The existing TUP granted by the Board of Adjustment expired and the applicant would not have been in compliance with the stipulation agreement concerning the site through no fault of the applicant. The 30-day TUP would give the applicant the opportunity to be heard by the Planning Commission and City Council. . The findings of fact for granting an administrative TUP are substantially complied with. The property was properly posted and notices sent to adjacent landowners for this administrative TUP.
