measures in R-1 and R-2 properties. Meredith Reckert commented that these measures would be more difficult to enforce than the manure clean-up measures. Commissioner SNOW expressed concern that horse owners who take their horses to summer pasture could lose the right to keep their animals under the general non-conforming use language, and asked the staff to address this matter before the next public hearing. The City has been informed that the ground lease has been signed. A permit has been issued for above grade construction upon satisfaction of the following requirements: 1. Construction and placement in service of the water hydrant off W. 44th Avenue. 2. Hard surface access within 150 feet of any point of the building. 3. Receipt by the City of a letter from Public Service Company stating the schedule for removal of the northern poles. Poles are scheduled to be relocated on June 1, 1998. 4. Verbal verification of approval by the Wheat Ridge Sanitation District of the sanitary sewer line accessing the W. 44th Avenue main. Please provide written documentation of approval. No Certificate of Occupancy (CO), temporary or otherwise, will be issued until the following occur or alternative arrangements have been agreed to in writing. 5. A revised landscape plan for Vem's shall be submitted and approved by the City prior to any final site improvements being made. Landscaping shall be installed prior to the issuance of a Certificate of Occupancy. Should weather conditions preclude the installation of the landscaping, an escrow shall be established to secure the completion of the landscaping. 6. A cost estimate and letter of credit for the Public Improvements should be submitted. 7. Approval of the plat by City Council. This is currently scheduled for June 22, 1998. 8. The Public Service Gas Regulator needs to be relocated. Easements have been executed for this relocation, but a relocation agreement still needs to be executed by one of the parties. It is understood that the cost of the relocation is the responsibility of Walgreens. 9. The construction of the Public Improvements will be done by Walgreens. Case No. MS-98-1: Application by HC Properties, Ltd. for approval of resubdivision of three parcels to allow for a lot line adjustment to accommodate the relocation of the Public Service natural gas regulator facility located at 7605 West 44th Avenue and 4401 Wadsworth Boulevard in the Commercial-One Zone District. Meredith Reckert presented an overview of the case stating that the owners of this property are V&M Rentals and Public Service Company of Colorado. The owners have requested a resubdivision of approximately 2.8 acres at the northwest corner of West 44th Avenue and Wadsworth Boulevard. She presented a map and slides of the property, and entered into the record the subdivision regulations, case file, packet materials and exhibits. She advised that the property is within the City of Wheat Ridge, all notification and posting requirements have been met and there was jurisdiction to hear the case. She stated there are currently two structures on four parcels of property (Vern's Restaurant and Lounge on parcel one and the Public Service Company gas regulator structure on parcel four) and that the primary reason for the request was to move the Public Service Company gas regulator structure to the back of the property to allow redevelopment to take place. Ms. Reckert advised that the right-of-way for both West 44th Avenue and Wadsworth is being dedicated by this plat and a blanket cross access easement has been provided allowing free movement through the drive aisles and parking areas on the property. She noted that all requirements of the Subdivision Regulations have been met. She added that the Public Service Company concurs with the proposed resubdivision, and the Colorado Department of Transportation has approved the right-of-way width for dedication and has approved an access permit. Ms. Reckert informed that it was staff s conclusion that the resubdivision is required to allow redevelopment of the property and, therefore, recommended approval. Following discussion by the Commission, Chair Thompson asked if there were any individuals present who wished to address this matter. It is required to allow redevelopment of this property. 2. All requirements of the subdivision regulations have been met. With the following conditions: 1. The language of the cross easements is to be approved by the City Attorney. 2. The cross easements are to be separately recorded. The motion carried by a vote of 7-0, Commissioner Shockley absent. 8. CLOSE THE PUBLIC HEARING Chair Thompson declared the public hearing closed. 9. OLD BUSINESS A. Large Animal Regulations. In response to Commissioner Gokey, Chair Thompson replied that the large animal regulations were scheduled for the April 16th Planning Commission, and requested that staff supply background materials on this issue to the new Planning Commission members. Commission GOKEY asked if the staff could look into the possibility of implementing fly control measures in R-1 and R-2 properties. Meredith Reckert commented that these measures would be more difficult to enforce than the manure clean-up measures. Commissioner SNOW expressed concern that horse owners who take their horses to summer pasture could lose the right to keep their animals under the general non-conforming use language, and asked the staff to address this matter before the next public hearing. She suggested that the Animal Control Commission also consider this issue.
