The temporary use permit allowed temporary surface parking at 12060 W. 52"d Avenue for not longer than 1 year. If it is the intent of the property owner to continue with surface parking at this location, a new application must be submitted for approval by the Board of Adjustment prior to the expiration of the current permit on June 25, 1999. Your new application would need to be submitted to the City by May 28, 1999, in order to be heard at the Board meeting of June 24, 1999. I would like to note, that staff is aware that not all of the conditions of approval have been met nor has a request for zone change been submitted with the City all of which may have a negative impact on any future application with the City. In addition, if an extension of the TUP is not requested, staff will start procedures to ensure that parking at this location ceases as of June 26, 1999. Case No. TUP 98-02: ?;This case, an application by Wheat Ridge 52 Investments for approval of a temporary use permit for additional parking for tenants, was presented by Susan Ellis. Parking would be on a vacant parcel of ground immediately adjacent to 12060 West 52nd Avenue. Said property is zoned A-2 and located at Lot 13 of the Standley Heights Subdivision. Ms. Ellis entered the zoning ordinance, case file, packet materials, slides and exhibits into the record. She advised that the property was within the City of Wheat Ridge, that all notification and posting requirements had been met and there was jurisdiction for the Board to hear the case. Ms. Ellis informed that the subject lot was currently being used for parking even though it was not surfaced in any way and there were no designated parking spaces. She stated that the applicant was in the process of submitting an application for rezoning of the property which, if approved, would allow for use by right in the near future. Ms. Ellis presented overhead projections of the site plan as well as slides of the subject property. She reviewed the site plan, stating that the lot is located on the Agricultural- Two piece of the development. The site plan showed what appeared to be a paved parking lot with defined parking spaces; however, the applicants indicated that it was not their intention to pave the lot or to define parking spaces, but to surface the lot with crushed stone. Ms. Ellis reviewed the Temporary Use Permit criteria and stated that the applicant had modified their existing parking plan by eliminating approximately nineteen parking spaces which were located in front of large bay doors and had been striped and designated for "loading only". Although parking was needed because of the unauthorized modification, she stated staffs conclusion that the criteria support approval of the request with certain conditions as contained in the staff report. She added that if the applicant had followed proper modification procedures, the staff would have worked with the applicant to modify parking to meet their needs. Bob Russell RFG Management 6025 South Quebec St., Englewood Mr. Russell, the applicant, was sworn by Chair MAURO. He informed that the project was acquired four years ago. Due to uses in the project itself they felt that additional land for parking would be needed in the future for existing tenancies and did acquire extra land in front of the largest tenant. He asked if the lot could be paved with asphalt Board of Adjustment - Page 2 06/25/98 considering the property is zoned for agriculture. (Susan Ellis replied that it can be paved on a temporary basis.) Because they plan to build an approximate 5000 square foot building on this space in the near future, he requested approval to do an AB3 base rather than asphalt which would be much more expensive (around $20,000) to install and remove at the time construction would take place. In response to a previous question from Board Member ABBOTT, Mr. Russell stated that the landscape medians are owned by the adjacent property owner and informed that the applicant is negotiating with the owner to take over the medians and maintain them in good clean condition. He stated they planned to install a temporary parking lot and stripe it and apply for a rezone in about 60 days. Board Member ABBOTT asked why the property can't be used as it is now. Ms. Ellis replied that it was a matter of having parking spaces designated as shown on the site plan and allowing safe ingress, egress and circulation through the lot. Board Member ABBOTT suggested concrete bumpers to delineate where cars could park. Mr. Russell requested that they be allowed to try it with the road base and striping and if it doesn't work, they would commit to installing concrete bumpers at that time. John Lowe RFG Management 602 South Quebec St., Englewood Mr. Lowe was sworn by Chair MAURO. He stated that the parking lot is a very temporary situation and that he did not believe an asphalt parking lot would be compatible with agricultural zoning Board Member WALKER expressed concern about providing parking for the new building the applicant was planning to build: Mr. Lowe said the lot itself would support a 13,000 square foot building and the building they are planning is a 4,000 to 5,000 square foot building. If such a building would not work for their use, he stated that they would not jeopardize a 43,000 square foot project by building this small building. In response to a question from Board Member HOWARD, the applicant replied that he had not been cited for parking violations. Susan Ellis informed that this matter was initiated through a complaint received by the Planning and Development Department about tenants parking on the vacant lot. Mr. Lowe informed that they immediately constructed a screening fence upon learning of the complaint, and now are requesting the TUP. Board of Adjustment Pa.