SUBJECT: Case No. TUP-98-3 / Rola Gardens DATE: July 14, 1998 F WHEgT ~ P a v m COC OR A~0 The applicant is requesting approval of a one (1) month temporary use permit to allow the sales of produce on an existing vacant property. The property in question is Lot 7 of the 70 West Business Center, located on the northwest corner of Interstate-70 Frontage Road West and West 32nd Avenue. The applicant has submitted a sketch site plan to show the proposed layout of the site. Access to the site will be from Interstate-70 Frontage Road West, and will flow into a temporary parking lot. A 10'X 15' tent and an 8'X 16' cooler will be placed on the site to house the produce. Staff will ensure the structures will comply with the required setbacks. The applicant does not plan on allowing for late night operations, ceasing business around 5 p.m. Pursuant to Section 26-6 (D)(3)(a), the zoning administrator is empowered to decide upon applications for temporary uses for up to one (1) month. FINDINGS OF FACT: When hearing and deciding requests for temporary permits, the zoning administrator shall base their decision in consideration of the following findings of fact: 1. Will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use; No. The request for the one (1) month temporary sales of produce should not have a detrimental effect upon the health, welfare and safety of the persons residing or working in the neighborhood as the applicant proposes to allow for adequate setback and separation between the temporary tents and any adjacent structures. Also, the temporary tents will be located outside of the required sight distance triangle so as to not impair the view of passing motorists and pedestrians. 2. Will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution, or cause drainage problems for the general area; Because the applicant proposes to allow for adequate separation of the temporary tents and adjacent structures, approval of this request should not adversely affect the adequate light and air to the adjacent properties. Also, due to the minor scope of the request, staff does not foresee any negative pollution impacts nor increase in drainage problems for the area. 3. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site; There is a possibility that this use may result in undue traffic congestions or traffic hazards as this property is located in an area of high traffic volume and access to the temporary lot does not provide for adequate stacking of vehicles. Staff surmised that an increase in traffic waiting to take a left from the Frontage Road onto West 32"d Avenue, could potentially block the access for the temporary lot. If the access point were blocked, the vehicles waiting to access the produce lot may cause a back up onto West 32"d Avenue, thereby adding to the existing traffic problems. 4. Will be appropriately designed, including setbacks, heights, parking, bulk, `buffering, screening and landscaping, so as to be in harmony and compatible with character of the surrounding areas and neighborhood, especially with adjacent properties; According to the site plan the applicant has submitted, there should be adequate parking provided for the property, but setbacks fro the temporary structures will need to be established during the building permit process. Because the request is only for one month, there will not be a need for landscaping or screening. 5. Will not overburden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. As stated before, this use may increase the traffic load on the existing streets. However, because the proposed use is only for one month, it is possible that the impact may be minimal. STAFF'S CONCLUSIONS Staff concludes that the request for the on-month temporary sales of produce from an existing vacant lot does comply with the existing uses already established within the development. Staff does have a concern regarding the possible traffic hazards that may exist due to the retail nature of the proposed use, but believes that the concerns are speculative.
