SONHEIM OF COUNSEL TELEPHONE 303-424-4486 FACSIMILE 303-424-4993 This office is legal counsel for David Butler. My client is the owner of the property at 10900 W. 44th Avenue, Wheat Ridge, CO. He operates a geophysical office and laboratory at that location. The improvements on the property consist of a two-story office building, a 12 by 24-foot sheet metal structure used as an office and laboratory facility, and another 11.9 by 39.6- foot sheet metal structure also used as an office and laboratory facility. This property is the old city hall for the City of Wheat Ridge. My client purchased the property from the City in 1979. At the time of the negotiation for purchase, my client advised the representatives of the City of my client's proposed use of this property which would entail the renovation of the office building and the construction of the sheet metal office and laboratory buildings. The City at that time represented to my clients that their proposed use of the property was in compliance with the zoning and use regulations of the City of Wheat Ridge. Based upon these representations, my client purchased the property and commenced the remodeling effort. In 1980 and 1981, the sheet metal office/laboratory buildings were installed on the premises. My client was told by the City at that time that no building permit was required. By 1988, the remodeling effort was basically complete. My client has operated a geophysical office and laboratory on the premises continuously since 1979. During the early part of this year, my client was advised that the City of Wheat Ridge was having a concern about the use of the sheet metal buildings which have been in place since 1980. The City staff apparently believes that these buildings are not technically in conformity with the current City zoning regulations. It is for this reason that my client is making application for a variance to allow him to continue his use of the sheet metal buildings as geophysical offices and laboratories.