-e 3 06/25/98 Board Member ECHELMEYER asked the status of the rezoning application. Mr. Lowe replied that it is still in the planning stages and would be similar to the adjacent building. He anticipated the application would be made in the next several months and, if not, they would request a rezone and repave the parking lot as allowed under City's industrial zoning codes. Following further discussion, Chair MAURO asked if there were any individuals present who wished to address this matter. There was no response. Upon a motion by Board Member ABBOTT and second by Board Member WALKER the following resolution was stated. Whereas, Board of Adjustment Application Case No. TUP-98-2 is an appeal to this Board from the decision of an administrative officer; and Whereas, the property has been posted the fifteen days required by law and there were no protests registered against it; and Whereas, the relief applied for may be granted without detriment to the public welfare and without substantially impairing the intent and purpose of the regulations governing the City of Wheat Ridge. Case No. WA-98-15: This case, an application by George Feeney for approval of a 9% building coverage variance to the 25% maximum building coverage requirement for R-1 zoned property located at 3869 Union Court, was presented by Alan White. He presented slides and overhead projections of the subject property and entered the zoning ordinance, case file, packet materials, slides and exhibits into the record. He informed that the property was within the City of Wheat Ridge, all notification and posting requirements had been met and there was jurisdiction to hear the case. Mr. White reviewed the application for a 4,311 square foot single-family residence which would cover 34% of the property where Wheat Ridge Code of Laws allows for 25% coverage. He reviewed the criteria used in evaluating a variance request as outlined in the packet. Mr. White informed that staff concluded that the criteria did not support approval of the request because it did not comply with the intent of the R-1 zone district in that it would allow a larger structure on a site designed to allow for openness and low-density residential. In this case, the applicant could redesign the dwelling to fit within the footprint limitation of the 251/o building coverage or allow the same amount of square footage in a two-story structure. L REQUEST The applicant, Wheat Ridge 52 Investments, is requesting approval of a Temporary Use Permit to allow the vacant lot north of the office warehouse to be used for parking. There is not enough parking for tenant/employees and their customers. The vacant lot is currently being used for parking, however, it is not surfaced in any way nor are there designated parking spaces. The applicant is in the process of submitting an application for re-zoning of the property allowing for a use by right in the near future if approved. II. SITE PLAN The property in question is square in shape and measures 160'x 150'. It is located on the Agricultural- two piece of the development. To the south of the lot is an office warehouse owned by the applicant. To the west of the lot is also an office warehouse owned by another party. To the north is W. 52nd Ave. and the City of Arvada, and to the east is a commercial construction business. The site plan shows what appears to be a paved parking lot with defined parking spaces. After speaking with the applicant, it is not their intention to pave the lot nor to define the parking spaces. They wish to surface the lot with crushed stone. III. TEMPORARY USE PERMIT CRITERIA Staff has the following comments regarding the criteria used to evaluate a Temporary Use Permit request. 1. Will this request have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use? No. This proposed temporary use would help to alleviate parking problems within the development. 2. Will this request adversely affect adequate light and air, cause significant air, water or noise pollution, or cause drainage problems for the general area? No. No structures are being proposed that would affect light and air, however a drainage report would have to be submitted and approved before any alterations are made to the site 3. Will this request result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to be determent of persons whether on or off the site? Yes. If the parking lot is not paved and striped according to our specifications, it could cause unsafe parking, loading and internal traffic conflicts. If the lot is paved and striped, it would create a much safer and less congested parking situation. Board of Adjustment Page 2 TUP-98-02/ Wheat Ridge 52 Investment 4. Will this request be appropriately designed, including setbacks, heights, parking bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties? Yes. The property in question is surrounded by commercial uses. If the lot is paved and striped, it will help to eliminate parking bulk. 5. Will this request overburden the capacities of the existing streets, utilities, parks schools, and other public facilities and services? No. The number of vehicle parked within this development will not change. It would just be the placement of the parking that would change, therefore not causing an overburden of the capacities of the existing streets. IV. STAFF CONCLUSIONS AND RECOMMENDATION Staff believes that the reason the new parking lot is needed is because the applicant has modified their existing parking plan by eliminating approximately 19 parking spaces. The 19 spaces that have been eliminated have been striped for "no parking, loading only". The spaces are in front of large bay doors utilized by the tenants. According to the Official Development Plan, these 19 spaces were not designated for "no parking" loading only" but for vehicular parking only. Although the new parking is needed because of unauthorized modifications, staff concludes that the above criteria does support an approval of the request. The "no parking, loading only" spaces are reasonable when loading docks and doors exist within a building. If the applicant had requested the modification following proper procedures, staff would have worked with the applicant to modify the parking to meet their needs. This is simply the "cart before the horse" scenario . Therefore, staff does support an approval of the request with the following recommendations. 1. The parking lot be paved with asphalt and striped per Wheat Ridge specifications. 2. The permit be approved for the period necessary to follow re-zoning procedures, but not to exceed one (1) year. 3. If the applicant chooses to request an extension of the temporary use permit, they must submit their application and be approved by the Board prior to their existing permit expiring or the use must cease the day of expiration. 4. The applicant must take the steps necessary to properly modify their existing Official Development Plan in regards to existing parking within the period of the permit. 5. The applicant must submit a drainage report and obtain approval before any alterations are made. V.
